Abstract

Prinsip Strict Liability Pelaku Usaha Dalam Rangka Mewujudkan Asas Keadilan Dan Kepastian Hukum Konsumen Berdasarkan Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen, untuk dapat dijadikan pedoman bagi Pelaku Usaha Jasa dan juga masyarakat selaku konsumen terkait dalam proses Pertanggungjawaban atas produk barang dan atau jasa yang dihasilkan jika berdampak kerugian kepada konsumen, sampai dengan hari ini belum dapat dilaksanakan dikarenakan adanya beberapa faktor. Penelitian ini bertujuan untuk mengetahui bagaimana bentuk penerapan prinsip strict liability pelaku usaha dalam rangka mewujudkan asas keadilan dan kepastian hukum konsumen, dan faktor apakah yang menjadi penghambat dalam penerapan prinsip strict liability pelaku usaha dalam rangka mewujudkan asas keadilan dan kepastian hukum konsumen. Hasil dan pembahasan dari penelitian bahwa walaupun Indonesia telah memiliki Norma dasar penegakan hukum perlindungan konsumen yang diatur dalam Undang-Undang Perlindungan Konsumen, namun seringkali perkara yang diajukan ke pengadilan umum/negeri masih mempergunakan ketentuan-ketentuan berdasarkan pasal-pasal yang terdapat dalam KUHPerdata. Hal ini mengindikasikan bahwa aparat penegak hukum belum memiliki pengetahuan yang memadai tentang dalil-dalil hukum yang terdapat dalam UUPK untuk dapat dipergunakan sebagai dasar gugatan dalam perkara-perkara sengketa konsumen. Hal tersebut diperparah dengan belum adanya persepsi yang sama diantara atau sesama aparat penegak hukum terhadap Undang-Undang Perlindungan Konsumen. Sulitnya menemukan perkara perselisihan product liability dan strict liability di pengadilan Indonesia karena para pihak yang bersengketa lazimnya menggunakan mekanisme sengketa perdata umum dan bukan melalui lembaga penyelesaian perselisihan sengketa konsumen.

Abstract

Abstract: This study aims to: (1) analyze the form of legal protection for clothing design rights holders under Law Number 31 of 2000 concerning Industrial Design; (2) identify obstacles in the legal protection process; and (3) formulate efforts to overcome these obstacles. This research employs a normative legal method, with secondary data sources consisting of literature related to intellectual property, industrial design, and statutory regulations. The results indicate that legal protection is provided through preventive measures-by registering industrial designs with novelty elements-and repressive measures-by enforcing laws against infringements, either through litigation or alternative dispute resolution. Major obstacles include low public awareness, limited government socialization efforts, complicated registration bureaucracy, and relatively high registration fees. Improvement efforts involve revising the law, utilizing information technology for online registration, enhancing law enforcement capacity, and strengthening the role of both government and society in protecting industrial design rights.Keywords: Legal Protection, Industrial Design, Exclusive Right.

Abstract

Electronic transactions are legal acts carried out using computers, computer networks, and/or electronic media. In electronic transactions, consumer losses can occur due to default or unlawful acts committed by business actors. Consumers also have the potential to be harmed if the products being traded are not registered with the government. The method used for research is called normative legal research. In order to resolve consumer disputes outside the courts, Law Number 8 of 1999 mandates the government to establish BPSK in districts/cities. BPSK decisions are final and binding. The execution of these decisions can be requested to the District Court. However, dispute resolution through BPSK does not eliminate criminal liability as regulated in Law Number 8 of 1999. BPSK decisions can be used as sufficient preliminary evidence for investigators to conduct investigations.

Abstract

Environmental degradation has emerged as one of the most pressing global challenges, demanding stronger legal frameworks to ensure accountability and sustainability. Within civil law systems, the expansion of liability principles plays a crucial role in addressing environmental harm by holding individuals, corporations, and even state actors responsible for ecological damages. This study examines the intersection between civil law and environmental protection, with a focus on how liability doctrines—such as strict liability, fault-based liability, and collective responsibility—are evolving to support sustainable justice. By employing a normative legal research method combined with comparative analysis, this research highlights the adaptation of civil liability in various jurisdictions to respond to environmental risks, including pollution, deforestation, and climate change. The findings suggest that while traditional civil law mechanisms provide a foundation for redress, innovative approaches such as environmental compensation funds, extended corporate liability, and integration of precautionary principles are necessary to strengthen legal remedies. Ultimately, this study argues that expanding civil liability not only enhances deterrence and accountability but also promotes equitable and sustainable solutions for environmental governance in the 21st century.

BasedonArticle 7 of Law Number 8 of 1999 concerning Consumer Protection, it is regulated that business actors are required to provide correct, clear, and honest information regarding goods and/or services. This study aims to explain the obligation to include product price information at the A&W Restaurant at Sultan Syarif Kasim II Airport, Pekanbaru City based on Law Number 8 of 1999 concerning Consumer Protection. The method used in this research is sociological law research. A&W Restaurant at Sultan Syarif Kasim II Airport Pekanbaru City carries out sales procedures in accordance with the A&W Restaurant franchise standard and is willing to compensate for all losses suffered by consumers if their employees are proven to have violated sales procedures. The obstacle in carrying out the obligation to include product price information at the A&W Restaurant at Sultan Syarif Kasim II Airport in Pekanbaru City is the ignorance of consumers. Consumers who feel aggrieved can sue A&W Restaurant at Sultan Syarif Kasim II Airport Pekanbaru City to the Pekanbaru City Consumer Dispute Resolution Agency (BPSK) or to the Pekanbaru District Court.Keywords: Consumer Protection, Business Actors, Obligations

