Abstract

Penyelenggaraan Pemilihan Umum menjadi tugas pokok dari Komisi Pemilihan Umum yang dibentuk berdasar Undang-undang Nomor 48 Tahun 2008 tentang Penyelenggara Pemilu. Pasal 2 ayat (1) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 menyatakan bahwa “kedaulatan berada di tangan rakyat dan dilaksanakan menurut Undang-Undang Dasar”. Pemikiran memberikan deskripsi hak asasi sebagai sebuah konsekwensi dari keberadaan Natural Rights manusia sebagai mahluk Tuhan. Hak-hak asasi tersebut sifatnya kodrati (natural) dalam arti kodratlah yang menciptakan dan mengilhami akal budi dan pendapat manusia; setiap orang dilahirkan dengan hak-hak tersebut; hak-hak itu dimiliki manusia dalam keadaan alamiah (state of nature) dan kemudian dibawanya dalam hidup bermasyarakat. Secara normatif, hak politik warga “hak untuk memilih” telah dijamin oleh putusan MK, namun dalam pelaksanaannya tentu masih harus dikaji secara mendalam. Pernyataan ini wajar dalam hal pemahaman warga dan petugas TPS terhadap putusan ini belum secara keseluruhan dipahami.Elections main tasks of the Election Commission established under Law No. 48 Year 2008 about Election. Article 2 paragraph (1) of the Constitution of the Republicof Indonesia 1945 states that “sovereignty in the hands of the people and executed accor ding to the Constitution.” Thought to provide a description of rights as a consequence of the existence of Natural Rights of man as God’s creatures. These rights are innate (natural) in meaning who create and inspire the human mind and opinion,  every person born with those rights, the rights were owned by humans in a state natural (state of nature) and then brought in social life. The normative, political rights citizens’ right to choose “has been secured by the decision of the Court, but in its implementation would still have to be studied in depth. This statement is reasonable in terms of understanding people and polling officers against this decision has not been a whole.

Abstract

Menurut Nr hukum. 28, 2009, setiap pemerintah daerah atau Provience sholud menjadi relay peraturan saja mereka lokal tentang Pajak dan Retribusi. Basis revisi pada dua alasan, pertama, tentang tarif dan waktu; kedua batas untuk mengambil uang dari fiskus. Untuk mencapai target anggaran, pemerintah setempat harus repaidly merevisi semua peraturan daerah. Berdasarkan alasan ini, penelitian ini akan muncul posisi Pajak Daerah dan Retribusi Daerah berurusan dengan Anggaran. Data akan menunjukkan tren pajak dan retribusi form 2007, 2008 dan 2009.According to law Nr. 28, 2009, every local government or provience sholud be a just they local regulation relay on Tax and Retribusi. The revision base on two reason, first, about tariff and the second, time limits to take some money from fiscus. To reach a target of Budgeting, local government should be repaidly revise all the local regulation. Base on this reason, this research will show up the position of Local Tax and Retribusi dealing with Local Budgeting. The data will show the trend of tax and retribusi, fraom 2007, 2008, and 2009.

Abstract

Penyelenggaraan pemerintahan yang seringkali disebut eksekutif, tidak cukup dinyatakan sebagai executive power yang diberi label pelaksana undang-undang. Executive di dalam pengertian yang luas justru memiliki kewenangan yang lebih dari sekedar pelaksana, executive power yang dalam terminologi lain disebut bestuur memiliki kewenangan hingga membuat aturan, mengikat personil, mengatur subsidi dan melaksanakan pengendalian dengan instrumen izin. Penggunaan kewenangan oleh penyelenggara pemerintahan harus diarahkan untuk tercukupinya perlindungan hukum bagi rakyat. Juga secara khusus untuk mampu memenuhi tugas-tugas yang harus dilakukan sebagai pemerintah. Pada dasarnya, tugas penyelenggara pemerintahan bukan saja menjaga kehidupan rakyat tetapi juga memenuhi kebutuhan hidup rakyatnya. Secara luas dinyatakan melindungi hak-hak rakyat sekaligus juga mencukupkan hak-hak rakyat. Dalam penyelenggaraan pemerintahan, khususnya di Jawa Timur telah dilakukan berbagai upaya terprogram untuk memenuhi prinsip-prinsip pemerintahan yang baik, khususnya dalam meningkatkan perlindungan HAM bagi warga miskin. Upaya tersebut dilakukan dengan tetap memperhatikan prinsip-prinsip penyelenggaraan pemerintahan yang akuntabel, transparan dan demokratis.Government administrator are often called the executive, but its not quite enough to be declared as the executive power that were labeled law enforcement. Executive in broad sense has more authority than just an implementer, the executive power in another terms is called bestuur, it have the authority to make the rules, binding personnel, organize and implement the subsidy and also perform an instrument control. The use of authority by government administrators should be directed, in order to the insufficient of people legal protection. Also specifically able to fulfill the dutys that have to be done as a government. Essentially, the task of government administrators are not only to maintain their people life, but also makes their people meets their needs. It was broadly stated that protecting their people rights is as well as replenishing their people rights. Especially in East Java governance, has been done some programmed efforts to fulfill the good governance principle, this is related to human rights protection improvements. The efforts are made with due regard to the principles of accountable governance, transparent and democratic.

