Abstract

Kebakaran hutan dan lahan menjadi salah satu hal yang paling sering kita dengar kejadiannya terutama di Kalimantan. Penelitian ini bertujuan untuk mengetahui alasan bencana kebakaran hutan dan lahan (karhutla) yang sering terjadi di Kalimantan, bagaimana pemerintah menanganinya, dampak serta konsekuensi bencana tersebut bagi masyarakat. Kebakaran hutan dan lahan tentunya sangat memberikan dampak yang besar baik bagi manusia, tumbuhan, hewan, udara, dan berbagai komponen pendukung yang ada di dalam kawasan tersebut. Penelitian ini menggunakan metode normatif yang dimana dalam penelusuran data dan informasinya melalui sumber data tertulis yang telah ada. Proses pengumpulan data dilakukan dengan menggunakan kata kunci yang relevan dan mencakup verifikasi serta evaluasi sumber informasi untuk memastikan keandalan data. Dengan demikian, penelitian ini memberikan gambaran menyeluruh mengenai permasalahan kebakaran hutan dan lahan di Kalimantan serta menawarkan rekomendasi bagi peningkatan efektivitas penanganan dan pencegahan di masa mendatang.

Abstract

Sampah merupakan salah satu masalah besar yang dihadapi Indonesia. Sampah dapat menyebabkan banyak hal, mulai dari polusi lingkungan hingga bencana seperti banjir. Selain itu, tumpukan sampah merupakan masalah yang tidak dapat dihindari dalam kehidupan sehari-hari. Hal ini tidak dapat dipungkiri karena sampah selalu ada selama aktivitas kehidupan berlangsung. Pada penulisan ini memfokuskan terkait bagaimana hukum lingkungan mengatur kebijakan dan bagaimana pengelolaan sampah pasca banjir untuk menciptakan pemulihan lingkungan. Sampah banjir biasanya didominasi oleh reruntuhan bangunan maupun sampah-sampah yang terbawa arus. Penanganan tidak bisa hanya diselesaikan oleh instansi namun ini juga menjadi permasalahan bersama. Banjir sendiri bisa terjadi bukan hanya karena faktor alam namun juga terdapat permasalahan-permasalahan yang timbul dari pemerintah suatu negara itu sendiri. menggunakan pendekatan yuridis normatif untuk menganalisis bagaimana penerapan Hukum Lingkungan dalam pengelolaan sampah pasca banjir sebagai upaya pemulihan lingkungan yang berkelanjutan. Dalam penelitian ini, akan dilakukan telaah terhadap berbagai peraturan hukum yang berkaitan dengan pengelolaan sampah pasca banjir, serta akan dievaluasi sejauh mana efektivitas dan keberlanjutannya dalam memulihkan lingkungan.

Abstract

The protection of human rights for women has been a central issue in international law, reflecting the evolving recognition of gender equality and the need to address systemic inequalities. Historically, women have been marginalized in both legal and societal structures, facing discrimination, violence, and economic disparity. However, over the past century, a series of international conventions, treaties, and declarations have sought to safeguard women's rights globally. Notably, the Universal Declaration of Human Rights (UDHR), the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW), and various regional instruments have played pivotal roles in shaping legal norms that promote gender equality and protect women from abuses. Despite these legal frameworks, challenges persist in the effective implementation and enforcement of women's rights protections. Cultural, political, and socio-economic barriers continue to obstruct the realization of gender equality in many regions, and women often remain vulnerable to violence, exploitation, and discriminatory practices. The international legal system, through the work of organizations such as the United Nations, has made strides in encouraging state accountability and establishing standards for the treatment of women, but gaps in enforcement mechanisms, state sovereignty, and varying cultural norms complicate the protection process. This paper explores the international legal frameworks designed to protect women's human rights, evaluates the effectiveness of these mechanisms, and examines the ongoing obstacles to achieving comprehensive gender equality. The study highlights the need for continued advocacy, stronger enforcement, and collaboration among global institutions to advance the protection of women's rights and ensure their full participation in all spheres of life.

