Abstract

This study explores the integration of Islamic legal principles into contemporary notarial practices in Indonesia, using a normative legal approach and qualitative methodology. It examines historical contributions, particularly from scholars such as Hilal ibn Yahya al-Bashri and Hajji Khalifah, who emphasized integrity, legal certainty, and ethical values in notarial law. The research investigates how these principles influence modern notarial roles under Law No. 2 of 2014. Findings highlight the importance of sharia compliance, ethics, and transparency in notarial duties, stressing that historical values remain essential for adapting to modern legal challenges.

Abstract

The recognition of indigenous community rights, particularly ulayat rights, within Indonesia’s national agrarian legal system faces significant regulatory and practical challenges. Although Article 18B(2) of the 1945 Constitution and the Basic Agrarian Law (UUPA) acknowledge ulayat rights, the lack of clear technical regulations creates legal uncertainty and frequently sparks agrarian conflicts between indigenous communities, the government, and private entities. This study aims to analyze the recognition of ulayat rights and the challenges of integrating customary law into the national agrarian legal framework. Utilizing a normative juridical method, this research examines relevant regulations and legal literature to identify regulatory gaps and propose ideal solutions for ulayat rights protection. The research results indicate that the absence of clear verification and registration mechanisms has hindered the protection of ulayat rights, caused legal uncertainty, and triggered agrarian conflicts, as seen in the case of Pulau Rempang. To deal with these problems, this research suggests creating a separate, open, and honest body to check ulayat rights along with a computerized system for registering these rights that takes into account local knowledge.   Pengakuan hak ulayat masyarakat adat dalam sistem hukum agraria nasional menghadapi tantangan signifikan, baik dari sisi regulasi maupun implementasi. Meskipun Pasal 18B ayat (2) UUD 1945 dan Undang-Undang Pokok Agraria (UUPA) mengakui hak ulayat, ketiadaan peraturan teknis yang jelas menyebabkan ketidakpastian hukum dan sering memicu konflik agraria antara masyarakat adat, pemerintah, dan pihak swasta. Penelitian ini bertujuan untuk menganalisis bentuk pengakuan hak ulayat dan tantangan integrasi hukum adat dalam hukum agraria nasional. Menggunakan metode yuridis normatif, penelitian ini mengkaji peraturan yang berlaku dan literatur hukum untuk mengidentifikasi kesenjangan regulasi serta solusi ideal untuk perlindungan hak ulayat. Hasil penelitian menunjukkan bahwa ketiadaan mekanisme verifikasi dan registrasi yang jelas telah menghambat perlindungan hak ulayat, menyebabkan ketidakpastian hukum, dan memicu konflik agraria, seperti yang terlihat dalam kasus Pulau Rempang. Untuk mengatasi tantangan ini, penelitian ini mengusulkan pembentukan badan independen untuk verifikasi hak ulayat yang bekerja secara transparan, serta sistem pendaftaran hak ulayat berbasis digital yang responsif terhadap kearifan lokal.

Abstract

This study aims to examine the supervision strategy carried out by the Business Competition Supervisory Commission (ICC) against anti-competition practices that can harm the market and consumers. ICC has a very important role in maintaining healthy business competition through supervision, law enforcement, and policy recommendations. This study uses a qualitative approach with in-depth interview methods and document analysis related to the implementation of the business competition law. The results of the study show that ICC carries out supervision through a preventive, detective, and law enforcement approach. Preventive supervision is carried out through education to business actors, while detective supervision utilizes technology such as big data to detect anti-competitive practices. Although the law enforcement carried out by ICC has succeeded in cracking down on many violations, it is constrained by a deterrent effect that is still low due to the amount of sanctions that are not proportional to the profits obtained from these illegal practices. In addition, ICC also functions as a policy advisor to encourage the creation of regulations that support fair business competition. This research suggests the need to increase the capacity of technology and human resources, as well as revisions to the amount of sanctions so that they can be more effective in tackling anti-competitive practices in Indonesia.

Abstract

The number of formal employment sectors available in Indonesia is very limited so the employment participation rate is not proportional to the available jobs. This causes the unemployment rate to increase, which has an impact on the increase in poverty rates. To encourage economic growth and reduce poverty levels, the government encourages people to work in the self-employed sector. The non-formal sector that is strongly encouraged by the current government is MSMEs. Based on data from the Ministry of Entrepreneurship and Cooperatives, in 2024 the number of micro business ownership and management will be dominated by women at 64%. This figure shows that women have a dual role in addition to being housewives, women also play a role as a booster of the ladder economy.  Therefore, this paper aims to increase women's income as entrepreneurs through several trainings, especially in the fish processing business. The sampling method of this study is a census, where all members of the group of 10 people receive training. This research was conducted for 5 months (July-November 2024). The training and assistance carried out includes 4 (four) types of activities with the following results: (1) MSME actors have been able to make profit and loss statements and cash flow statements, so that business actors can separate business capital and personal finance. (2) MSME actors can explore creative ideas in design so that the appearance of MSME product packaging becomes more attractive. (3) MSME actors already have social media to help market their products, in this case the social media is Instagram (4) The technology that seeks to help MSME actors extend the product expiration period is a retorch machine.

Abstract

This study aims to analyze the application of Law Number 23 of 2004 concerning the Elimination of Domestic Violence (PKDRT) by the Deli Serdang City Resort Police (Polresta) in handling cases of domestic violence (KDRT). The method used is an empirical juridical approach with data collection through interviews, documentation studies, and direct observation. The results of the study show that the Deli Serdang Police have implemented procedural steps such as receiving reports, visum et repertum, and investigations. However, the implementation of the law has not been fully effective because informal mediation practices are still found that have the potential to reduce the deterrent effect for perpetrators and weaken legal protection for victims. Case data over the past five years (2020–2024) shows that physical violence is the most dominant form of domestic violence, while psychological and sexual violence is still rarely reported, indicating underreporting. The main obstacles in law enforcement include fear and dependence on victims, lack of witnesses, and family intervention. Judging from Lawrence M. Friedman's law enforcement theory, the weak structure and culture of law are obstacles in the implementation of the substance of the law. Meanwhile, from the perspective of legal protection theory, the authorities have not fully provided security and justice guarantees for victims. This study recommends the need to strengthen the victim protection system and the consistency of law enforcement without compromise to ensure legal certainty and justice.

Abstract

This study addresses the main legal issue concerning the management of underground space in major cities in Indonesia amid rapid urbanization. The current regulations, such as the Basic Agrarian Law, do not provide clear provisions regarding the right to use underground space, leading to legal uncertainty and potential conflicts of interest. The position of this research is to analyze existing regulations through a normative juridical approach and propose legal solutions that are more adaptive to the needs of urban modernization. This paper examines the limitations of current regulations and suggests the need for more comprehensive, specific legislation governing underground space rights. The main findings of this study reveal the inadequacy of the existing legal framework in accommodating the management of underground space fairly and sustainably, and the urgency for regulatory reforms that are more responsive to Indonesia’s urbanization developments.
