Abstract

A notary is a public official who has the authority to make authentic deeds regarding all acts, agreements and provisions required by statutory regulations and/or desired by interested parties. A deed made by a Notary can be used as strong evidence and the Notary needs to keep the contents of the deed he has made confidential. In carrying out their position, Notaries should be careful to avoid unlawful acts which can then be summoned by the judiciary. UUJN provides space for investigators to be able to examine Notarial deeds for investigative purposes as intended in Article 66 UUJN. The problem discussed is an examination of the minutes of Notarial deeds carried out by the Regional Notary Honorary Council for the purposes of investigations related to the principle of confidentiality and forms of protection for Notaries as public officials who are called upon to provide information. regarding the contents of the deed. The result obtained is that the Notary's obligation to keep the deed confidential as intended in Article 16 paragraph (1) letter f UUJN can be concluded as not violating the Principle of Notary Confidentiality. A Notary, in carrying out his official duties, is obliged to keep the contents of the deed and all information obtained by the Notary confidential in carrying out his official duties, unless statutory provisions order the Notary who is summoned as a witness to disclose this matter. keep the Notary's position confidential and fulfill his legal obligations as a witness in providing information regarding the contents of the deed as necessary. as evidence in court for law enforcement.

Abstract

Dalam RP3YD Ikatan Notaris Indonesia telah menetapkan pelaksanaan kongres yakni di Bandung Jawa Barat. Ada beberapa bakal calon ketua merasa kebaratan karena salah satu bakal calon ketua berasal dari wilayah tersebut sehingga, bakal calon yang lain mengusulkan kepada pengurus pusat INI untuk memindahkan tempat dan melakukan pemilihan melalui i-vote, sedangkan pengurus pusat menyetujui akan hal itu dengan membuat keputusan diluar kongres, karena tidak ada titik temu maka pengurus pusat minta mediasi kepada ditjen ahu dan ditjen ahu melakukan hal tersebut hingga pada akhirnya tidak ada hasil terhadap mediasi tersebut. Keadaan demikian diperparah dengan masuknya ditjen ahu yang mengakomodir ketentuan pengurus pusat tersebut dengan mengatur terkait pelaksanaan kongres INI, tindakan ini menimbulkan keributan baru apakah ditjen ahu berwenang untuk melakukan hal tersebut. Metode penelitian yang digunakan yaitu metode penelitian yuridis normatif dengan melakukan pendekatan kepada Undang-Undang (statute approach) dan pendekatan konseptual (conceptual approach). Adapun hasil dari penelitian ini yaitu bahwa ditjen ahu memang berwenang untuk mengawasi organisasi notaris tapi bukan mengatur organisasi notaris tersebut dengan melakukan atau memutuskan terhadap pelaksanaan kongres INI, sedangkan tindakan ditjen ahu tersebut merupakan tindakan yang masuk atau dapat dikategorikan sebagai tindakan melampaui wewenangnya karena tidak ada dasar hukum yang mengatur untuk ditjen ahu mengatur organisasi notaris.

Abstract

Notary is a public official authorized to make authentic deeds and have other authorities. In carrying out his duties and authority, the Notary must be able to maintain the confidentiality of every data of the parties in the deed he makes. parties in the deed he makes. The principle of confidentiality that has been regulated in UUJN Article 16 paragraph (1) letter f has the potential to clash with the concept of Cyber Notary, which has also been contained in notary concept which has also been contained in UUJN Article 15 paragraph (3) which in its explanation states explanation states that one of the other powers of Notary referred to is the authority to certify transactions conducted electronically (Cyber Notary). The authority of Notary in Cyber Notary has drawn pros and cons in various circles. various circles. The problem arises when in the implementation of Cyber Notary uses the services of third parties to build up to the maintenance of the Cyber Notary electronic system. Thus, there will be a third party. Thus, there will be a third party who can access all deeds in the system. This means that the data parties are no longer a secret of the notary and are no longer in accordance with the principle of confidentiality that requires the notary to in accordance with the principle of confidentiality that requires the Notary to maintain its confidentiality as it has been applied so far. This research will examine the implementation of the principle of Notary confidentiality and the urgency of regulating the protection of parties' data in Cyber Notary to prevent notaries from being sued in the future. This research uses a normative legal research method with a statue approach and conceptual approach. The results showed that the need for Cyber Notary must be in line with the regulation of data protection of the parties in the Cyber Notary because UUJN has provided rules that the Notary is obliged to keep confidential everything about the Deed he makes and all information obtained to protect the parties' data.

