Abstract

Laws are a fundamental component of a state, providing protection and ensuring that every person has the opportunity to receive medical treatment from qualified medical professionals. In the medical field, every action carries the potential for conflict, particularly between medical professionals and patients. When patients experience pain, disability, death, or other adverse outcomes, medical professionals may be accused of malpractice. It is important to recognize that there is always some level of risk involved in any medical procedure, but many patients do not fully understand the difference between malpractice and medical risk, leading to frequent misunderstandings. Malpractice occurs when medical professionals act either intentionally or negligently, which can result in the application of penal laws. In contrast, losses caused by inherent medical risks are not subject to such laws. The actions of doctors and medical professionals are regulated by the Indonesian Criminal Code, Indonesian Civil Code, and the Doctor's Code of Ethics. In conclusion, malpractice involves either intentional wrongdoing or negligence by medical professionals in the provision of medical services, and it is crucial to take steps to prevent such occurrences

Abstract

This research is to address human trafficking in Myanmar is a deeply councerning issue. The situation is exacerbated by the ongoing conflict and the lack of effective governance in many areas. Human trafficking is a serious transnational crime threatening global security, particularly in Southeast Asia. Economic factors like poverty and job scarcity make many individuals vulnerable to exploitation. Indonesia, as a major labor supplier, often serves as a source, transit, and destination for human trafficking. ASEAN has implemented measures like the ASEAN Plan of Action Against Trafficking in Persons, but challenges remain due to legal disparities among member states. Indonesia's laws, including the Anti-Trafficking Law, provide a framework to combat this crime, yet improvements in enforcement and victim support are needed. This is a dogmatic normative juridical method, which involves exploration, examines, and explanation of legal doctrines and rules to address the legal issues.T he research concludes that regional and international cooperation is vital, including information sharing and law enforcement collaboration. ASEAN should consider revising the principle of non-intervention and establishing a regional human rights court. Firm actions, such as economic sanctions, may be needed against those involved in trafficking, including Myanmar's military junta. Effective law enforcement and cooperation are essential for ASEAN members to collectively address human trafficking, ensuring security and legal certainty for all.

Abstract

Consumer protection law plays a crucial role in safeguarding the rights and interests of consumers in various sectors by ensuring fair trade practices, product safety, preventing fraud, and building trust between consumers and businesses. This research aims to analyse legal liability in the context of consumer protection against illegal gold circulation. This research uses a normative-dogmatic juridical research method. The results show that there is a significant violation of consumers' right to correct and accurate information, which affects their purchasing and investment decisions. The research suggests the need for greater transparency and the application of stricter sanctions to prevent similar incidents in the future. The theoretical implications of this research strengthen the understanding of the application of consumer protection law in real practice, while its practical implications emphasise the importance of industry compliance with legal standards to maintain consumer confidence and market integrity.

Abstract

Penelitian ini mengevaluasi tantangan yang dihadapi oleh Badan Pengawas Obat dan Makanan (BPOM) dalam memastikan keamanan produk sebelum dan sesudah beredar di pasar. BPOM bertanggung jawab untuk melakukan evaluasi yang menyeluruh dan berulang terhadap produk guna memastikan keamanannya bagi konsumsi masyarakat. Tanggung jawab ini tidak hanya terbatas pada tahap persetujuan awal, tetapi juga mencakup pengawasan pascapasar untuk mendeteksi dan menangani risiko yang ditimbulkan oleh produk yang tidak aman atau ilegal. Dalam menjalankan mandatnya, BPOM bekerja sama dengan instansi pemerintah serta melibatkan masyarakat guna mempercepat proses deteksi dan penarikan produk bermasalah. Apabila ditemukan produk yang berisiko tinggi terhadap kesehatan, BPOM wajib mengambil tindakan tegas, seperti mencabut izin edar, menarik produk dari peredaran, meninjau ulang keamanannya, memusnahkan produk, dan menerapkan sanksi hukum yang berlaku. Perlindungan konsumen yang efektif menuntut BPOM untuk senantiasa waspada dalam mengawasi produk yang sudah maupun belum beredar. Selain itu, BPOM juga memiliki kewajiban untuk secara berkala memberikan informasi terkini kepada publik mengenai status keamanan produk demi meningkatkan transparansi dan kepercayaan konsumen. Penelitian ini menyimpulkan bahwa BPOM harus secara konsisten melaksanakan pengawasan pra-pasar dan pascapasar untuk memastikan bahwa bahan yang digunakan sesuai dengan yang terdaftar, guna menjaga kepercayaan konsumen dan mencegah kelalaian pengawasan.

