Abstract

Jurnal ini mengkaji mengenai perlindungan hukum bagi Kreditur terkait Adanya Akta Pemberian Hak Tanggungan yang tidak didaftarkan Serta menggunakan jenis penelitian yuridis normatif dengan metode pendekatan perundang-undangan (Statute Approach) dan pendekatan konseptual (Conceptual Approach). Hasil penelitian ini menyimpulkan bahwa Hasil penelitian menunjukan bahwa akibat hukum dari tidak didaftarkannya Akta Pemberian Hak Tanggungan (selanjutnya disebut APHT) terhadap perjanjian kredit perbankan yang dibuat para pihak dihadapan Notaris/Pejabat Pembuat Akta Tanah (selanjutnya disebut PPAT) adalah kreditur tidak memiliki kedudukan yang diutamakan. Dimana bentuk perlindungan hukum yang dapat diberikan kepada Kreditur sebagai bentuk antisipasi tidak didaftarkannya APHT adalah dengan penandatanganan akta kuasa menjual pada saat akad kredit. Hak Kreditur terhadap benda jaminan dalam hal APHT tidak didaftarkan yaitu tidak memberikan hak saling mendahului dibandingkan dengan Kreditur lainnya.Tujuan dari pembebanan Hak Tanggungan adalah dalam rangka memberikan perlindungan dan kepastian hukum kepada semua pihak (khususnya Kreditur) dan juga untuk memenuhi asas publisitas. Pasal 1 ayat (1) Undang-Undang Hak Tanggungan mengatur ketentuan mengenai pemberian Hak Tanggungan dari Debitur kepada Kreditur sehubungan dengan hutang yang dijaminkan dengan Hak Tanggungan. Pemberian hak ini dimaksudkan untuk memberikan kedudukan yang diutamakan kepada Kreditur yang bersangkutan (Kreditur preferent) dari pada Kreditur-Kreditur lain. Dengan demikian pemberian Hak Tanggungan adalah sebagai jaminan pelunasan hutang Debitur kepada Kreditur sehubungan dengan perjanjian pinjaman/kredit yang bersangkutan. Hak Tanggungan tidak akan lahir tanpa adanya pendaftaran APHT. Namun pada prakteknya masih dijumpai beberapa oknum PPAT yang terlambat mendaftarkan APHT ke Kantor Pertanahan dengan berbagai alasan, tentu saja hal ini akan merugikan pihak Kreditur sebagai pemberi kredit.

Abstract

The practice of Surrogate Mothers according to Indonesian law gives rise to the problem that Positive Law in Indonesia does not yet recognize provisions regarding renting a womb (Surrogate Mother). This research aims to understand and comprehend Surrogate Mothers according to Indonesian law. This writing uses normative legal research methods with a type of legislative analysis approach (State approach). This research resulted in research that Indonesian law does not have regulations regarding the implementation of Surrogate Mother engagements. According to the provisions of the health law, surrogate motherhood cannot be carried out because of the clear regulations of the health law. Likewise with regulations in the realm of civil law, even though Article 1338 of the Civil Code states that "All agreements made legally apply to the law for those who make them," Article 1320 of the Civil Code provides conditions for the validity of an agreement, one of which is the existence of a halal cause. So that an agreement made must not conflict with legal regulations. So the implementation of Surrogate Mother cannot be implemented.

Abstract

ABSTRAKBerbicara tentang informasi kita tidak bisa menafikkan peran dari pada pers, Pada zaman dimana informasi menjadi unsur dominan dalam perkembangan kehidupan masyarakat saat ini, peran pers sangatlah Vital. Pers mutlak diperlukan dalam tata kehidupan bermasyarakat, apalagi dalam suatu negara yang mengalami modernisasi. Sebagai sarana penyebarluasan informasi dan alat kontrol social yang ada di masyarakat, pers berharap memiliki kebebasan dalam melakukan peranannya. Kebebasan yang memungkinkan para insan pers bisa memilih, menentukan, mengerjakan tugas mencari, meliputi berita, dan melakukan penyiaran berita kepada publik untuk memenuhi hak publik untuk mendapatkan informasi. Kebebasan pers bahkan ditempatkan sebagai salah satu syarat mutlak bagi negara yang menganut sistem demokrasi.Dalam konteks pertanggungjawaban dalam korporasi terdapat asas “siapa yang bertanggung jawab maka ia yang berbuat” dan oleh karena perusahaan pers harus berbentuk badan hukum, maka Pemimpin Redaksilah yang dianggap bertanggung jawab apabila terjadi pelanggaran hukum pidna pers. Dalam pertimbangannya majelis hakim menyebutkan bahwa pimpinan redaksi dianggap mempunyai pengalaman, pemahaman, dan pengetahuan dalam bidang jurnalistik serta mempunyai wewenang untuk menentukan layak tidaknya suatu berita atau gambar untuk dimuat.Kata Kunci : Delik Pencemaran nama baik di Indonesia.ABSTRACT                    Talking about information, we cannot ignore the role of the press. In an era where information is the dominant element in the development of people's lives today, the role of the press is vital. The press is absolutely necessary in the order of social life, especially in a country undergoing modernization. As a means of disseminating information and a means of social control in society, the press hopes to have the freedom to carry out its role. Freedom that allows members of the press to choose, determine, carry out the task of searching, covering news, and broadcasting news to the public to fulfill the public's right to obtain information. Freedom of the press is even placed as one of the absolute requirements for a country that adheres to a democratic system.               In the context of accountability in a corporation, there is the principle of "who is responsible then he who acts" and because a press company must be a legal entity, it is the Chief Editor who is considered responsible if there is a violation of the criminal law of the press. In their consideration, the panel of judges stated that the editor-in-chief is considered to have experience, understanding, and knowledge in the field of journalism and has the authority to determine whether or not a news or image is appropriate for publication.Keywords: Defamation offense in Indonesia.