Abstract

The problem of partners in this community service activity is the lack of knowledge of members of Confederation of Prosperous Trade Union of Indonesia of Riau Province on protection of contract labor rights based on Law Number 13 of 2003 about Employment. The solutions offered in the public service activities are the improvement of K-SBSI members' knowledge of Riau province on the protection of the rights of labor contracts based on Law Number 13 of 2003 about Employment. The method of implementation of community service activities is by using lecture, dialogue, and discussion methods in order to provide legal counseling to partners. Participation of partners in community service activities is to provide time, provide a place with other supporting facilities, and present the community as participants of legal counseling. Output targets of community service activities are the publication of scientific articles in legal journals. The conclusion is that the community service has been successfully implemented and the benefits can be felt directly by the participants, which is to increase the knowledge of K-SBSI members of Riau Province regarding the protection of contract labor rights based on Law Number 13 of 2003 about Employment. This can be seen from the answers of the participants in the questionnaire given after the implementation of the activity. Of the 16 participants, 87.5% said they understood it.

Abstract

Abstract: The consumer dispute resolution process based on the Consumer Protection Law can be achieved through litigation and non-litigation channels. Settlement through non-litigation channels is carried out by BPSK through Mediation, Conciliation, and Arbitration. BPSK cannot play an active role in resolving consumer disputes, this is because the substance of the regulations, procedures and mechanisms for dispute resolution contain many weaknesses. Consumer protection is essentially all efforts that guarantee the fulfillment of the rights and obligations of consumers and business actors as well as ensuring legal certainty, efforts to resolve consumer disputes through BPSK face problems including: too complex tasks because it functions as a consumer dispute resolution institution and includes guidance and supervision. The absence of clear regulations regarding budget allocation. Lack of human resources for BPSK members, and low legal awareness of consumers and business actors.Keywords: Consumer Protection, BPSK, Dispute Resolution

Abstract

This research departs from the unclear status of Intellectual Property Rights as part of joint property in Islamic Family Law. The immaterial nature of Intellectual Property Rights but its significant economic value poses its own challenges in the context of property division, especially after divorce or the death of one of the spouses. This research aims to understand and analyze in depth the position of joint property derived from Intellectual Property Rights in the perspective of Islamic Family Law, as well as investigate the status and dispute resolution of such property in legal practice in Indonesia. The main focus of the research includes three main problems: (1) What is the position of joint property rights related to Intellectual Property Rights from the perspective of Islamic Family Law? (2) What is the status of Intellectual Property Rights as joint property in marriage? and (3) How is the settlement of joint property disputes originating from Intellectual Property Rights according to Islamic Family Law in Indonesia. The methodology used is library research with a content analysis approach and a comparative method to the relevant legal system. Data sources consist of primary legal materials such as Law Number 1 of 1974 concerning Marriage, Law Number 28 of 2014 concerning Copyright, and regulations related to joint property; and secondary materials in the form of books, journals, and other legal documents. The data analysis technique uses a normative juridical approach. The results showed that although the principle of joint property in Islamic Family Law recognizes joint ownership of property obtained during marriage, there is no normative clarity regarding the position of Intellectual Property Rights as part of joint property. This creates ambiguity in dispute resolution, especially when Intellectual Property Rights become the main source of income or have high commercial value. This research emphasizes the need for the development of more specific regulations and progressive legal interpretations to ensure legal certainty, justice, and protection of the rights of spouses in the division of joint property involving Intellectual Property Rights. The research recommendations encourage the integration of contemporary fiqh approaches and Islamic family law reform in Indonesia in addressing modern economic developments involving intellectual property as an object of joint ownership.

Abstract

Pencipta atau pemegang hak cipta memiliki hak ekonomi untuk melakukan: Penerbitan ciptaan; Penggandaan ciptaan dalam segala bentuknya; Penerjemahan ciptaan; Pengadaptasian, pengaransemenan, atau pentransformasian ciptaan; Pendistribusian ciptaan atau salinannya; Pertunjukan ciptaan; Pengumuman ciptaan; Komunikasi ciptaan; serta Penyewaan ciptaan. Pada dasarnya, untuk melindungi hak cipta tentunya harus didaftarkan. Apabila seseorang ingin agar kekayaan intelektualnya terlindungi oleh hukum, maka harus bersedia mengikuti prosedur pendaftaran yang telah ditetapkan oleh negara. Tujuan dari penelitian ini adalah untuk mengkaji secara mendalam bagaimana bentuk perlindungan hak ekonomi atas hak cipta yang telah diatur dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Metode yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif, yaitu penelitian yang dilakukan dengan menelaah bahan pustaka atau data sekunder. Hasil Hak cipta adalah hak eksklusif pencipta yang timbul secara otomatis berdasarkan prinsip deklaratif setelah suatu ciptaan diwujudkan dalam bentuk nyata tanpa mengurangi pembatasan sesuai dengan ketentuan peraturan perundang-undangan. Hak cipta terdiri atas hak ekonomi dan hak moral. Hak ekonomi adalah hak untuk mendapatkan manfaat ekonomi atas ciptaan serta produk hak terkait.
