Abstract

Penulisan artikel ini membahas mengenai perlindungan hukum atas hak keperdataan bagi orang di bawah pengampuan dengan mengambil studi kasus pada putusan nomor 70/Pdt.P/2018/PN Banyumas. Dalam penelitian yang menggunakan metodoli studi kasus ini penulis menemukan bahwa akibat hukum dari sebuah pengampuan adalah terampu dinilai belum/tidak memiliki kecakapan untuk melakukan perbuatan Hukum. Dalam putusan ini membahas mengenai subjek hukum yang memiliki gangguan jiwa. Abstract

A notary is a public official authorized by the state to create authentic deeds that have full evidentiary force before the law. However, in practice, notaries often abuse their authority in carrying out their duties, resulting in the loss of authenticity of the deed and causing losses to the parties. This study aims to analyze the forms of abuse of authority committed by notaries in creating authentic deeds, the resulting legal consequences, and the forms of legal accountability that can be imposed on notaries. The research method used is normative juridical, by examining applicable statutory provisions, legal doctrine, and relevant court decisions. The approaches used include a statutory approach, a conceptual approach, and a case approach. The results of the study indicate that abuse of authority by notaries can occur in various forms, including creating deeds without the presence of the parties, falsifying data, and providing false information in the deed. These actions not only violate the principles of professionalism and integrity of the notary's office, but also result in the deed losing its evidentiary force. Legal accountability for notaries who abuse their authority can take the form of administrative, civil, or criminal sanctions, depending on the level of error and the impact of their actions. To prevent recurrence of abuse of authority, it is necessary to strengthen the oversight system by the Notary Supervisory Board, improve moral integrity, and update the notary professional ethics education and training system. Abstract

The results of this study show that the right of liability is the object of guarantee that is most in demand by creditors (banks) as debt collateral. The value of the rights contained in thecertificate of rights of dependents has an important influence in determining the position of creditors as creditors who have preferential rights or only limited to as a concurrent creditor. If the value of the dependent rights has a greater value than the debtor's debt, then the creditor's position as the holder of the liability right is the preferred creditor, which takes precedence repayment of it than other creditors. However, the determination ofthe creditor's position as a preferred creditor or not can also be viewed from the proceeds of the sale of the object of liability from the results of auction execution. If the selling price of theobject of liability is greater than the debtor's debt, the creditor has the right to take precedence over full repayment by taking the proceeds Net sales are only limited to debtors. Meanwhile, if the proceeds from the sale of the object of liability are smaller than the debtor's debt, then the remaining debt of the debtor positions the creditor as a concurrent creditor meaning that the repayment of the remaining debtor is divided equally with other creditors

Abstract

The results of this study show that the regulations used as the basis for the bankruptcy boedel on land purchased based on evidence in the form of a Sale and Purchase Binding Agreement (PPJB) in full entered by the receivership into the bankruptcy boedel section are generally based on Articles 1131, 1132 of the Civil Code and Article 21 of the Bankruptcy Law and PKPU. When examining point b of the formulation of the civil chamber law number 7 SEMA Number 4 of 2016 that the purchase of land in good faith which is only proven by PPJB is paid off and the land is under its control, then the ownership of the land is legally valid. Therefore, the determination of bankruptcy boedel by the curator must heed the element of justice for land buyers in good faith. The legal implication of the act of the curator deliberately inserting the land that was sold and purchased based on PPJB Paid into the bankruptcy boedel is that it can be canceled. The cancellation can be done through a lawsuit filed by the buyer as stipulated in Article 3 paragraph (1) of the Bankruptcy Law and PKPU. This is because the purchase of land and/or buildings purchased by buyers who have good intentions and have been physically controlled is legally valid, therefore the act of the curator entering the buyer's land previously purchased from the seller based on PPJB Lunas is a wrong legal act, because it has implications for harming buyers who have obtained the land by legal means

Abstract

Digital transformation has rapidly penetrated various sectors, notably including notarial practices across Indonesia. This article is dedicated to analyzing the practical implementation of electronic certificates when notaries manufacture authentic deeds. The analysis refers specifically to Law No. 2 of 2014, which amends the Notary Position Law (UUJN), and examines its relationship with the Law on Information and Electronic Transactions (UU ITE). The adoption of electronic certificates and electronic signatures (TTE) holds significant promise, aiming for efficiency, speed, and enhanced security of legal documents, fully aligning with the modern concept of "Cyber Notary". Nevertheless, this study revealed a critical finding: a normative discrepancy exists. While the UUJN still conservatively mandates physical presence and written form, the ITE Law boldly acknowledges the validity of electronic documents. This regulatory gap is consequential. The absence of explicit regulations concerning electronic authenticated deeds created by notaries directly results in legal uncertainty regarding the deed's strength of proof. Consequently, we assert the urgent need for harmonizing regulations. Developing an integrated digital infrastructure is also vital to guarantee legal certainty and protection for both the public and notaries as they navigate the digital era.

