Abstract

The relation between legal subjects such as person or legal entity in a case, frequently generates dispute. Along with the complexity of social life, then, the more parties are involved in the dispute, the wider scope of the dispute case. One of the concerned dispute in the society is Industrial Relations Disputes that become the competence of Industrial Relations Court. Since 2015, The Act No. 2/2004 about Industrial Relations Dispute Settlement has enforced effectively, it still has many weaknesses, wether from practical or regulation aspects. The legal problems of its Act cause the settlement of Industrial Relations Dispute become less effective and efficient, also hamper the principle of constante justitite (principle of rapid, fair and easy trial). The research concluded that the practical/operational level of the Judges Panel in examining and adjudicating the cases of Industrial Relations Dispute in Industrial Relations Court of Samarinda, which tend to apply the general civil procedure law, from the examination of legal standing of the parties, exception, interlocutory decision, replik, duplik, writen proof, the witnesses, experts/professional witnesses, conclusion and verdict. This procedures only prolong the examination and trial process to settle the case of Industrial Relations Dispute. Therefore, the SOP (Standard Operational Procedure) of the settlement of Industrial Relations Dispute cannot be well-implemented yet as the mandate of the law.

Abstract

Korupsi merupakan salah satu masalah terbesar yang dihadapi oleh bangsa Indonesia khususnya kota Samarinda Kalimantan Timur. Banyak Orang yang tidak percaya lagi dengan penegakan hukum tindak pidana korupsi, dengan berbagai alasan kasus korupsi lepas dari tuntutan hukum membuat komponen masyarakat menjadi kehilangan kepercayaan terhadap penegakan hukum tindak pidana korupsi. Dampak yang dilahirkan akibat korupsi sangat berbahaya yang berakibat pada perkonomian dan pembangunan negara secara nasional. Jenis penelitian yang digunakan dalam tulisan ini adalah metode pendekatan empiris yang merupakan pendekatan yang relevan dengan permasalahan yang diteliti yaitu pendekatan langsung ke Masyarakat. Sehingga dapat memperoleh gambaran tentang persepsi masyarakat terhadap penegakan hukum tindak pidana korupsi dan kendala pelaksanaan penegakan hukum tindak pidana korupsi di kota samarinda.  Berdasarkan hasil dan luaran yang dicapai dalam program penelitian adalah khususnya teruntuk masyarakat RT 29 Kelurahan Pelabuhan Kecamatan Samarinda Kota adalah pemahaman masyarakat yang ingin diketahui meliputi kesadaran (awareness), pengetahuan (knowledge), dan sikap (attitude) serta perilaku (behavior) masyarakat mengenai tindak pidana korupsi. Analisis dari tulisan ini menunjukan bahwa masyarakat banyak yang belum begitu mengerti dan paham mengenai penegakan hukum tindak pidana korupsi. Gambaran hasil dari kegiatan survey ini diharapkan dapat dijadikan masukan dan saran yang dapat membantu mengembangkan strategi yang efektif dalam memberantas korupsi serta peran masyarakat sebagai pengawas.

Abstract

Kutai Kartanegara Regency as an autonomous region has regional development planning documents as an integral part of the provincial and national development planning systems. The greater role of Regional Original Revenue (PAD) means less regional dependence on central assistance. The purpose of this study was to determine the role of the Regional Revenue Agency of Kutai Kartanegara Regency in carrying out levies and carry out supervision of swallow nest owners in exercising their authority to pay taxes to increase local revenues and to determine the calculation of the swallow's nest tax rate which was set at 10% based on the Regulation Regency of Kutai Kartanegara Number 2 Year 2011 regarding Regional Tax. The method used in this study is normative with the main informant namely the Regional Revenue Agency of Kutai Kartanegara Regency. The results showed that the Regional Revenue Agency of Kutai Kartanegara Regency in carrying out levies and carrying out supervision of swallow bird nest owners in carrying out their authority to pay taxes to increase local revenue is still not optimal. Supervision should also be carried out in the implementation of levies, in order to evaluate the administration of levies. The calculation of the tax rate for swallow's nest which is set at 10% based on the Kutai Kartanegara Regency Local Regulation Number 2 of 2011 concerning Regional Taxes is good enough but in terms of implementation it must be carried out to the entrepreneur of swallow's nest.

Abstract

The relationship between banks and customers is based on the two most related elements, namely law and trust. A bank can only carry out activities and develop its bank, if the community "believes" to place its money, on banking products that exist in the bank. The higher the trust of the community, the higher the public's awareness to save money with the bank and to use other banking services. Public trust is the main key to the development or failure of a bank, in the sense that without the trust of the community, then a bank will not be able to carry out its business activities. For business people, banks are the main complement in carrying out daily activities, controlling the entry and exit of funds and achieving success, and are usually in the form of checking accounts. Based on this, the writer wants to examine more deeply the relationship between customers and banks regarding account information, bank rights and customer rights, and is associated with existing regulatory regulations.