Abstract

Social security in Indonesia is contained in the constitution. The content of this social security is regulated in article 28 H paragraph (3) of the 1945 Constitution of the Republic of Indonesia which states "that every person has the right to social security which enables his/her full development as a dignified human being". The Social Security Administering Body or often abbreviated as BPJS plays a very important role in carrying out its duties. One of them is providing social security and improving the welfare of all Indonesian workers in accordance with the Vision and Mission of BPJS Employment. Return to work is one of the new programs from BPJS Employment. The legal basis underlying the Return to work program includes: Government Regulation Number 44 of 2015 concerning the Implementation of Work Accident and Death Insurance Programs, Minister of Manpower Regulation No. 10 of 2016 concerning Procedures for Providing Return to Work Programs as well as Promotional Activities and Preventive Activities for Work Accidents and Work-related Diseases. The aim of this research is to determine the implementation of Return to Work at PT. Steel Pipel Industry of Indonesia (SPINDO) and to determine the inhibiting and supporting factors for the Return to Work program at PT. SPINDO. This research uses empirical legal research methods. Meanwhile, the results of the research show that: 1) PT. SPINDO has implemented the Return to Work Program ; 2) factors inhibiting the return to work program at PT. SPINDO almost doesn't exist. Meanwhile, the supporting factors for this return to work program include: first , socialization has been carried out by BPJS Ketenagakerjaan Karimunjawa to PT. SPINDO. Second , the facilities are adequate at PT. SPINDO is able to support the implementation of the return to work program .

Abstract

Desa inklusi memberikan ruang pada minoritas yaitu penyandang disabilitas terhadap haki dani kewajibani yangi isetara, iharkat idan imartabat iyang isederajat serta memiliki iperan idan kedudukan iyang isama idalam kehidupan masyarakat di desa. Pemerintah Desa Ngawonggo Kabupaten Malang telah mengupayakan perlindungan hukum terhadap penyandang disabilitas dengan menetapkan Peraturani Desai Nomori 2i Tahuni 2023i tentangi Pembentukani Kelompoki Inklusi Penyandang Disabilitas Desa. Metode yang digunakan adalah pelatihan terapi fisik kepada kelompok penyandang Disabilitas. hasilnya ii pengabdiani kepada masyarakat ini dalam rangka optimalisasi merealisasikan tugas dan fungsi kelompok inklusi sebagai upaya mempercepat kemandirian bagi penyandang disabilitas melalui pelatihan terapi fisik.

Abstract

Penelitian ini bertujuan untuk menganalisis makna upah proporsional berdasarkan Putusan Mahkamah Konstitusi (MK) Nomor 168/PUU-XXI/2023 terhadap regulasi ketenagakerjaan yang diatur dalam Undang-Undang Nomor 6 Tahun 2023. Putusan MK tersebut menegaskan pentingnya prinsip keadilan dan proporsionalitas dalam penentuan upah, khususnya dalam konteks hubungan kerja antara pekerja dan pemberi kerja. Melalui pendekatan yuridis normatif, penelitian ini mengkaji implikasi putusan tersebut terhadap kebijakan ketenagakerjaan, termasuk bagaimana prinsip upah proporsional dapat diimplementasikan dalam praktik. Hasil penelitian menunjukkan bahwa Putusan MK Nomor 168/PUU-XXI/2023 memberikan landasan hukum yang kuat untuk menciptakan sistem pengupahan yang lebih adil dan seimbang, serta mendorong perlindungan hak-hak pekerja. Namun, implementasinya memerlukan penyesuaian dan harmonisasi dengan regulasi ketenagakerjaan yang ada, termasuk UU Nomor 6 Tahun 2023, untuk memastikan efektivitas dan kepatuhan secara menyeluruh. Penelitian ini diharapkan dapat memberikan kontribusi dalam pengembangan kebijakan ketenagakerjaan yang lebih responsif terhadap prinsip keadilan sosial.

