Abstract

This research is motivated by the author submitting an application against a lawsuit related to the determination of the estimated value limit that is not in accordance with applicable regulations, causing losses to the debtor. The purpose of this study is to determine the auction mechanism and the application of determining the value of the mortgage object by the seller. This research is based on the normative legal research method through a legal approach. The results of this study are that the auction mechanism for the execution of mortgage objects through the State Assets and Auction Service Office must comply with the rules in the Regulation of the Minister of Finance Number 213/PMK.06/2020 concerning Auction Implementation Guidelines. The implementation of the determination of the boundary of the mortgage object in the field has not been in accordance with the procedure and legal protection for the debtor has not been maximized because it can only be done through a lawsuit in court and the State Assets and Auction Service Office does not have the authority to conduct an auction against the applicable boundary determination. Suggestions for the Government to change the method of setting boundaries, which previously had 2 (two) methods, namely an assessment to avoid losses suffered by debtors and provide more legal benefits for debtors.

Abstract

Penerapan hukuman mati (qishash) dalam hukum Islam sebagai pemenuhan hak konstitusional keluarga korban, pelaku dan masyarakat, namun dari sudut pandang humanis adanya alasan pemaaf, jika keluarga korban memaafkan pelaku, dengan ketentuan memberikan ganti rugi secara perdata berupa diyat (kompensasi), sebagai pengganti hukuman mati (qishash), oleh karena itu penerapan hukuman mati perlu dilakukan secara selektif dan penuh kehati-hatian, juga objektif dengan kondisi riil yang ada di masyarakat, dan pula memperhatikan isu-isu serta gerakan yang terjadi dalam masyarakat nasional maupun internasional, sehingga sanksi hukumannya memberikan rasa keadilan, kepastian hukum dan kemanfaatan bagi para korban dan keluarganya terhadap hal yang menimpanya, juga terhadap pelaku itu sendiri, serta masyarakat luas, agar terciptanya rasa aman, damai dan tenteram.

Abstract

Geographical Indication is one of the Intellectual Property Rights that protects things that have features, attributes, or reputations related to the location from which they originated. Arabica coffee, which is native to Toraja South Sulawesi, has distinct attributes that distinguish it from other types of coffee, earning it a reputation as one of the world's best. The "TORAJA" brand, on the other hand, misleads customers about its uniqueness. Arabica coffee's reputation will be jeopardized if it is not from Toraja and its quality differs from that of Toraja coffee. To preserve Torajan arabica's reputation and coffee farmers, geographical indication registration on this Torajan arabica coffee is required. Geographical Indications must be legally protected in order to identify whether individuals are communal or collective. Belonging to the community in the registered Geographical Indication region is what the communal community character entails.

Abstract

Abstrak-Sektor keuangan adalah salah satu sektor yang memiliki peran pentingdalam perekonomian negara dan terus berkembang sejalan dengan kebutuhanmasyarakatnya. Saat ini, inovasi di sektor keuangan yang dikenal sebagaiteknologi keuangan atau financial technology (fintech) telah menarik perhatiandunia. Sebagai negara maju, perkembangan fintech di Singapura juga layak untukdilihat. Di Indonesia, lingkungan regulasi ekonomi digital ditangani oleh berbagaiundang-undang dan lembaga keuangan, yaitu Otoritas Jasa Keuangan (OJK) danBank Indonesia (BI). Penelitian ini menggunakan pendekatan yuridis normatif.Sumber dan tipe data yang digunakan berasal dari tinjauan literatur, bertujuanuntuk memberikan wawasan tentang aspek regulasi fintech dan perlindungan datapribadi di Singapura dan Indonesia, dan apa yang dapat dilakukan pemerintahuntuk mengantisipasi dan mengatur layanan fintech yang selalu berkembang danuntuk mengelola risiko perlindungan data yang lebih baik di sektor keuangan diIndonesia. Kata Kunci: Teknologi Keuangan, Perlindungan Data, Pemerintah, Indonesia danSingapura.

Abstract

Abstrak- Penelitian ini membahas pentingnya hukuman berat kepada pelakutindak pidana perniagaan kulit satwa harimau sumatera yang dilindungi, sertamenemukan keterlibatan korporasi dalam tindak pidana perniagaan kulit sawtaharimau tersebut sebagaimana dalam Putusan Pengadilan Negeri Liwa Nomor141/Pid.Sus-LH/2016/Pn LIW tertanggal 25 Januari 2017. Penelitianmenggunakan metode pendekatan yuridis-normatif. Kerangka Teori yangdigunakan dalam penelitian ini adalah Teori Pertanggungjawaban Korporasi. Darihasil penelitian ini diperoleh kesimpulan bahwa dalam tindak pidana perniagaankulit harimau sumatera, korporasi dapat dimintai pertanggungjawaban sepanjangdalam fakta persidangan dapat dibuktikan keterlibatan korporasi. Apabilamengacu pada Putusan Pengadilan Negeri Liwa tersebut, maka korporasi dapatdimintakan pertanggungjawaban dikarenakan tidak menutup kemungkinanTerdakwa I dan Terdakwa II telah beberapa kali melakukan perburuan harimausumatera yang dimana mungkin saja dijual kepada perusahaan (korporasi),sehingga berdasarkan teori/ajaran pertanggungjawaban korporasi yaitupertanggungjawaban mutlak (strict liability), pertanggungjawaban pengganti(vicarious liability), identifikasi (indentification) dan agresi (aggregation), tidakhanya terdakwa I dan Terdakwa II sebagai orang perorangan yang harusdimintakan pertanggungjawabannya, akan tetapi terdakwa bersama-samakorporasi dapat diminta bertanggungjawab akibat tindak pidana yang telahdilakukannya. Kata Kunci : Pertanggungjawaban Pidana, Korporasi, Harimau Sumatera

