Abstract

In positive law, completion of terrorism in Indonesia solved through Penal Policy/Policies of criminal law by issuing and publishing various legal products, a Substitute Regulation of Law (Perpu) No. 1 of 2002 regarding the eradication of criminal acts of terrorism, reinforced into Law Act No. 15 of 2003 the Government is also issuing Substitute Regulation of Law (Perpu) No. 2 of 2002 regarding the enactment of the Substitute Regulation of Law (Perpu) No. 1 in 2002 reinforced into Law Act No.16 of 2003 and Law Act No. 9 of 2013 regarding the prevention and eradication of criminal acts of Terrorism Financing, until forming the anti terror units from both the indonesian army forces, police or non governmental institutions. Police (Densus 88) as the main actor of law enforcement and disruption network of terror along with the Attorney General and justice system.

Abstract

This activity addressed waste problems in Tanjung Atap Barat Village, Ogan Ilir Regency. The community has tried to deal with it, but it has not been optimal. Another reason is to increase public awareness of waste management so it becomes a medium to improve the economy and create a society’s legal awareness. Thus, what is village regulations' role in waste management in Tanjung Atap Barat village? What steps can be taken so that the waste problem in Tanjung Atap Barat village becomes of economic value? By following the Regulation of Tanjung Atap Barat Village Number 003 of 2020 About the Management of Household Waste and the Surrounding Environment, the community improves waste management in the village and raises awareness of environmental issues. Village Regulation Number 003 of 2020 has a system consisting of 14 chapters and 37 articles. If it is examined more deeply, waste has the potential to affect household income. Therefore, improvement can start through its citizens, especially women and the younger generation. Every household is involved in managing at least its own waste, socialization, training, mentoring, and direct practice to increase public understanding and knowledge in handling waste into economic value. Especially in Tanjung Atap Barat village, it has started with placing trash cans in every house. Also, waste is segregated by its type: plastic, paper, and household waste.

Abstract

Marriage and divorce registration issues are specifically mentioned in Law Number 16 of 2019, which amends Law Number 1 of 1974 on marriage, however there remains ambiguity. How is the jurisdiction of religious courts on the matter of marriage and divorce registration following the publication of the Regulation of the Minister of Home Affairs of the Republic of Indonesia Number 108 of 2019? is the formulation of the problem in this study. Empirical legal research is the type of research that is conducted. Based on findings, research indicates that religious courts and religious affairs offices have the authority to prohibit marriage and divorce registration issues. Due to alleged uncertainty, its jurisdiction has been reduced since the Minister of Home Affairs of the Republic of Indonesia issued Regulation Number 108 of 2019. Religious courts perform judicial duties and provide rulings or decisions as their final output. While the power of the government is responsible for the administration of the marriage industry

Abstract

Pelaksanaan kontrak dapat menimbulkan sejumlah masalah hukum, salah satunya adalah pengakhiran kontrak secara sepihak Ada berbagai upaya perbaikan atas pelanggaran kontrak, perbaikan yang tepat dalam suatu kasus tergantung pada materi subyek kontrak dan sifat pelanggarannya di antaranya tuntutan ganti rugi dengan cara memperoleh kembali sejumlah uang, atau tuntutan atas dasar Quantum Meruit. Adapun permasalahan yang diangkat dalam penelitian ini adalah apa perbedaan klaim Quantum Meruit dengan klaim ganti rugi pada umumnya? Dan kapan klaim Quantum Meruit dapat menjadi pilihan yang tepat sebagai perbaikan atas pelanggaran kontrak? Tujuan dari penelitian ini adalah mengetahui apa yang membedakan antara klaim Quantum Meruit dengan klaim ganti rugi pada umumnya dan mengetahui kapan klaim Quantum Meruit dapat menjadi pilihan yang tepat sebagai perbaikan atas pelanggaran kontrak. Dan bermanfaat untuk mempermudah menyelesaikan sengketa hukum yang timbul dari kontrak dan mempermudah dalam hal penentuan kompensasi. Metode Penelitian yang digunakan adalah penelitian hukum normatif. Dikatakan Quantum Meruit apabila sebanyak yang telah diperoleh Quantum Meruit sebagai sebuah konsep pemulihan berarti 'sebanyak yang layak' dan mengukur pemulihan berdasarkan kontrak tersirat untuk membayar kompensasi sesuai dengan nilai yang wajar dari layanan yang diberikan semata-mata untuk mengembalikan jumlah yang menjadi haknya. Sementara Ganti rugi adalah cara pemenuhan atau kompensasi hak oleh pengadilan yang diberikan kepada satu pihak yang menderita kerugian oleh pihak lain yang melakukan kelalaian atau kesalahan sehingga menyebabkan kerugian tersebut. Quantum Meruit dapat menjadi pilihan yang tepat pada saat terdapat sebuah kontrak baik itu secara tersurat maupun tersirat mengenai sebuah pemberian jasa tetapi di dalamnya tidak ada klausul persetujuan tentang pemberian upah, situasi di mana ada perbuatan kedua belah pihak terdapat sebuah kontrak baru tersirat yang menggantikan kontrak asli salah satu pihak yang berkontrak memilih memutus kontrak karena pelanggaran yang dilakukan oleh pihak lain demikian juga apabila salah satu pihak menghalangi pihak lain dari melaksanakan kewajiban-kewajibannya berdasarkan kontrak.

