Abstract

In the world of work, many company need high school or bachelor graduates who have soft and hard skills. One of supporting soft skill needed in work world is the ability to communication. For this reason, students in school are expected to be able to understand communication literacy. Many are proficient in English but sometimes lack direction and lack knowledge of communication literacy. On this occasion, Putera Batam University lecturers conducted training activity for Students in high school on Profession English Proficiency and Communication Law Literacy especially at SMA Negeri 27 Batam. Lecturers who provide coaching and training are lecturers who are experts in their fields; they are from English Literature and Law program. The training provided is oriented towards improving language speaking skills and communication legal literacy using the communication practice method. The results of this training show that students are able to demonstrate their communication skills by 1) appearing in front of the class practicing their language skills 2) Understanding about communication literacy is shown by active participation of students in discussions 3) evaluating by holding practice followed by discussion.

Abstract

Meningkatnya tindak pidana pencabulan yang dilakukan oleh anak yang terjadi di kota Batam pada tahun 2019 sebanyak 19 kasus yang melibatkan 15 anak, kemudian tahun 2020 sebanyak 22 kasus yang melibatkan 18 anak, tahun 2021 sebanyak 37 kasus yang melibatkan 30 anak, dan tahun 2022 sebanyak 40 kasus yang melibatkan 30 anak, sehingga menimbulkan kekhawatiran dan keresahan dari masyarakat terhadap tumbuh kembang anak, melihat dari banyaknya kasus yang terjadi penulis mencoba mencari penyebabnya sebagai akibat dari meningkatnya pelecehan dan kejahatan asusila terhadap anak di Kota Batam. Penelitian ini merupakan penelitian yuridis normatif yang menganalisis peraturan perundang-undangan yang berlaku dan data sekunder lainnya yang dikumpulkan dengan teknik studi kepustakaan dan dianalisis secara deskriptif kualitatif. Hasil penelitian bahwa penegakan hukum terhadap pelaku tindak pidana asusila terhadap anak di Kota Batam (Studi pada Polres Barelang Kota) tergolong efisien. Ada faktor-faktor yang dapat mempengaruhi penegakan hukum, antara lain faktor hukum, faktor penegak hukum, sarana atau fasilitas, dan faktor masyarakat dan budaya. Terdapat faktor-faktor yang menjadi kendala atau kendala dalam pemberantasan tindak pidana asusila terhadap anak di Kota Batam. Data yang diperoleh dari Polresta Barelang Polresta Kota Batam menunjukkan adanya faktor seperti pendidikan dan ekonomi yang rendah, faktor lingkungan atau tempat tinggal, faktor minuman beralkohol, faktor teknologi, dan faktor peran korban dalam ranah etiologi kriminologi.

Abstract

The material provided in this coaching is divided into 2 groups, namely the legal group and the business group aimed at "Youth / Young Generation". The coaching material given to the legal group is to provide an introduction and / or understanding of the existing arrangements (rules of law), because after all he will be the next generation of religious leadership, nation and state. To not be wrong, then from an early age given an understanding of the rule of law that exists in the midst of the nation and state society. With the hope that with a brief education / training like this, he will understand. The debriefing material provided to business groups is to provide an introduction and/or understanding and invite adolescents/young people from an early age to develop their talents in business. To understand the importance of living independently in the future, of course in this case how to do good business, full of honesty and justice, and understand how to develop.

Abstract

This research aims to analyze the factors that influence the implementation of tourism development in the Anambas Islands to increase the number of tourist visits. The research method is descriptive qualitative, primary data sources are interviews and observations. Secondary resources are reviews of relevant literature and documentation from the Anambas Cultural Tourism Office. The data analysis technique is Triangulation. Factors influencing implementation can be seen from the theory developed by Van Metter and Van Horn, namely policy standards and targets, resources, communication, characteristics of implementing agents, and social, political, and economic conditions. The regulations governing Anambas Islands tourism are included in the National Tourism Destination (DPN) development plan through the 2010-2025 National Tourism Development Master Plan (RIPPARNAS), which is directed at tourism development which is difficult to achieve policy program targets, this is because in the regulations There are no Standard Operating Procedures available in tourism development itself, so that SOPs in regulations become one of the influential obstacles. Then, synergy between the government and the community is needed in implementing the tourism development of the Anambas Islands.

Abstract

In an increasingly digital era, the issue of theft and dissemination of personal data has become a profound global concern. This research focuses on criminal liability in the dissemination of personal data, with the aim of reviewing and analyzing the current criminal legal framework in addressing violations related to personal data. The research employs a normative juridical method, referencing various legislations, court decisions, and relevant legal literature. We also analyze recent changes and developments in criminal law concerning the dissemination of personal data. The results of this research depict the complexity of regulations related to handling cases of personal data dissemination. Factors such as the type of data involved, the intent of the perpetrator, and the impact on affected individuals are crucial considerations in determining the level of criminal liability. The research also discusses potential criminal sanctions that may be imposed on perpetrators of personal data breaches, including fines and imprisonment. Additionally, we identify challenges in enforcing laws related to personal data and provide insights into potential improvement efforts. This research provides valuable insights into how current criminal law addresses the issue of personal data dissemination and promotes better protection for individuals in an ever-evolving digital era.

