Abstract

Dalam terselenggaranya pemilu, calon dari presiden dan wakil presiden beserta DPR dan DPD melakukan kampanye untuk mendapatkan dukungan dari masyarakat. Kegiatan kampanye tidak hanya dilakukan secara langsung dihadapan masyarakat tetapi bisa dilakukan dengan media elektronik salah satunya ialah media sosial. Kehadiran internet tentu membawa dampak positif dan negatif bagi dunia. Adanya internet menghadirkan berita politik secara langsung untuk ditujukan kepada masyarakat, seperti informasi mengenai black campaign atau kampanye hitam yang dilakukan tidak hanya oleh masyarakat umum tetapi juga dilakukan oleh elit politik. Pengertian kampanye pemilu menurut Pasal 1 angka 35 Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum disebutkan bahwa “kampanye Pemilu adalah kegiatan perserta pemilu atau pihak lain yang ditunjuk oleh peserta Pemilu untuk meyakinkan pemilih dengan menawarkan visi, misi, program, dan/atau citra diri peserta Pemilu”. Kampanye hitam (black campaign) dapat membahayakan bagi keutuhan bangsa dan negara. Penggunaan internet khususnya media sosial memang memberikan dampak positif kepada masyarakat, tetapi akan menimbulkan ancaman bagi ideologi bangsa apabila dipergunakan untuk sesuatu yang salah seperti kampanye hitam. Kampanye hitam yang dilakukan dalam media sosial meliputi perbuatan seperti penghinaan, fitnah, bullying sampai menyebarkan berita bohong atau biasa dikenal hoax di berbagai media sosial. Terdapat kampanye negatif dibolehkan karena info yang dikatakan berupa fakta yang telah diverifikasi meskipun bentuknya menyerang pihak lawan. Sebagai masyarakat haruslah paham mengenai kampanye yang baik dan buruk, meskipun dalam penerapannya sebagian masyarakat akan melakukan kampanye hitam sebagai bentuk dukungan kepada salah satu calon yang dipilih agar lawan kalah dalam pemilihan umum.

Abstract

The purpose of this research is to describe the authority of district/city governments in managing government affairs in the education sector. As a consequence of the implementation of regional autonomy using the concurrent principle, there is a division of governmental affairs both at the central government and regional governments. This study focuses on the distribution of government affairs in the education sector. Because the study of government affairs in the education sector is small, the authors examine this matter. The research method is normative juridical research using statutory and conceptual approaches. The results of this study are because education is part of human rights, and the government is responsible for protecting, guaranteeing, and fulfilling the right to education for citizens. Then because of the consequences of implementing autonomy, then in terms of administering government affairs in the education sector, there is a division of functions. District/City Governments are tasked with overseeing the running of the education system in which local governments manage Early Childhood Education, Elementary Schools, and non-formal education as stipulated in laws and regulations.

Abstract

The objective of this research is to examine legal regulations concerning the misuse of personal data for political purposes. Legal protection against the unauthorized use of personal data by Political Parties (Parpol) is a crucial issue in today’s digital era. With advancements in information technology, individuals' personal data have become increasingly vulnerable to misuse and privacy violations. The protection of personal data as a Human Right (HAM) must be guaranteed by all parties, including the government and the private sector. The current situation reveals weak regulations governing the collection, storage, and use of personal data, which may lead to violations of individuals’ privacy rights. This study employs a normative juridical method with a literature review approach. The findings indicate the necessity of clear and strict legislation to protect personal data from misuse, as well as the importance of public awareness regarding their privacy rights. Through collaboration between the government, the business sector, and civil society, a secure and sustainable digital ecosystem can be fostered. Concrete steps to enhance personal data protection in Indonesia include the enactment of Law Number 27 of 2022 on Personal Data Protection (UU PDP), which is expected to provide a strong legal framework for safeguarding individual privacy in the ever-evolving digital era.