Abstract

Kekerasan seksual, baik dalam bentuk verbal, nonfisik, fisik, maupun digital, dapat berdampak serius pada kesehatan penyintas, termasuk aspek nutrisi, fungsi otak, dan keseimbangan mental. Oleh karena itu, mekanisme penyusunan simpulan dan rekomendasi sanksi harus berorientasi pada perlindungan semua pihak yang terlibat dan berbasis keadilan serta transparansi. Prinsip Utama dalam Penyusunan Simpulan dan Rekomendasi Sanksi memberikan ruang aman bagi penyintas untuk berbicara tanpa rasa takut akan disalahkan atau diragukan, menyusun proses investigasi dan rekomendasi sanksi dengan mempertimbangkan dampak psikologis terhadap penyintas. Setiap keputusan harus didasarkan pada bukti yang kuat dan valid, bukan asumsi atau bias dan Tidak hanya melindungi penyintas, tetapi juga memastikan hak terlapor untuk mendapatkan proses yang transparan dan adil.

Abstract

This research aims to conduct a juridical analysis of cases of circulation of illegal cosmetic products. The method used is normative-dogmatic juridical research, which focuses on relevant legal doctrines and principles. The approach used is a conceptual approach and a statutory approach, with primary legal sources including the Health Law, BPOM Regulations, the Criminal Code (KUHP), and the Criminal Procedure Code (KUHAP). Secondary legal sources include journals, books, and other references that support the analysis. The results show that the distribution of illegal cosmetic products that do not meet safety and quality standards, as in the case of the defendant Megawati binti Rahmat alias Mega in verdict number 39/Pid.Sus/2020/PN Slr, is a serious violation of health law and consumer protection in Indonesia. Based on the principle of liability based on the element of fault, the defendant can be held legally responsible because it is proven that she distributed cosmetics without a distribution permit containing hazardous substances such as mercury. The Panel of Judges considered that the defendant's actions fulfilled the elements of unlawful acts in accordance with Article 1365 of the Civil Code and Article 196 of Law of the Republic of Indonesia Number 36 of 2009 concerning Health. The implications of this research emphasize the importance of strict law enforcement and the application of the principle of responsibility to protect public health from dangerous cosmetic products.

Abstract

In Indonesia, a foreign arbitral award refers to a decision issued by an arbitration institution or arbitrator outside the country or recognized as such under Indonesian law. This classification reflects Indonesia’s adherence to the principle of territoriality in distinguishing arbitration awards as "international." However, enforcement remains contentious due to courts' broad interpretation of public policy under Article 66(c) of Law No. 30 of 1999. Despite Constitutional Court Decision No. 100/PUU-XXII/2024, the lack of a clear definition of public policy persists, leaving courts to determine its scope on a case-by-case basis. Until further regulations provide clarity, Article 66(c) will remain ambiguous and continue to be a basis for challenging foreign awards. A comparison with Singapore highlights two key findings. First, Indonesia applies a broad and inconsistent interpretation of public policy, while Singapore’s approach is narrower and more predictable. Second, Indonesian courts lack uniformity, as shown in three patterns: (1) awards are rejected for allegedly breaching sovereignty by restricting access to local courts; (2) awards are annulled for contravening Indonesian laws; and (3) awards are refused for endangering national interests. Rather than redefining international arbitration awards, Indonesia needs clearer guidelines and consistent application of public policy to enhance investor confidence and its global arbitration competitiveness.