Abstract

Whistleblowing plays a strategic role in maintaining transparency and accountability within institutions, including in the context of employment relations. However, whistleblowers often face retaliation in the form of dismissal, psychological pressure, or unfair transfers. In Indonesia, regulations explicitly protecting whistleblowers from retaliation are still absent. The absence of an anti-retaliation clause in Law Number 13 of 2003 concerning Manpower indicates a weak legal framework for whistleblowers in the workplace. This study aims to analyze the legal gaps related to the protection of whistleblowers, identify socio-cultural factors that exacerbate the risk of retaliation, and compare protection models in other countries such as Malaysia and Australia. The methods used are a normative juridical approach and comparative law. The results show that Indonesian regulations are still partial and do not provide strict sanctions for perpetrators of retaliation. Therefore, legal reform is needed, including anti-retaliation provisions in the Employment Law and collaborating with the Witness and Victim Protection Agency (LPSK). This reform is crucial for strengthening good governance practices in the workplace and ensuring legal protection for workers with integrity.

Abstract

Dalam menjalankan suatu usaha masyarakat juga harus taat dan patuh pada peraturan perundang-undangan yang berlaku dinegara tersebut, khususnya dinegara Republik Indonesia. Menjalankan suatu usaha ada juga masyarakat yang berani melanggar peraturan yang berlaku demi mencari keuntungan yang lebih besar, salah satunya adalah peredaran rokok ilegal. Di Kota Batam peredaran rokok ilegal begitu menjamur, praktek tersebut tidak hanya dilakukan oleh pemain besar saja, penjual diwarung kecil juga ada menjual rokok ilegal tersebut guna untuk memperoleh keuntungan yang besar. Untuk mengetahui peran Bea Cukai Kota Batam dalam upaya menanggulangi peredaran rokok ilegal. Penelitian ini dilakukan dikantor Bea Cukai Kota Batam Tipe B dengan mengumpulan data melalui wawancara dan observasi. Hasil dari penelitin tersebut pihak Bea Cukai telah melakukan upaya preventif dan represif guna untuk menanggulangi peredaran rokok ilegal. Dalam upaya tersebut pihak Bea Cukai Kota Batam menemukan beberapa kendala dalam menjalankan tugas dan fungsinya, yaitu pelaku penyeludup yang menggunakan high speed dalam melakukan operasi mereka diwilayah perairan.

Abstract

Rapid technological development in the era of globalization has significantly transformed various aspects of human life, particularly in the digital economy and social interactions within cyberspace. The emergence of Industry 4.0, artificial intelligence, big data, and electronic transaction systems has improved efficiency and accessibility in modern society. However, these advancements are also accompanied by increasing misuse of technology, resulting in various forms of cybercrime such as hacking, online fraud, and other electronic-based criminal activities. This study aims to analyze the relevance of the principle of legality in the new Indonesian Criminal Code (KUHP) in addressing the evolution of digital crime in Indonesia, particularly in response to the rapid development of technology. The research method used is normative legal research with statutory and conceptual approaches, examining the new Criminal Code, the Electronic Information and Transactions Law, and relevant legal literature. The findings indicate that the principle of legality remains a fundamental doctrine in Indonesian criminal law, particularly through the application of lex scripta, lex certa, lex stricta, and lex praevia principles. However, the rapid, cross-border, and technologically complex nature of digital crime creates a regulatory gap, causing law to lag behind social reality. Although the new Criminal Code introduces the concept of living law, it has not fully addressed the complexity of evolving digital crimes. Therefore, harmonization between the Criminal Code, the Electronic Information and Transactions Law, and other sectoral regulations is required, along with adaptive legal reform, to ensure that the principle of legality remains relevant in providing legal certainty, justice, and effective law enforcement in the digital era.

Abstract

Sexual violence against women has become an increasingly serious social issue in Indonesia, with data showing a significant increase in reported cases, often linked to gender inequality and inadequate legal protection. Prior to the enactment of Law Number 12 of 2022 concerning Crimes of Sexual Violence (TPKS Law), the legal framework for protecting victims had weaknesses, such as limited coverage, a focus primarily on criminal aspects without a holistic approach to victims' rights, and a lack of effective mechanisms for recovery and restitution. This study aims to analyze the form and effectiveness of legal protection for women victims of sexual violence under the TPKS Law. The research method used is normative juridical, with a legal and conceptual approach, through analysis of legal texts, court decisions, and related legal concepts. Key findings indicate that the TPKS Law expands protection for victims through medical and psychological rights, protection from revictimization, social recovery, and more comprehensive restitution. In conclusion, the TPKS Law is a progressive legal instrument for protecting victims of sexual violence. However, its implementation still faces challenges such as limited resources, public awareness, and harmonization with other regulations.

Abstract

Cyberbullying is one form of crime in the digital space that has serious impacts on victims, both psychologically, socially, and economically. The characteristics of this crime, such as the anonymity of perpetrators, its wide reach, and the rapid dissemination of information, pose distinct challenges to the enforcement of criminal law. This study aims to analyze the criminal liability of cyberbullying perpetrators from the perspective of Indonesian criminal law and to identify obstacles in efforts to provide legal protection for victims.The research method employed is a normative juridical approach through library research, conducted by examining statutory regulations, legal doctrines, and relevant literature. The results of the study indicate that criminal liability for cyberbullying perpetrators is fundamentally supported by existing legal frameworks, primarily through Law Number 11 of 2008 on Electronic Information and Transactions, as amended by Law Number 19 of 2016, as well as provisions in the Indonesian Criminal Code, particularly Articles 310 and 311 concerning defamation. Nevertheless, the implementation of these legal provisions continues to face various obstacles, including the limited understanding of law enforcement officials, difficulties in digital evidence collection, technological developments that are not balanced with regulatory updates, and the low level of public awareness in reporting cases. Therefore, more comprehensive efforts are required through regulatory strengthening, capacity building for law enforcement authorities, inter-agency cooperation, and digital education and literacy to ensure effective legal protection for victims of cyberbullying in Indonesia.
