Abstract

Environmental sustainability and land ownership rights are critical issues in international law, addressing the balance between conservation and property rights. This study explores these complexities through a comparative legal analysis and literature review. The research aims to understand how international legal frameworks manage the interface between environmental protection and land ownership rights across diverse jurisdictions. Findings underscore the challenges and opportunities in achieving harmonious coexistence between these interests, emphasizing the pivotal role of international law in shaping policies that foster sustainable development while safeguarding property rights.

Abstract

This research examines the legal frameworks addressing nominee agreements in land ownership between foreign nationals and Indonesian citizens, with a focus on developing policy recommendations to strengthen these frameworks. Nominee agreements are often utilized to circumvent restrictions on land ownership by foreign nationals, posing significant legal and regulatory challenges. This study employs a qualitative approach, combining doctrinal analysis and empirical research, to evaluate the current legal provisions and their enforcement. A comparative analysis with international practices is conducted to identify best practices and potential improvements for Indonesia. Key findings highlight significant gaps and weaknesses in the existing legal framework, which undermine the effectiveness of land ownership regulations and pose risks to national sovereignty and economic stability. The study proposes comprehensive policy recommendations aimed at enhancing transparency, accountability, and enforcement mechanisms in land ownership regulations. These recommendations are designed to foster a more robust and cohesive legal framework that can effectively address the complexities of nominee agreements and safeguard Indonesia's land resources.

Abstract

Pandemi COVID-19 telah menyoroti pentingnya kesiapan hukum dalam menghadapi bencana pandemi. Artikel ini mengevaluasi efektivitas undang-undang dan kebijakan yang ada di Indonesia dalam menangani pandemi, serta mengidentifikasi kelemahan dalam kesiapan hukum. Dengan menggunakan metode analisis dokumen dan wawancara dengan pakar, penelitian ini menyajikan temuan mengenai kesenjangan dalam regulasi yang ada dan dampaknya terhadap penanganan krisis. Berdasarkan analisis ini, artikel ini mengusulkan kerangka kerja hukum yang diperbarui untuk meningkatkan kesiapan menghadapi pandemi di masa depan. Rekomendasi yang diberikan bertujuan untuk memperkuat infrastruktur hukum dan kebijakan publik, sehingga dapat merespons lebih cepat dan efektif terhadap keadaan darurat kesehatan publik yang serupa di masa depan.

Abstract

This study examines two critical dimensions of Indonesia’s national legal reform: the urgency of overhauling the National Legislation Program (Prolegnas) following executive interventions during President Joko Widodo’s administration, and the implications of such interventions on judicial morality. Employing a qualitative comparative methodology, the research integrates document analysis of Prolegnas, draft laws, and government regulations, regulatory audits, and in-depth interviews with legislative and judicial stakeholders. Findings reveal that fragmented authority and the omnibus law approach without thorough audits generate legal uncertainty, while abrupt statutory revisions cause ethical dilemmas for judges and inconsistencies in legal interpretation. The study recommends embedding systematic regulatory audits, early involvement of the judicial council, establishing an independent ethics oversight body, and incorporating explicit judicial morality clauses in every legislative amendment. This integrated framework aims to ensure Prolegnas produces laws that are responsive, accountable, and substantively just.

Abstract

This study aims to examine the legal policy of the Indonesian government in determining the COVID-19 vaccination policy and the extent to which its implementation meets the principles of justice, especially in terms of equal access and an educational approach to the community. The research method used is a normative qualitative approach with an analysis of laws and regulations, official government documents, and scientific literature. Data were collected through literature studies and analyzed descriptively-analystically. The results of the study show that although the vaccination policy was designed as a form of protecting the public interest, its implementation still faces challenges in terms of inequality in vaccine distribution, lack of public education, and a legal approach that tends to be coercive. For this reason, the vaccination policy needs to be reviewed to emphasize the principles of social justice, respect for human rights, and public participation as part of a responsive and democratic legal policy.
