Abstract

This research aims to investigate the role of digital signatures in notarization, focusing on their implementation and impact. Against the backdrop of developments in information technology, the use of digital signatures by Notaries is becoming increasingly relevant but also poses challenges in the process of making notarial deeds. The implementation of digital signatures can increase efficiency and security in making notarial deeds, but there are still obstacles related to certainty of time, place of deed making, and the need for more specific regulations related to cyber notary in Indonesia. The results of this study provide an in-depth understanding of the role of digital signatures in notaries and provide a basis for further development in integrating information technology in notarial practice.

Abstract

A notary is a public official who has the authority to make authentic deeds regarding all acts, agreements and provisions required by statutory regulations and/or desired by interested parties. A deed made by a Notary can be used as strong evidence and the Notary needs to keep the contents of the deed he has made confidential. In carrying out their position, Notaries should be careful to avoid unlawful acts which can then be summoned by the judiciary. UUJN provides space for investigators to be able to examine Notarial deeds for investigative purposes as intended in Article 66 UUJN. The problem discussed is an examination of the minutes of Notarial deeds carried out by the Regional Notary Honorary Council for the purposes of investigations related to the principle of confidentiality and forms of protection for Notaries as public officials who are called upon to provide information. regarding the contents of the deed. The result obtained is that the Notary's obligation to keep the deed confidential as intended in Article 16 paragraph (1) letter f UUJN can be concluded as not violating the Principle of Notary Confidentiality. A Notary, in carrying out his official duties, is obliged to keep the contents of the deed and all information obtained by the Notary confidential in carrying out his official duties, unless statutory provisions order the Notary who is summoned as a witness to disclose this matter. keep the Notary's position confidential and fulfill his legal obligations as a witness in providing information regarding the contents of the deed as necessary. as evidence in court for law enforcement.

Abstract

This paper aims to review the legal certainty of the regulation outstanding land and building rights “perolehan hak atas tanah dan bangunan” (BPHTB) in the implementation of complete systematic land registration “pendaftaran tanah sistematik lengkap” (PTSL). This study uses normative research with legal approach that related regulation land registration. The problems in this study are in the presence the norm conflicts between article 33 point 1 and 2 “ Peraturan Menteri Agraria dan Tata Ruang Nomor 6 Tahun 2018” about complete systematic land registration that holders of land rights from PTSL have the obligation to pay BPHTB that contrary to article 3 “Undang undang Nomor 20 tahun 2000” about the Duty to Obtain Land and Building Rights which states that government programs for development are not objects of BPHTB.

Abstract

As time progresses, of course, existing technology also develops. Entering the 4.0 era which begins to require the implementation of digitalization from various sectors. In addition to making it easier, the digitalization era can minimize errors that occur due to human error. In this case, special challenges are encountered in the implementation of Cyber Notary. Explanation of Article 15 Paragraph (3) of the Notary Law only mentions the authority to certify a transaction carried out electronically (Cyber Notary). However, unfortunately, regarding the authority of the Notary in terms of Cyber Notary, there are no further regulations. This study uses a normative legal research method with a conceptual approach and focuses on the use of time stamps in the duties of a notary related to the duties and authorities of a notary, namely making authentic deeds. The time setting on the time stamp provides a sign that the authentic document or deed was made in a unit of time that can be accounted for by using the services of a third party, namely the time stamp authority. The existence of a third party is needed because the time on each computer can vary. Therefore, a third party is needed who can guarantee this. In this case, the Ministry of Law and Human Rights can be trusted to overcome this problem.

Abstract

Hak Tanggungan dalam perjanjian kredit mempunyai fungsi untuk memberikan rasa aman bagi kreditur apabila terjadi wanprestasi oleh debitur melalui eksekusi Hak Tanggungan. Namun upaya hukum dari debitur berupa gugatan agar pelaksanaan lelang eksekusi ditangguhkan dan permohonan restrukturisasi kredit menimbulkan permasalahan baru. Penulis dalam penelitian ini ingin menelaah dan menganalisa lebih lanjut tentang upaya hukum debitur untuk menangguhkan pelaksanaan eksekusi hak tanggungan dan ratio decidendi Putusan Mahkamah Agung Republik Indonesia Nomor 2859K/PDT/2011. Metode penelitian yang digunakan adalah penelitian hukum normatif, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau bahan hukum sekunder sedangkan pendekatan masalah dilakukan dengan menggunakan pendekatan undang-undang dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa debitur hanya dapat mengajukan gugatan penangguhan lelang eksekusi hak tanggungan apabila didasarkan pada adanya cacat hukum pada perjanjian kredit atau hutang piutang atau perjanjian pengikatan hak tanggungan. Tidak adanya restrukturisasi pinjaman tidak dapat dijadikan alasan untuk menunda eksekusi hak tanggugan.Mortgage within credit agreement plays role as warrant to provide secure for creditor when contract default is happened. Mortgage is conducted through execution of mortgage rights. Nevertheless, legal effort from debtor in form of suit to suspend the auction of mortgage coupled with restructuring of the credit stimulate new. The present research tries to elaborate and examine further about legal protection of debtor in suspending execution of mortgage. Moreover, the present study also tries to study ratio decidendiof Indonesian Supreme Court No 2859K/PDT/2011. The method used in the present study is a normative legal research, namely legal research which is conducted by examining the library materials or secondary law while in finding and collecting the data is done by two approaches, namely the law and conceptual approaches. The present study shows that debtor able to propose suspension of mortgage auction when there is some defect within the credit agreement. The absence of credit restructuring can be used as justification to suspend or delay execution of mortgage rights.

