Abstract

Indonesia telah mencakup konsep mata uang digital bank sentral atau rupiah digital dalam Undang-Undang No. 7 Tahun 2011 tentang Mata Uang. Namun, ketentuan tersebut masih dianggap kurang kuat dalam menerapkan rupiah digital karena masih ada beberapa hal yang belum diatur, menciptakan kekosongan hukum. Salah satunya adalah distribusi rupiah digital. Penelitian tesis ini bertujuan untuk mengkaji regulasi hukum yang mengatur distribusi mata uang digital bank sentral sebagai alat pembayaran dalam transaksi elektronik. Selain itu, penelitian ini membandingkan pengaturan hukum distribusi mata uang digital bank sentral sebagai alat pembayaran dalam transaksi elektronik di Indonesia dengan di Bahama. Tujuan lainnya adalah untuk merumuskan konstruksi hukum ke depan terkait distribusi rupiah digital guna merekomendasikan pembaruan hukum. Penelitian ini menggunakan pendekatan doktrinal hukum dengan pendekatan konseptual, perundang-undangan, dan perbandingan. Melalui studi kepustakaan dan analisis deduktif, ditemukan bahwa peraturan yang ada masih belum memberikan kepastian hukum terhadap distribusi rupiah digital di Indonesia. Sementara di Bahama, regulasi yang telah disusun secara konkret dalam Bahamian Dollar Digital Currency Regulations, 2021. Oleh karena itu, konstruksi hukum ke depan perlu menegaskan kewenangan Bank Indonesia dalam mengelola rupiah digital, merancang infrastruktur teknologi, mengatur distribusi kepada perantara dan masyarakat, serta mempertimbangkan sanksi administratif terkait

Abstract

The relationship between ethical norms and legal norms is different for experts, especially concerning their position. Moreover, legal norms seem to be superior to ethical norms. This study aims to analyze the position of ethical norms and legal norms. The dignified justice theory was chosen because it seeks to orient the divine and human aspects, which can only be fulfilled if ethical and legal norms synergize. This research is juridical-normative research. The juridical-normative research was chosen because it confirms the existence of ethical norms and legal norms as part of the system of norms prevailing in society. The study's results confirm that, in practice, legal court decisions are often considered higher and more authoritative than ethical court decisions. This has implications for the position of ethical norms that are considered inferior to legal norms. Furthermore, the theory of dignified justice seeks to see the relationship between ethical norms and legal norms as different norms, but in its implementation in society, the two norms must synergize and complement each other.

Abstract

DPRD is said to be a regional legislative body because it has the authority to make local regulations, several local government laws that have been in force mention that DPRD has a legislative function, similar to the DPR. The filling of positions for DPRD members is also done together with the filling of positions for DPR members in legislative elections. This has created the impression that DPRDs and DPRs are both legislative institutions, even though they are different. To make the difference more significant, there must be a revision/reorganization of the Local Government Law. The purpose of this research is to understand and find out about the problems and structuring of DPRD in the implementation of local government. The type of research used is normative juridical, while the approaches used in this research are three, namely legislative approach, conceptual approach, and historical approach. The results of the research in this journal are that the DPRD as an organizing institution of local government should be regulated in the Local Government Law together with the regional head and not regulated in other laws such as the MD3 Law. The Local Government Law also needs to organize the functions of the DPRD where the first order of functions should be the functions of supervision, budgeting, and the formation of local regulations. This is because DPRDs more often or routinely carry out supervisory functions, rather than budgetary and local regulation formation functions. The filling of the positions of DPRD members is carried out simultaneously with the positions of regional heads, not through elections together with members of the DPR. The nomenclature of DPRDs should also be changed, i.e. Provincial DPRDs should be changed to Provincial Councils, while DPRDs at the Regency/City level should be changed to Regency/City Councils. Suggestions in this research are aimed at making a new law on legislative institutions that does not include provisions on DPRDs, considering that DPRDs are not legislative institutions, but regional government organizing institutions.

Abstract

The Constitutional Court's involvement of the notary profession in approving marriage agreements without the support of technical regulations regarding the legal mechanism of such agreements has led to normative conflicts, created legal uncertainties, and has the potential to harm husbands and wives who enter into marriage agreements. This situation involves informal changes in legislation and the absence of legal provisions regulating the notary's authority. The issues arising include juridical aspects related to the notary's authority, legal certainty issues, and sociological aspects related to the legality of marriage agreements not recognized by notaries. In this context, this research aims to examine whether the notary's authority to approve marriage agreements, as per the Constitutional Court Decision, is not contrary to the principle of legal certainty and how the understanding of the meaning of marriage agreements for objects other than marital property. The research findings indicate that the new authority granted by the Constitutional Court Decision No. 69/PUU/XII/2015 is an attribution-based authority derived from legislation. In other words, notaries obtain authority directly from the wording of Article 29 paragraph (1) of the Marriage Law. Article 29 paragraph (1) of the Marriage Law after the Constitutional Court Decision No. 69/PUU/XII/2015 stipulates that marriage agreements can be made before, during, and throughout the marriage with a written agreement certified by the Marriage Registrar or Notary. Although marriage agreements with objects other than marital property are not explicitly regulated, they are implicitly addressed, essentially governing family relationships. The existence of marriage agreements with objects other than marital property aims to protect and provide benefits to the parties involved in case of disputes.

