Abstract

Indonesia is one of the countries that has ratified the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), which serves as the main international instrument regulating trade in endangered animals and plants. As a consequence of this ratification, Indonesia is legally obligated to harmonize its domestic legal framework—currently embodied in Law Number 32 of 2024 concerning Amendments to Law Number 5 of 1990 on the Conservation of Biological Natural Resources and Their Ecosystems—with the principles of animal protection outlined under CITES. This article examines the implementation of CITES in Indonesia, particularly in the context of protected wildlife trafficking cases. It aims to identify the challenges faced in law enforcement and to propose policy recommendations that could strengthen national efforts in biodiversity protection. The research employs literature review, regulatory analysis, and case study methods to provide a comprehensive understanding of how CITES obligations are operationalized within Indonesia’s legal and institutional framework. Findings reveal that, despite the existence of an adequate legal foundation, operational barriers, weak inter-agency coordination, limited forensic capacity, and socio-economic pressures have undermined the overall effectiveness of CITES implementation. Therefore, this study recommends enhancing law enforcement capacity, regulatory harmonization, international collaboration, and public education campaigns to achieve more effective biodiversity conservation outcomes.

Abstract

This research aims to analyze bank lending policy strategies that support the sustainable energy sector in Indonesia, with a focus on improving the effectiveness of public welfare. The research identifies the urgency of sustainable energy as a response to global environmental challenges and the need for sustainable development. With reference to Law No. 23/1999 on Bank Indonesia and Bank Indonesia Regulation No. 14/22/PBI/2012, the normative juridical method was used to analyze the relevant legal and policy frameworks, as well as lending practices by banks in Indonesia. The results revealed a gap between existing policies and the implementation of lending practices, especially in relation to sustainable energy projects. The analysis highlights the need for capacity building of banks in managing sustainable energy project risks, development of innovative financing products, and cross-sector collaboration. The research shows that transparency and adequate reporting standards can increase trust and attract more investment into sustainable energy projects. The results confirm that the suggested strategies can enhance the role of banks in supporting Indonesia's transition to sustainable energy and contribute to people's welfare. The implications of this research emphasize the importance of implementing the research recommendations to strengthen synergies between bank lending policies and sustainable energy initiatives in Indonesia.

Abstract

This research aims to analyze the implementation of the Personal Data Protection Law (PDP Law) No. 27 of 2022 in the e-commerce sector in Indonesia, with a focus on consumer data protection. The method used is normative juridical, focusing on analyzing relevant documents and regulations to outline the legal framework and its application in e-commerce practices. Sources of legal materials include laws and regulations, academic literature, and interviews with legal experts and e-commerce practitioners. The results show that e-commerce companies have made significant adjustments to comply with the PDP Law, including improved privacy policies and investments in data security technologies. However, challenges to the full implementation of the PDP Law remain, particularly regarding consumers' and companies' awareness and understanding of the rights and obligations stipulated in the PDP Law. While there has been an increase in consumer trust in e-commerce platforms, increasing consumer awareness and active participation in the protection of their data still requires further efforts. The implication of this study is that the PDP Law No. 27 of 2022 has provided a stronger and more comprehensive legal framework for consumer data protection in Indonesia's e-commerce sector. However, to maximize the effectiveness of this law, a concerted effort is needed between regulators, the e-commerce industry, and the wider public to improve education and awareness of personal data protection, as well as ongoing adjustments to data management practices by e-commerce companies.

Abstract

Unilateral termination of employment due to union-busting practices is a serious problem in industrial relations in Indonesia. This study analyzes legal protection for workers against unilateral termination of employment due to union busting, referring to the Industrial Relations Court (PHI) Decision Number 229/Pdt.Sus-PHI/2019/PN.Bdg and the Supreme Court Decision Number 436 K/Pdt.Sus-PHI/2020. This study uses a normative juridical method with a case approach, a regulatory approach, and data collection techniques through literature studies. The results of the study indicate that PT. Asmo Indonesia (PT. Denso Manufacturing) is predicted to have carried out union-busting practices by unilaterally terminating the employment of the union chairman without going through the bipartite and tripartite mechanisms by the provisions of the regulations. Although there are indications of violations of the right to associate as regulated in Law Number 21 of 2000, the courts at the PHI and cassation levels do not explicitly summarize the practice of union busting in their legal considerations. Unilateral termination of employment of active workers in trade unions can be charged as an unlawful act. Therefore, it is necessary to strengthen legal protection for workers to prevent discriminatory and repressive actions by employers against freedom of association. In addition, judges in industrial relations cases need to consider more comprehensively the aspects of Human Rights and the principle of justice in every decision related to employment.