Abstract

Digitalization has become a global trend that has brought significant changes in various sectors, including the notary field. This study aims to analyze the opportunities and challenges of digitalization in notary practice in Indonesia, focusing on its impact on work efficiency, data security, document validity, and regulatory readiness. The research approach uses a mixed-method with a sequential explanatory design. Quantitative data was obtained through a survey of 150 respondents consisting of notaries, PPATs, and notary service users, while qualitative data was collected through in-depth interviews with practitioners, academics, and regulators. The results of the study show that digitalization presents great opportunities, such as increased efficiency through electronic signatures, blockchain-based document security, and the expansion of service access to remote areas. However, the challenges faced are no less significant. The disharmony between the Information and Electronic Transactions Law (ITE Law) and the Notary Position Law (UUJN) creates legal uncertainty regarding the validity of digital documents. In addition, the risk of data leakage and lack of technological literacy among notaries are the main obstacles in the implementation of digitalization. This study concludes that digital transformation in the notary sector requires harmonization of regulations, increasing the capacity of human resources, and strengthening technological infrastructure. Strategic recommendations include revision of legal policies, technology training for notaries, and investments in data security. With these steps, digitalization is expected to support notary practices that are more efficient, safe, and relevant to the needs of society in the technological era. This research provides important insights for regulators, notaries, and other stakeholders in welcoming the digital notary era.

Abstract

Mortgage guarantee is a form of material security regulated in Indonesian civil law. Provisions regarding mortgage guarantees can be found in Articles 1162 to 1232 of the Civil Code (Civil Code). These articles include general provisions to special rules related to mortgage guarantees. In addition, the Commercial Code (KUHD) also regulates certain aspects of mortgage collateral, especially in Articles 314 to 316, which highlight objects that can be used as collateral for mortgages in business transactions. In addition to these regulations, Law Number 17 of 2018 concerning Notary Services also has relevance in regulating mortgage guarantees, especially in relation to the process of recording and legal validation of mortgage agreements. This journal article discusses international legal studies related to the execution of mortgage-backed assets located outside the territory of Indonesia. The main focus of this study is to analyze how international legal principles can be applied in the context of cross-border mortgage guarantee dispute resolution. With a legal reconstruction approach, this study aims to provide an in-depth understanding of the relationship between international law and the implementation of the right of guarantee on a global scale

Abstract

A notarial protocol is a collection of documents that are considered State Archives and must be stored and maintained by the Notary in accordance with the provisions of applicable laws and regulations. Based on Article 15 paragraph (1), Article 16 paragraph (1) letter b, Article 58, Article 59, and Article 63 of the Notary Law (UUJN/UUJN-P), a Notary is responsible for storing the deeds and Notarial Protocols throughout their term of office, and these will be passed on to another Notary or their successor. The responsibility of the Notary holding the protocol is also to maintain the confidentiality of the personal data of the parties involved in legal actions reflected in the authentic deed. The lack of regulations governing the digital storage of the Notarial Protocol has created a legal gap. As a result, the digital storage of Notarial Protocols can only function as backup data

Abstract

This research is to determine the urgency of updating and Unification of Law Number 5 of 1960 concerning Basic Agrarian Principles Regulations. The type of research method used is a normative juridical method using literature study of legal materials. Law Number 5 of 1960 concerning Basic Agrarian Principles Regulations is a legal product that has regulated land law since 1960. This law is still in effect today. By looking at the year the legal product was created, it becomes an interesting topic regarding its validity and application. There are several problems that arise because there has been no update to the law governing land. This is due to Law Number 5 of 1960 concerning Basic Agrarian Principles Regulations. Abstract

Seiring  dengan berkembangnya politik pertanahan, Pemerintah dan beberapa kementrian banyak yang membuat peraturan-peraturan yang terkait dengan Hak Guna Usaha (HGU), dalam penelitian ini penulis ingin lebih fokus membahas terkait dengan Kewajiban Pemegang HGU untuk memberikan fasilitas perkebunan masyarakat sebesar dua puluh persen, terdapat dua instasi pemerintah yang menerbitkan peraturan terkait dengan kewajiban tersebut, kedua Instansi ini adalah Kementrian ATR/Ka.BPN dan Kementrian Pertanian. Kewajiban pemegang HGU untuk meberikan fasilitas perkebunan rakyat ada pada otoritas dua instansi, yaitu Kemetrian ATR/Ka.BPN (Pembuatan Peraturan Pelaksananya berdasarkan Peraturan Pemerintah No.18 Tahun 2021 Tentang Hak Pengelolaan, Hak Atas Tanah, Satuan Rumah Sususn, dan Pendaftaran Tanah) dan Kementrian Pertanian (Pembuatan Peraturan Pelaksananya berdasarkan Peraturan Peraturan No. 26 Tahun 2021 Tentang Penyelenggara Bidang Pertanian), masing masing kementrian memiliki penerapan pelaksanaan dan sanksi yang berbeda  terhadap pemegang HGU yang tidak melaksanakan kewajiban tersebut, Kementrian Pertanian berwenang menerbitkan izin usaha sehingga tindakan hukum terdapat pelanggaran kewajiban pemberian kebun masyarakat dilakukan melalui mekanisme administrasi perizinan seperti pemberian teguran, pemberhentian kegiatan usaha untuk sementara, dan pencabutan izin usaha, sementara dalam peraturannya Kementrian ATR/Ka.BPN memberikan sanksi terhadap pemegang HGU yang tidak melaksanakan kewajiban pemberiaan fasilitas kebun rakyat akibat hukumnya dapat dibatalkan oleh Ka.BPN sebelum jangka Waktu HGU selesai.