Abstract

Law enforcement efforts must pay attention to the criminal offence of Obstruction of Justice, because it can have an impact on the law enforcement process itself. Thus, this research discusses how the regulation of the criminal offence of Obstruction of Justice in the legislation. The purpose of this research is to understand what actions are included in the category of Obstruction of Justiice. The type of research used is normative legal research. The research data used is secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials.  The results of the study suggest that in Law Number 1 Year 2023, the criminal offence of Obstruction of Justice is regulated in more detail in Chapter VI on Criminal Offences Against the Judicial Process, which is divided into three parts: Misdirection of the Judicial Process: Includes falsification of evidence, giving false testimony, and actions that interfere with the judicial process. The maximum sanction is six years imprisonment or a category V fine (Article 278), Disrupting and Obstructing the Judicial Process: Includes disrupting a trial, disobeying a court order, attacking the integrity of the authorities, and obstructing an investigation. The maximum sanction is seven years and six months' imprisonment or a category IV fine. (Articles 279-292), Destruction of Court Buildings, Courtrooms, and Court Equipment: This includes damaging the court building or court equipment which results in the court session not being able to continue. The maximum sanction is five years imprisonment. (Article 293) In addition, Law No. 1 of 2023 also covers the Protection of Witnesses and Victims from Article 294 to Article 299, to ensure safety and justice for witnesses and victims in the judicial process.

Abstract

The rise of pollution and environmental destruction due to human actions in the environment utilizing and even intentionally polluting or destroying the environment in people's lives. When a default occurs, companies as legal subjects are responsible for paying costs and interest in addition to compensation. They are also responsible for paying compensation if they conduct an illegal act.. The issue in this research How The Responsibility Of Compesation Charge In Environmental Pollution For Consolidated Actor Companies. The purpose of this study is to find out the form of responsibility of Compesation Charge in Environmental Pollution for Consolidated Actor Companies. The method used is Normative.The author's consideration of this issue leads to the conclusion that the special provisions of Article 122 of Law Number 40 of 2007 addressing Limited Liability Companies supersede the provisions of Article 87 paragraph (2), which are now general provisions. Therefore, Lex specialis derogat legi generali—the rule that special provisions take precedence over general laws—applies in this situation. As a result, the provisions of Article 122 of Law Number 40 of 2007 regarding Limited Liability Companies supersede those of Article 87 paragraph (2) of Law Number 32 of 2009 regarding Environmental Protection and Management.

Abstract

Desa adalah kesatuan masyarakat hukum yang memiliki batas wilayah yang berwenang untuk mengatur dan mengurus urusan pemerintahan, kepentingan masyarakat setempat berdasarkan prakarsa masyarakat, hak asal usul, dan/atau hak tradisional yang diakui dan dihormati dalam sistem pemerintahan Negara Kesatuan Republik Indonesia. Salah satu misi pemerintah pada saat ini yaitu untuk membangun daerah pedesaan yang dapat dicapai melalui sebuah pemberdayaan masyarakat dengan tujuan untuk meningkatkan produktivitas dan keanekaragaman usaha yanga ada, terpenuhinya sarana dan fasilitas untuk mendukung peningkatan ekonomi desa, membangun dan memperkuat institusi yang mendukung rantai produksi dan pemasaran, serta mengoptimalkan sumber daya manusia sebagai dasar pertumbuhan ekonomi desa Sementara perihal tata kelola organisasi pada pemerintahan desa, hal yang paling sering dibahas adalah bentuk akuntabilitas pengelolaan keuangan alokasi dana desa. Pengelolaan/penggunaan keuangan desa merupakan kegiatan yang penuh dengan risiko. Hal ini dikarenakan besarnya dana yang dikelola oleh desa. Risiko-risiko tersebut dapat disebabkan oleh lingkungan internal maupun eksteral pengelola keuangan itu sendiri. Maka langkah awal sangat perlu untuk dilakukan kajian untuk mengidentifikasi risiko-risiko tersebut dimana dengan melakukan Penerapan  manajemen  risiko dalam  pengelolaan  dana  desa  dapat meningkatkan  kinerja  pengelolaan dana desa, dan mengurangi resiko yang timbul. Oleh karena itu perlu diberikan pengetahuan dan wawasan kepada masyarakat tentang  pengetahuan tentang pengelolaan/penggunaan dana desa yang baik; tentang resiko-resiko apa saja yang dapat timbul dalam pengelolaan/penggunaan dan desa; Masyarakat dapat mengetahui dan belajar bagaimana cara memitigasi resiko-resiko yang timbul dari pengelolaan / penggunaan dana desa tersebut.

Abstract

The phenomenon of motorbike riding among minors is increasingly widespread both in cities and villages. Many teenagers under the age of 17 pass by on motorbikes every day. The reasons for riding a motorbike vary, they are influenced by internal and external factors of the rider. Internal factors that influence the child include self-motivation to be able to ride a motorbike, while external factors are influenced by friends who can generally ride motorbikes, the relatively far distance from home to school, and parents who have given permission to them to ride motorbikes. Various policies have been implemented to tackle the problem of underage motorbike riders. Several ways to overcome this problem include enforcing laws related to driving regulations, providing mobility and accessibility for all citizens in a safe and environmentally friendly manner, giving an appeal to parents to always guide and supervise their children in terms of driving restrictions and provide knowledge about traffic signs and the dangers of driving a vehicle on the road to children.
