Abstract

The law enforcement framework will in general save essential standards as far as satisfying equity, exclusively because of reasons of satisfying legitimate sureness. Victims in a crime, in the National Legal System, the position is not profitable. Because the victim, in the (Criminal) Judicial System, is only an accessory, not the main actor or just a witness. The type of research used by the author in compiling this research is normative legal research or library law research. It should be emphasized that restorative justice is fundamentally a concept, both about justice and due process, not a theory. Because it is the basis for the development of the judiciary, restorative justice is referred to as the philosophy of justice. So, it is possible to view restorative justice as a collection of legal procedures that primarily seek to repair (recover) the losses suffered by crime victims. In the science of criminal law, justice must try to restore the situation to how it was before the crime was committed. The situation changes when someone breaks the law. So that's where the role of law is to protect the rights of every victim of crime. Helpful equity additionally accentuates common liberties and the need to perceive the impacts of social unfairness and in basic ways review them, as opposed to just giving the culprits formal or lawful equity and casualties not getting any equity. Supportive equity likewise looks to reestablish casualties' security, individual regard, respect, and all the more significantly, a feeling of control. The helpful equity framework can be applied in the event that the lawful culture in a nation requires its execution for a specific case.

Abstract

Bilyet Giro is part of banking services in Indonesia carried out by conventional commercial banks. Conventional commercial banks are closely related to people's economic activities. The use of Bilyet Giro as a means of payment began to be felt by businesses, so the introduction and use of Bilyet Giro is a sign that the public knows the important role of Bilyet Giro as a means of giral payment. For issuers who issue empty bilyet giro will receive administrative sanctions in the form of inclusion of the customer's name into the Blank Giro Withdrawal Black List, and the customer is required to return the remaining unused bilyet giro blanks. The name of the customer listed in the blacklist expires, and then can be accepted again as a bank customer. However, if the issuer of an empty bilyet giro has an indication and it should be suspected that after the investigation process it turns out that there is an element of fraud, criminal sanctions can be imposed as stipulated in the Criminal Code. Guarantee of legal certainty in the application of the principle stated in Article 1 paragraph (1) of the Criminal Code, namely that a person can only be punished for his actions, if criminal sanctions for those actions have been regulated in advance in the Law. No matter how evil an act is, it will not be punishable if there is no law prohibiting it and mentions its sanctions. (Article 1 paragraph (1) of the Criminal Code).

Abstract

Research on the legal strength of land tenure statements (SPPT) as a basis for land rights in East Kutai Regency, East Kalimantan, aims to find out the position of the SPPT as proof of land rights in the land law system and the legal strength of a land tenure statement as proof of ownership rights. Above ground. This research was carried out because many landowners in East Kutai still rely on the legality of their land using SPPT as proof of land ownership. They assume that having the SPPT is strong enough as proof of ownership of land rights. This can be seen in the number of land cases that enter the judicial process where the SPPT is still recognized. Meanwhile, based on the negative land law system with a positive tendency adopted by Indonesia, the strongest evidence for land ownership rights is only a certificate issued by the National Land Agency, and even then it still has the potential to be sued as long as the truth can be proven. In this research, normative and descriptive juridical research methods are used to answer legal issues by describing, analyzing, assessing, and explaining appropriately and analyzing applicable laws and regulations as well as various opinions of legal experts, with the aim of answering the problems raised.

Abstract

Padatnya arus lalu lintas serta angkutan jalan diperlukan perangkat hukum guna menciptakan ketertiban lalu lintas dan angkutan jalan. Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan merupakan sarana hukum dalam kehidupan bernegara yang mengatur masyarakat sebagai subyek hukum agar pengendara sepeda motor tidak melakukan pelanggaran lalu lintas, seperti tidak memiliki SIM, tidak memiliki STNK, penyerobotan lampu lalu lintas, memanfaatkan jalan yang tidak sesuai peruntukannya, serta mengendarai secara melawan arah. Berdasarkan hal tersebut, penulis melakukan penelitian mengenai peran Polres Jakarta Pusat dalam meningkatkan kesadaran hukum bagi pengendara sepeda motor beserta kendala-kendalanya. Metode pendekatan yang digunakan dalam penelitian ini bersifat yuridis normatif dan empiris. Hasil penelitian menunjukkan bahwa peran polisi lalu lintas terkait dengan penerapan Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan di wilayah hukum Polres Metro Jakarta Pusat, antara lain melaksanakan fungsi represif (pengawasan) dan fungsi tindakan hukum terhadap pengendara sepeda motor. Satuan Lalu Lintas Polres Metro Jakarta Pusat, sebagai penegak hukum dalam melakukan tindakan hukum preventif yakni dengan memberikan pemahaman mengenai Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan serta perundang-undangan lainnya. Adapun kendalanya adalah kurangnya kesadaran hukum masyarakat yang cenderung secara sengaja (human behavior) melakukan pelanggaran lalu lintas, rambu-rambu lalu lintas yang kurang memadai, serta perilaku segelintir oknum penegak hukum lalu lintas yang moralnya tidak baik. Kata Kunci : Peran Polisi Lalu Lintas Dalam Meningkatkan Kesadaran Hukum Abstract: Dense traffic flow and road transport required legal tools to create traffic order and road transport. Law Number 22 Year 2009 on Road Traffic and Transportation is a legal means in the life of a state that governs the public as a legal subject so that motorcyclists do not commit traffic violations, such as not having a driver's license, not having vehicle registration, traffic light accumulation, roads that do not fit the designation, as well as riding in opposite directions. Based on this, the authors conducted research on the role of Central Jakarta Police in raising legal awareness for motorcyclists along with its constraints. The method of approach used in this research is juridical normative and empirical. The result of the research shows that the role of traffic police is related to the implementation of Law Number 22 Year 2009 on Traffic and Road Transport in Central Jakarta Police, among other things, to carry out the function of repressive and legal action function against motorcyclists. Central Jakarta Traffic Police Traffic Unit, as a law enforcer in conducting preventive legal action by providing an understanding of Law Number 22 Year 2009 on Traffic and Road Transport as well as other legislation. The obstacles are the lack of awareness of public law that tend to intentionally (human behavior) to traffic violations, inadequate traffic signs, and the behavior of a handful of law enforcement officers whose morale is not good. Abstract

