Abstract

Notaries, as public officials, are authorized to draw up authentic deeds in the Indonesian language as mandated by Article 43 paragraph (1) of Law Number 2 of 2014 on the Amendment to Law Number 30 of 2004 concerning the Notary Position (UUJN-P) and Article 31 of Law Number 24 of 2009 concerning the National Flag, Language, Emblem, and Anthem. In practice, parties who do not understand Indonesian including foreign nationals often require the assistance of a translator to ensure that the content of a deed is fully understood before signing. The problem is that regulations governing the position, qualifications, and legal responsibilities of sworn translators who assist in the making of notarial deeds remain scattered, overlapping, and partly derived from colonial-era regulations such as Staatsblad 1859 Number 69 and Staatsblad 1894 Number 16, thereby creating a normative gap that potentially threatens the legal certainty of authentic deeds. This study aims to examine the urgency of specific regulations concerning sworn translators in the context of notarial deed-making and its implications for the validity and evidentiary force of deeds. The study employs a normative juridical method with a statute approach and a conceptual approach, analyzed qualitatively and prescriptively. The findings indicate that the absence of comprehensive regulation on the role of sworn translators in notarial deed-making creates uncertainty regarding legal liability when translation errors harm the parties, as well as ambiguity concerning the translator's position within the structure of an authentic deed. This study recommends harmonizing regulations among the UUJN-P, the Language Law, and the Ministerial Regulation on Sworn Translators, accompanied by specific technical rules binding notaries and sworn translators to guarantee legal certainty and protection for parties to a notarial deed.

Abstract

This study aims to analyze the authority of Notaries in executing deeds outside their official jurisdiction based on the principles of territoriality and legal certainty. The issue arises because, in practice, some Notaries draft deeds beyond their designated jurisdiction as determined in their appointment decree, which normatively contradicts Article 18 of Law No. 2 of 2014 concerning Notary Office. This situation raises legal concerns regarding the validity of the deed and the accountability of the Notary as a public official. This research employs a normative juridical method with statutory, conceptual, and case approaches. The statutory approach examines the relationship between the territorial principle and the implementation of notarial authority. The conceptual approach explores theories of competence and legal certainty, while the case approach reviews several Supreme Court decisions addressing the overreach of notarial jurisdiction. The findings indicate that executing a deed outside the official jurisdiction constitutes an ultra vires act, reducing the authenticity of the deed and potentially rendering it void. Therefore, strengthening regulations and supervisory mechanisms by consistently applying the territorial principle is essential to ensuring legal certainty and protecting good-faith parties.

Abstract

Hak Tanggungan dalam perjanjian kredit mempunyai fungsi untuk memberikan rasa aman bagi kreditur apabila terjadi wanprestasi oleh debitur melalui eksekusi Hak Tanggungan. Namun upaya hukum dari debitur berupa gugatan agar pelaksanaan lelang eksekusi ditangguhkan dan permohonan restrukturisasi kredit menimbulkan permasalahan baru. Penulis dalam penelitian ini ingin menelaah dan menganalisa lebih lanjut tentang upaya hukum debitur untuk menangguhkan pelaksanaan eksekusi hak tanggungan dan ratio decidendi Putusan Mahkamah Agung Republik Indonesia Nomor 2859K/PDT/2011. Metode penelitian yang digunakan adalah penelitian hukum normatif, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau bahan hukum sekunder sedangkan pendekatan masalah dilakukan dengan menggunakan pendekatan undang-undang dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa debitur hanya dapat mengajukan gugatan penangguhan lelang eksekusi hak tanggungan apabila didasarkan pada adanya cacat hukum pada perjanjian kredit atau hutang piutang atau perjanjian pengikatan hak tanggungan. Tidak adanya restrukturisasi pinjaman tidak dapat dijadikan alasan untuk menunda eksekusi hak tanggugan.Mortgage within credit agreement plays role as warrant to provide secure for creditor when contract default is happened. Mortgage is conducted through execution of mortgage rights. Nevertheless, legal effort from debtor in form of suit to suspend the auction of mortgage coupled with restructuring of the credit stimulate new. The present research tries to elaborate and examine further about legal protection of debtor in suspending execution of mortgage. Moreover, the present study also tries to study ratio decidendiof Indonesian Supreme Court No 2859K/PDT/2011. The method used in the present study is a normative legal research, namely legal research which is conducted by examining the library materials or secondary law while in finding and collecting the data is done by two approaches, namely the law and conceptual approaches. The present study shows that debtor able to propose suspension of mortgage auction when there is some defect within the credit agreement. The absence of credit restructuring can be used as justification to suspend or delay execution of mortgage rights.