Abstract

Bahwa salah satu ciri Hak Tanggungan, yaitu kepada Kreditor sebagai pemegang  Hak Tanggungan diberikan kedudukan yang diutamakan kepada pemegang jaminan (droit de preference), yaitu Kreditornya. Ciri seperti ini tercantum dalam kalimat terakhir Pasal 1 angka 1 UUHT, yaitu ”...yang memberikan kedudukan yang diutamakan kepada kreditor tertentu terhadap kreditor-kreditor lain”. Kemudian ciri tersebut disebutkan pula dalam Pasal 20 ayat (1) huruf b UUHT pada kalimat terakhir ditegaskan bahwa ” ...pemegang Hak Tanggungan dengan hak mendahului daripada kreditor-kreditor lainnya”. Kedudukan yang diutamakan bagi Kreditor menjadi menjadi tergerus ketika harta yang dijaminan utang Debitor ke Kreditor ternyata Debitor tersangkut korupsi. Harta benda milik Debitor tersebut disita atas perintah pengadilan, padahal harta benda tersebut sedang dijaminkan kepada Kreditor. Jika terjadi seperti Droit de Preference dari Kreditor menjadi tidak diutamakan lagi karena yang harus didahulukan pemenuhanyan atau pengembalianyan kepada negara, yang pada akhirnya Kreditor hanya akan menerima sisanya jika ada, tapi jika tidak ada maka Kreditor akan sangat dirugikan. Dalam Pasal 19 ayat (2) dan (3) Undang-Undang Nomor 31 tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi Upaya hukum yang bisa dilakukan oleh Kreditor hanyalah mengajukan/mengirimkan Surat Keberatan kepada pengadilan yang menjatuhkan sita, meskipun demikian tidak menangguhkan pelaksanaan putusan pengadilan. Dengan pengaturan seperti itu Kreditor yang beritikad baik pun dirugikan dan droit de preference (asas prioritas) bagi kreditor sudah tidak memberikan perlindungan hukum dan kepastian hukum.Kata kunci: Debitor; Droit de Preference; KreditorAbstract: Whereas one of the characteristics of the Underwriting Right, namely to the Creditor as the Holder of the Underwriting Right, is given a priority position to the guarantee holder (Droit de preference), namely the Creditor. Such characteristics are listed in the last sentence of Article 1 number 1 of the UUHT, namely "... which gives a certain creditor's priority to other creditors". Then this feature is also mentioned in Article 20 paragraph (1) letter b of the UUHT in the last sentence. It is stated that "... the Holder of Mortgage with the right to precede other creditors". The preferred position for Creditors becomes eroded when the assets guaranteed by the Debtor's debt to the Creditors are found to be involved in corruption. Debtor property is confiscated by court order, even though the property is being pledged to the creditor. If something happens like Droit de Preference from a creditor becomes no longer a priority because it must be prioritized to fulfillment or return to the state, which in the end, the creditor will only receive the rest if there is, but if there are no creditors will be greatly disadvantaged. In Article 19 paragraph (2) and (3) of Law Number 31 of 1999 concerning Eradication of Corruption, a legal remedy which can be carried out by Creditors is only to submit / send an Objection Letter to the court that imposed the seizure, however it does not suspend the implementation of the court's decision. With such an arrangement, creditors with good intentions are disadvantaged, and Droit de preference (priority principle) for creditors has not provided legal protection and legal certainty.Keywords: Debtor; Droit de Preference; Creditor

