Abstract

This article discusses the meaning of the verse ar-Rijal Qawwamuna 'ala an-Nisa' bima fadhdhalallhu b'adhamuh 'ala ba'dh in surah an-Nisa' verse 34 according to the interpretation of al-Sya'rawi. This article also explains the dialectic of the scholars in understanding the meaning of the verse. This tafsir study includes a thematic interpretation model that discusses one maudhu 'in the al-Qur'an, namely the discussion about men as leaders for women. In this research, obtained through literature review and processed using descriptive-comparative methods. This study aims to provide understanding and reduce tension in the midst of debates that have not yet found a clear point regarding this verse

Abstract

Mediation in the settlement of Islamic civil cases is a stage that should not be missed by the litigants. Basically, mediation is done face-to-face directly in a special room. However, mediation can be done virtually or using virtual communication media. The implementation of virtual mediation can be done using the WhatsApp, Line, or Zoom Meeting applications. According to Soerjono Soekanto, there are several factors that determine law enforcement, namely legal factors, community factors, cultural factors, facilities and facilities factors and legal factors. The implementation of virtual mediation when viewed from the factors described and all that have not been fulfilled, but there are several things that need to be done so that virtual mediation can be carried out smoothly, there must be a special application there must be a source of legal reference that is specifically regulated.

Abstract

Abstrak: Pengadilan Agama hanya bisa memutuskan permohonan itsbat nikah, apabila dilakukan dan dicatatkan secara agama Islam. Yang menjadi Latar belakang permasalahan penelitian ini berawal dari sebuah Putusan yang penulis temukan bahwa Pemohon dengan suaminya dahulunya telah melaksanakan perkawinan secara Islam, namun seiring berjalannya waktu pemohon sekarang pindah agama. Kemudian bahwasanya pemohon dengan suami pemohon dilaksanakan secara siri dan belum tercatat di Kantor Urusan Agama Kedungkandang Kota Malang, sehingga pemohon dengan suami pemohon perlu mengistbatkan pernikahannya karena status hukum perkawinan pemohon dengan suami pemohon belum jelas dan untuk mengurus akta kematian dan mencatatkan perkawinan pemohon dengan suaminya. Penelitian memfokuskan pada dua pembahasan yaitu, Pertama untuk mengetahui bagaimana permohonan istbat nikah oleh pemohon non muslim berdasarkan asas personalitas keislaman. Kedua, mengetahui bagaimana putusan hakim Pengadilan Agama Malang dalam perkara penetapan permohonan istbat nikah oleh pemohon non muslim perspektif teori keadilan John Rawls. Penelitian ini Merupakan jenis penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan, sedangkan sumber hukum yang dikumpulkan berupa data primer yakni dokumen putusan hakim Pengadilan Agama Malang dalam menetapkan istbat nikah pemohon non muslim dalam putusan nomor 0998/Pdt.G/2021/PA.Mlg. Data sekunder yakni perundang-undangan, buku teori keadilan John Rawls yang berjudul dasar-dasar filsafat politik untuk mewujudkan kesejahteraan sosial dan negara. Pengumpulan bahan hukum berupa mengumpulkan berbagai dokumentasi baik itu berupa buku, majalah, dokumen dan lain-lain. Teknik analisis bahan hukum dengan menggunakan yaitu reduksi data, penyajian data, dan penarikan kesimpulan. Hasil Penelitian menunjukkan (1) bahwa berdasarkan Penetapan Pengadilan Agama Kota Malang Putusan Nomor 0098/Pdt.G/2021/Pa.Mlg, tidak dapat memenuhi ketentuan asas personalitas keislaman, yaitu Pemohon I dan Pemohon II telah beragama Kristen, bidang yang diperiksa adalah perkawinan dengan permohonan pengesahan perkawinan/itsbat nikah. Meskipun perkawinan Pemohon I dan Pemohon II sekarang telah berpindah agama menjadi non muslim, akan tetapi dahulunya menikah secara Islam, namun oleh karena Pemohon I dan Pemohon II telah menjadi non muslim, maka yang bersangkutan tidak terikat dengan agama Islam, sehingga seharusnya permohonan pengesahan nikahnya harus ditujukan ke pengadilan negeri. (2) dalam perkara putusan Pengadilan Agama Kota Malang jelas meskipun Pemohon I dan Pemohon II telah sekarang telah berpindah agama menjadi non muslim, akan tetapi dahulunya menikah secara Islam, sehingga tidak bisa dianggap setara dengan status pemohon sekarang akan tetapi jelas apa yang menjadi bahan pertimbangan. Keadilan memang tidak melulu harus setara. Didalam perkara permohonan itsbat nikah pemohon non muslim secara hukum tidak mempunyai legal standing tetapi kalau kita hanya melihat apa yang tertulis maka keadilan sulit di implementasikan ke seluruh pihak. Abstract

