Abstract

Pelaksanaan kontrak dapat menimbulkan sejumlah masalah hukum, salah satunya adalah pengakhiran kontrak secara sepihak Ada berbagai upaya perbaikan atas pelanggaran kontrak, perbaikan yang tepat dalam suatu kasus tergantung pada materi subyek kontrak dan sifat pelanggarannya di antaranya tuntutan ganti rugi dengan cara memperoleh kembali sejumlah uang, atau tuntutan atas dasar Quantum Meruit. Adapun permasalahan yang diangkat dalam penelitian ini adalah apa perbedaan klaim Quantum Meruit dengan klaim ganti rugi pada umumnya? Dan kapan klaim Quantum Meruit dapat menjadi pilihan yang tepat sebagai perbaikan atas pelanggaran kontrak? Tujuan dari penelitian ini adalah mengetahui apa yang membedakan antara klaim Quantum Meruit dengan klaim ganti rugi pada umumnya dan mengetahui kapan klaim Quantum Meruit dapat menjadi pilihan yang tepat sebagai perbaikan atas pelanggaran kontrak. Dan bermanfaat untuk mempermudah menyelesaikan sengketa hukum yang timbul dari kontrak dan mempermudah dalam hal penentuan kompensasi. Metode Penelitian yang digunakan adalah penelitian hukum normatif. Dikatakan Quantum Meruit apabila sebanyak yang telah diperoleh Quantum Meruit sebagai sebuah konsep pemulihan berarti 'sebanyak yang layak' dan mengukur pemulihan berdasarkan kontrak tersirat untuk membayar kompensasi sesuai dengan nilai yang wajar dari layanan yang diberikan semata-mata untuk mengembalikan jumlah yang menjadi haknya. Sementara Ganti rugi adalah cara pemenuhan atau kompensasi hak oleh pengadilan yang diberikan kepada satu pihak yang menderita kerugian oleh pihak lain yang melakukan kelalaian atau kesalahan sehingga menyebabkan kerugian tersebut. Quantum Meruit dapat menjadi pilihan yang tepat pada saat terdapat sebuah kontrak baik itu secara tersurat maupun tersirat mengenai sebuah pemberian jasa tetapi di dalamnya tidak ada klausul persetujuan tentang pemberian upah, situasi di mana ada perbuatan kedua belah pihak terdapat sebuah kontrak baru tersirat yang menggantikan kontrak asli salah satu pihak yang berkontrak memilih memutus kontrak karena pelanggaran yang dilakukan oleh pihak lain demikian juga apabila salah satu pihak menghalangi pihak lain dari melaksanakan kewajiban-kewajibannya berdasarkan kontrak.

Abstract

Fenomena mengenai perselingkuhan semakin marak akhir-akhir ini. Hampir setiap hari media cetak maupun elektronik sering menampilkan berita hangat mengenai kasus perselingkuhan. Perselingkuhan dalam pernikahan bersifat merusak dan dapat menimbulkan akibat negatif. Akibat negatif yang ditimbulkan dapat terjadi pada pelaku perselingkuhan maupun pasangan pelaku perselingkuhan. Selingkuh adalah perbuatan zina karena intinya adalah hubungan seksual secara illegal antara dua insan yang berbeda jenis tanpa ikatan perkawinan. Karena itu tidak ada hukum yang mentolerir perbuatan tersebut, masyarakat pun mencelanya, apalagi norma agama (Islam) tidak membenarkannya. Dalam KUHP Indonesia dijelaskan bahwa yang dinamakan zina adalah sebagaimana disebutkan di dalam pasal 284 KUHP sebagai sebuah tindak pidana dengan hukuman penjara selama-lamanya sembilan bulan, dengan ketentuan sebagai berikut: a. Laki-laki yang beristeri yang berzina sedang diketahuinya bahwa pasal 27 KUHP berlaku baginya. b. Perempuan yang bersuami yang berzina.

Abstract

Mutual funds are a forum for fund owners/investors to invest their funds in securities portfolios by the Investment Manager, in other words, the investment manager has an important role in managing investors' funds. Moreover, the funds managed by the investment manager are very large, however, the regulation regarding this matter is deemed inadequate so it is not uncommon for investment managers to neglect by ignoring the rights of investors which cause investors to suffer losses and are not protected. The issues that will be discussed are how the legal protection provided to mutual fund investors and the responsibilities of investment managers who default on losses suffered by investors. Based on these issues, the purpose of this research is to find out the legal protection for mutual fund investors who suffer losses due to errors from investment managers. This research uses an empirical legal research method by using the data collection techniques through interviews. From the data obtained, it shows a form of protection that given provided to investors is in the form of opened information. The investment manager will be responsible for the losses suffered by the investors, but is not more than the fee given by investors to the investment manager. If the investors’ report is not responded to, or Bapepam’s action against the investment manager which is proven to be inadequate for investors, then investors can file a lawsuit against the law through the district court. Investors must have sufficient evidences to prove the investment manager’s negligence which resulted in losses.