Abstract

Corruption crimes in government procurement of goods and services, such as bribery, price mark-ups, and manipulation of bidding processes, can disrupt good governance, cause financial losses to the state, and diminish public trust in the government. Therefore, legal audits by the State Prosecutor play a crucial role in preventing financial losses to the state and identifying administrative errors that potentially harm state finances based on the results of such legal audits. The research findings indicate that the legal audit by the State Prosecutor in avoiding financial losses to the state through the Prosecution is governed by the Cooperation Agreement between the Ministry of Home Affairs, the State Prosecutor, and the Indonesian National Police. This audit involves receiving reports or complaints from the public, verifying with supporting evidence, providing written notices of handling outcomes, and protecting the identity of the reporters. The steps of the legal audit include ensuring objectives, planning, data confidentiality, document collection and analysis, report preparation, result exposition, and result delivery to the applicants. These stages also involve auditing findings analysis, compliance evaluations, decision feasibility assessments, and considerations for further legal actions, all aimed at maintaining integrity and accountability in governance. The State Prosecutor uses legal audits to ensure legal compliance and identify errors that could harm state finances. They determine indications of criminal acts or legal violations and assess sufficient evidence to support allegations of violations. During the audit process, the State Prosecutor looks for irregularities or legal non-compliance related to public fund management, financial misconduct, and other administrative violations involving state finances.

Abstract

This This paper analyzes the legal provisions relating to land acquisition for the public interest by using the perspective of the concept of justice according to Thomas Aquinas. This normative juridical method study illustrates that the nomenclature of land acquisition for the public interest contained in Law Number 2 of 2012 concerning Land Acquisition for Development in the Public Interest and has been revised in part in Law Number 6 of 2023 concerning Job Creation has not embodied the concept of justice echoed by Thomas Aquinas in the fulfillment of one's rights. This study concludes that the nomenclature of land acquisition for the public interest has a critical note regarding commutative justice (Justitia commutative), namely the legal provisions regarding the assumption that the community agrees to the use of their land contained in the nomenclature of land acquisition for the public interest, even though the person concerned was not present in the public consultation session. This is not in accordance with Thomas Aquinas' concept of justice, which emphasizes the equality of a person as a holder of land rights that must be fulfilled.

Abstract

This paper aims to analyze how the harmonization of land bank law and land law provisions in agrarian reform. This study is a normative legal research that examines the harmonization of land bank law and land law provisions in Indonesia. This research uses a statute approach to find the harmonization of land bank legal rules through Law Number 13 of 2022 concerning the Formation of Legislation. This research uses data from Law No. 63 of 2023 on Job Creation, Government Regulation No. 64 of 2021 on the Land Bank Agency, Law No. 5 of 1960 on Basic Agrarian Principles, and MPR Decree No. IX of 2001 on Agrarian Reform. The data is processed by analyzing the harmonization of the legal rules of the land bank and the provisions of land law in agrarian reform through Law Number 13 of 2022 concerning the Formation of Legislation. The results of this study show that the land bank regulated in the provisions of Law No. 63 of 2023 on Job Creation and Government Regulation No. 64 of 2021 on the Land Bank Agency is disharmonious with the 1945 Constitution, Law No. 5 of 1960 on Basic Agrarian Principles, and MPR Decree No. IX of 2001 on Agrarian Reform.

Abstract

Terbitnya Inpres No. 1 Tahun 2022 tentang Optimalisasi Pelaksanaan Program Jaminan Kesehatan menginstruksikan kepada seluruh Kementerian untuk melakukan optimalisasi program Jaminan Kesehatan Nasional, hal ini juga menginstruksikan kepada seluruh Kementerian/Lembaga untuk mengambil langkah-langkah sesuai tugas, fungsi dan kewenangan masing-masing, termasuk juga pada Kementerian Agraria dan tata ruang/ Badan Pertanahan Nasional sebagai bentuk penindak lanjutan atas Inpres No. 1 tahun 2022, setiap permohonan pelayanan pendaftaran peralihan hak atas tanah atau hak milik atas satuan umah susun karena jual beli harus dilengkapi dengan fotokopi kartu peserta Badan Penyelenggara Jaminan Sosial (BPJS) Kesehatan serta menjadi peserta aktif dalam program Jaminan Kesehatan (JKN). Melalui kebijakan ini, diharapkan masyarakat melengkapi terlebih dahulu registrasi BPJS nya sebelum melakukan pengurusan hak-hak atas tanah. Adanya inpres ini membuktikan bahwa pemerintah secara tidak langsung memaksakan BPJS kesehatan kepada masyarakat. Tujuan penelitian ini adalah untuk mengetahui bagaimana kepastian hukum keabsahan kartu Kartu BPJS Kesehatan tersebut serta akibat hukum yang ditimbulkan terhadap kebijakan pemerintah atas pendaftaran peralihan hak atas tanah karena jual beli dengan syarat sebagai peserta aktif Badan Penyelenggara Jaminan Sosial Kesehatan. Metode penelitian yang digunakan yakni normatif. Pendekatan masalah yang digunakan dalam penelitian ini ialah pendekatan perundangan-undangan (statute approach), pendekatan konseptual (conceptual approach), serta pendekatan sejarah hukum (historical approach). Hasil penelitian menyimpulkanrsyaratan BPJS Kesehatan dalam peralihan hak atas tanah karena jual beli tidak sesuai dengan asas atau norma hukum pada umumnya yaitu asas kepastian hukum. Tidak adanya kepastian hukum yang berkenaan dengan produk hukum dari Peralihan Hak Atas Tanah Jual Beli karena tidak dapat didaftarkan di Kantor Pertanahan seta menimbukan akibat hukum tundanya proses Peralihan Hak Atas Tanah karena jual beli yang turut berimplikasi pada tertundanya kepemilikan Sertifikat sebagai alat bukti Peralihan Hak Atas Tanah.