Abstract

Indonesia's administrative justice system is at a critical juncture, facing challenges of inefficiency, inconsistency, and limited access to fair legal recourse. This research examines the urgent need for a transformative approach in establishing an Indonesian Administrative Court grounded in the principles of fairness and proportionality. Despite progress in administrative reform, the current system often falls short of delivering just outcomes for citizens, leaving many marginalized and without proper redress. The novel contribution of this study lies in its comprehensive framework for integrating these foundational principles into the court’s design and practice. By analyzing both international best practices and local judicial traditions, the research proposes a set of reforms that would enhance the accessibility, transparency, and responsiveness of the administrative judiciary. The principle of fairness emphasizes equal treatment and impartial decision-making, while proportionality ensures that legal outcomes align with the scale of the issues at hand. Through an in-depth case study of administrative court decisions, this work identifies critical gaps where these principles can be meaningfully implemented. The urgency of these reforms is underscored by the growing demand for public accountability and citizen trust in the judiciary, which is essential for Indonesia’s democratic stability. By offering practical solutions and a conceptual shift, this research provides a timely contribution to the ongoing discourse on judicial reform in Indonesia, with the potential to reshape the administrative court system into a more equitable and effective institution for all citizens.

Abstract

Indonesian Environmental Law has regulated Anti-Strategic Litigation Against Public Participation (Anti-SLAPP) which guarantees protection to everyone who fights for the right to a good and healthy environment, not to be criminally prosecuted or sued civilly, as stipulated in Article 66 of the UUPPLH. Hope is still far from reality, because data shows that many communities and/or environmental warriors are victims of SLAPPs as part of the backlash from those they report or oppose when they participate and defend people's right to a good and healthy environment. This article aims to discuss; (1) Problems of Anti-SLAPP Regulation and Application in Indonesia and (2) The Urgency of renewal Anti-SLAPP Regulations in Indonesian Environmental Law. The research method uses normative juridical methods. The results of the discussion showed that (1) the problems of regulating and implementing Anti-SLAPP include three elements, namely legal substance problems, legal structure problems and problems in legal culture: and (2) There are at least 7 reasons that cause the urgency of renewal of Anti-SLAPP Regulations in Indonesian environmental law to be able to realize the protection of society participation in environmental protection and management.

Abstract

Pengadaan barang dan jasa pemerintah merupakan aspek strategis dalam penyelenggaraan pembangunan yang menuntut prinsip transparansi, akuntabilitas, dan kepastian hukum. Penelitian ini bertujuan untuk menganalisis pentingnya perumusan kontrak yang jelas dalam mencegah sengketa pada pengadaan barang dan jasa pemerintah, dengan studi kasus di Pemerintah Provinsi DKI Jakarta. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan studi kasus melalui analisis dokumen hukum, wawancara mendalam, dan observasi terhadap proses penyusunan serta pelaksanaan kontrak pengadaan. Hasil penelitian menunjukkan bahwa banyak sengketa pengadaan disebabkan oleh ketidakjelasan klausul kontrak mengenai tanggung jawab, ruang lingkup pekerjaan, dan mekanisme penyelesaian sengketa. Kontrak yang tidak dirumuskan secara detail menimbulkan multitafsir dan ketidakpastian hukum bagi para pihak. Pembahasan menegaskan bahwa perumusan kontrak yang sistematis dan selaras dengan ketentuan Peraturan Presiden Nomor 16 Tahun 2018 dapat mengurangi risiko konflik, meningkatkan efektivitas pelaksanaan proyek, dan memperkuat tata kelola pemerintahan yang bersih. Selain itu, kompetensi Pejabat Pembuat Komitmen (PPK) dalam memahami aspek hukum kontrak menjadi faktor penting dalam menjamin kualitas perumusan kontrak. Kesimpulan penelitian ini menegaskan bahwa kejelasan rumusan kontrak merupakan kunci utama dalam mewujudkan pengadaan barang dan jasa yang efisien, transparan, dan minim sengketa di lingkungan pemerintah daerah

