Abstract

Periode Khilafah al-Rasyidah merupakan fase awal dalam sejarah peradaban Islam yang menampilkan karakter idealitas dan realitas yang khas. Penelitian ini bertujuan untuk menganalisis dan mendeskripsikan pembentukan Khilafah al-Rasyidah I-II. Penelitian ini menggunakan pendekatan studi kepustakaan, memanfaatkan sumber-sumber primer seperti kitab sejarah klasik dan tafsir, serta sumber sekunder berupa kajian modern terkait topik ini. Analisis difokuskan pada dimensi idealitas dalam implementasi syariat Islam, keadilan sosial, dan pengelolaan pemerintahan yang berlandaskan Al-Qur'an dan Sunnah, serta realitas yang dihadapi berupa konflik internal, tantangan geopolitik, dan dinamika sosial-ekonomi. Hasil penelitian menunjukkan bahwa meskipun idealitas Khilafah al-Rasyidah menjadi panutan, kompleksitas realitas sering kali memengaruhi implementasi ideal tersebut. Studi ini memberikan wawasan mendalam mengenai kontribusi politik Islam di masa Khilafah al-Rasyidah terhadap perkembangan peradaban Islam secara keseluruhan.

Abstract

This study proposes ideas for reforming Husein Muhammad’s ushul fiqh to address and deconstruct the gender biases present in some aspects of Islamic law in Indonesia. Using a conceptual research approach through a literature study, this research finds that Husein Muhammad employed the method of reforming ushul fiqh when examining women’s fiqh issues. Husein Muhammad’s approach to tajdid in ushul fiqh includes Tawhid as the fundamental basis for understanding the Qur’an and hadith, interpreting the concept of asbâb al-nuzûl by examining the broader historical context of human traditions at the time of the Qur’an’s revelation, rather than a narrow focus, differentiating between muhkamat verses with universal values and mutasyabihat verses with particular dimensions, considering Makiyyah verses to have a universal dimension, in contrast to Madaniyyah verses which are seen as having specific dimensions, and typologizing verses into those with legal dimensions and those with informative dimensions, as well as distinguishing between legal hadiths and informative hadiths. The renewal of the epistemology of Islamic law proposed by Husein Muhammad aims to produce Islamic legal interpretations that are just and gender-equal, freeing women from the constraints of patriarchal culture and misogynistic fiqh texts.

Abstract

The reactualization of Islamic law has been a topic of interest for scholars and scholars across the world. This research aims to analyze the implications of Munawir Sjadzali's perspectives on Islamic law in contemporary Indonesian society. The research employed a library research approach, focusing on qualitative descriptive analysis. The analysis was conducted through a process of thematic analysis, identifying and interpreting patterns related to the adaptation and reinterpretation of Islamic teachings. Deductive and inductive reasoning were applied to draw conclusions from the literature, facilitating a deeper understanding of the implications. The study provides a nuanced view of how Islamic law can be relevant and applicable to modern societal challenges, potentially influencing both academic thought and practical applications within Islamic jurisprudence. It may offer guidance for policymakers and legal practitioners in integrating traditional Islamic principles with contemporary legal frameworks.

Abstract

This article raises the importance of philosophical thinking by focusing on three main things: the paradigm of the urgency of philosophical thinking, the internal and external factors that influence it, and its positive and negative implications for Muslim thinking. The research method used is library research with a text approach based on literature theory. Data collection is done through collection, selection, classification, and analyzed with qualitative data analysis techniques of Miles and Huberman models. The results of the study show that the urgency paradigm of philosophical thinking has three forms: as a critical dialog partner, as a parent of science, and as an insight enhancer. Internal factors that influence the urgency of philosophical thinking include human curiosity, human awe of the universe, and thinkers' dissatisfaction with existing answers. External factors include freedom of thought, research into the origin of nature, and the influence of myths and fables in the Greek belief system. The positive implications of the urgency of philosophical thinking on Muslim thought include being a guide to scientific issues, a compass for the development of knowledge, and a means of testing scientific reasoning. However, there are also negative implications such as the emergence of nihilism, uncertainty, and lack of concern for practical or empirical aspects. In conclusion, the paper emphasizes that philosophy has an important role in various aspects of people's lives. In understanding nature, values, and actions, philosophy helps shape the way we understand the origins of knowledge. It also plays a key role in the development of science, ethics, politics, culture, and enriches our understanding of the meaning and purpose of life.

