Abstract

Introduction: Maluku Province, as an archipelagic region, is highly vulnerable to narcotics trafficking and abuse. Its strategic yet remote location makes it a potential route for illicit drug distribution. The growing spread of narcotics poses a serious threat to youth and legal order, requiring comprehensive and contextual criminal policy responses.Purposes of the Research: This study aims to analyze the criminal policy in addressing narcotics crimes in Maluku Province and to identify the influencing factors.Methods of the Research: The research applies both normative and empirical juridical methods. Data were collected through document analysis of laws and legal literature, as well as interviews with law enforcement authorities and related agencies in the region.Results Main Findings of the Research: The findings reveal that current criminal policies in Maluku face substantial challenges, including limited infrastructure, lack of qualified personnel, and weak inter-agency coordination. The archipelagic geography itself emerges as a significant barrier to effective law enforcement. This study offers a novel contribution by mapping these island-based structural constraints and proposing an integrated criminal policy model that combines penal and non-penal approaches—such as legal education, community empowerment, and rehabilitation. This framework holds potential for broader application in other archipelagic or remote regions of Indonesia.

Abstract

Latar belakang:  Ketidakseragaman dalam pemidanaan perkara narkotika menimbulkan ketidakpastian hukum serta persepsi ketidakadilan di masyarakat, di mana pelaku dengan karakteristik perkara yang serupa menerima hukuman yang berbeda secara signifikan. Fenomena ini terjadi meskipun asas individualisasi pidana memberikan kewenangan kepada hakim untuk mempertimbangkan kondisi individual terdakwa. Tujuan: Penelitian ini bertujuan untuk mengkaji faktor-faktor dalam ratio decidendi (pertimbangan hukum hakim) yang menyebabkan disparitas pemidanaan, serta menganalisis penerapan asas individualisasi pidana dalam putusan perkara narkotika di Indonesia. Metode: Penelitian normatif yuridis ini menggunakan analisis terhadap dua putusan Pengadilan Negeri Rantauprapat, yakni Putusan No. 626/Pid.Sus/2020/PN.Rap dan Putusan No. 159/Pid.Sus/2019/PN.Rap, keduanya berdasarkan Pasal 112 ayat (1) UU No. 35 Tahun 2009. Pendekatan yang digunakan meliputi pendekatan perundang-undangan dan konseptual. Hasil: Hasil penelitian mengungkapkan bahwa disparitas pemidanaan terjadi akibat kebebasan hakim dalam menjatuhkan pidana, perbedaan penafsiran terhadap fakta persidangan, serta pertimbangan faktor yang meringankan dan memberatkan terdakwa. Terdakwa dengan barang bukti lebih sedikit sebesar 0,64 gram dan tanpa alat pendukung justru menerima hukuman lebih berat dibanding terdakwa dengan barang bukti lebih banyak sebesar 1,30 gram yang disertai dengan bong, timbangan, dan ponsel, yang hanya divonis 3 tahun. Meskipun demikian, tanpa pedoman pemidanaan yang jelas, penerapan asas individualisasi pidana berpotensi menimbulkan ketidakpastian hukum dan rasa ketidakadilan di masyarakat. Kesimpulan: Pelaksanaan asas individualisasi pidana yang efektif memerlukan penguatan pedoman pemidanaan, peningkatan kualitas ratio decidendi, serta pelatihan hakim guna memastikan bahwa disparitas pemidanaan mencerminkan perbedaan kasus yang nyata, bukan variasi yudisial yang bersifat arbitrer.

Abstract

Introduction: The fulfillment of the rights of child pornography victims is contained in the Child Criminal Justice System Act and Based on the context of Law No. 35 of 2014 on Amendments to Law No. 23 of 2002 on Child Protection and Government Regulation (PP) Number. 40 Year 2011 On The Development, Mentoring and Recovery of Children Victims and Perpetrators Ponography. Legal protection of children and their rights as victims and perpetrators of pornography do not seem to have received serious attention even though it actually depends on how a country finds a leader who cares about children.Purposes of the Research: This paper aims to analyze and discuss the fulfillment of the rights of child pornography victims in the Child Criminal Justice System.Methods of the Research: Research methods are used with normative juridical research types. The problem approach used is the legal approach, concept analysis approach, case approach, Source of legal materials used primary legal materials and secondary legal materials. Collection techniques through literature studies and then analyzed through the way of description using qualitative methods.Results of the Research: The results showed that the fulfillment of the rights of child pornography victims has not been fulfilled properly in accordance with Law No. 11 of 2012 on the Criminal Justice System of Children. This means that the Child Protection Act has not been balanced with the implementation of child protection. This is because there are still obstacles faced in the fulfillment of the rights of children victims porngrafi. The fulfillment of the rights of children victims of pornography in the legislation include: the right of mentoring, the right of health services, the right of guidance, the right of protection and in Government Regulation No. 40 of 2011 on the guidance, mentoring, and recovery of children who are victims and perpetrators of pornography according to Article 20 is done by means of mentoring: counseling, psychological therapy, social advocacy, improving ability and willingness, providing access to health services and / or legal assistance.
