Abstract

Perkembangan fintech lending syariah terus menggeliat yang menyasar masyarakat Muslim. Akan tetapi, penyelenggaraan fintech lending syariah di Indonesia masih berkiblat kepada peraturan fintech konvensional sehingga berpotensi terjadi penyimpangan dalam hal kepatuhan syariah (sharia compliance) dan dapat memberikan celah bagi penyelenggara untuk melakukan berbagai penyimpangan yang merugikan pengguna layanan. Penelitian ini bertujuan untuk menganalisis kedudukan fintech lending syariah dan urgensi pembentukan peraturannya di Indonesia disamping juga hendak memotret upaya perlindungan hukum bagi pengguna layanan. Penelitian ini merupakan penelitian yuridis normatif yang menginstrumentasikan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Data yang digunakan dalam penelitian ini adalah data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier yang diperoleh melalui studi kepustakaan (library research) atau studi dokumen. Hasil penelitian ditemukan bahwa operasionalisasi bisnis fintech syariah memiliki payung hukum yang cukup untuk dijadikan dasar pijakan dalam penyelenggaraan fintech syariah mengacu kepada beberapa peraturan terkait baik berupa Undang-Undang ataupun Peraturan Pemerintah dan/atau Lembaga seperti POJK No. 77 Tahun 2016 dan Fatwa DSN-MUI No. 117 Tahun 2018. Namun demikian, POJK tersebut lebih berkonotasi ke arah fintech konvensional sehingga berpotensi menimbulkan penyimpangan terhadap kepatuhan syariah (shariah compliance). Oleh karenanya, pembentukan peraturan fintech syariah menjadi sangat penting sebagai wujud perlindungan bagi pengguna layanan.

Abstract

This research elaborates on the power politics prevailing in Indonesia regarding women's leadership in the public sphere in Indonesia. Without realizing it, the patriarchal culture that lives in society makes women marginalized so that women are often neglected, including their rights in public leadership. This research utilizes a phenomenological approach to give meaning to the phenomenon of women's leadership in the public sphere. In addition, the legislative approach is also presented to capture and analyze regulations that open and close access for women in the public sphere. This article concludes that a woman is someone who has the right to organize and influence or organize society to achieve the goals of a country. The existence of several regulations in Indonesia that open space for women to take part in public leadership makes Indonesia an egalitarian country that provides equal and balanced rights for men and women to occupy strategic positions in the public sphere. This research found that women have the right to leadership in the public sphere just like men. Likewise, in the discourse of Islamic law, leadership is not monopolized by men but women can fill it as well as men. Penelitian ini mengelaborasi politik kekuasaan yang berlaku di Indonesia terkait kepemimpinan perempuan di ranah publik di Indonesia. Tanpa disadari, budaya patriarki yang hidup di masyarakat menjadikan perempuan termarginalkan sehingga perempuan seringkali terabaikan hak-haknya termasuk hak dalam kepemimpinan publik. Penelitian ini menginstrumentasikan pendekatan fenomenologi yang hendak memberikan makna terhadap fenomena kepemimpinan perempuan di ranah publik. Disamping itu, pendekatan perundang-undangan juga dihadirkan guna memotret dan menganalisis peraturan-peraturan yang membuka dan menutup akses bagi perempuan di ranah publik. Artikel ini menyimpulkan bahwa perempuan adalah seseorang yang berhak untuk mengatur dan mempengaruhi atau mengatur masyarakat untuk mencapai tujuan suatu negara. Adanya beberapa peraturan di Indonesia yang membuka ruang bagi perempuan untuk andil dalam kepemimpinan publik menjadikan Indonesia sebagai negara egaliter yang memberikan hak yang sama dan seimbang bagi laki-laki dan perempuan untuk menduduki posisi strategis di ranah publik. Penelitian ini menemukan bahwa perempuan memiliki hak kepemimpinan di ruang publik seperti halnya laki-laki. Begitupun dalam diskursus hukum Islam, kepemimpinan tidak dimonopoli kaum laki-laki namun perempuan bisa mengisinya juga sebaimana laki-laki.

Abstract

This article aims to elaborate on the regulation and model of Islamic microfinance in Indonesia. A clear understanding of the types of microfinance and the business model run by Islamic microfinance is needed to answer the problems faced by this institution. Solid and stable Islamic microfinance institutions serve a critical role in increasing access to loans and business capital for the poor and micro-enterprises. So far, the poor have not been reached by formal financial institution programs. This study employs a normative juridical approach using primary and secondary legal documents. The study results show that the role of the sharia supervisory board and the Cooperatives and SMEs Office has not played an optimal role in ensuring the compliance of microfinance managers with sharia principles and values and prudent microfinance management. The presence of regulations and institutions that guarantee sharia microfinance deposits is needed to protect managed funds and increase public trust.