Abstract

Atikel ini mengkaji mengenai Reformasi Tanzimat dan westernisasi sebagai periode krusial dalam proses modernisasi dan westernisasi Kesultanan Utsmaniyah. Reformasi ini merupakan respons terhadap melemahnya struktur politik, militer, dan ekonomi di tubuh kesultanan Turki Usmani, sekaligus bentuk penyesuaian terhadap dominasi Eropa yang tengah mencapai kemajuan dalam bidang ilmu pengetahuan, hukum, dan tata kelola pemerintahan. Penelitian ini menggunakan metode kualitatif deskriptif dan mengolaborasikan dengan pendekatan kajian pustaka terhadap berbagai sumber primer dan sekunder. Hasil kajian menunjukkan bahwa Reformasi Tanzimat menjadi titik balik penting dalam pembentukan sistem pemerintahan modern, penataan ulang hukum, serta transformasi sosial yang mengantarkan pada tumbuhnya nasionalisme Turki. Meski sarat dengan pengaruh nilai-nilai Barat, arus westernisasi tersebut tetap berupaya mempertahankan identitas Islam-Turki dalam bingkai budaya Usmaniyah. Artikel ini menegaskan bahwa Reformasi Tanzimat bukan sekadar adaptasi terhadap Barat, melainkan strategi sintesis antara tradisi dan modernitas yang kemudian melandasi lahirnya negara-bangsa Turki modern pada awal abad ke-20. This article examines the Tanzimat Reforms and Westernization as a crucial period in the modernization and westernization process of the Ottoman Empire. The reforms emerged as a response to the weakening of the political, military, and economic structures within the Ottoman state, as well as an adjustment to the growing European dominance marked by advancements in science, law, and governance. This research employs a qualitative descriptive method combined with a literature review approach, utilizing both primary and secondary sources. The findings reveal that the Tanzimat Reforms marked a significant turning point in the establishment of a modern administrative system, legal restructuring, and social transformation that eventually fostered the rise of Turkish nationalism. Although deeply influenced by Western values, the wave of Westernization still sought to preserve the Islamic-Turkish identity within the Ottoman cultural framework. This article asserts that the Tanzimat Reforms were not merely an adaptation to the West but a strategic synthesis between tradition and modernity that laid the groundwork for the emergence of the modern Turkish nation-state in the early twentieth century.

Abstract

This article examines the relevance of Muhammad Abduh's thoughts on women's emancipation for addressing Domestic Violence in Indonesia. The study addresses the ongoing issue of gender-biased religious interpretations that legitimize acts of violence within the household, a problem evidenced by more than 10,000 reported cases in 2023. Abduh was chosen due to the significant influence of his reformist ideas—particularly his views on qiwamah—on the development of Islamic family law in Indonesia, largely through the intellectual networks of Al-Azhar University. The objectives of this research are twofold: first, to descriptively analyze Abduh’s concept of qiwamah as articulated in his principal works (Tafsir al-Manar and Risalat al-Tawhid); and second, to evaluate its normative and practical relevance in shaping an Islamic legal framework that opposes domestic violence in the Indonesian context. The study employs a contextual hermeneutic method, supported by comparative analysis between Abduh’s ideas and Indonesian domestic violence legislation. The findings reveal that Abduh offers three central arguments: qiwamah as a moral and protective responsibility rather than a justification for male dominance; the spiritual and ethical equality of men and women; and the necessity of legal reform grounded in the principle of maslahah. These ideas are found to be in harmony with the core values of Indonesia’s Law No. 23 of 2004 on the Elimination of Domestic Violence. The study concludes that Abduh’s reinterpretation provides a strong theological foundation for the prevention of domestic violence in Indonesia, although its practical application remains challenged by conservative interpretations and the ongoing need for contextual adaptation.

