Abstract

This paper aims to investigate the reform of corruption eradication in Indonesia from three crucial aspects: the form of the Corruption Eradication Commission (KPK), the formulation of corruption in material and formal aspects, and other additional support system such as asset recovery and the protection of justice collaborator and whistle blower. This paper is a normative-legal research where it dissects secondary data which includes statutory regulations, various legal documents, researches, and other references relevant to corruption eradication in Indonesia. KPK could be strengthened in particular aspects with changes in regards its design of authority and its relationship with other authorities in corruption eradication process. Artikel ini bertujuan untuk meneliti reformasi pemberantasan korupsi dari tiga aspek penting: bentuk dari Komisi Pemberantasan Korupsi, perumusan korupsi dalam aspek materiil maupun aspek formiil, serta hal-hal pendukungnya seperti pemulihan aset dan perlindungan justice collaborator dan whistleblower. Tulisan ini merupakan penelitian hukum normatif yang menelaah data sekunder. Data sekunder yang ditelaah antara lain adalah peraturan perundang-undangan, berbagai dokumen hukum, penelitian, dan referensi lainnya yang relevan dengan pemberantasan korupsi di Indonesia. Komisi Pemberantasan Korupsi (KPK) akan diperkuat dalam aspek tertentu dengan diubahnya desain wewenang serta koordinasi hubungan antara KPK dan pihak berwenang lainnya dalam pemberantasan korupsi.

Abstract

Post-enactment of Act Nr. 12 of 2011, MPR Decree was put again the hierarchy of legislation, which cause problems in the context of the state of law of Indonesia. This was normative legal research. Now, the number of MPR Decree is only 6 decrees remaining, so re-existence and placement of MPR Decree is not relevant. Hierarchy should be made by simplification approach by reducing the nomenclature of law in the hierarchy of legislation. MPR Decree should have not been included in the hierarchy, especially under the Constitution. If the MPR Decree still be placed under the Constitution, we need to hold the mechanism to review MPR Decree, if there is a contradiction with the Constitution or the restriction of human rights, which actually should not be limited by the MPR.

Abstract

Through the decision No. 117/PUU-VII/2009, Constitutional Court applies Rawls conception of justice that emphasizes the equality of all people with equality  of opportunity by applying fair or equal opportunity principle. Institutional design between the DPR and DPD viewed by Constitutional Court as an inequiality condition, so that to reach a value of justice, equal opportunity principle should take precedence and priority. Stregthening DPD is necessary to uphold the checks and balances mechanisms in Indonesia.

Abstract

The result of this legal research show the existence of conditionally constitutional and conditionally unconstitutional decision in reviewing laws from 2003 to 2015, although that model of decision is not regulated in the positive law.  There are 5 characteristics of conditionally constitutional decision, those are (1)  Court  gives interpretation or certain requirements in order to remain constitutional provisions tested throughout implemented according to the specified requirements of the Constitutional Court; (2) based on the rejected verdict; (3) a conditionally constitutional clause can be found only on the consideration of the Court, or can be found on the judgment and injunction; (4) conditionally constitutional decision require re-judicial review if the norm is not in line with the interpretation of the Constitutional Court; (5) encouraging legislative review. Regarding the conditionally unconstitutional decision, there are 4 characteristics, those are (1) the verdict certainly include a conditionally unconstitutional clause; (2) a conditionally verdict can be the meaning or interpretation of a norm, or give the terms of the norm is unconstitutional; (3) based on the granted verdict either partially or completely; (4) does not substantially different from the conditionally constitutional clause.

Abstract

The existence of Islamic law substance in national law, specifically in an Act, has been indirectly placed the Constitutional Court in the position that also has a role in determining the development of Islamic law in the national law system. It can be seen in the context of judicial review of Act that has Islamic law substance or that explicitly regulates Islamic law. This research specifically answers: (a) how is the justification of the inclusion of Islamic law in Indonesian national law? (b) how are the pattern of judicial review petitions and court decisions of Acts related to Islamic law? This research is normative-juridical research, which analyses secondary data such as laws and regulations, Constitutional Court decisions, and articles related to the inclusion of Islamic law in the national law. The results show that the justification of the accommodation of Islamic law in the national law system is related to the construction of state and religion relationship. It indicates that Indonesia is not a religious state, but it is a state that has a divine principle. Furthermore, based on the analysis of judicial review decisions from 2003 to 2019, the pattern of petitions and court decisions of judicial reviews of laws related to Islamic law substance shows at least three main petitions, namely: (a) questioning state intervention in the implementation of Islamic law; (b) questioning the administration of the implementation of Islamic law; (c) petitions for the inclusion of Islamic law in the positive law.