The urgency of this research lies in the pressing need to rectify the antinomy of norms between the protection of customary land rights (hak ulayat) and the neoliberal investment regime following the enactment of the Job Creation Law, which has triggered structural agrarian conflicts. This study aims to deconstruct the distorted interpretation of the State Right of Control (Hak Menguasai Negara), which currently legitimizes state-facilitated land grabbing practices through the Land Bank instrument and licensing bureaucracy. Through critical analysis, this study seeks to formulate legal corrections to realign the direction of agrarian politics with the constitutional mandate of social justice. This research employs a normative legal research method focused on examining the antinomy of norms and dogmatic conflicts between the protection regime for customary law communities and the investment acceleration regime within the national agrarian legal system. The study finds that post-Job Creation Law, the agrarian legal paradigm has shifted drastically toward neoliberalism, distorting the state's function into a commercial agent through the Land Bank. Its implementing regulations operate as a legal ecosystem that facilitates the systematic dispossession of people's land and nullifies public participation for the sake of investment. This reduces the philosophy of land to merely a capital asset, perpetuates structural conflicts, and manifestly betrays the constitutional mandate.

Abstract

The increase in land certificate fraud cases highlights the shortcomings of Indonesia's traditional land management system. Because of this circumstance, the government has decided to digitize land through the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) in an attempt to establish a system that is secure, effective, and transparent. The purpose of this study is to examine how land digitization functions in preventing land certificate forgery and assess its effectiveness and implementation challenges from a legal and technical perspective. Law Number 5 of 1960 concerning Basic Agrarian Regulations (UUPA), Government Regulation Number 18 of 2021, and Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency Number 1 of 2021 concerning Electronic Certificates are just a few of the laws and regulations that are examined using a normative juridical approach. According to the study's findings, the use of electronic certificates, or "e-certificates," can minimize the risk of forgery through a digital verification system, electronic signatures, and cybersecurity-based data storage. However, its effectiveness is still hampered by technological infrastructure, human resource capacity, and issues of personal data protection. Therefore, optimizing land digitization must be accompanied by regulatory harmonization, improved cybersecurity, and strengthening the public's digital legal literacy. These steps are a crucial foundation for realizing an accountable and equitable land system in the digital age.

Abstract

The development of information technology has increased the strategic value of domain names as digital identities and intellectual property assets. However, in practice, the phenomenon of cybersquatting has emerged, namely the registration of domain names by unauthorized parties to control or profit from similarities with well-known trademarks. This phenomenon has given rise to legal conflicts between brand owners and domain name holders, while national regulations have not explicitly regulated the dispute resolution mechanism. This article aims to analyze the application of the principle of lex specialis derogat legi generali in resolving cybersquatting disputes through national arbitration institutions, specifically the Indonesian Internet Domain Name Manager (PANDI). This research uses a normative juridical method with a statutory approach and literature study. The results of the discussion indicate that Law No. 20 of 2016 concerning Trademarks and Geographical Indications should be positioned as lex specialis compared to Law No. 11 of 2008 in conjunction with Law No. 19 of 2016 concerning Information and Electronic Transactions (ITE), considering that the object of the dispute is closely related to the protection of intellectual property rights. Furthermore, PANDI's domain arbitration rulings have not yet received full legal recognition in the national judicial system, thus reducing the effectiveness of their resolution. The establishment of specific regulations governing domain names and their dispute resolution is necessary to provide legal certainty and comprehensive protection for brand owners in the digital realm