Abstract

This article will discuss Islamic boarding schools which were initially as centers for Islamic studies and then innovated as social economic centers by developing entrepreneurship in Islamic boarding schools and then analyzing them from the perspective of sharia maqashid. This research is a qualitative research, with the type of field research (field research). The data sources in this study consist of two data sources, namely primary data and secondary data. Using three data collection techniques: Observation, interview, and observation. The results of the study show that the Raudhatul Ulum Islamic Boarding School has played a dual role, both as an Islamic educational institution and as an economic role in improving the welfare, both internal and external of the Islamic boarding school by operating and developing Islamic boarding school business units in various fields such as trade, services, agriculture, and religious tourism. And it can be concluded that the entrepreneurship applied by the Raudhatul Ulum Islamic Boarding School to the welfare of the community has fulfilled the five principles of maqasid sharia or commonly known as kulliyat al-khamsah (five general principles). The five maqashids are: hifdzu din (maintaining religion), hifdzu nafs (maintaining the soul), hifdzu 'aql (maintaining the mind), hifdzu maal (maintaining property), and hifdzu nasab (maintaining offspring).

Abstract

Abstract: Bangsalsari Village is the village with the most cases of unregistered marriage among other villages in the Jember Regency area. Among the problems that occur there are men and women who want to get married, perform the sacred contract in front of an ustaz or community leader as a penghulu by fulfilling the pillars and conditions according to religion, but do not report and register their marriage at the Office of Religious Affairs. This is influenced by the culture and beliefs of the local community. The approach and type of research used in this research is qualitative-empirical. Collecting data by means of interviews and documentation, then processed by the stages of Editing, Classifying and Verifying. Based on the results of the study, the negative effects received by the wife and children from the absence of marriage registration such as not being able to go to school, not being able to sue for divorce from their husbands when experiencing and not being able to inherit from their husbands in Bangsalsari Village, Bangsalsari District, Jember Regency. The maqashid al-Syari'ah Al-Syathibi perspective, namely marriage registration is included in the Dlaruriyat aspect, as well as sakinah, mawaddah and rahmah which are also the most important components in household life in Bangsalsari Village.Keywords: Marriage Siri; Impact on Wife and Children; Maqashid Sharia.Abstrak: Desa Bangsalsari merupakan merupakan desa terbanyak terjadinya kasus nikah siri di antara desa-desa lainnya yang ada di wilayah Kabupaten Jember. Di antara permasalahan yang terjadi di sana yaitu laki-laki dan perempuan yang ingin melangsungkan pernikahan, melakukan akad sakral tersebut dihadapan seorang ustaz atau tokoh masyarakat sebagai penghulu dengan terpenuhi rukun dan syaratnya menurut agama, akan tetapi tidak melaporkan dan mencatatkan pernikahan mereka di Kantor Urusan Agama, hal ini dipengaruhi oleh budaya dan kepercayaan masyarakat setempat. Pendekatan dan jenis penelitian yang digunakan penelitian ini adalah kualitatif-empiris. Pengumpulan data dengan cara wawancara dan dokumentasi, kemudian diolah denga tahapan Editing, Classifying dan Verifying. Berdasarkan hasil penelitian, pengaruh negatif yang diterima oleh istri dan anak dari tidak adanya pencatatan nikah seperti tidak dapat bersekolah, tidak dapat menggugat cerai suami ketika mengalami dan tidak dapat jatah waris dari suami di Desa Bangsalsari, Kecamatan Bangsalsari, Kabupaten Jember. Perspektif maqashid al-Syari’ah Al-Syathibi, yaitu pencatatan nikah termasuk dalam aspek Dlaruriyat, sama halnya dengan sakinah, mawaddah dan rahmah yang juga menjadi komponen paling penting dalam kehidupan rumah tangga di Desa Bangsalsari.Kata Kunci: Nikah Siri; Dampak Terhadap Istri dan Anak; Maqashid Al-Syari’ah.