Abstract

Upaya penyelenggaraan ketahanan keluarga di wilayah Provinsi Kalimantan Timur didasarkan pada 5 (lima) dimensi ketahanan keluarga yang mengacu pada Buku Katalog Pembangunan Ketahanan Keluarga dari Kementerian PPPA Republik Indonesia. Kelima dimensi tersebut meliputi Dimensi Landasan Legalitas dan keutuhan Keluarga, Dimensi Ketahanan Fisik, Dimensi Ketahanan Ekonomi, Dimensi Ketahanan Sosial-Psikologi, Dimensi Ketahanan Sosial-Budaya. Mengacu pada kelima dimensi tersebut, maka diperlukan kajian hukum terhadap Praktek Penyelenggaraan Ketahanan Keluarga di Provinsi Kalimantan Timur agar dapat dijadikan sebagai bahan acuan dalam pembuatan atau penyusunan rancangan peraturan daerah tentang Penyelenggaraan Ketahanan Keluarga di Provinsi Kalimantan Timur, sebagai landasan penguatan ketahanan keluarga oleh seluruh stakeholders, baik yang bersentuhan langsung, maupun tidak langsung berdasarkan tugas pokok, fungsi dan kewenangan masing-masing. Penelitian ini bertujuan untuk mengetahui dan mengkaji praktek penyelenggaraan ketahanan keluarga di Provinsi Kalimantan Timur dan untuk mengetahui dan menganalisis permasalahan yang dihadapi masyarakat Kalimantan Timur terkait ketahanan keluarga. Penelitian ini merupakan penelitian hukum Empiris (Yuridis Empiris). Hasil penelitian ini menunjukkan bahwa Praktek penyelenggaraan ketahanan keluarga serta permasalahan yang dihadapi oleh masyarakat kalimantan timur terkait ketahanan keluarga dapat dilihat dari 2 (dua) aspek yakni Aspek Legalitas dan Keutuhan Kelurga serta Aspek Ketahanan Fisik. Aspek Legalitas dan Keutuhan Keluarga menjelaskan bahwa kondisi sosiologis masyarakat Kalimantan Timur terkait penyelenggaraan ketahanan keluarga di Provinsi Kalimantan Timur sesungguhnya masih membutuhkan dorongan regulasi dari pemerintah daerah, dalam hal ini adalah pemerintah provinsi. Hal ini tergambar pada data-data yang telah dicantumkan dalam tabel-tabel diatas, yang dapat kita gambarkan dengan angka perceraian di Provinsi Kalimantan Timur, angka kriminalitas di Provinsi Kalimantan Timur dan kepemilikan akte kelahiran di Provinsi Kalimantan Timur. Aspek ketahanan Fisik menjelaskan bahwa kondisi faktual masyarakat di Provinsi Kalimantan Timur atau permasalahan masyarakat kaltim terkait ketahanan keluarga yakni digambakan dengan Kecukupan pangan dan daya beli masyarakat Kalimantan Timur sebagai indikator kesejahteraan, Pengeluaran untuk daya beli masyarakat terhadap jenis makanan yang menggambarkan pola konsumsi rata-rata sebuah keluarga. Kepemilikan Rumah di Provinsi Kalimantan Timur, serta Pekerja dan Pengangguran di Provinsi Kalimantan Timur.

Abstract

Perkembangan teknologi saat ini membuat sistem keuangan konvensional terlihat tidak praktis lagi dan memakan waktu yang cukup lama dalam hal melakukan pinjam meminjam. Perbankan, pasar modal, ataupun perusahaan pembiayaan menjadi kurang diminati, seperti dalam urusan pinjam meminjam dana karena saat ini kegiatan pinjam meminjam bisa diakses dengan mudah melalui internet atau smartphone. Transaksi keuangan atau pinjam meminjam jauh dari kata kaku dan berbelit dengan hadirnya layanan Fintech untuk melakukan pinjam meminjam uang berbasis online. Penelitian ini bertujuan untuk mengetahui praktik pinjam meminjam uang berbasis online ditinjau dari Peraturan Otoritas Jasa Keuangan Nomor 77/POJK.01/2016 tentang layanan pinjam meminjam uang berbasis teknologi informasi dan mengetahui perlindungan hukum terhadap hak dan kewajiban para pihak dalam transaksi pinjam meminjam berbasis online. Penelitian ini menggunakan metode penelitian hukum Yuridis Normatif yang bersumber dari bahan hukum primer dan bahan hukum sekunder. Hasil penelitian yakni kepastian hukum terhadap praktik pinjam meminjam berbasis online ditinjau dari peraturan otoritas jasa keuangan Nomor 77/POJK.01/2016 tentang layanan pinjam meminjam uang berbasis teknologi informasi diperlukan untuk menjamin kepastian hukum khususnya bagi Pemberi Pinjaman apabila terjadi gagal bayar dari pihak Penerima Pinjaman. Dan Perlindungan hukum bagi para pihak dalam transaksi pinjam meminjam uang berbasis online dapat dilakukan secara preventif dan represif.

