Abstract

Fake news (hoax) is information that is actually not true. In its distribution, it is necessary to handle and make efforts so that fake news (hoax) is not spread to the public as public consumption. In this research, researchers utilized the type of Normative Juridical Research. Another term for normative research is doctrinal research, also called library or document research. Type The Department of Communication and Information (Diskominfo) of Samarinda City needs to tighten the handling and efforts, the article is that fake news (hoax) is often spread widely so that people believe in the fake news (hoax). Law Number 19 of 2016 concerning Electronic Information and Transactions regulates the spread of hoaxes in article 28 paragraph (1), so that an action is needed by the Samarinda City Communication and Information Office (Diskominfo) and seeks to spread false news (hoax). is not disseminated to the public.

Abstract

Latar Belakang: Pelayaran merupakan salah satu industri jasa yang berkembang saat ini dimana bidang usahanya yaitu pengiriman barang. Perusahaan pelayaran sekarang ini lebih banyak menggunakan kontainer atau peti kemas dalam jasa pengirimannya. Metode Penelitian: Metode penelitian yang digunakan penulis adalah metode Hukum Yuridis Normatif yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data primer dan data sekunder. Hasil Penelitian: Penetapan Mekanisme yang dilaksanakan keagenan pelayaran antara lain melaporkan secara tertulis rencana dan realisasi kedatangan dan keberangkatan kapal yang diageni, penyerahan dokumen kapal kepada Syahbandar, dan unit penyelenggara pelabuhan setempat serta instansi pemerintah terkait, pengurusan jasa kepelabuhan yang diperlukan kapal tersebut, penunjukan perusahaan bongkar muat untuk kepentingan pemilik kapal, pembukuan dan pencairan muatan, penerbitan konosemen untuk dan atas nama pemilik kapal, penyelesaian tagihan atas nama pemilik kapal, penyelesaian pengisian bunker bahan bakar minyak dan air tawar serta pemenuhan kebutuhan perlengkapan dan perbekalan. Kesimpulan: Pengawasan Komisi Pengawas Persaingan Usaha terhadap penetapan harga dalam keagenan pelayaran dengan melaksanakan pengawasan berupa bimbingan dan penyuluhan yang diberikan kepada pelaku usaha yang meliputi kegiatan advokasi, sosialisasi, seminar, dan kegiatan lainnya yang sejenis yang terkait dengan upaya dalam mewujudkan persaingan usaha yang sehat agar penerapan dari asas dan tujuan dari Undang-Undang tersebut dapat tercapai dengan baik.

Abstract

This research aims to analyze and determine the role of banking in Providing business capital for MSMEs in the Kutai Lama area and analyze banking efforts in overcoming obstacles faced by perpetrators MSMEs in the Kutai Lama site environment in providing business capital loans.The method used in this research is a qualitative method, with normative juridical approach.The research results show that banking has a very big role in helping MSMEs develop business through providing business capital for MSME actors, especially those in wealth in the old Kutai site environment. There are two important roles for banking in helping MSMEs in developing their business both before roviding business capital and After providing business capital, namely first, carrying out an powerment program MSMEs before providing business capital loans. Second, do the program coaching and supervision of MSMEs after providing business capital loans.Furthermore, there are banking efforts to overcome the obstacles faced by MSME actors in the Kutai Lama site environment in providing business capital loans namely by providing outreach regarding financing for MSMEs by parties banking, Providing training and education for MSME players so they can develop business income, and provide credit restructuring for MSME players who have had a history of bad credit.

Abstract

This study aims to analyze and determine the role and influence of maklon service companies in the production and distribution process of cosmetic products from a corporate law perspective, and to analyze and determine the form of legal guarantees and responsibilities of maklon service companies to consumers in cases of illegal product circulation. The method used in this study is a qualitative method, with a normative legal approach. The results of the study indicate that maklon service companies have a strategic role in the cosmetics industry by providing efficient production and distribution services. The role of maklon service companies in cosmetic production is to provide cost and time efficiency for cosmetic business actors, maintain and improve product quality, and provide innovation to cosmetic business actors' products. While the role of maklon service companies in the distribution of cosmetic products is to ensure compliance with regulations and permits, provide products on a large scale, and provide data and formulation protection. Maklon service companies have a great responsibility in ensuring that the cosmetic products they produce comply with applicable regulations. Forms of legal guarantees to consumers include product safety guarantees, information disclosure guarantees, and compensation and settlement guarantees. While maklon service companies have a great responsibility in preventing the circulation of illegal products. The form of legal responsibility of the maklon service company towards consumers in cases of illegal product distribution is responsibility for breach of contract, administrative responsibility (sanctions from BPOM and the Government), civil responsibility (compensation to consumers), and criminal responsibility (imprisonment and fines).