Abstract

Abstract: Marriage is a sacred event experienced by a man and a woman. According to the marriage, there is inner and outer peace, but looking at the historical facts, especially in the pre-Islamic era, women did not get a favorable position at that time. Which is influenced by the socio-cultural society that adheres to a patriarchal system. So, that men monopolize all matters related to family matters. This results in inequality in social life. The existence of a marriage tradition rooted in the patriarchal system, resulted in the marriage being like a sale and purchase contract, where women became the object of merchandise. From the results of the study it was found that in the pre-Islamic era, the nature of marriage was something that was natural and cultural. Meanwhile, the purpose of marriage is only to obtain offspring and satisfy lust. As long as for the Islamic era, the nature of marriage is something that is instinctive and the law is regulated by religion. With the result that marriage is intended to worship, find happiness, produce offspring, and vent lust.Keywords:  Marriage; Pre-Islamic; Early Islam.Abstrak: Pernikahan merupakan suatu peristiwa sakral yang dialami oleh pasangan pria dan wanita. Yang mana dengan adanya pernikahan tersebut, maka diperoleh ketenteraman lahir dan batin, Namun melihat fakta sejarah yang ada, terlebih di era pra Islam, maka perempuan tidaklah mendapatkan posisi yang menguntungkan kala itu. Yang mana hal tersebut terpengaruh oleh sosio kultural masyarakat yang menganut sistem patriarki. Sehingga pria memonopoli segala urusan terkait dengan masalah keluarga. Hal ini mengakibatkan adanya ketidaksetaraan di dalam kehidupan sosial bermasyarakat. Adanya tradisi perkawinan yang mengakar pada sistem patriarki, mengakibatkan pernikahan tersebut tak ubahnya sebagai kontrak jual beli, di mana wanita menjadi obyek barang dagangan. Dari hasil penelitian didapati bahwa pada era pra-Islam, hakikat pernikahan adalah sesuatu yang sifatnya alamiah dan kultural. Sedangkan tujuan pernikahan hanya semata untuk memperoleh keturunan dan memuaskan syahwat. Adapun pada masa Islam, hakikat pernikahan adalah sesuatu yang sifatnya naluriah dan hukum yang diatur oleh agama. Sedangkan pernikahan ditujukan untuk beribadah, mendapatkan kebahagiaan, memperoleh keturunan, dan melampiaskan syahwat.Kata Kunci: Pernikahan; Pra Islam; Awal Islam.

Abstract

The Compilation of Islamic Law is the material basis for the Panel of Judges in deciding cases in the Religious Courts. However, the substantive content of KHI still needs to be reviewed. One of them is the problem of perfect tamkin as the cause of the husband's obligation to support his wife in Article 80 paragraph (5) KHI. The meaning contained in this phrase is classified as abstract, thus giving birth to various interpretations of judges, even though in essence the cases handled tend to be the same. Therefore, this study aims to determine substantive weaknesses and reconstruct the meaning of perfect tamkin and review it from Abdullah bin Bayyah's maqasid perspective. The method used is normative qualitative method using KHI as the primary legal material. Methods of data collection using the method of documentation. This research resulted in: (1) in article 80 paragraph (5) KHI found substantive weaknesses that must be addressed, namely: a) incomplete adoption of fiqh opinions; b) the substance of the article which leads to the applicability of meaning in general; and c) the judges' interpretations vary which causes confusion in the meaning of nature. (2) in reconstructing the article, elaboration is needed between the interpretation of the fuqaha and the judge. In order to find a formula regarding the definition of perfect tamkin, its indicators, and the conditions for a wife to earn a living. In the maqasid review, it was found that the method used to determine tamkin is sukut al-syari' and it belongs to al-wasilah ila al-maqsad al-tabi'i