Abstract

The rise of pollution and environmental destruction due to human actions in the environment utilizing and even intentionally polluting or destroying the environment in people's lives. When a default occurs, companies as legal subjects are responsible for paying costs and interest in addition to compensation. They are also responsible for paying compensation if they conduct an illegal act.. The issue in this research How The Responsibility Of Compesation Charge In Environmental Pollution For Consolidated Actor Companies. The purpose of this study is to find out the form of responsibility of Compesation Charge in Environmental Pollution for Consolidated Actor Companies. The method used is Normative.The author's consideration of this issue leads to the conclusion that the special provisions of Article 122 of Law Number 40 of 2007 addressing Limited Liability Companies supersede the provisions of Article 87 paragraph (2), which are now general provisions. Therefore, Lex specialis derogat legi generali—the rule that special provisions take precedence over general laws—applies in this situation. As a result, the provisions of Article 122 of Law Number 40 of 2007 regarding Limited Liability Companies supersede those of Article 87 paragraph (2) of Law Number 32 of 2009 regarding Environmental Protection and Management.

Abstract

The Indonesian National Police obtains a mandate from laws tasked with maintaining security and order, protecting, serving, enforcing the law and protecting the public. One of these tasks is the prevention of theft with violence crimes by the Police Resort in the East OKU. In seeking answers to this problem, the author used empirical research methods, by conducting interviews with several parties, including the East OKU Police Resort and the perpetrators of violent crimes. The results of the study suggest that, first, the things that cause theft with violence crimes are caused by two factors, namely endogenous and exogenous factors, but the causative factors that often cause theft with violence crimes in the East OKU such as economic level, low education that causes unemployment, the environment, and lack of legal awareness, and supported by situations and conditions. The second is done by using penal and non-penal effort. Prevention with Penal efforts focuses more on the repressive nature, that is, actions carried out after the occurrence of crime. The study's findings revealed the effectiveness of criminal law and policy in preventing violent stealing.

Abstract

This study examines the characteristics of positive legal justice in Indonesia and the use of the concept of adab from the Islamic worldview as an offer to reconstruct legal justice in Indonesia. This research is doctrinal research using inductive-deductive logic using library materials. The data was then analyzed using qualitative methods. The results showed that First, the characteristics of legal justice in Indonesia, which are based on the paradigm of legal positivism, show that the essence of the source of justice comes from written legal norms, namely the law that separates law and morals. In the end, the separation itself is a manifestation of the law of partial justice. Many legal justice ideas have been developed by several legal experts in Indonesia by making efforts to reconstruct positivist legal thought into the context of Indonesian legal thought that reflects the values of justice based on state philosophy and guidelines for the Preamble of the 1945 Constitution, "For the sake of justice based on the Divine The Almighty. Second, Civilized legal justice based on Adab values is then used as an offer to reconstruct the existing positive legal justice so that the new legal justice will be able to reflect all the virtues that come from the highest standards these are wisdom, courage, temperance, and justice. Legal justice as the result of the implementation of the law will have the essence of high virtue values and the requirements for correct knowledge, if implemented, will lead to fair conditions as reflected by Adab.

Abstract

Health is an essential part of societal well-being that must be pursued in line with Indonesia's aspirations as stated in the 1945 Constitution. This effort is carried out based on the principles of non-discrimination, participation, protection, and sustainability to develop human resources, enhance national competitiveness, and support national development. Written agreements in healthcare services are crucial to ensure optimal service delivery. This requires adequate healthcare facilities as the venue for implementing health efforts. In Indonesia, the agreement system follows an open principle that allows for the formation of agreements in accordance with existing laws or practices. The purpose of such agreements is to establish balanced cooperation and serve as a basis for resolving future issues. Through agreements, the involved parties are expected to uphold their promises, create clear legal relationships, and ensure protection and fairness for all.

Abstract

To create a standardised and compliant service, an Internal Regulation or Hospital by Laws is required, which becomes the operational basis for all medical personnel and hospital staff. This dedicaction is expected to strengthen governance, compliance, and service quality at RSUD Rupit in order to fulfil community expectations and standards set by the government optimally and sustainably. Using empirical research by combining qualitative, participatory, and analytical approaches, so that the review and revision of internal regulations of RSUD Rupit can be carried out systematically to produce better and more effective regulations. A review of the internal regulations (Hospital By Laws) at RSUD Rupit identified several aspects that need to be improved to enhance efficiency and quality of services. The proposed improvements include drafting and writing the content of the regulations. After the review, the team will revise and draft the regulations, and refine the draft based on input from the North Musi Rawas District Health Office, PERSI, and stakeholders. The final draft will be submitted to the hospital leadership and Board of Trustees for review and approval. After that, the regulation will be ratified by the regional head, giving legality and legitimacy to the Hospital By Laws

Abstract

There is a lack of adequate understanding regarding health service quality through the optimization of Standard Operating Procedures (SOP) at AR-ROYYAN Hospital, Ogan Ilir Regency. This service activity aims to enhance the hospital's understanding of improving health service quality by optimizing SOPs. A visual presentation using slides and supporting materials was employed to clarify the SOPs at AR-ROYYAN Hospital. This was followed by a Q&A session to facilitate direct interaction between speakers and participants, allowing for further clarification. Engaging small discussion groups stimulated the exchange of opinions and fostered a shared understanding. Additionally, brochures and pamphlets were distributed to help participants comprehend and disseminate the information within the community. This holistic approach is expected to yield a positive and sustainable impact. The Q&A session and discussions revealed that while AR-ROYYAN Hospital has established good SOPs, these procedures have not been specifically classified for each department