Abstract

Consumer disputes between defaulting bank debtors and banks are a crucial issue in consumer protection within the financial services sector. This research aims to examine the efforts and obstacles faced by the Consumer Dispute Settlement Board (BPSK) of Samarinda City in resolving such disputes, viewed through Law No. 8 of 1999 concerning Consumer Protection. Employing a normative juridical research method supplemented by interview data, this study analyzes BPSK's authority, procedures, and challenges. The findings indicate that BPSK Samarinda endeavors to resolve these disputes, particularly through mediation. BPSK facilitates dialogue between consumers (debtors) and business actors (banks), provides education, and guides the parties toward achieving amicable, win-win solution agreements according to established procedures. However, BPSK encounters significant constraints, including potential jurisdictional overlap with other financial sector dispute resolution bodies (LAPS-SJK), limitations in the legal basis specifically governing its authority in the banking sector, late reporting by consumers after enforcement actions (auctions), and insufficient public awareness, sometimes coupled with delayed responsiveness from business actors. Although BPSK serves as an accessible and low-cost alternative dispute resolution mechanism, strengthening its legal foundation and conducting massive outreach are necessary to enhance its effectiveness in handling complex banking disputes.

Abstract

The Consumer Protection Law in Indonesia has so far focused more on transactions between consumers and business actors without distinguishing between commercial products and subsidized products . In fact, subsidized products such as clean water from PDAM, subsidized electricity, and subsidized fuel have different legal characteristics because The price is set by the government and monitored by certain bodies . This difference has implications for price transparency, service quality standards, and dispute resolution mechanisms which is not fully regulated in the UUPK. This article aims to analyze the incompleteness of consumer protection regulations for subsidized products and propose a fairer and more effective legal reconstruction . By using normative approach , this research to study national regulations, WTO principles related to subsidies, and comparative studies with other countries . The results of the study indicate that consumer protection for subsidized products requires a more specific legal framework. to guarantee consumer rights without ignoring the interests of the government as a regulator and service provider as a special business actor . Therefore, it is necessary regulatory reconstruction that accommodates price transparency, improved service quality, and clearer dispute resolution mechanisms for consumers of subsidized products

Abstract

Covid-19 saat ini menjadi wabah yang serius di seluruh penjuru dunia. Pandemi ini memaksa kebijakan social distancing (menjaga jarak fisik) untuk meminimalisir persebaran wabah, keramaian, kerumunan secara langsung yang telah diblokade oleh pemerintah, berlaku juga untuk kegiatan belajar mengajar. Interaksi guru dan siswa dalam proses pembelajaran sangat penting. Dengan adanya proses pembelajaran daring, guru harus benar-benar memperhatikan proses belajar siswa yang dilakukan secara online. Peran guru BK sangat penting membantu siswa mengatasi permasalahan selama pembelajaran daring. Guru BK tidak memberikan materi-materi ataupun tugas yang memberatkan siswa, tetapi menyajikan layanan melalui format yang bermakna bagi siswa dalam pengembangan karakter selama di rumah

Abstract

Modern cooperatives are increasingly required to implement professional, transparent, andaccountable governance in response to the growing complexity of business activities andpublic accountability. This study aims to examine the implementation of Good CorporateGovernance (GCG) principles within the Indonesian cooperative legal systemandtoformulate an ideal model for strengthening GCG-based regulation and cooperativegovernance. This research employs normative legal research methods using statutory, conceptual, and comparative approaches, through an analysis of Law Number 25 of 1992onCooperatives, its implementing regulations, and legal doctrines on corporate governance. The findings reveal that the principles of GCG have been normatively accommodatedintheIndonesian cooperative legal framework, particularly through economic democracy, theresponsibilities of cooperative management, and accountability mechanisms withinthegeneral meeting of members. However, such regulation remains implicit, fragmented, andlacks comprehensive governance standards comparable to those applied in modern corporateentities. Furthermore, this study proposes that an ideal model for strengthening GCG-basedcooperative regulation and governance should be developed through the reformof cooperative legislation that explicitly incorporates the principles of transparency, accountability, responsibility, independence, and fairness; the enhancement of the roles andprofessionalism of cooperative organs; and the establishment of modern cooperativegovernance guidelines aligned with cooperative values and identity. This model is expectedto promote legally sound, ef iciently managed, and sustainable cooperatives with enhancedcompetitiveness within the national economic system
