Abstract

Masyarakat merupakan komponen yang tidak terpisahkan dalam penyelenggaraan pemerintahan, termasuk dalam penyelenggaraan pemerintahan desa. Namun penyelenggaraan pemerintahan desa saat ini cenderung mengesampingkan partisipasi masyarakat yang sejatinya menjadi perwujudan salah satu asas dalam penyelenggaraan pemerintahan desa yaitu asas partisipatif. Saat ini masyarakat hanya dianggap sebagai objek penyelenggaraan pemerintahan desa. Hal inilah yang melatarbelakangi peneliti untuk melakukan sebuah penelitian yang bertujuan untuk menganalisis bagaimana partisispasi masyarakat dalam penyelenggaraan pemerintahan desa di Desa Pringgasela Selatan Kabupaten Lombok Timur. Metode penelitian yang kami gunakan dalam penelitian ini adalah penelitian hukum empiris dengan menggunakan beberapa pendekatan yaitu, pendekatan konseptual dan pendekatan perundang-undangan. Peneitian ini menyimpulkan bahwa penyelenggaraan pemerintahan desa saat ini masih belum sepenuhnya mengimplementasikan asas partisipatif yang ditunjukan dengan tidak masifnya pelibatan masyarakat dalam penyelenggaraan pemerintahan. Hal tersebut dilatarbelakangi oleh beberapa faktor seperti kurangnya pemahaman konseptual penyelenggara pemerintahan desa dan belum jelasnya regulasi yang mengatur secara spesifik bentuk keterlibatan masyarakat dalam bentuk produk hukum desa maupun perundang-undangan terkait.

Abstract

The village is the smallest governmental organization that possesses autonomy in managing its governance, commonly referred to as village autonomy. This autonomy serves as a means for all components involved in village governance—both the village government and other community elements—to synergize in implementing development within the village. However, at present, village governance is not yet fully carried out in synergy with all elements within the village. This situation underlies our initiative to conduct outreach on the importance of synergy or collaboration in the implementation of village governance. Our activities were carried out through lectures, discussions, and legal consultations. Based on the outreach we conducted, village governance, particularly in Sembalun Village, has not been collaborative. This is due to a lack of understanding among the components of village governance regarding the duties and roles of the community as part of the governance system, including the various forms of participation they can offer. Therefore, we provide recommendations based on our outreach, suggesting that all forms of governmental and developmental activities in the village should involve community participation in their implementation.

Abstract

The implementation of simultaneous elections or five (5) box elections has implications for the accumulation of workloads for election organizers, which within reasonable limits has an impact on the quality of general election implementation. In addition to the threat to the quality of general election implementation, the accumulation of workloads for organizers concentrated in a certain time period due to the tight timing of general elections in the same year causes relatively long periods of free time for election organizers. The purpose of this study is to determine the implications of the separation of national and local elections and its effectiveness in the implementation of elections in Indonesia. This research is a type of normative legal research that uses a legislative approach. The results explain that the separation of national and local elections in the implementation of elections has implications for regulatory changes related to election laws and regional elections that are not only related to technical aspects, but also touch on the institutional design of election organizers, the flow of stages of implementation, nomination mechanisms, and budget management of encouraging rationality of voters in using their voting rights, the transfer of government power at the central and regional levels which is mutually consolidated and will reduce the coattail effect between presidential and regional legislative elections. Furthermore, separating national and local elections will ensure greater election effectiveness, as voters face simpler choices. Logistics provision and distribution will be faster and more accurate, and local figures will be more likely to dominate the House of Representatives (DPR) ticket.

Abstract

Controversy ensued when the public judged that the President had turned a blind eye to the unconstitutional removal of Aswanto by issuing a policy on dismissing Aswanto and at the same time appointing Guntur judges, namely Presidential Decree Number 114/P/2022 concerning Dismissal and Appointment of Constitutional Court Judges. Based on this, problems were found, regarding the validity of a state administrative decision and how the validity of Presidential Decree Number 114/P/2022 concerning Dismissal and Appointment of Constitutional Court Judges. The research method used is normative juridical method, using statutory approach, case approach, and conceptual approach. The results of the study show that the KTUN has validity if it fulfills the material and formal requirements, as well as the conditions specified in Article 52 of Law Number 30 of 2014. Then Presidential Decree Number 114/P/2022 concerning Dismissal and Appointment of Constitutional Court Judges is invalid because it does not comply with the provisions in Article 52 paragraph (2) of Law Number 30 of 2014.