Abstract

The advancement of blockchain technology has created challenges for traditional regulatory frameworks, regarding consumer protection in crypto asset ecosystems. This paper examines dichotomy between on-chain governance mechanisms embedded within blockchain protocols and off-chain regulatory approaches imposed by state authorities. Through normative legal research and comparative analysis of international regulatory practices, this study identifies critical gaps in Indonesia's current crypto asset regulatory framework. The research reveals that existing regulations, through government’s commodity-based approach, inadequately address the technological governance inherent in blockchain systems like smart contracts, decentralized protocols, and automated consensus mechanisms. The study proposes a hybrid regulatory construction that synchronizes technological governance with traditional state regulation to create comprehensive consumer protection. The findings demonstrate that integrating on-chain compliance mechanisms with off-chain oversight can enhance consumer safety while maintaining innovation momentum. This research contributes to digital law study by providing regulatory models suitable for Indonesia's legal system and broader emerging market contexts.

Abstract

Recreational vessels represent an evolution of maritime tourism and shipping activities that are rapidly developing in Indonesia. However, from a legal standpoint, their status and regulation remain unclear. There is an overlap of authority between the Ministry of Tourism and the Ministry of Transportation, as well as disharmony between business classifications in the KBLI (Indonesian Standard Industrial Classification) and the national shipping licensing system. This article aims to analyze the legal status of recreational vessels within the maritime legislation system and its implications for legal certainty and implementation in practice. The method used is normative juridical, employing a statutory and document analysis approach. The findings indicate that recreational vessels still lack an explicit definition in Indonesia’s positive law, and their regulation is not yet harmonized between the maritime and tourism systems. Strengthened regulation and cross-sector harmonization are necessary to ensure legal certainty and support the growth of the marine tourism sector

Abstract

Hukum acara formil yang berlaku di Pengadilan Agama dalam menyelesaikan sengketa waris relatif memakan waktu yang cukup lama. Hal ini mengakibatkan waktu serta biaya yang dikeluarkan menjadi lebih besar. Mekanisme small claim court yang diatur oleh Mahkamah Agung melalui PERMA No. 2 tahun 2015 tentang tata cara penyelesaian sengketa sederhana dalam sistem peradilan umum menjadi titik terang. Konsep small claim court tersebut diharapkan dapat diaplikasikan dalam sistem peradilan agama sehingga mampu memangkas waktu yang lama dalam penyelesaian sengketa waris di Pengadilan Agama. Penelitian ini bertujuan untuk menawarkan terobosan baru dalam sistem peradilan agama di Indonesia khususnya terkait penyelesaian sengketa waris. Penelitian ini merupakan penelitian yuridis normatif dengan pendekatan perundang-undangan dan konseptual dengan menggunakan studi kepustakaan sebagai alat analisis bahan hukum. Hasil penelitian menunjukkan bahwa penyelesaian sengketa waris di Pengadilan Agama dengan konsep small claim court dipandang mungkin untuk diimplementasikan sebagai bagian dari pembaharuan hukum acara peradilan agama. Namun demikian, hal itu perlu diiringi dengan pengklasifikasian perkara waris ke dalam perkara besar dan kecil dilihat dari nilai harta warisan yang disengketakan. Oleh karenanya, perluasan pengaturan mekanisme small claim court ke dalam sistem peradilan agama menjadi penting guna memangkas mekanisme penyelesaian perkara yang terlalu lama.The formal procedural law that applies in the Religious Courts in resolving inheritance disputes takes a relatively long time. This results in greater time and costs. The small claim court mechanism regulated by the Supreme Court through Supreme Court Regulation No. 2 of 2015 concerning the procedure for resolving simple disputes in the general justice system to become a bright spot. The concept of small claim court is expected to be applied in the religious justice system so that it can cut down the long time in resolving inheritance disputes in the Religious Courts. This study aims to offer a new breakthrough in the system of religious justice in Indonesia, especially in relation to the resolving of inheritance disputes. This research is a normative juridical research with a law and conceptual approach by using literature study as a legal material analysis tool. The results showed that the resolving of dispute of inheritance in the Religious Court with the small claim court concept was considered possible to be implemented as part of the renewal of the religious court procedural law. However, this needs to be accompanied by the classification of inheritance cases into large and small cases seen from the value of the disputed inheritance. Therefore, the expansion of the small claim court mechanism into the religious justice system is deemed necessary in order to reduce the mechanism for resolving cases that are too long.