Abstract

This study aims to analyze the law of e-Marketplace Auction in PMK No. 122 of 2023 concerning Auction Implementation Guidelines using Roscoe Pound's law as a tool of social engineering. This research is normative juridical type by describing the legal provisions of e-Marketplace Auction in PMK No. 122 of 2023 concerning Guidelines for the Implementation of Auctions. 122 of 2023 concerning Auction Implementation Guidelines with an analytical descriptive approach using Roscoe Pound's law as a tool of social engineering theory. The results of this study indicate that auctions in Indonesia have developed through the use of electronic technology which is regulated in PMK No. 122 of 2023. The enactment of PMK NO. 122 of 2023 is a form of social engineering (tool of social engineering) for the proliferation of auction practices on internet media carried out by the community as a result of technological developments. The enactment of PMK No. 122 of 2023 is a government directive to the public to conduct auctions through e-Marketplace Auction in e-commerce that has been registered with the Indonesian e-commerce association. This requirement is a form of embodiment of Roscoe Pound's theory of law as a tool of social engineering which functions to ensure the protection of public interests (state), society, and each individual so that it can be said that the legal provisions of e-Marketplace Auction in PMK No. 122 of 2023 are a form of legal participation in the process of social change in society.

Abstract

Digital transformation has rapidly penetrated various sectors, notably including notarial practices across Indonesia. This article is dedicated to analyzing the practical implementation of electronic certificates when notaries manufacture authentic deeds. The analysis refers specifically to Law No. 2 of 2014, which amends the Notary Position Law (UUJN), and examines its relationship with the Law on Information and Electronic Transactions (UU ITE). The adoption of electronic certificates and electronic signatures (TTE) holds significant promise, aiming for efficiency, speed, and enhanced security of legal documents, fully aligning with the modern concept of "Cyber Notary". Nevertheless, this study revealed a critical finding: a normative discrepancy exists. While the UUJN still conservatively mandates physical presence and written form, the ITE Law boldly acknowledges the validity of electronic documents. This regulatory gap is consequential. The absence of explicit regulations concerning electronic authenticated deeds created by notaries directly results in legal uncertainty regarding the deed's strength of proof. Consequently, we assert the urgent need for harmonizing regulations. Developing an integrated digital infrastructure is also vital to guarantee legal certainty and protection for both the public and notaries as they navigate the digital era.

Abstract

Penelitian ini membahasan mengenai ngaimana penerapan prinsip kehati hatian notarsi dalam pebuatan akta untuk meinimalisir terjadinya keterangan palsu yang nantinya akan merugikan notaris. Seorang notaris harus teliti dan juga menerapkan prinsip ini dalam menjalankan kewenangan serta tugasnya. Penelitian yang menggunakan metode penelitian normative ini di ambil dengan menggunakan bahan hukum promer , skunder dan tersier yang mana dilakukan dengan bahan kepustakaan. Hasil penelutian ini menggambarkan seorang notaris harus menerapkan prinsip kehatihatian untuk menghindari risiko yang merugikan berbagai pihak termasuk juga notaris dalam menjalankan kewenangan sesuai dengan UUJN yang berlaku.

Abstract

Penulisan artikel ini membahas mengenai perlindungan hukum atas hak keperdataan bagi orang di bawah pengampuan dengan mengambil studi kasus pada putusan nomor 70/Pdt.P/2018/PN Banyumas. Dalam penelitian yang menggunakan metodoli studi kasus ini penulis menemukan bahwa akibat hukum dari sebuah pengampuan adalah terampu dinilai belum/tidak memiliki kecakapan untuk melakukan perbuatan Hukum. Dalam putusan ini membahas mengenai subjek hukum yang memiliki gangguan jiwa. Pertimbangan hakim dalam menetapkan seseorang sebagai pengampu berdasarkan putusan nomor 70/Pdt.p/2018/PN Banyumas adalah berdasarkan fakta hukum yang ada