AbstractsThe abstract of this article authors several points, among others: Firstly, Purpose of Article; to analyze labor regulation concerning income provision towards welfare for employers in Indonesia. Secondly, Scope of Work; that the legal implementation focuses on Indonesian labor law arrangements, and then concerning pressures relevant to income as an international standard for laborers, and demand for wage acceptance as a facility for labor welfare, and also labor law dispute settlement in the Indonesian welfare system. Thirdly, Legal Methodology; refers to qualitative research with secondary materials from normative and empirical sources, also by conducting legal comparison from other countries outside of Indonesia. Fourthly, Result in Summary; on the systemic implementation of Indonesian labor regulation as stipulated in a written constitution, that ”Each citizen shall reserve the rights for adequate employment and income based on sustainable standards (Article 27 paragraph (2), 1945 Indonesian Constitution). The income pressure for International labor standards via ILO has created a standard system to protect the rights of laborers binding themselves in an agreement, based on ILO Convention No.89 the Year 1949 which instigated the birth of Law Number 18 the Year 1956 concerning Ratification of ILO Convention No. 80 the Year 1957. Demands for income to be accepted as labor welfare has yet to reiterate the importance of wage component in applicable labor law (Law Number 13 the Year 2003 concerning Employment) since it allows Governor in each province to regulate the measurement of labor’s wage on annual basis. Similarly with labor trial pattern which only allows the Industrial Relations Court and not solely referring to labor arbitration institution as expected from ILO and WTO as international organizations. Sedang ruang Lingkupnya bahwa pelaksanaan hukum pengaturan hukum perburuhan Indonesia, kemudian terhadap tekanan mengenai penghasilan dari standar buruh Internasional, dan tuntutan penerimaan penghasilan sebagai fasilitas kesejahteraan buruh, juga sistem penyelesaian hukum perburuhan dalam sistem kesejahteraan di Indonesia. Metode Penelitian digunakan adalah menggunakan cara penelitian kualitatif dengan bahan sekunder dari bahan hukum normatif dan empiris, juga melakukan perbandingan hukum dari luar Indonesia. Hasilnya bahwa terhadap penerapan sistemik pengaturan perburuhan Indonesia yang telah dijabarkan dalam konstitusi tertulis menekankan bahwa” tiap-tiap warga negara berhak atas pekerjaan dan penghidupan yang layak bagi kemanusiaan” (Pasal 27 ayat (2) UUD 1945). Tekanan penghasilan dari standar buruh Internasional melalui ILO telah menciptakan suatu sistem standar melindungi hak buruh mengikatkan diri di dalam perjanjian yang konvensi ILO No.89 Tahun 1949 mengenai lahir UU No.18 Tahun 1956 tentang Persetujuan Konvensi ILO No.80 Tahun 1957. Tuntutan penerimaan penghasilan sebagai kesejahteraan buruh belum memberikan penegasan komponen upah dalam perundang buruh berlaku (UU No.13 Tahun 2003 tentang Ketenagakerjaan) karena memberikan pada setiap pemerintahan Gubernur setiap provinsi untuk mengatur besar-kecil pengupahan buruh untuk setiap tahunnya.Kata Kunci: Pengaturan Penghasilan, Kesejahteraan Buruh Indonesia. Системное изменение условий труда между спросом и давлением в отношении доходов для обеспечения благосостояния в ИндонезииАннотацияЦель исследования: проанализировать трудовые условия при предоставлении дохода для обеспечения благосостояния предпринимателями в Индонезии. Предмет исследования: выполнение и условие трудового законодательства  Индонезии, затем давление на доход со стороны международных трудовых стандартов и требования о принятии дохода в качестве объекта социальной сферы для рабочих, и также системы урегулирования трудового законодательства в системе социального обеспечения в Индонезии. Используемые методы исследования: качественный метод исследования с использованием вторичных материалов из нормативных и эмпирических правовых материалов, а также в проведении юридических сравнений за пределами Индонезии. Результаты исследования: применение индонезийских трудовых норм, описанных в писаной конституции, подчеркивают, что « каждый гражданин имеет право на труд и достойную жизнь для человечества» (пункт (2) статьи 27 Конституции 1945 года). Давление на доходы со стороны международных трудовых стандартов через МОТ привело к созданию стандартной системы защиты прав трудящихся в соответствии с Конвенцией МОТ № 89 от 1949 года о принятии Закона № 18 от 1956 года об Утверждении Конвенции МОТ № 80 от 1957 года. Что касается благосостояния рабочих, он не подтвердил компонент заработной платы в применимом трудовом законодательстве (Закон № 13 от 2003 года о рабочей силе), поскольку он даёт правительству каждого губернатора каждой провинции право регулировать сумму заработной платы на каждый год. Точно так же модель трудового правосудия допускает только PPHI (Разрешение Производственных Споров), а не единственное учреждение арбитражного урегулирования трудовых конфликтов, как ожидается от мировых учреждений МОТ и ВТО.Ключевые слова: Управление доходами, Благосостояние индонезийских рабочих.

