Abstract

This community empowerment and development program aims to increase public awareness, especially marriage couples in Batangkuis District in legalizing their marriages. Basically, the couples have known the necessity of registering marriages, but do not register for various reasons. They do not have a marriage book even though they have been married for a long time.To achieve this goal, two (2) phases of activities were carried out, (1) Legal counseling carried out for two days in two partner villages with the theme of the introduction, usefulness and benefits of marriage registration and legal consequences arising from not registering marriages and to (2) assistance activities in making marriage books. The targets are couples in the two partner villages who have long been married religiously but have not registered marriage. After legal counseling about the benefits and importance of marriage registration, there was an enthusiasm to ask for assistance in recording their marriages because most of the couples had been married for a long time and had many children but had no evidence of legality of their marriage. The enthusiasm of the husband and wife shows the approach through legal counseling is effective to move their legal awareness to register their marriages.

Abstract

Social media is a gathering place for people using internet networks, not infrequently even on social media people who have the same mutual interests and form a community. The presence of these community groups can certainly be a target for business people to promote their products, including products from MSMEs. Promotion through the community on social media can be done through soft selling. Effective and efficient use of social media by business actors as a means of trade promotion requires guidance and direction through training. Therefore, in this community service activity, training was carried out on improving and developing business opportunities for Micro, Small and Medium Enterprises (MSMEs) through online promotions on social media to MSMEs located in Kelurahan Gedung Johor. The method of implementing activities is carried out in the form of counseling and interactive dialogue with participants. The use of social media is carried out effectively by providing the best service to consumers by conveying honestly and in good faith, about the merchandise being promoted, there are no things to hide, this is useful for building the seller's reputation and maintaining the trust given by consumers so that consumers remain loyal to the merchandise products of these MSME entrepreneurs.

Abstract

Community service with the issue of early marriage is very important in order to encourage and empower the community, especially youth and village officials to be aware, know, have the capacity and participate in preventing and rejecting early marriage. Through this program socialization/campaign through KIE will be carried out in the Village of Pool, Percut Sei Tuan District, Deli Serdang Regency and training of peer educators and paralegals from the community in an effort to prevent early marriage. Through this program it is also hoped that there will be youth participation in the formation of a youth community and village apparatus formed through a Village Decree on Rejecting Early Marriage in the Village of Pond, Percut Sei Tuan District.

Abstract

Penelitian ini mengkaji keabsahan hukum dan aspek keadilan dari perjanjian kerja sama bagi hasil Kapal Motor Penangkap Ikan Ata Droe yang disepakati secara lisan pada tahun 2016 antara Yusri Usman bin Usman (pihak pertama) dan Mahdi Bin H. Syukri (pihak kedua) di Idi, Aceh. Sengketa muncul akibat pihak kedua tidak membagikan hasil keuntungan sebagaimana telah disepakati. Penelitian ini bertujuan untuk menganalisis keabsahan perjanjian menurut Pasal 1320 KUHPerdata, menilai keadilan hukum bagi pemilik kapal, serta menelaah pertimbangan hukum majelis hakim dalam perkara wanprestasi tersebut. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Data diperoleh melalui studi pustaka dan wawancara dengan hakim dan praktisi hukum. Hasil penelitian menunjukkan bahwa perjanjian tersebut sah menurut hukum, namun pihak pertama tidak memperoleh keadilan karena tidak menerima keuntungan yang menjadi haknya. Seharusnya majelis hakim mengabulkan sebagian gugatan ganti rugi berdasarkan Pasal 1239 KUHPerdata

Abstract

Song commercialization on YouTube often violates copyright as unauthorized reproduction disregards creators' moral and economic rights. This normative descriptive research examines legal protection, perpetrator liability, and legal considerations in Decision 913K/Pdt.Sus-HKI/2022. Legal protection is implemented preventively through copyright registration and repressively through compensation claims and criminal charges. Unauthorized reproduction perpetrators face criminal sanctions up to 10 years imprisonment or Rp4 billion fine. The court's decision is deemed disproportionate in depicting creators' losses and inadequately reflects principles of justice and legal certainty.

Abstract

Sertifikat Hak Milik merupakan salah satu bentuk alat bukti yang memiliki kedudukan penting dalam sistem hukum pertanahan di Indonesia. Keberadaan sertifikat tidak hanya berfungsi sebagai tanda bukti kepemilikan atas tanah, tetapi juga memberikan jaminan kepastian hukum bagi pemegang hak. Namun dalam praktiknya, sengketa kepemilikan tanah masih sering terjadi meskipun telah diterbitkan sertifikat hak milik oleh instansi yang berwenang. Hal tersebut menimbulkan pertanyaan mengenai sejauh mana kekuatan pembuktian sertifikat hak milik dalam menyelesaikan sengketa kepemilikan tanah di pengadilan. Penelitian ini bertujuan untuk menganalisis ketentuan hukum yang mengatur jual beli tanah menurut peraturan perundang-undangan yang berlaku di Indonesia, mengkaji kekuatan sertifikat hak milik sebagai alat bukti dalam sengketa kepemilikan tanah, serta menganalisis pertimbangan hakim dalam Putusan Mahkamah Agung Nomor 4690 K/Pdt/2024 terkait kekuatan pembuktian sertifikat hak milik dalam sengketa kepemilikan tanah. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Data yang digunakan merupakan data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa pengaturan jual beli tanah di Indonesia diatur dalam berbagai peraturan perundang-undangan, terutama Undang-Undang Pokok Agraria, Peraturan Pemerintah tentang Pendaftaran Tanah, serta ketentuan hukum perdata mengenai pembuktian. Sertifikat hak milik pada dasarnya memiliki kekuatan pembuktian yang kuat sebagai alat bukti kepemilikan tanah karena diterbitkan oleh pejabat yang berwenang melalui proses pendaftaran tanah. Namun demikian, sertifikat tersebut tidak bersifat mutlak dan masih dapat digugat apabila dapat dibuktikan adanya cacat hukum dalam proses penerbitannya. Dalam Putusan Mahkamah Agung Nomor 4690 K/Pdt/2024, hakim mempertimbangkan berbagai alat bukti serta fakta hukum yang terungkap di persidangan untuk menilai kekuatan pembuktian sertifikat hak milik dalam menentukan pihak yang sah sebagai pemilik tanah. Dengan demikian, sertifikat hak milik memiliki kekuatan pembuktian yang kuat namun tetap bersifat tidak absolut karena masih dapat diuji kebenarannya melalui proses peradilan.