Abstract

This conceptual article aims to analyze about the justification and legal aspect of employment termination because of efficiency phenomenon in covid-19 pandemic period. Article 164 paragraph 4 Manpower Act and Constitutional Court Decision Number 19/PUU-IX/2011 already stipulated that employment termination because of efficiency must be followed by company closure. But, covid-19 pandemic situation was forcing the employers to do employment termination because of efficiency without a company closure. The conclusion of this article is the employers did the termination without the company closure based on consideration that, it would prevent more damage than did it with the closure. The company closure would bring result all of workers, including the employers, loss their jobs. The employment termination because of efficiency, but without company closure could be preserved the operational of company and maintain the other workers’ jobs. This efficiency reason is not actually prohibited in Article 153 paragraph 1 Manpower Act and in ILO’s Convention and Recommendation 1982. However, this termination could not use Article 164 paragraph 4 Manpower Act and Constitutional Court Decision Number 19/PUU-IX/2011 as the legal basis. The compensation formulation model of the termination could use the formulation of termination without worker’s fault as stipulated by Manpower Act. In addition, the institutions of industrial relaton dispute resolution must supervise the termination process, in order the process would be staged fairly, coincide with the principles of legal termination, and the workers’s compensastion would be fulfilled by the employers.

Abstract

The third amendment of Indonesia’s 1945 Constitution, conducted in 2001, had significant implications for the nation’s judiciary. It transformed the judiciary from a single to a dual structure. Consequently, there are two apexes of the judiciary: the Supreme Court and the Constitutional Court. Furthermore, the establishment of the Constitutional Court divided judicial review authority between the two apex courts. The Constitutional Court can review laws against the Constitution, while the Supreme Court has the power to review whether regulations, made under laws, contradict such laws. Although the Indonesian Constitution provides explicit delineations over the absolute competence of judicial review, the division of judicial review has often triggered tension between the two courts. The Constitution allows the Supreme Court to have additional authorities granted by laws. On the other hand, the Constitutional Court has the power to review any law against the Constitution, including laws related to the Supreme Court. This article seeks to answer the important question of whether the Constitutional Court could influence or intervene in the Supreme Court through judicial review. The authors argue that the duality of judicial review authority unintentionally causes an imbalance in the functional relationship between the two apexes of the judiciary. The main reason is that the Constitutional Court can influence or intervene in the Supreme Court through constitutional review authority. The authors examine two essential aspects of this: (1) the functional implications of duality of judicial review authority; and (2) the implementation of the Constitutional Court’s authority in reviewing laws, especially those closely related to the Supreme Court’s authorities. Various cases are examined to illustrate how the Constitutional Court could directly or indirectly influence the Supreme Courts’ authorities. The Constitutional Court, however, often seems to ‘play safe’ to maintain the judiciary’s imbalanced relationship caused by the dualism of judicial review authority.

Abstract

Pemerintah menetapkan Kabupaten Manggarai sebagai satu dari 205 daerah yang masuk dalam tahapan pertama menuju penyelenggaraan Pilkada serentak pada tahun 2020 mendatang. Penyelenggaraan Pilkada tersebut dilaksanakan pada tahun 2015. Panwas selaku organ yang menjalankan fungsi pengawasan di Kabupaten Manggarai sayangnya belum optimal karena pengaruh beberapa faktor, seperti kompleksitas Pilkada, tingginya potensi sengketa/konflik, keterlambatan pelantikan komisioner Panwas, serta diperparah dengan kurangnya manajemen internal kelembagaan itu sendiri. Lebih lanjut, realisasi fungsi pengawasan ini masih sebatas pada konteks represif, sementara pada konteks preventif masih belum terlaksana dengan baik. Hal ini tak lain karena tidak adanya arsip kerja kelembagaan Panwas terdahulu yang sebenarnya dapat dijadikan sebagai modal perbaikan kerja lembaga ke depan, serta dapat ditindaklanjuti dengan analisis pemetaansengketa/konflik Pilkada di Kabupaten Manggarai.

Abstract

Keberlakuan Undang-Undang Nomor 6 Tahun 2014 tentang Desa memberikan implikasi yang signifikan terhadap kedudukan desa dalam sistem ketatanegaraan di Indonesia. Akan tetapi terdapat beberapa diskursus yang muncul salah satunya berkaitan dengan pengaturan distribusi urusan pemerintahan. Pencermatan terhadap topik tersebut semakin menunjukkan urgensinya ketika melihat praktik yang terjadi di Daerah Istimewa Yogyakarta di mana desa (dalam konteks keistimewaan DIY disebut Kalurahan) dimungkinkan untuk menerima distribusi urusan pemerintahan berupa urusan keistimewaan. Tulisan ini menjawab rumusan masalah sebagai berikut: (a) Bagaimana pengaturan mengenai Desa sebagai penerima tugas pembantuan dalam hukum positif di Indonesia? (b) Bagaimana pengaturan Kalurahan sebagai penerima tugas pembantuan berupa urusan keistimewaan di Daerah Istimewa Yogyakarta? Penelitian ini adalah penelitian yuridis normatif dengan menganalisis data sekunder berupa peraturan perundang-undangan yang relevan. Hasil dari penelitian ini menunjukkan bahwa terdapat ketidakharmonisan dalam konstruksi pengaturan desa sebagai penerima tugas pembantuan dan pemberian penugasan kepada Kalurahan di DIY didasari pada pemaknaan yang diperluas dari ketentuan dalam Perdais 1/2018, yang kemudian dijadikan dasar dalam Pergub 13/2022 untuk memberikan penugasan berupa urusan keistimewaan kepada Kalurahan.