Abstract

The free nutritious meal program is a plan to provide nutritious meals in schools or Islamic boarding schools to improve students' nutrition. Estimated number of beneficiaries (nationally) of the free nutritious meal program for 514 districts/cities with a total of 16,110,000 million school children. The aim of this research is to determine the application of Pancasila values through the free nutritious meal program. This research uses the Systematic Literature Review (SLR) method by identifying, reviewing, evaluating, and interpreting available research to be used as a data source. The aim of the free nutritious meal program launched by the government is closely related to the fifth principle of Pancasila, namely "Social Justice for All Indonesian People." Through this program, the government seeks to provide equal access to all students in Indonesia regardless of economic or social background. This program reflects the value of social justice because every individual is treated equally and gets the same benefits for the common good. This program is also expected to play a role in reducing social disparities. By providing free nutritious food, students from underprivileged families can have their nutritional needs met without having to be burdened with additional costs. Adequate dietary needs will help improve students' health and improve their learning abilities.

Abstract

The classical legal concept within executive and legislative scopes is no longer adequate to help understand the strategic measures taken by the Provincial Government of East Java and the potential of communicative actions of the DPRD of the Province of East Java. The making of autonomous regulations tends to be exclusive and overlooks the involvement of the public as the origin from which the procedures of legislative drafting began. The legal thought introduced by Habermas came as a solution to legislation-related issues, but it seems to be accepted only by the dialogue between legislators and the executive body. This article aims at analyzing the interaction that takes place between discourse theory and the duality of administrative and communicative powers by Habermas relating to the strategic measures taken by the Provincial Government of East Java. A normative-juridical method was used, involving the literature study of legal concepts and the data revealing the performance of the Legal Bureau of the Provincial Government of East Jav a. Communicative measures exist in the construction of autonomous regulations while facilitating measures and evaluations of autonomous regulations set by the regency or municipality represent a strategic example.

Abstract

Penelitian ini membahas partisipasi pemilih pemula dalam pelaksanaan Pemilu serentak 2024 di Indonesia dengan metode analisis secara normatif terhadap pelaksanaan hak pilih sebagai wujud partisipasi politik warga negara. Pemilu serentak yang menggabungkan pemilihan legislatif dan eksekutif menjadi momentum penting untuk mengukur tingkat kesadaran politik generasi muda, khususnya usia 17-25 tahun yang berjumlah sekitar 20% dari total Daftar Pemilih Tetap (DPT) nasional. Tingginya jumlah tersebut menunjukkan peran strategis pemilih pemula dalam menentukan arah pembangunan nasional. Namun partisipasi mereka masih menghadapi berbagai kendala seperti minimnya pengetahuan tentang prosedur pemilu, rendahnya literasi politik, serta terbatasnya sosialisasi dari penyelenggara. Berdasarkan ketentuan Pasal 4 Peraturan KPU Nomor 7 tahun 2022 tentang Penyusunan Daftar Pemilih dalam Penyelenggaraan Pemilihan Umum dan Sistem Informasi Data Pemilih. Penelitian ini menelaah aspek normatif dari hak memilih, syarat kepemilikan hak pilih, serta implementasi di lapagan. Dengan menggunakan penelitian hukum normatif, penelitian ini bertujuan untuk menggambarkan sejauh mana kerangka hukum menjamin dan mendorong keterlibatan aktif pemilih pemula dalam Pemilu serentak 2024, serta merefleksikan efektivitas pelaksanaannya di Provinsi Kalimantan Barat.

Abstract

At the beginning of 2023 in RT 03, Bumiayu Village, Malang City, the number of heads of families reached 198 heads of families (KK). The compulsory expansion from 1 (one) RT to 2 (two) or more RTs is only carried out when the RTs exceed the number of 50 (fifty) households. Therefore, this community service aims to accompany the expansion of the Rukun Neighbor institution to accelerate welfare in RT 03 Bumiayu Village, Malang City. Implementation methods include (1) Focus Group Discussion (FGD), (2) Assistance in the expansion of RT 03 Bumiayu Village Malang City, and (3) Media use from the results of the RT 03 expansion assistance team, Bumiayu Village, Malang City.
