Abstract

In colonial times, the city of Surabaya was an important part that held a lot of history. Surabaya is known as the oldest port city in Indonesia during the Dutch East Indies era and was the centre of government and international trade. Apart from that, Surabaya was also named a city of heroes because the heroes at that time were willing to sacrifice themselves to fight for and defend the independence of the Republic of Indonesia by fighting the invaders. On that basis, Surabaya is rich in cultural heritage. Most of the heritage of these historic buildings is still standing and can be found in several areas of the city of Surabaya. The local Department of Tourism and Culture has established regulations to protect original historic buildings as city heritage. However, in fulfilling the rights and obligations of individuals and city governments, land rights owned from generation to generation must be considered by the local city government. This research uses normative juridical with doctrinal and statutory regulatory approaches. This research aims to find regional regulations regarding cultural heritage related to ownership rights in managing cultural heritage land and buildings.

Abstract

Increased activity in the business sector has led to competition, which has led to business disputes between business actors. Arbitration is a form of non-litigation dispute resolution with confidential, fast, simple, and measurable costs. This research uses a normative-dogmatic judicial research method with a statutory and regulatory approach and a conceptual approach. It is hoped that the presence of BANI Surabaya will be able to play a significant role in answering the needs of business actors in a non-litigation manner, especially in the city of Surabaya and its surroundings. The majority of dispute completions completed by BANI Surabaya are construction projects involving technical matters. The diversity of backgrounds and experiences of the arbitrators at BANI Surabaya can complement the results of the decisions made. BANI Surabaya has a role in administering the settlement process through arbitration based on applicable provisions.

Abstract

In order to implement the idea of fair business competition, this article will analyze the function and legal obligations of online marketplaces in limiting commercial actors as 'official stores'. Normative juridical law research with statutory and conceptual techniques was used to create this study. According to the results, the distribution of commodities from producers to consumers has been altered by digital disruption. Currently, a number of online marketplace platforms offer 'official store' services to a small group of business players so they can expand their enterprises exclusively. Applying 'official stores' terms and conditions to business actors is prohibited by both Law No. 5 of 1999, which prohibits unfair business competition, and Government Regulation 29 of 2021, which relates to the implementation of the trade sector. Distributors and agents of associated producers will face unfair economic rivalry as a result of producers entering the online market as 'official stores'. Producers are prohibited from selling their products in retail settings, whether offline or online, in accordance with the relevant legislation. The findings of this study should benefit the parties involved in the online marketplace by fostering fair commercial competitiveness.

Abstract

Children’s interactions and lifestyles worldwide have greatly benefited from the expansion of the internet gaming sector. However, the practice of minors purchasing and reselling online game certificates has prompted concerns about the accountability of corporate operators and potential legal repercussions. In the context of minors purchasing online game vouchers, this study investigates the responsibilities of commercial actors and the legal implications. This research methodology uses a normative legal approach to gather data from the literature, relevant judicial judgments, statutes, and regulations. This analysis aims to comprehend corporate actors' accountability, legal ramifications, and parents' function in this type of transaction. The findings demonstrated that business actors who offer online game vouchers have a duty to uphold the legitimacy of transactions. Businesses have a responsibility to make sure that such transactions adhere to ethical and legal standards, even though many laws forbid minors from engaging in transactions without their parent's permission. The legal ramifications of minors purchasing and selling online game vouchers may include possible violations of consumer rights, the protection of personal data, and provisions of contracts that may be void owing to age restrictions. Monitoring and limiting their children's access to these kinds of transactions is a crucial responsibility for parents. Collaboration between commercial actors, the government, and parents is required to maintain the integrity and protection of children in online game voucher purchasing and selling operations.

Abstract

This research examines the regulation of indigenous peoples' rights within Indonesia's national legal framework and identifies gaps between sustainable development aspirations and the implementation of existing regulations. A normative juridical method is applied to analyse legal documents, as well as assess the integration of customary law in the context of national legal pluralism. Results show that while there is constitutional recognition of indigenous peoples' rights, there are inconsistencies in actual implementation, particularly in support of sustainable economic goals. It was also found that indigenous economic development initiatives are often hampered by inadequate infrastructure and access to technology. Education relevant to indigenous needs and wider market access for indigenous products need improvement. Indigenous participation in policy formation and social protection still needs to be strengthened. In conclusion, legal reforms are needed that include improved frameworks to protect and develop the rights of indigenous peoples and ensure sustainable development goals in national development). Abstrak Penelitian ini mengkaji regulasi hak-hak masyarakat adat dalam kerangka hukum nasional Indonesia dan mengidentifikasi kesenjangan antara aspirasi pembangunan berkelanjutan dan implementasi regulasi yang ada. Metode yuridis normatif diterapkan untuk menganalisis dokumen hukum, serta menilai integrasi hukum adat dalam konteks pluralisme hukum nasional. Hasil penelitian menunjukkan bahwa meskipun ada pengakuan konstitusional atas hak-hak masyarakat adat, terdapat inkonsistensi dalam implementasi sebenarnya, terutama dalam mendukung tujuan ekonomi berkelanjutan. Ditemukan juga bahwa inisiatif pembangunan ekonomi masyarakat adat sering terhambat oleh infrastruktur yang tidak memadai dan akses terhadap teknologi yang terbatas. Pendidikan yang relevan dengan kebutuhan masyarakat adat dan akses pasar yang lebih luas untuk produk-produk adat perlu ditingkatkan. Partisipasi masyarakat adat dalam pembentukan kebijakan dan perlindungan sosial masih perlu diperkuat. Kesimpulannya, diperlukan reformasi hukum yang mencakup kerangka kerja yang lebih baik untuk melindungi dan mengembangkan hak-hak masyarakat adat serta memastikan tujuan pembangunan berkelanjutan dalam pembangunan nasional.