Abstract

The effectiveness of anti-corruption law enforcement in Indonesia is facing a severe legitimacy crisis. This condition is characterized by a paradox between a robust legal framework on paper and its inadequate implementation in practice, thereby eroding public trust. This research aims to critically analyze the central role of judges in determining this effectiveness, with an analytical focus on the problematic interpretation of legal norms and the systemic challenges that impede judicial performance. Through a normative legal approach fortified by a case study, this research employs qualitative content analysis to dissect the legal reasoning in two key 2024 decisions from the Corruption Crimes Court. The findings reveal a diametrically different legal treatment of defendants. On one hand, the court was capable of convicting an individual defendant (a rogue judge) through a procedural application of the law. On the other hand, the court acquitted five large corporations of all legal charges in a corruption case that resulted in significant state economic losses. This acquittal was based on the legalistic argument that the proven act did not constitute a criminal offense. This dualism confirms that law enforcement effectiveness remains sporadic, undermined by a disparity in the professional capacity of judges to interpret the element of “unlawful act,” particularly in complex corporate crimes. It is concluded that without systemic judicial reform to standardize legal interpretation and strengthen accountability, anti-corruption law enforcement will remain blunted when confronting powerful economic actors.

Abstract

This research examines the tension between substantive justice and legal certainty within the Indonesian criminal justice system, which arises from the legal ambiguity surrounding the Justice Collaborator. The case study focuses on the Justice Collaborator verdict in the premeditated murder case involving Irjen FS. Utilizing a normative juridical research method through statute, case, and conceptual approaches, this study aims to analyze how the legal vacuum regarding the Justice Collaborator in the Penal Code is addressed through judicial adaptation. The findings indicate that the Panel of Judges constructed a “parallel penal track” to grant a reward to Bharada E as the Justice Collaborator. This track refers to sectoral legal instruments such as Law Number 13 of 2006 and Supreme Court Circular Number 4 of 2011. Although this practice successfully realized substantive justice, it inherently creates a systemic implication in the form of tension between judicial discretion and the principle of legal certainty, a pillar of the civil law system. It is concluded that the absence of a codified norm for the Justice Collaborator potentially threatens the consistency and predictability of criminal law, which, if not promptly addressed through reform, could risk the systemic delegitimization of the criminal justice system in the future. Therefore, this research recommends the urgent need for a comprehensive codification of the Justice Collaborator doctrine into the Penal Code and Law Number 8 of 1981 to align the needs of law enforcement with the maintenance of the principle of legality.

Abstract

Conflicts over inherited company shares underscore ongoing legal uncertainties and highlight the need for a thorough legal review. The inheritance of shares in a Limited Liability Company (PT) is classified as a transfer of rights by operation of law (rechtsverkrijging onder algemene titel) as stipulated in the Indonesian Civil Code (KUHPerdata) and Law Number 40 of 2007 concerning Limited Liability Companies (Company Law). In principle, company shares are inheritable assets, and heirs have the right to receive them in accordance with inheritance laws. However, in practice, legal issues frequently arise when other shareholders object to heirs entering as new shareholders. This matter becomes more intricate when the company’s Articles of Association include clauses that limit the transfer of shares to external parties without the approval of current shareholders. This study aims to investigate the legal framework and practical application of share inheritance in limited liability companies in Indonesia. It employs a normative legal research method with statutory and conceptual approaches, drawing on secondary legal materials. The findings demonstrate that the inheritance of shares necessitates balancing the civil rights of heirs with the company’s interest in preserving business stability and continuity. This study presents a legal harmonization framework that has not been extensively explored in prior research. The innovation lies in its suggestion to harmonize inheritance law and corporate law to address potential conflicts and improve legal protection for both heirs and corporate stakeholders.