There is no legal basis for giving testament wajibah to a grandparent in Indonesia. However, the Religious Courts of Tarakan, in decision number: 610/Pdt.G/2014/PA.Trk. the judges gave testament wajibah portion of the inheritance to the grandparent because the heir’s mother blocked their position and the parenting role carried out by the grandparent since the mother left the heir, and her existence was unknown. The judge’s decision must consider the principles of legal certainty, benefits, and a sense of justice for the parties. Therefore, this research focuses on the judge’s legal reasoning in decision number: 610/Pdt.G/2014/PA.Trk. and how the judge’s decision is seen from the perspective of Aristotle’s distributive justice theory. This research is juridical-normative with cases and conceptual approaches. The results showed that the judge’s legal reasoning through the process of de heuristic and de legitimate, legal basis that judges used are the holy Qur’an, hadith, KHI, and Islamic law. The judges consider the role of grandparents during the heir to life. And giving testament wajibah to grandparents is considered fair based on Aristotle’s distributive justice theory because they have fulfilled the proportional principle requirements.How to cite item: Saiban, K., Al Kaswy, T., SJ, F. Abstract

Children who experience violence need to be protected and their rights fulfilled, because many losses have been suffered. Children's rights are contained in Law No. 35 of 2014 concerning Amendments to Law No. 23 of 2002 on Child Protection. In fact, the low quality of child protection in Indonesia has drawn a lot of criticism regarding the scope of the implementation of children's rights which is carried out as a form of protection for child victims of sexual violence to ensure the survival of children which is part of human rights. This research is a type of empirical legal research with interviews and documentation techniques; The results show that the process of protecting child victims of sexual violence by the Koppatara Foundation is through receiving complaints, accompaniment, case handling, and case termination. And the implementation of fulfilling the rights of child victims of sexual violence according to maqāṣid al-syarī'ah Jasser Auda can be implemented through the implementation of effective fulfillment of children's rights which aims for the benefit of the child and prioritizes legal certainty and upholds the values of justice are based on the main objectives of the policy The Child Protection Act for the benefit of child victims of sexual violence.

Abstract

The Compilation of Islamic Law is the material basis for the Panel of Judges in deciding cases in the Religious Courts. However, the substantive content of KHI still needs to be reviewed. One of them is the problem of perfect tamkin as the cause of the husband's obligation to support his wife in Article 80 paragraph (5) KHI. The meaning contained in this phrase is classified as abstract, thus giving birth to various interpretations of judges, even though in essence the cases handled tend to be the same. Therefore, this study aims to determine substantive weaknesses and reconstruct the meaning of perfect tamkin and review it from Abdullah bin Bayyah's maqasid perspective. The method used is normative qualitative method using KHI as the primary legal material. Methods of data collection using the method of documentation. This research resulted in: (1) in article 80 paragraph (5) KHI found substantive weaknesses that must be addressed, namely: a) incomplete adoption of fiqh opinions; b) the substance of the article which leads to the applicability of meaning in general; and c) the judges' interpretations vary which causes confusion in the meaning of nature. (2) in reconstructing the article, elaboration is needed between the interpretation of the fuqaha and the judge. In order to find a formula regarding the definition of perfect tamkin, its indicators, and the conditions for a wife to earn a living. In the maqasid review, it was found that the method used to determine tamkin is sukut al-syari' and it belongs to al-wasilah ila al-maqsad al-tabi'i

Abstract

Abstract: Marriage is a sacred event experienced by a man and a woman. According to the marriage, there is inner and outer peace, but looking at the historical facts, especially in the pre-Islamic era, women did not get a favorable position at that time. Which is influenced by the socio-cultural society that adheres to a patriarchal system. So, that men monopolize all matters related to family matters. This results in inequality in social life. The existence of a marriage tradition rooted in the patriarchal system, resulted in the marriage being like a sale and purchase contract, where women became the object of merchandise. From the results of the study it was found that in the pre-Islamic era, the nature of marriage was something that was natural and cultural. Meanwhile, the purpose of marriage is only to obtain offspring and satisfy lust. As long as for the Islamic era, the nature of marriage is something that is instinctive and the law is regulated by religion. With the result that marriage is intended to worship, find happiness, produce offspring, and vent lust.Keywords:  Marriage; Pre-Islamic; Early Islam.Abstrak: Pernikahan merupakan suatu peristiwa sakral yang dialami oleh pasangan pria dan wanita. Yang mana dengan adanya pernikahan tersebut, maka diperoleh ketenteraman lahir dan batin, Namun melihat fakta sejarah yang ada, terlebih di era pra Islam, maka perempuan tidaklah mendapatkan posisi yang menguntungkan kala itu. Yang mana hal tersebut terpengaruh oleh sosio kultural masyarakat yang menganut sistem patriarki. Sehingga pria memonopoli segala urusan terkait dengan masalah keluarga. Hal ini mengakibatkan adanya ketidaksetaraan di dalam kehidupan sosial bermasyarakat. Adanya tradisi perkawinan yang mengakar pada sistem patriarki, mengakibatkan pernikahan tersebut tak ubahnya sebagai kontrak jual beli, di mana wanita menjadi obyek barang dagangan. Dari hasil penelitian didapati bahwa pada era pra-Islam, hakikat pernikahan adalah sesuatu yang sifatnya alamiah dan kultural. Sedangkan tujuan pernikahan hanya semata untuk memperoleh keturunan dan memuaskan syahwat. Adapun pada masa Islam, hakikat pernikahan adalah sesuatu yang sifatnya naluriah dan hukum yang diatur oleh agama. Sedangkan pernikahan ditujukan untuk beribadah, mendapatkan kebahagiaan, memperoleh keturunan, dan melampiaskan syahwat.Kata Kunci: Pernikahan; Pra Islam; Awal Islam.