Abstract

Gunungkidul Regency is one of the regions that has experienced significant growth in the tourism sector in the last two decades. The beauty of the karst landscape, underground caves, and the series of southern beaches are major attractions for both domestic and international tourists. Amidst this development, challenges arise in managing space that balances economic interests and environmental preservation. The use of space for tourism purposes is often inconsistent with established spatial plans, resulting in conflicts over spatial use, damage to karst ecosystems, and shifts in the function of protected areas. This study aims to critically examine theories and approaches to spatial planning and evaluate the extent to which these approaches are applied in sustainable tourism development in Gunungkidul Regency. The approach used is a juridical-sociological one, examining the relationship between spatial planning legal norms and empirical conditions in the community. Data collection techniques were carried out through interviews with policymakers and tourism actors, direct observation of tourism development locations, and literature studies of planning documents such as the RTRW (Regional Spatial Plan), RDTR (Regional Spatial Plan), and regional regulations. The results show that the spatial planning approach that has been applied to date tends to be top-down and technocratic, thus lacking the involvement of local communities as the primary subjects of development. Mismatches between planning and implementation persist, particularly in the form of zoning violations and weak oversight of land use conversion.

Abstract

The phenomenon of overseas proxy shopping servicesis growing rapidly as part of the digital economy, but the practiceis informal and without written contracts, creating legal uncertaintyfor all parties. Jastip transactions, which are often conducted through social media, rely solely on trust and brief communication, creatingvulnerabilities to fraud, default, non- conforming goods, damage,and issues of responsibility for customs fees and cross- jurisdictional risks. The absence of a contract means that the legal relationship between the jastiper and the consignor lacks a clear structure, making it difficult to determine rights,obligations, and dispute resolution in the event of loss. This articleanalyzes the forms of legal uncertainty in foreign jastip transactionswithout contracts and explains the strategic role of contract drafting as ainstrument of legal protection. Through the preparation of a written contract that includes the identities of the parties, specifications of the goods, risk sharing, costs, delivery mechanisms, refunds, and dispute resolution, contract drafting is able toprovide legal certainty, protect the rights of the parties, minimize the risk ofdisputes, and increase the professionalism of jastip practices. Therefore,the existence of a written contract is not merely a formality, but a fundamental necessityto create safe, transparent, and accountable jastip transactionsin the cross-border digital trade ecosystem

Abstract

The development of information technology has driven significant changes in contracting practices, including the emergence of electronic contracts as a form of agreement in digital transactions. This study aims to analyze the legal basis, validity requirements, constituent elements, and legal status of electronic contracts under the Law of ITE, Government Regulation No. 71 of 2019, Government Regulation No. 80 of 2019, and the general principles of agreement in the Civil Code. The research employs a normative juridical method with a qualitative analytical approach through a literature review of legislation and relevant legal doctrine. The study’s findings indicate that electronic contracts fundamentally possess the same validity as conventional written contracts, provided they satisfy the validity requirements of Article 1320 of the Civil Code and the technical provisions set forth in the implementing regulations of the UU ITE. These provisions include the use of reliable electronic systems, adherence to the principles of prudence and good faith, and the provision of clear electronic information. Electronic contracts must also contain the essentialia, naturalia, and accidentalia elements as regulated in Government Regulation No. 71 of 2019, and they are subject to additional rules applicable to electronic transactions under Government Regulation No. 80 of 2019. The implications of this study underscore the importance of raising electronic system security standards, providing legal education for participants in digital transactions, and strengthening regulations on digital proof and evidentiary rules so that electronic contracts can deliver optimal legal certainty.

Abstract

This article examines the application of the force majeure clause in PT Freeport Indonesia’s export contracts when delays in export permits arise from government actions. The study focuses on two central issues: whether such delays can be classified as force majeure, and how the clause is implemented within Freeport’s commodity contracts. Based on an analysis of contract law doctrine, the Indonesian Civil Code, and international commercial practices, the delay in export permits satisfies the elements of force majeure because it originates from government policies beyond the company’s control, is unforeseeable, unavoidable, and results in the temporary impossibility of performing delivery obligations. The contractual practices of Freeport further show that the force majeure clause is structured to anticipate government intervention through mechanisms such as formal notification, proof of non-negligence on the part of the company, and adjustments to delivery schedules once permits are reinstated. The findings confirm that the force majeure clause functions as an effective legal tool to protect Freeport and maintain the stability of international trade relations amid fluctuating mineral export regulations. This study highlights the need for more precise and adaptive drafting of force majeure clauses to address regulatory uncertainty in the mining sector.
