Abstract

Penelitian ini menelaah bagaimana hukum waris Islam diterapkan dan dipahami dalam keragaman sosial serta budaya masyarakat Indonesia. Kajian ini memusatkan perhatian pada interaksi antara norma hukum, praktik adat, dan relasi gender dengan mensintesis temuan dari tiga puluh dua penelitian ilmiah yang diterbitkan antara tahun 2020 hingga 2024. Hasil analisis menunjukkan bahwa meskipun hukum Islam memberikan kerangka yang jelas mengenai pembagian warisan, penerapannya dalam kehidupan masyarakat sering kali dipengaruhi oleh tradisi lokal dan struktur sosial yang kuat, yang membentuk cara pandang terhadap keadilan dan keseimbangan. Tiga tema utama muncul dari berbagai penelitian tersebut. Pertama, ketimpangan gender masih menjadi persoalan yang terus berulang, di mana perempuan kerap menerima perlakuan tidak setara meskipun ketentuan fikih memberikan hak yang jelas. Kedua, koeksistensi antara hukum Islam dan hukum adat menciptakan ruang negosiasi, di mana tafsir lokal sering kali menyesuaikan atau menafsirkan ulang ketentuan formal hukum Islam. Ketiga, rendahnya kesadaran dan literasi hukum di kalangan masyarakat pedesaan masih menjadi hambatan dalam mewujudkan praktik distribusi warisan yang adil. Dengan memadukan perspektif hukum, budaya, dan etika, penelitian ini menawarkan pemahaman yang menyeluruh tentang hukum waris Islam sebagai sistem moral yang hidup. Penelitian ini menegaskan bahwa keadilan sejati dalam pewarisan tidak hanya menuntut pembaruan hukum, tetapi juga dialog budaya, pendidikan masyarakat, dan empati sosial. Pendekatan seperti ini memungkinkan hukum Islam tetap setia pada landasan etiknya sekaligus tanggap terhadap keragaman sosial yang menjadi ciri khas masyarakat Indonesia.

Abstract

The global ecological crisis indicates that technical methods and regulations alone are insufficient to change human behavior related to the environment, thus requiring approaches that touch on moral and spiritual aspects. This study aims to design and examine spiritual-ecological education as an alternative approach in building sustainable environmental awareness. This research uses a qualitative method based on literature study using Miles and Huberman's analysis through summarization, exposition, and data conclusion drawing. The results of the study show that spiritual-ecological education has three important outcomes, namely: (1) the integration of the values of monotheism, khalifah, and ecological trust creates a solid environmental ethical framework; (2) the methods of ecosufism and scientia sacra deepen students' affective and reflective understanding of the relationship between humans and nature; and (3) contextual learning methods such as eco-pesantren and environmental programs may connect spiritual values with real ecological activities. This study contributes scientifically by developing a theoretical basis for spiritual-ecological education that combines theological, philosophical, and pedagogical aspects of environmental education. These results imply the importance of developing lesson plans and teacher training that place spirituality as the basis of ecological understanding, with the caveat that drawing general conclusions from the study results requires further empirical testing.

Abstract

This research is to explain the relationship between the ijtihad process and the ethical values ​​that a mujtahid must have, including aspects of the discussion of ijtihad in ushul fiqh, and outlining the ethical principles that a mujtahid must have. The method in this study uses a qualitative approach that is library-based, data sources are collected from journals, books and other supporting materials that discuss ijtihad in ushul fiqh. Ijtihad plays an important role in the development of Islamic law, especially in facing the transformations that occur in technology, social, and culture as well as globalization. By using ijtihad, Islamic teachings remain relevant throughout time and can answer various questions that arise in the current era. However, ijtihad also has limitations; it must be carried out by people who qualify as mujtahid and must not conflict with the basic principles of Islamic teachings. To achieve broader results and in accordance with the needs of the community, ijtihad is currently carried out not only individually but also collectively through fatwa institutions. In conclusion, ijtihad functions as an important link between classical Islamic literature and contemporary conditions. Ethics are also an important foundation in ijtihad, because a mujtahid must be ethical for the sake of welfare, justice, and honesty for the benefit of all.