Abstract

Disputes over child custody often occur after a divorce. Although the regulation on child custody has been regulated in the Marriage Law and Compilation of Islamic Law (KHI), it is allegedly not responsive enough to gender justice that gives child custody to one party based on the particular type genitals. So this triggers gender inequality and injustice. This article analyses the problem of establishing child custody descriptively analytically with a gender approach as a tool of analysis. This article concludes that the laws and regulations in Indonesia regarding the determination of child custody are still classified as gender-biased and have not been responsive enough to the issue of gender justice. Reciprocal interpretation model (qira'ah mubadalah), as a new approach in understanding the text, if applied in following the rules can be interpreted with the perspective of distinction between men and women who place women and men as human subjects that are whole and equal. Thus, both mothers and fathers alike have the same opportunities in child custody as long as they have qualified abilities in terms of childcare.

Abstract

An Islamic state is a state that bases its constitution on the teachings of the Qur'an, where the state aims to achieve the people's welfare. In order to achieve this goal, Islam recognizes political thought as a means to realize this goal. One form of political thought is exemplified by the change of head of state in Medina after the death of the Prophet Muhammad, SAW. Islamic politics not only focuses on the change of head of state but also upholds the application of the values ​​of the Qur'an as the foundation for the formation of the state structure and the basis for managing the state. Although similar, the view of Islamic ideology as the basis for the state still causes debate to this day because there are Islamic views that are not in line with the foundation of the modern state. This conceptual paper discusses two main topics: the first concept of the state in the Qur'an and the second relationship between Islam and the state. The results of the author's study show that, first, the Qur'an does not explicitly regulate the form of the state but explains the principles and procedures for the state, such as governance, equality and protection of rights, politics, economics, and trade. Second, there is a correlation between religious ideology and the context of the state where religion is used as the basis for instilling values ​​in the state. However, this idea has been debated and developed depending on the paradigm used. There are at least three schools of theory in the relationship between Islam and the state, including conservative, modernist, and secular.

Abstract

This article analyzes the effectiveness of Human Rights (HAM) Courts in Indonesia within the framework of national and international law. Based on Law No. 26 of 2000 on Human Rights Courts, this special court was established to enforce accountability and justice for victims of gross human rights violations and to uphold the principle of non-impunity. However, more than two decades after its establishment, the court’s effectiveness remains questionable, as only a few cases have been prosecuted and most defendants were eventually acquitted. By examining cases such as East Timor (1999), Tanjung Priok (1984), and the Trisakti and Semanggi Tragedies (1998–1999), this study identifies key obstacles stemming from legal, political, and institutional factors. Legally, weaknesses in Law No. 26 of 2000—particularly its limited temporal jurisdiction and the ineffective application of command responsibility—restrict the scope of enforcement. Politically, weak government commitment and interference from power structures undermine judicial independence. Institutionally, poor coordination between the National Commission on Human Rights (Komnas HAM) and the Attorney General’s Office, limited human resources, and inadequate protection for witnesses and victims further reduce the court’s capacity to function effectively. The findings indicate that Indonesia’s Human Rights Courts remain symbolic rather than substantive, failing to deliver justice, truth, and redress for victims. The article argues that reform of the human rights judicial system must involve legal amendments, stronger political will, institutional capacity-building, and the integration of transitional justice principles—namely truth, justice, reparation, and non-recurrence. Through such measures, Human Rights Courts could serve as genuine instruments for upholding the rule of law and human dignity in Indonesia

Abstract

Dikotomi pertanggungjawaban pidana terhadap anggota Kepolisian Negara Republik Indonesia (Polri) yang terlibat dalam tindak pidana perjudian online menimbulkan persoalan normatif yang kompleks. Sebagai subjek hukum ganda, anggota Polri tidak hanya tunduk pada ketentuan pidana umum sebagaimana diatur dalam Pasal 303 KUHP dan Pasal 27 ayat (2) jo. Pasal 45 ayat (2) Undang-Undang Nomor 11 Tahun 2008 jo Undang-Undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik (ITE), tetapi juga pada kewajiban etik dan disipliner berdasarkan Undang-Undang Nomor 2 Tahun 2002, Peraturan Pemerintah Nomor 2 Tahun 2003, serta Perkap Nomor 14 Tahun 2011. Keterlibatan aparat penegak hukum dalam tindak pidana seperti perjudian online tidak hanya melanggar hukum positif, tetapi juga menciptakan krisis legitimasi terhadap institusi kepolisian itu sendiri. Ketidakefektifan mekanisme pengawasan internal, lemahnya penindakan atas pelanggaran etik, serta potensi impunitas akibat solidaritas korps memperlihatkan adanya kegagalan struktural dalam menegakkan prinsip equality before the law. Kritik terhadap pendekatan hukum yang masih bersifat simbolik dan prosedural memperkuat urgensi reformasi sistemik dalam penegakan hukum terhadap aparat negara. Penataan ulang kerangka pertanggungjawaban pidana dan etik secara simultan, transparan, dan berkeadilan substantif menjadi prasyarat dalam membangun institusi Polri yang profesional, akuntabel, serta berorientasi pada supremasi hukum dan perlindungan hak asasi manusia.
