Abstract

This study explores the concept of marbagi dos in relation to the changing inheritance practices of the Mandailing community, viewed through the lens of legal culture. Marbagi dos, which literally means equal in the Mandailing indigenous people, has traditionally had a very important social dimension and equality. The type of research methodology used in this study is qualitative with a descriptive approach. The research data was obtained through interview techniques and participatory observation. In-depth interviews will be carried out with traditional leaders, scholars, and community members who play a direct role in the inheritance process. Using a legal culture approach, this study analyzes how the changes in values in Mandailing society are influenced by Islam which has implications for changes in inheritance practices in Mandailing, as well as how the community balances customary traditions with modern equality demands. The results of the study show that this inheritance transformation is a reflection of the adaptation of the Mandailing people to social changes, while maintaining cultural values within the framework of customary law. The implications of this study suggest that customary law is dynamic and capable of adapting to Islamic law and state law, highlighting the need for synergy between these three legal systems in crafting more inclusive policies.

Abstract

Abstract

Purpose: This study explores various strategies that enable the integration of Pancasila values into the country's economic system, particularly in efforts to empower the people's economy and reduce dependence on significant capital. Study Design/Methodology/Approach: This study utilises library research to explore and integrate existing theoretical perspectives, both from classical and contemporary literature, with integrative and connective analysis across various literature so that it does not merely present separate theoretical perspectives. Findings: The Pancasila economy can serve as a national strategic plan to undermine the dominance of exploitative capitalism by introducing a new development paradigm based on social justice, economic sovereignty, and ecological sustainability. It can also function as a socio-economic engineering instrument that strengthens social cohesion, reinforces state legitimacy, and paves the way for Indonesia to emerge as a pioneer of alternative paradigms on the international stage. The economy can also provide creativity for other developing countries in regulating a more humanistic, inclusive, and equitable world economy. Originality/Value: The Pancasila economy not only strengthens the nation's independence and competitiveness through the management of resources that favour the people, the empowerment of MSMEs, and the fair redistribution of assets, but also presents a global alternative that challenges the paradigm of exploitative capitalism by placing social solidarity, cooperation, and ecological sustainability as the main foundations of economic development.

Abstract

Halal certification has become a major highlight on the global stage, especially in line with the rapid growth of the halal product market. This study aims to thoroughly review the concept of halal and explore its important implications in the social and economic spheres, as well as challenges and opportunities in halal certification. This study is a literature study conducted with a comprehensive literature analysis approach. This literature analysis includes the process of Investigation, data collection, and in-depth analysis of various literature sources that are relevant to the subject of study. The results of this study highlight that halal certification is a complex and diverse process with significant social and economic impacts. The different certification processes in other countries and organizations pose substantial challenges in global trade but also open up great opportunities in the halal product market. In the social dimension, halal certification plays an important role in maintaining Muslim communities' religious beliefs and values but also poses a risk of discrimination against non-Muslim communities in this economic sphere. The main challenges that need to be addressed include harmonizing global standards and preventing abuse in the halal certification process. Meanwhile, the economic opportunities associated with halal products remain large, particularly in line with the growing global demand.

Abstract

In the study of feminist hermeneutics, gender construction in Islamic law tries to bridge the gap between the dominant patriarchal norms in interpreting traditional Islamic law and modern society regarding gender equality for social justice. By exploring the classical literature and contemporary Islamic legal text, this study focuses on the problems of gender construction through the lens of feminist hermeneutics in Islamic law. The pattern in this feminist hermeneutic approach not only expands but also deepens the understanding of paradigmatic changes in gender construction in the framework of Islamic law. This perspective introduces a new idea for exploring gender construction within the legal framework. This approach challenges the dominant patriarchal interpretation of Islamic law, particularly women's roles and rights. This social change can be perceived in an inclusive view more responsive to gender issues.[ Dalam kajian lensa hermeneutika feminis, konstruksi gender dalam hukum Islam berupaya menjembatani kesenjangan antara norma-norma dominan patriarki dalam interpretasi hukum Islam tradisional dan tuntutan masyarakat modern dalam kesetaraan gender demi keadilan sosial.

Abstract

This study aims to identify and analyze the challenges and opportunities in scientific research on the thoughts of both living and deceased figures, utilizing the framework of oral history theory and the theory of maslahah. Through a qualitative research approach based on literature studies, this research demonstrates that when studying living figures, researchers benefit from direct access through in-depth interviews, allowing for the collection of rich and contextual primary data. However, the primary challenge lies in the potential bias of respondents, which can affect the validity of the research findings. Conversely, research on deceased figures offers data stability from unchanging secondary sources, though the limitation of access to direct clarification poses a significant challenge. In light of this, the analysis of ral history theory highlights the importance of direct interviews in understanding the experiences of living subjects, while maslahah theory provides ethical guidance in considering the social impact and general welfare resulting from this research. The analysis based on these two theories indicates that scientific research on figures, whether living or deceased, requires a structured and ethical approach to produce meaningful contributions to the development of knowledge and society. This study suggests the need for special attention to the selection of methodology and the application of rigorous research ethics to ensure the validity and utility of research outcomes, and recommends further support for more in-depth research in this context. Consequently, this research not only enriches the academic literature but also provides critical insights into the role of figures in history and thought, as well as their relevance to contemporary challenges and needs.

Abstract

The digital revolution has fundamentally reshaped the way consumers interact with the marketplace. The emergence of e-commerce platforms has accelerated economic transactions while simultaneously introducing complex legal challenges, particularly regarding consumer protection. This study critically examines the effectiveness of consumer protection mechanisms in the digital era, with a focus on e-commerce practices in both domestic and cross-border contexts. Using a normative, juridical, and qualitative approach, the research examines the implementation of consumer protection principles in online transactions, with a specific focus on transparency, data privacy, unfair contract terms, and the accessibility of dispute resolution channels. The findings indicate that although several legal frameworks—such as electronic transaction laws and consumer protection statutes—have adapted to digital developments, their enforcement remains inconsistent and fragmented. Many consumers are unaware of their rights in digital transactions, while existing regulations often struggle to keep pace with the rapid pace of technological innovation. The study also reveals that dispute resolution in e-commerce is still dominated by platform-based mechanisms, which tend to prioritize business interests over consumer rights. Furthermore, cross-border transactions often create jurisdictional ambiguities that weaken consumer protection. This research makes an academic contribution by presenting a conceptual model of adaptive consumer protection, which integrates technological responsiveness, legal flexibility, and ethical accountability. It extends the theoretical discourse on digital consumer law by proposing the harmonization of international standards and the establishment of collaborative enforcement mechanisms between states and digital platforms.