Abstract

Seiring  dengan berkembangnya politik pertanahan, Pemerintah dan beberapa kementrian banyak yang membuat peraturan-peraturan yang terkait dengan Hak Guna Usaha (HGU), dalam penelitian ini penulis ingin lebih fokus membahas terkait dengan Kewajiban Pemegang HGU untuk memberikan fasilitas perkebunan masyarakat sebesar dua puluh persen, terdapat dua instasi pemerintah yang menerbitkan peraturan terkait dengan kewajiban tersebut, kedua Instansi ini adalah Kementrian ATR/Ka.BPN dan Kementrian Pertanian. Kewajiban pemegang HGU untuk meberikan fasilitas perkebunan rakyat ada pada otoritas dua instansi, yaitu Kemetrian ATR/Ka.BPN (Pembuatan Peraturan Pelaksananya berdasarkan Peraturan Pemerintah No.18 Tahun 2021 Tentang Hak Pengelolaan, Hak Atas Tanah, Satuan Rumah Sususn, dan Pendaftaran Tanah) dan Kementrian Pertanian (Pembuatan Peraturan Pelaksananya berdasarkan Peraturan Peraturan No. 26 Tahun 2021 Tentang Penyelenggara Bidang Pertanian), masing masing kementrian memiliki penerapan pelaksanaan dan sanksi yang berbeda  terhadap pemegang HGU yang tidak melaksanakan kewajiban tersebut, Kementrian Pertanian berwenang menerbitkan izin usaha sehingga tindakan hukum terdapat pelanggaran kewajiban pemberian kebun masyarakat dilakukan melalui mekanisme administrasi perizinan seperti pemberian teguran, pemberhentian kegiatan usaha untuk sementara, dan pencabutan izin usaha, sementara dalam peraturannya Kementrian ATR/Ka.BPN memberikan sanksi terhadap pemegang HGU yang tidak melaksanakan kewajiban pemberiaan fasilitas kebun rakyat akibat hukumnya dapat dibatalkan oleh Ka.BPN sebelum jangka Waktu HGU selesai.

Abstract

The development of the current digital era has brought many changes, not only in the world of education and government, but in the role of Notaries as well. As a result of this change, notaries have new responsibilities in safeguarding the personal data of parties to notarial agreements. The research method used is normative research, where the author conducted a review of positive law in Indonesia, especially the regulations of Law Number 27 of 2022 concerning Personal Data Protection. Research findings indicate that Notaries act as guarantors of clients' trust and confidentiality with respect to personal information and bear responsibility for the safe and lawful handling of such information. Notaries are generally known as data controllers who have the obligation to maintain the confidentiality of personal information under their supervision. Notaries are obliged to provide warnings to the public and related agencies if there is a violation of the protection of personal identity information (PII) in their jurisdiction.

Abstract

Legal disputes over land rights have become a fundamental and complex problem in the history of the development of agrarian law in force in Indonesia. The inequality that occurs in the pattern of distribution of control, ownership, use and utilization of land, which is also exacerbated by the condition of many land being abandoned by land rights holders, either due to intentional or unintentional factors, has triggered widespread cases of land disputes that have occurred until At the moment. The government itself has attempted to create policies and related regulations, in order to find solutions in resolving cases of ownership disputes over abandoned land. This includes Government Regulation Number 20 of 2021, concerning controlling abandoned areas and land. In this research the author raises two issues, namely, what is the urgency of eliminating ownership rights to abandoned land based on Government Regulation Number 20 of 2021, and what legal remedies can be taken by land rights owners and/third parties who suffer losses due to their abolition rights to abandoned land based on Government Regulation Number 20 of 2021. This research is a form of normative legal analysis (normative legal research), using a statutory approach and a conceptual approach. This research also has important implications in the context of land law, especially in terms of protecting the rights of land owners and encouraging the use of productive land uses. It is hoped that the results will serve as a guide for land ownership rights holders, the government and legal practitioners to better understand the relevant regulations and the impact of loss of ownership rights to land due to abandonment in accordance with the provisions contained in Government Regulation Number 20 of 2021.