Abstract

This paper discusses the legal advantages of using blockchain technology for notary protocol archives in Indonesia. This research is normative legal research. It uses primary and secondary legal materials to analyze the blockchain technology for notary protocol archives. With the development of information technology, notary services are inevitably shifting to electronic services, known as cyber notaries. The Notary Protocol is considered a state document and must be treated as such, stored, and kept authentic according to Law of Republic of Indonesia Number 30 of 2004 concerning Notary. Even if the notary who owns the protocol is on leave or dies, the protocol is categorized as a State Archive and is subject to Law of Republic of Indonesia Number 43 of 2009 concerning Archives. Blockchain technology offers a decentralized way of digital archiving.

Abstract

Every person experiences disagreements, conflicts, issues, and confrontations in their lifetime. Nobody wants to get into a disagreement with someone else. Each business actor, particularly in economic activities, should always be prepared for the possibility of disagreements that may arise at any point in the future. Here, the business actor will select the form of dispute resolution that best fits their requirements. This study employed a normative juridical research methodology that combines a doctrinal and statutory regulation approach. This study concludes that arbitration is a non-litigation dispute settlement mechanism. With its many benefits, arbitration plays a big part in settling business conflicts.

Abstract

Terbatasnya lahan di Indonesia telah menyebabkan pengembang properti berbondong-bondong membangun sistem perumahan secara vertikal atau bertingkat. Kondotel lahir dari konsep penggabungan antara kondominium dan hotel. Status kepemilikan unit kondotel secara hukum berkaitan dengan bentuk perlindungan hukum yang dapat diterapkan terhadap pemilik unit kondotel dalam kasus wanprestasi oleh pengembang. Metode penelitian yang digunakan dalam penelitian normatif ini adalah pendekatan perundang-undangan, doktrin dan kasus. Penelitian ini menyimpulkan bahwa mekanisme penyelenggaraaan kondotel serta dasar hukum status kepemilikan kondotel yang mengacu pada Undang-Undang Nomor 20 Tahun 2011 tentang Rumah Susun memberikan bukti alas hak atas kepemilikan unit kondotel pada pemilik kondotel berupa Sertifikat Hak Milik atas Satuan Rumah Susun. Dalam kaitannya dengan kasus wanprestasi oleh pengembang maka pemilik kondotel sekaligus konsumen memiliki hak untuk menuntut ganti rugi atas kerugian yang dideritanya pada pengembang. Konsumen yang telah melaksanakan asas iktikad baik (good faith) dan penuh tanggung jawab berhak memperoleh perlindungan hukum. Oleh sebab itu, penyelenggaraan kondotel kedepannya memerlukan aturan baru yang secara khusus mengatur mengenai mekanisme penyelenggaraan kondotel.The limited land condition in Indonesia has caused property developers build vertical or multi-storey housing systems. Condotel was born from the concept of merging between condominiums and hotels. The legal status of the condotel unit ownership relates to the form of legal protection that can be applied to the owner of the condotel unit in the case of default by the developer. The research method used in this normative research is the approach to legislation, doctrine and cases. This study concludes that the condotel management mechanism and the legal basis for the condotel ownership status which refers to Law Number 20 of 2011 concerning Flats provide evidence of the right to ownership of the condotel unit to the condotel owner in the form of a Certificate of Ownership of the Flat Unit. In relation to the case of default by the developer, the owner of the condotel as well as the consumer has the right to claim compensation for the losses suffered by the developer. Consumers who have implemented the principle of good faith and are full of responsibility are entitled to legal protection. Therefore, future condotel operations require new rules that specifically regulate the condotel operation mechanism.

Abstract

Human rights are inherent in human dignity and are essential for the protection of individuals and society. The Indonesian government has established human rights rules under the Universal Declaration of Human Rights, but human rights violations continue, particularly in the context of international human trafficking. The Indonesian Human Trafficking Crime Task Force has received 757 reports, with victims coerced into working as child laborers, commercial sex workers, illegal immigrants, and ship crew members. The Indonesian government regulates migrant workers through Law 18/2017, but many are mistreated and exploited by foreign employers. This research uses juridical-normative legal research to examine literature, ideas, and laws to propose solutions. It employs conceptual and statutory approaches. Through this research, it is found that to strengthen migrant worker protection, governments must collaborate, tighten regulations, offer guidance, and establish efficient channels for handling grievances. The International Convention on the Protection of the Rights of Migrant Workers and Their Families is crucial for ensuring the rights and protection of migrant workers, but its implementation faces challenges.

Abstract

Researches asses problems related to the role of BPOM in providing service to ensure all products that have and haven't been released to public are safe to consume. BPOM have those products gone through several phases again and again, both before release (pre-market) and after release (post-arket), to ensure that those products are safe to consume. BPOM must also work together with state officials and people in general to speed up the process of detecting illegal products. If such products, which has dangerous effects on consumer's health, are found, BPOM must immediately take a decisive action by removing release permit, withdrawing, reassess, destroying the products, and invoking the penal law if needed. To provide maximum protection for consumers, BPOM must always be on alert to oversee products that have and haven't been released in ensuring that they are safe to consume. In conclusion, BPOM must always give an information update for any products that have been released to public