Abstract

The position of the Consumer Dispute Settlement Body in the judicial power law is not as a court institution but carries out an adjudicating function called a Quasi Court with resolution through mediation, conciliation, and arbitration, the decisions of which are final and binding.  The formulation of the problem in this paper is: Why is legal protection needed for consumers as a Quasi Court from the Final Decision of the Consumer Dispute Settlement Agency (BPSK)? Meanwhile, the method used in this research is the normative method, using a statutory and analytical approach, then the legal materials used are primary, secondary, and tertiary legal materials.  Consumers are weaker in existence than business actors, because business actors often carry out actions that can harm consumers to gain profits, therefore consumers need to receive legal protection, even though UUPK has been formed to resolve disputes through the Consumer Dispute Resolution Agency (BPSK), but the BPSK decision which is final and binding has not been fully implemented consistently as stated in the Consumer Protection Law (UUPK), because there is still an opportunity to submit objections for parties who object to the BPSK decision.

Abstract

This research explores sustainable lending procedures in the Indonesian banking sector, which is the key to fair and sustainable economic development. Based on Law No. 10 of 1998 concerning Amendments to Law No. 7 of 1992 concerning Banking, as well as Law No. 21 of 2011 amended by Law No. 4 of 2023 concerning Development and Strengthening of the Financial Sector, this study explores the implementation of Financial Services Authority Regulation No. 51/POJK.03/2017. Using a qualitative approach, researchers inventory and analyze relevant legal materials to assess the effectiveness of sustainable lending. The research findings show that despite progress, improvements in supervision and risk management are still needed to ensure sustainable financial practices. This research proposes a credit distribution model that takes into account the principles of justice and sustainability, through strategic coordination between financial institutions, government, and other stakeholders to achieve appropriate economic development goals based on the 1954 Constitution

Abstract

Artikel ini membahas tentang konsep nasionalisme dalam Al-Quran. Konsep ini merupakan konsep cinta tanah air yang telah dianjurkan dalam Al-Quran. Proses mencari konsep nasionalisme ini dilakukan dengan mengumpulkan ayat-ayat yang berkaitan dengan cinta tanah air. Khususnya dalam metodologi tafsir maudhu’i. Mengumpulkan ayat-ayat dengan secara tematik. Artikel ini merupakan penelitian tematik berwajah kualitatif dengan menggunakan sumber penelitian primer, ayat Al-Quran dan sumber sekunder, bahan bacaan tentang nasionalisme. Kemudian hasil penelitian disajikan dengan naratif-analitis dari beberapa contoh ayat-ayat Al-Quran sebagai bentuk implementasi teori dan penguatan pemahaman.

Abstract

The post-reform Indonesian legal system is characterized by hyper-regulation and disharmony in legislation. This study aims to analyze systemic weaknesses in the legislative drafting process that contribute to legal uncertainty and ineffectiveness. Weaknesses are identified in three main aspects: Substantive Aspects (harmonization), Procedural Aspects (participation and planning), and Technical Aspects (quality of Legal Drafting). The study results indicate that the dominance of sectoral approaches, minimal inter-institutional coordination, and the low quality of human resources for drafting are the main factors behind this acute legislative flaw. These weaknesses have serious impacts on legal certainty, the effectiveness of public policy, and the investment climate. This article examines the root causes of substantive, procedural, and technical problems in the drafting of legislation in Indonesia, referring to Law No. 12 of 2011 (and its amendments) concerning the Formation of Legislation.

Abstract

Indonesia is one of the countries that ratified the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), which is the main international instrument to regulate trade in endangered animals and plants. Therefore, as a consequence of the ratification, Indonesia is obliged to adjust its legal system which is currently contained in Law Number 32 of 2024 concerning Amendments to Law Number 5 of 1990 concerning the Conservation of Biological Natural Resources and Their Ecosystems to be in line with the principles of animal protection regulated by CITES. This article analyzes the application of CITES in Indonesia in the context of protected wildlife trafficking cases, identifies enforcement constraints, and offers policy recommendations to strengthen biodiversity protection. The methods used are literature studies, regulatory analysis, and representative case studies. The results of the study show that despite the existence of an adequate legal framework, operational obstacles, inter-agency coordination, lack of forensic capacity, and socio-economic aspects still reduce the effectiveness of CITES implementation. Recommendations include strengthening law enforcement capacity, harmonizing regulations, increasing international cooperation, and public education campaigns.