Abstract

This research is motivated by the author's interest in observing the development of Indonesian contract law which until now continues to face challenges, especially in the era of globalization where there has been a shift in business activities from conventional to digital era. The purpose of this study is to analyze the readiness of Indonesian contract law in the face of its increasingly diverse developments that affect social aspects and change the way business people interact with each other. The transaction process in the business world that is carried out without direct meetings using internet media is included in the category of electronic transactions. Electronic transactions in business have various forms, one of which is electronic commerce or commonly known as e-commerce. This advancement makes it easier for individuals and companies to carry out various types of business transactions, especially in trade. This research uses normative legal research method through conceptual approach. The results show that there are several issues that are still a problem for Indonesian contract law, one of which is the validity of electronic contracts and dispute resolution in online transactions. In answering this issue, the author urges the government to immediately create and pass a new contract law, namely the National Contract Law which, as of this writing, is still in the drafting stage.

Abstract

The increase in the prestige of berenuk drinks was not matched by the amount of production that was unable to meet the increasing market demand. This is because the processing is still manual and uses a very traditional method (using limited human resources), so it takes up to 12 hours to process. This is where the PKM Team of Universitas Muhammadiyah Tangerang is here to provide solutions for the two partners, where the solution will not be realized without a grant from the National Research and Innovation Agency of the Ministry of Education and Culture. The involvement of students and the contributions of the two partners during the PKM activity really helped the PKM Team of Universitas Muhammadiyah Tangerang complete the mandate from the National Research and Innovation Agency grant of the Ministry of Education and Culture completely, although it is recognized that 2 (two) components are still in the process of completion, for example: patent registration and publication of accredited journals. However, in general/overall, with all the challenges faced during the COVID-19 pandemic, the PKM Team of Universitas Muhammadiyah Tangerang has succeeded in carrying out the duties and mandates of the National Research and Innovation Agency of the Ministry of Education and Culture.

Abstract

This study explains and informs about the legal certainty of double land certificates in Indonesia, because this is a legal problem that often arises especially in Indonesia. The research method is by researching sources from Google Scholar, library materials, and secondary materials. The results of the study indicate that the resolution of disputes over double land certificates is prioritized through a mediation process (non-litigation) if it is not proven then it is continued through the court process

Abstract

The increasing population has caused various problems, such as severe traffic congestion to environmental degradation that threatens Bali's unique biodiversity. These problems have an impact on the quality of life of residents and the attractiveness of Bali as a tourist destination. As a result, strategic actions that focus on sustainable development, and better environmental management, According to BPS data, the population of Bali increased by 15 percent from 2010 to 2019. However, this population increase also raises problems, especially related to infrastructure, public services, and environmental preservation amidst rapid development, but studies on the effectiveness of implementation in the field are still limited. This study aims to fill this gap by analyzing in depth the factors that influence the success or failure of population control policy implementation in Bali, especially from a legal perspective. By understanding the obstacles faced, this study is expected to provide more effective policy recommendations to overcome the problem of overpopulation and achieve sustainable development in Bali.

Abstract

nvestment is something that is growing rapidly in society. Apart from being easy, investing can also provide quite large profits. However, there is still a lot of illegal investment occurring in society. This is due to a lack of strict law enforcement and a lack of public education regarding investment. Therefore, it is necessary to educate the public and provide strict law enforcement to perpetrators of illegal investments so that people do not become victims in the future. Illegal investments usually offer large profits in a short time with low risk. Law enforcement against illegal investments can be carried out from two perspectives, namely civil and criminal. Investment is a rapidly growing trend within society, presenting an easy way to achieve substantial profits. Despite its potential benefits, there remains a significant presence of illegal investment activities. This issue primarily stems from insufficient law enforcement and a lack of public education about investment principles and risks. To mitigate this problem, it is crucial to enhance public awareness and implement stringent legal measures against those involved in illegal investments, ensuring that individuals are protected from becoming future victims. Typically, illegal investments promise high returns in a short period with minimal risk, attracting many unsuspecting individuals. Effective law enforcement against these fraudulent activities can be approached from both civil and criminal perspectives, addressing the issue comprehensively.