Abstract

This study aims to analyze the authority of Notaries in executing deeds outside their official jurisdiction based on the principles of territoriality and legal certainty. The issue arises because, in practice, some Notaries draft deeds beyond their designated jurisdiction as determined in their appointment decree, which normatively contradicts Article 18 of Law No. 2 of 2014 concerning Notary Office. This situation raises legal concerns regarding the validity of the deed and the accountability of the Notary as a public official. This research employs a normative juridical method with statutory, conceptual, and case approaches. The statutory approach examines the relationship between the territorial principle and the implementation of notarial authority. The conceptual approach explores theories of competence and legal certainty, while the case approach reviews several Supreme Court decisions addressing the overreach of notarial jurisdiction. The findings indicate that executing a deed outside the official jurisdiction constitutes an ultra vires act, reducing the authenticity of the deed and potentially rendering it void. Therefore, strengthening regulations and supervisory mechanisms by consistently applying the territorial principle is essential to ensuring legal certainty and protecting good-faith parties.

Abstract

Amanat UUJN perubahan tahun 2014 Pasal 82 ayat 5 menyebutkan dalam penetapan, pembinaan, dan pengawasan terhadap organisasi notaris diatur dalam peraturan menteri, peraturan menteri tersebut baru diundangkan pada tanggal 17 Juni 2025, namun dalam Permenkum khususnya Pasal 9 ayat 1 yang menyebutkan bahwa dalam keadaan tertentu menteri melalui direktur jenderal dapat menetapkan pengurus organisasi notaris, tentu hal ini menarik untuk dikaji lebih lanjut dikarenakan Pasal 82 ayat 3 UUJN yang mengatakan bahwa organisasi notaris bersifat bebas dan mandiri, selain itu dalam UU Ormas juga menyebutkan bahwa sengketa yang berkaitan dengan internal organisasi maka penyelesaian melalui AD/ART organisasi apabila tidak kunjung selesai maka diselesaikan melalui gugatan ke pengadilan. Metode penelitian yang digunakan yaitu metode penelitian yuridis normatif dengan melakukan pendekatan kepada Undang-Undang (statute approach) dan pendekatan konseptual (conceptual approach). Adapun hasil dari pembahasan ini yaitu apabila kita mengkaji dari segi teori hans kelsen tentang jenjang norma maka ketentuan pasal 9 ayat 1 tersebut bertentangan dengan peraturan yang berada diatasnya yakni UU dan PP Ormas, dan UUJN sedangkan apabila kita mengkaji dari teori hukum H.LA. Hart mengatakan bahwa hukum itu terkadang tidak selalu berada pada ruang yang gelap maupun terang terkadang dia berada dalam ruang atau lingkup yang abu-abu.

Abstract

The insolvency of the debtor has legal consequences on the rights and obligations of the parties involved, including the collateral guarantor. Collateral guarantors have the responsibility to fulfil debt payment obligations if the main debtor is unable to pay off his obligations. This study aims to analyse the obligations of collateral guarantors in cases of debtor bankruptcy based on bankruptcy law in Indonesia. The research method used is normative juridical with a statutory and case approach. The results showed that collateral guarantors still have an obligation to fulfil debt payments even though the main debtor is declared bankrupt, unless there is an agreement that regulates otherwise. In addition, in practice, there are problems related to the execution of collateral and legal protection for guarantors in the bankruptcy system. Therefore, there is a need for legal certainty and a clearer protection mechanism for collateral guarantors in order to create a balance between the interests of creditors and guarantors. This research will discuss how bankruptcy law in Indonesia regulates the obligations of collateral guarantors in the event that the debtor experiences bankruptcy. This research will also analyse the problems that often arise in practice, and provide recommendations to clarify the legal protection mechanism for collateral guarantors.

Abstract

A brand is a sign that can be displayed graphically in the form of an image, logo, name, word, letter, number, color arrangement, in 2 (two) dimensions and 3 (three) dimensions, sound, hologram, or a combination of 2 (two) or These elements are used to differentiate goods or services produced by individuals or legal entities in the field of trade in goods and/services. Redirection is a process, method, action, replacement, exchange, alteration. Meanwhile, rights are the power to do something (because it has been determined by law, applicable regulations, and authority according to law). In the case regarding the transfer of rights to a brand, a notary as a public official is authorized by law to make deeds. Notaries play a role in the distribution of inheritance in making deeds of inheritance statements and certificates of inheritance rights as supporting documents in the transfer of rights to registered trademarks based on inheritance, the registration of which must be through an application to the Minister.
