Abstract

Kata kunci: perlindungan hukum; pencemaran logam berat; aktivitas pertambangan; hak atas lingkungan hidup; pulau sangiheABSTRACTMining activities on Sangihe Island carry the potential for heavy metal pollution, which impacts environmental quality and the fulfillment of the community's right to a good and healthy environment a right guaranteed under Article 28H, Paragraph (1) of the 1945 Constitution of the Republic of Indonesia. As a small island region, the management and utilization of Sangihe Island must also comply with the provisions of Law Number 1 of 2014 (an amendment to Law Number 27 of 2007) concerning the Management of Coastal Areas and Small Islands, which emphasizes protecting environmental carrying capacity and ecosystem sustainability. This study aims to analyze the effectiveness of legal protections for communities affected by heavy metal pollution and to evaluate the implementation of small-island area protections in ensuring the fulfillment of the right to a good and healthy environment. The study employs a socio-legal approach, combining an analysis of legislation and its implementation through a review of legal materials, scholarly literature, court rulings, and relevant social facts. The findings indicate that although Indonesia possesses a legal framework to protect coastal areas and small islands, its implementation remains ineffective due to weak oversight, law enforcement, and inter-agency coordination, as well as suboptimal community participation in environmental monitoring. Consequently, legal protection for communities affected by heavy metal pollution has not been optimally realized. Therefore, strengthening oversight, ensuring consistent law enforcement, improving inter-agency coordination, and actively involving the community are crucial to guaranteeing the protection of the right to a good and healthy environment in a fair and sustainable manner. Keywords: legal protection; heavy metal pollution; mining activities; right to the environment; sangihe island

Abstract

This article analyzes the legal politics of recentralization of mineral and coal mining licensing in Indonesia from a prophetic legal perspective. The urgency of this research arises from the increasing agrarian conflicts, environmental damage, and uneven distribution of economic benefits, which show weaknesses in mining governance in both the decentralized and post-centralization eras. The amendment through Law Number 3 of 2020 marks a shift of authority from the local government to the central government, which aims to improve governance, but creates new problems related to participation and justice. This study aims to analyze the legal politics of the recentralization of mineral and coal mining licensing and evaluate it from the perspective of prophetic law, which includes the values of humanization, liberation, and transcendence. The method used is normative juridical with a legal and conceptual approach. The results show that recentralization strengthens state control and increases administrative efficiency, but has not been able to guarantee substantive justice due to limited public participation, unequal distribution of benefits, and weak environmental protection. From the perspective of prophetic law, these policies do not fully reflect the values of humanization, liberation, and transcendence. The novelty of this research lies in the use of prophetic law as an analytical framework in the legal politics of natural resources, which was previously mainly studied through political economy or administrative governance approaches. The study also proposes a reconstruction of legal politics through a participatory decentralization model based on prophetic values, a synthesis between centralization and decentralization. This model is expected to achieve fairer, more inclusive, and sustainable mining governance.