Abstract

This research aims to investigate the role of digital signatures in notarization, focusing on their implementation and impact. Against the backdrop of developments in information technology, the use of digital signatures by Notaries is becoming increasingly relevant but also poses challenges in the process of making notarial deeds. The implementation of digital signatures can increase efficiency and security in making notarial deeds, but there are still obstacles related to certainty of time, place of deed making, and the need for more specific regulations related to cyber notary in Indonesia. The results of this study provide an in-depth understanding of the role of digital signatures in notaries and provide a basis for further development in integrating information technology in notarial practice.

Abstract

A notary is a public official who has the authority to make authentic deeds regarding all acts, agreements and provisions required by statutory regulations and/or desired by interested parties. A deed made by a Notary can be used as strong evidence and the Notary needs to keep the contents of the deed he has made confidential. In carrying out their position, Notaries should be careful to avoid unlawful acts which can then be summoned by the judiciary. UUJN provides space for investigators to be able to examine Notarial deeds for investigative purposes as intended in Article 66 UUJN. The problem discussed is an examination of the minutes of Notarial deeds carried out by the Regional Notary Honorary Council for the purposes of investigations related to the principle of confidentiality and forms of protection for Notaries as public officials who are called upon to provide information. regarding the contents of the deed. The result obtained is that the Notary's obligation to keep the deed confidential as intended in Article 16 paragraph (1) letter f UUJN can be concluded as not violating the Principle of Notary Confidentiality. A Notary, in carrying out his official duties, is obliged to keep the contents of the deed and all information obtained by the Notary confidential in carrying out his official duties, unless statutory provisions order the Notary who is summoned as a witness to disclose this matter. keep the Notary's position confidential and fulfill his legal obligations as a witness in providing information regarding the contents of the deed as necessary. as evidence in court for law enforcement.

Abstract

Dalam RP3YD Ikatan Notaris Indonesia telah menetapkan pelaksanaan kongres yakni di Bandung Jawa Barat. Ada beberapa bakal calon ketua merasa kebaratan karena salah satu bakal calon ketua berasal dari wilayah tersebut sehingga, bakal calon yang lain mengusulkan kepada pengurus pusat INI untuk memindahkan tempat dan melakukan pemilihan melalui i-vote, sedangkan pengurus pusat menyetujui akan hal itu dengan membuat keputusan diluar kongres, karena tidak ada titik temu maka pengurus pusat minta mediasi kepada ditjen ahu dan ditjen ahu melakukan hal tersebut hingga pada akhirnya tidak ada hasil terhadap mediasi tersebut. Keadaan demikian diperparah dengan masuknya ditjen ahu yang mengakomodir ketentuan pengurus pusat tersebut dengan mengatur terkait pelaksanaan kongres INI, tindakan ini menimbulkan keributan baru apakah ditjen ahu berwenang untuk melakukan hal tersebut. Metode penelitian yang digunakan yaitu metode penelitian yuridis normatif dengan melakukan pendekatan kepada Undang-Undang (statute approach) dan pendekatan konseptual (conceptual approach). Adapun hasil dari penelitian ini yaitu bahwa ditjen ahu memang berwenang untuk mengawasi organisasi notaris tapi bukan mengatur organisasi notaris tersebut dengan melakukan atau memutuskan terhadap pelaksanaan kongres INI, sedangkan tindakan ditjen ahu tersebut merupakan tindakan yang masuk atau dapat dikategorikan sebagai tindakan melampaui wewenangnya karena tidak ada dasar hukum yang mengatur untuk ditjen ahu mengatur organisasi notaris.

Abstract

Notary is a public official authorized to make authentic deeds and have other authorities. In carrying out his duties and authority, the Notary must be able to maintain the confidentiality of every data of the parties in the deed he makes. parties in the deed he makes. The principle of confidentiality that has been regulated in UUJN Article 16 paragraph (1) letter f has the potential to clash with the concept of Cyber Notary, which has also been contained in notary concept which has also been contained in UUJN Article 15 paragraph (3) which in its explanation states explanation states that one of the other powers of Notary referred to is the authority to certify transactions conducted electronically (Cyber Notary). The authority of Notary in Cyber Notary has drawn pros and cons in various circles. various circles. The problem arises when in the implementation of Cyber Notary uses the services of third parties to build up to the maintenance of the Cyber Notary electronic system. Thus, there will be a third party. Thus, there will be a third party who can access all deeds in the system. This means that the data parties are no longer a secret of the notary and are no longer in accordance with the principle of confidentiality that requires the notary to in accordance with the principle of confidentiality that requires the Notary to maintain its confidentiality as it has been applied so far. This research will examine the implementation of the principle of Notary confidentiality and the urgency of regulating the protection of parties' data in Cyber Notary to prevent notaries from being sued in the future. This research uses a normative legal research method with a statue approach and conceptual approach. The results showed that the need for Cyber Notary must be in line with the regulation of data protection of the parties in the Cyber Notary because UUJN has provided rules that the Notary is obliged to keep confidential everything about the Deed he makes and all information obtained to protect the parties' data.