Abstract

The role of the Business Competition Supervisory Commission (KPPU) of Regional Office V Balikpapan is to create a Healthy Business Competition Climate in East Kalimantan.The practice of fraud in the tender process in the implementation of procurement of government goods / services can be in the form of conspiracy. Business Competition Supervisory Commission (KPPU) as supervisor of business competition based on Law Number 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition has the task of supervising the prohibition of conspiracy in tenders as stipulated in article 22 of Law Number 5 of 1999, One of which is to decide breach of tender conspiracy in this case the case that has been handled by the KPPU of the Balikpapan Regional Representative Office namely Case Number 17 / KPPU-L / 2016 concerning Alleged Violations Article 22 of Law Number 5 of 1999 concerning Improvement of the Jongkang Road to Jakarta Samarinda Samarinda Karang Paci Road (Ring Road III) Tenggarong Seberang District. The method used in this study is normative juridical supported by field research, namely the Business Competition Supervisory Commission (KPPU) Regional Office V Balikpapan. The results of the study based on the case verdict showed that the KPPU of the Balikpapan Representative Office had successfully handled this case so that they had sentenced each Reported Party I, and 2 They had sentenced each Reported Party I, and 2 PT Karyatama Nagasari as Reported Party I and PT Jasin Effrin Jaya as Reported Party II, to pay a fine of Rp. 5,021,028,000.00 (Five Billion Twenty One Million Twenty Eight Thousand Rupiah) which must be deposited to the State Treasury, and Prohibit PT Karyatama Nagasari as Reported Party I and PT Jasin EffinJaya as Reported Party II to participate in the tender in the field of road construction services for 2 (two) years in all regions of Indonesia.

Abstract

This study aims to determine the implementation of facility rights and accessibility for people with disabilities at health institutions in Samarinda City (in terms of East Kalimantan Provincial Regulation Number 1 of 2018 concerning the Protection and Fulfillment of the Rights of Persons with Disabilities). This research is an empirical legal research which is sourced from primary data and secondary data. The results showed that the facility rights and accessibility for persons with disabilities at Health Offices in Samarinda City were still not evenly distributed, and facilities that were not friendly to persons with disabilities or were still not easily accessible to persons with disabilities and still did not meet the requirements of the needs of persons with disabilities. So it is suggested that local governments can implement facility rights and accessibility for persons with disabilities since the issuance of this regional regulation and that regional governments should consider helping and being more concerned about the rights of persons with disabilities in Samarinda City.

Abstract

This study aims to determine the arrangement of tax collection againstOnline Shop what researchers did in Samarinda City. This research is a Normative Law research that originates from primary and secondary legal materials. The results of this study indicate that the arrangement of tax collection ononline shop as Taxpayers are Law Number 36 of 2008 concerning Income Tax, Government Regulation Number 23 of 2018 concerning Income Tax on Income from Business Received or Earned by Taxpayers with Certain Gross Turnover and tax provisions related toecommerce has been confirmed in the Circular Letter of the Director General of Taxes Number SE-62/PJ/2013 Concerning the Affirmation of Tax Provisions on TransactionsEcommerce,in its implementation there is no specific data collection ononline shop as a Taxpayer. So it is suggested that the government can issue laws and regulations that can cover all forms of e-commerce in order to create a good tax payment mechanism.

Abstract

Termination of Employment is the termination of the employment relationship between the company and the employee. Severance pay must be given to workers who have been laid off for normal reasons, such as resignation/retirement but in practice there are companies that are not willing to pay severance pay to workers in the Indonesian Borneo Labor Union. The research uses normative juridical sources from legal materials and interviews. The research focuses on the actions of companies that do not pay severance pay. The results show that the company does not pay severance pay because the worker is considered to have resigned unilaterally but what is considered here is related to the company employing workers/laborers over the age of 60 years who should have retired because they avoid unwanted things such as work accidents, the retirement age is regulated in the Permenaker No. 2 of 1995 Paragraph 1 and Paragraph 2, so that the company is obliged to pay severance pay in Article 156. Type It is recommended that the company pays severance pay in accordance with the provisions of Article 167 Paragraph 5, namely Severance Pay in Article 156 Paragraph 2, severance pay in Article 156 Paragraph 3, Reimbursement of Rights Article 156 Paragraph 4 of Law No. 13 of 2003 concerning Manpower in conjunction with Law No. 11 of 2020 concerning Job Creation and implementing the contents of Decision Number: 83/Pdt.Sus-PHI/2015/PN Smr who already have permanent legal force related to the nominal payment of severance pay due to the termination of the law employment interest because the worker/labourer has retired.
