Abstract

In the case of extortion ever happened in the city of Batam. The extortion is in the process of Accepting New Students at SMPN 10 Batam City. The indications of PPDB fraud have actually become suspicion in the community, but in law enforcement in the case of extortion is quite complicated because it is designed systematically in such a way that it will be difficult later in the proof process. Obtained evidence in the form of Money, Proof of Acceptance of New Students, and SK. This investigation is in accordance with KUHAP Article 1 Paragraph (19), the investigation which took place at SMPN 10 Batam City was said to be caught red-handed, the suspect was found at that time. The obstacles of the police in this illegal levy are: Lack of information from the public about the crime of illegal levies and is covered up in carrying out illegal levies at schools, thus hampering the police. Efforts that can be made by the police are to appeal to each agency regarding legal sanctions when committing illegal levies and carrying out patterns of prosecution or punishment against illegal levies based on the legal provisions in the prevailing laws and regulations.

Abstract

Pasal 1 angka (1) Undang-Undang Republik Indonesia Nomor 35 tahun 2014 tentang Perlindungan Anak menyatakan bahwa anak adalah orang yang belum berusia 18 (delapan belas) tahun, juga berarti anak yang masih dalam kandungan. Dan dalam kasus pidana anak yang berurusan dengan hukum ada penyelesaian non-litigasi atau apa yang sering disebut sebagai diversi. Menurut Pasal 1 angka (7) UU Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Remaja, diversi adalah diversi penyelesaian kasus anak dari proses peradilan pidana di luar peradilan pidana. Diversi juga diatur dalam Diversi dan Manajemen Anak. Dan dalam tahap investigasi, polisi harus mencoba Sistem Peradilan Pidana Remaja. Metode yang digunakan pengacara adalah penelitian normatif yang merujuk pada Hukum yang berkaitan dengan Junvenile Justice dan Perlindungan Anak. Abstract

Copyright is one of the Intellectual Property Rights (IPR) that aims to provide protection to the creator. When discussed about the ownership of a copyright song is different from other rights in IPR, especially regarding moral rights that actually need to be obtained by the songwriter. Therefore, the author is interested in taking the title of Legal Review regarding Copyright Regarding Moral Rights as One of the Exclusive Rights To Songwriters.  Based on the title, the purpose of the research raised is: To find out the moral rights obtained by songwriters based on laws and regulations. This research is used Qualitative method. The nature of this research is descriptive, namely by studying, explaining the rules related to the problems raised. In addition, in the writing taken secondary data by collecting data from the library, then using data materials such as: First, primary data materials are regulations related to Copyright; Second, secondary data materials are books, papers, thesis, journals related to Copyright; Third, tertiary data material is an English dictionary.

Abstract

Writing scientific papers is inseparable from the life of academic source. Scientific writing is not only an obligation and an interest at the college level but also at the school level. The problem that exists when the team did an observation at school, the lack of an atmosphere of writing scientific papers for both teachers and students made the level production of scientific papers in schools very low. Students were preoccupied with theoretical learning and the target of pursuing the test scores as well as the teacher was spent time fulfilling all the learning outcomes in class. Important things that could be used by teachers and students to excel in the field of scientific writing are eliminated. On the other hand, awareness and understanding of plagiarism problems such as the method of citing or writing references was still low. Those were also driven by a lack of writing atmosphere at the school level and a lack of understanding of plagiarism itself. With the various obstacles and phenomena found, the school's target community service team collaborated with multi-disciplinary lecturers by involving students to find solutions to these problems. This activity was carried out at SMK Pertiwi Batam by involving students and teachers. The results of this dedication showed the high enthusiasm of teachers and students as well as the ability to write scientific papers and awareness to prevent plagiarism. This services was held for 6 meetings from January to April 2021. This activity was attended by 30 participants who were held online with media zoom. Each meeting is held for 1.5 hours. The implementation of these services began with the provision of knowledge about scientific papers, methods, techniques, and materials related to classroom action research. Service is also given the legal approach regarding plagiarism.

Abstract

Prostitusi terutama Prostitusi yang menggunakan media sosial melibatkan beberapa pihak, antara lain penyedia jasa, pengguna jasa dan pekerja seks komersial selaku pihak yang menjajakan diri. Dari ketiga pihak yang terlibat tersebut tidak semuanya dapat dikenakan aturan mengenai kejahatan prostitusi. Hal inilah yang menjadi kelemahan pemerintah dalam menanggulangi kejahatan prostitusi. Sebagai contoh dalam Kitab Undang-Undang Hukum Pidana hanya mengatur mengenai larangan terhadap mereka yang membantu dan menyediakan pelayanan seks secara ilegal, artinya hanya penyedia jasa saja yang dapat dikenakan sanksi pidana sementara pengguna jasa dan pekerja seks komersial tidak dapat dikenakan sanksi. Jenis penelitian yang digunakan adalah penelitian hukum normatif. Hasil penelitian adalah Pertanggungjawaban pidana pekerja seks komersial dalam tindak pidana prostitusi yang menggunakan media sosial dapat diberikan dengan menggunakan aturan hukum yang dapat mengakomodir hal tersebut. Adapun pidana penjara yang dapat diterapkan dalam menjatuhkan sanksi adalah pidana penjara minimal 6 (enam) bulan dan maksimal 6 (enam) tahun dengan denda minimal Rp. 250.000.000,- dan denda maksimal Rp. 3.000.000.000,-.