Abstract

Abstract: Bangsalsari Village is the village with the most cases of unregistered marriage among other villages in the Jember Regency area. Among the problems that occur there are men and women who want to get married, perform the sacred contract in front of an ustaz or community leader as a penghulu by fulfilling the pillars and conditions according to religion, but do not report and register their marriage at the Office of Religious Affairs. This is influenced by the culture and beliefs of the local community. The approach and type of research used in this research is qualitative-empirical. Collecting data by means of interviews and documentation, then processed by the stages of Editing, Classifying and Verifying. Based on the results of the study, the negative effects received by the wife and children from the absence of marriage registration such as not being able to go to school, not being able to sue for divorce from their husbands when experiencing and not being able to inherit from their husbands in Bangsalsari Village, Bangsalsari District, Jember Regency. The maqashid al-Syari'ah Al-Syathibi perspective, namely marriage registration is included in the Dlaruriyat aspect, as well as sakinah, mawaddah and rahmah which are also the most important components in household life in Bangsalsari Village.Keywords: Marriage Siri; Impact on Wife and Children; Maqashid Sharia.Abstrak: Desa Bangsalsari merupakan merupakan desa terbanyak terjadinya kasus nikah siri di antara desa-desa lainnya yang ada di wilayah Kabupaten Jember. Di antara permasalahan yang terjadi di sana yaitu laki-laki dan perempuan yang ingin melangsungkan pernikahan, melakukan akad sakral tersebut dihadapan seorang ustaz atau tokoh masyarakat sebagai penghulu dengan terpenuhi rukun dan syaratnya menurut agama, akan tetapi tidak melaporkan dan mencatatkan pernikahan mereka di Kantor Urusan Agama, hal ini dipengaruhi oleh budaya dan kepercayaan masyarakat setempat. Pendekatan dan jenis penelitian yang digunakan penelitian ini adalah kualitatif-empiris. Pengumpulan data dengan cara wawancara dan dokumentasi, kemudian diolah denga tahapan Editing, Classifying dan Verifying. Berdasarkan hasil penelitian, pengaruh negatif yang diterima oleh istri dan anak dari tidak adanya pencatatan nikah seperti tidak dapat bersekolah, tidak dapat menggugat cerai suami ketika mengalami dan tidak dapat jatah waris dari suami di Desa Bangsalsari, Kecamatan Bangsalsari, Kabupaten Jember. Perspektif maqashid al-Syari’ah Al-Syathibi, yaitu pencatatan nikah termasuk dalam aspek Dlaruriyat, sama halnya dengan sakinah, mawaddah dan rahmah yang juga menjadi komponen paling penting dalam kehidupan rumah tangga di Desa Bangsalsari.Kata Kunci: Nikah Siri; Dampak Terhadap Istri dan Anak; Maqashid Al-Syari’ah.

Abstract

Interfaith marriage has emerged as a significant and complex issue within Indonesian society, encompassing academic, social, and religious dimensions. This research aims to explore and address the academic, social, and religious challenges posed by interfaith marriages in Indonesia, referencing both previous research findings and a recent court decision. In the academic sphere, the study delves into the legal aspects, rights, obligations, and judicial implications of interfaith marriages. It sheds light on how Indonesian law regulates such unions. The recent Surabaya District Court's Decision Number 916/Pdt.P/2022/PN.Sby, permitting an interfaith marriage, is analyzed through the lens of Jasser Auda's Maqasid al-Shariah theory, which emphasizes social welfare, justice, and human rights in Islamic law. The decision reflects a shift from classical to contemporary Maqasid, focusing on human development and rights, particularly the freedom to marry across religious boundaries. This study contributes to a comprehensive understanding of interfaith marriage in Indonesia, emphasizing a contemporary interpretation of Islamic law and universal human rights, ultimately working towards harmony and inclusivity in this diverse society.

Abstract

The Ottoman Dynasty was one of the largest forms of Islamic government in history. This study aims to investigate and understand the comparison between the concept of the caliphate in the Ottoman Dynasty, one of the largest Islamic empires in history, and the form of a modern state with democracy, namely the State of Indonesia. This study uses comparative historical analysis, taken from primary sources, historical records, and scientific literature to trace the evolution of governance in the Ottoman Dynasty and the State of Indonesia. The results of this study indicate that there is no standard form of state practice in Islam. The monarchy system in the form of a caliphate state used by the Ottomans is in line with that conveyed by Ibn Abi Rabi who supports a monarchical form of government. The democratic system in the form of a republican state implemented in Indonesia is identical to the concept of Imamah conveyed by al-Mawardi. Any idea or formulation about state practice is permitted in Islam as long as it does not deviate from the references to the Qur'an and Hadith.