Abstract

Perkembangan ilmu pengetahuan dan teknologi yang pesat selalu diikutidengan perkembangan kejahatan atau tindak pidana yang semakin maju. Halini ditandai dengan pesatnya perkembangan cara melakukan kejahatan(modus operandi) maupun alat yang digunakan. Perkembangan ilmupenggetahun dan teknologi telah merubah zaman sehingga berdampak padaperilaku setiap manusia dalam dunia bisnis, dimana saat ini banyak sekalihasil-karya orang lain yang diakui menjadi miliknya sendiri, tentu saja hal inisangat bertentangan dengan aturan hukum positif yang berlaku di Indonesia.Hak cipta sebagai suatu bagian dalam bidang HKI juga terkena imbas dariharmonisasi hukum ini, dalam praktiknya harmonisasi hak cipta yang telahdilakukan perubahan sebanyak 4 kali telah merubahparadigma dan pola pikirdari masalah publik menjadi masalah perdata, dimana sebelum UU Nomor28 Tahun 2014 diberlakukan hak cipta merupakan delik biasa, akan tetapisetelah terjadinya perubahan ditandai dengan disahkannya UU Nomor 28Tahun 2014 hak cipta merupakan delik aduan.

Abstract

Dalam menjalankan suatu usaha masyarakat juga harus taat dan patuh pada peraturan perundang-undangan yang berlaku dinegara tersebut, khususnya dinegara Republik Indonesia. Menjalankan suatu usaha ada juga masyarakat yang berani melanggar peraturan yang berlaku demi mencari keuntungan yang lebih besar, salah satunya adalah peredaran rokok ilegal. Di Kota Batam peredaran rokok ilegal begitu menjamur, praktek tersebut tidak hanya dilakukan oleh pemain besar saja, penjual diwarung kecil juga ada menjual rokok ilegal tersebut guna untuk memperoleh keuntungan yang besar. Untuk mengetahui peran Bea Cukai Kota Batam dalam upaya menanggulangi peredaran rokok ilegal. Penelitian ini dilakukan dikantor Bea Cukai Kota Batam Tipe B dengan mengumpulan data melalui wawancara dan observasi. Hasil dari penelitin tersebut pihak Bea Cukai telah melakukan upaya preventif dan represif guna untuk menanggulangi peredaran rokok ilegal. Dalam upaya tersebut pihak Bea Cukai Kota Batam menemukan beberapa kendala dalam menjalankan tugas dan fungsinya, yaitu pelaku penyeludup yang menggunakan high speed dalam melakukan operasi mereka diwilayah perairan.

Abstract

The ability to speak English is one of the skills that must be possessed by students as their expertise that can be used in the field of work and is also important for teachers to teach and practice in the learning process. In the world of work, children who have graduated are required to have skills in communicating in English, and communication students are also expected to understand communication literacy. Many are good at speaking English but sometimes lack direction and lack of knowledge about communication literacy. On this occasion, the lecturers of Putera Batam University held a Coaching for Students and Teachers on Profession English Proficiency and Communication Law Literacy for Teachers and Students at MTs Manbaa'ul Nurul Hidayah Batam. The method used is by collecting data from observations, questionnaires and group discussions. The result of this service is that participants already understand English and communication legal literacy. There are 60% of the participants who have practiced English and communication law literacy.

Abstract

SMK Bisa, SMK Hebat, and SMK Siap Kerja are the mottos that are often heard today as motto in SMK. Vocational High Schools are specifically directed to master a vocational from an early age so that Vocational High School graduates have specific abilities and can be competitive in the world of work. The current world of work also does not only master on hard skills, communication plays an important role for these students to support the vocational soft skill abilities. English as a medium of communication is also the most important role in the world of work. Moving on from the need to master communication with English media, the team of this community training took the initiative to go down to school to share their knowledge, especially in terms of English speaking. In communication skills are also needed to build an interesting atmosphere. Therefore, the rhetorical communication is needed as a way to build interesting atmosphere in speaking. Moving on from these problems the community team collaborated with language and social science experts implemented this activity by sharing knowledge toward vocational school in Batam. This training activity applied the community education with training and practice course technique. The training provided is oriented towards improving speaking and communication rhetoric skills through speech and debate methods. The results of this activity showed that students begin to enjoy practicing communication as speech speakers or debate speakers. Through this method, students felt more confident to speak English because they talk about contemporary topics and are close to the world of teenagers themselves.

Abstract

Digital literacy is widespread and often addresses key issues. To educate students on digital literacy, it is necessary to develop reading skills, read the content carefully, and then use digital literacy to understand the content. This activity aims to improve the digital literacy skills of teenagers, especially at SMAN 2 Koto Pariaman. The formulation of activity forms, activity stages, and evaluation are the three stages that become the method of implementing PKM activities. The assessment results show that the level of understanding of members about continuing education is very high, and they have awareness about the risks involved in the web and virtual entertainment, as shown by the consequences of the poll of 83.3% related to negative substances on the Web. However, the evaluation results showed that the majority of participants only used the internet to communicate, play games, and use social media, so they did not understand digital literacy regarding the use of the internet for science.
