Abstract

Reclamation of coastal areas is becoming increasingly widespread in various regions, under the pretext of increasing investment and regional income, permits to carry out reclamation seem easy, BUMN/BUMD or the private sector are made partners of cooperation by the government as executors of reclamation projects. The reclamation project legalized by the government is based on the existence of marine conservation, investment in coastal areas and small islands, and the construction of seaside dwellings. Even though the reclamation project is in direct contact with the lives of the surrounding community, especially fishing communities in coastal areas and small islands. Privatization and commodification of marine resources which then displaces the existence of coastal communities and eliminates their access to their livelihoods, this is a violation of human rights. Based on this, the legal issues that will be discussed in this study are first, the government's obligation to protect human rights for communities in coastal areas and small islands. Second, whether Law Number 1 of 2014 concerning Amendments to Law Number 27 of 2007 concerning Management of Coastal Areas and Small Islands and the regulations under it have provided access to protection of the human rights of coastal communities and small islands.

Abstract

Harmonization and synchronization are required in the development of laws and regulations in order to strengthen the law and avoid overlapping regulations. Sexual crime legislation, there is the phrase "without the consent of the victim" or better known as sexual consent in the Regulation of the Minister of Education and Culture of Research and Technology Number 30 of 2021 concerning the prevention and handling of violence in the higher education environment (Permendikbudristek 30/2021), the term of sexual consent is not in line with the sexual crime regulations in other laws and regulations. This research method uses a normative approach that refers to legislation and norms, as well as a conceptual approach to explain the theory used systematically. The results of the study indicate that sexual consent is inappropriate for sexual violence, because sexual consent is contrary to the Criminal Code, the Law on the Elimination of Domestic Violence, the Trafficking in Persons Act, the Pornography Law, and the Act Sexual Violence.

Abstract

The additional pension program mandated in Article 189 paragraph (4) of Law Number 4 of 2023 concerning the Development and Strengthening of the Financial Sector (UU PPSK) aims to improve old-age protection for workers and harmonize existing pension programs. However, the discourse on wage deductions to pay additional pension contributions has raised concerns among workers, especially those with middle to lower incomes. This study examines the constitutionality of the additional pension program and the forms of legal protection for people who are unable to pay contributions. The research method used is normative legal research with a statutory and conceptual approach. The results show that the additional pension program has the potential to conflict with citizens' constitutional rights to social security and decent work. Legal protection for people who are unable to pay contributions can be carried out through government supervision, administrative sanctions, and efforts to restore participant rights. However, the implementation of the additional pension program still faces significant challenges, such as weak fundamental economic conditions and potential overlap with the existing social security system. Regulatory harmonization, strengthening supervision, and focusing on optimizing existing programs are needed to ensure the effectiveness of pension programs in ensuring the welfare of all Indonesian workers.

Abstract

This study analyzes the role and position of the Honorary Council of the Constitutional Court (MKMK) in maintaining the integrity and ethics of Constitutional Judges in Indonesia. Although MKMK has been legitimized through PMK Number 1 of 2023, in-depth studies on its position in the state institutional system are still limited. This research uses a normative approach with a focus on analyzing legislation and related legal concepts. The results show that MKMK acts as a quasi judicial body that handles violations of the code of ethics of constitutional judges, as well as a state support institution that supports supervision in the constitutional system. This research emphasizes the importance of a deeper understanding of the position of the MKMK to ensure its optimal function in accordance with the principles of the rule of law

Abstract

The retirement age for the position of Notary, as stipulated in Article 8 paragraph (1) letter b and Article 8 paragraph (2) of Law No. 30 of 2004 on the Position of Notary, explicitly limits the maximum age for holding the position to 65 (sixty-five) years. However, an extension may be granted up to 67 (sixty-seven) years. The Constitutional Court considers this retirement age regulation to be "constitutional," thereby opening the possibility for Notaries to extend their tenure until the age of 70 (seventy), provided they undergo a medical examination at a government hospital or a hospital designated by the Minister of Law. Following Constitutional Court Decision No. 84/PUU-XXII/2024, which allows Notaries to serve until the age of 70, this article explores the reasons behind the extension and the legal procedures required for its implementation.

Abstract

Pencak Silat, Indonesia’s cultural heritage and global sport, entails intense physical contact with high injury risks. Thus, legal protection is vital to safeguard athletes’ rights and ensure fair, safe, and dignified competition. Although Indonesia has legal frameworks on sports and human rights, their implementation in protecting Pencak Silat athletes remains weak and requires urgent improvement. Purposes of the Research: Analyze the forms and mechanisms of legal protection for Pencak Silat athletes in Indonesia from the perspective of sports law. Examine the integration of legal protection with human rights principles, particularly in relation to athletes’ safety and welfare. Provide recommendations to strengthen the existing regulatory framework and improve its implementation in the field. Methods of the Research: The research employs a normative juridical approach by analyzing laws and regulations, including Law Number 11 of 2022 on Sports and Law Number 39 of 1999 on Human Rights. The study also utilizes secondary data obtained from scholarly literature, government documents, and relevant case studies. A comparative analysis is conducted to evaluate the alignment between sports law provisions and human rights protection, supported by qualitative assessment of legal practices in Indonesia. Results of the Research: Findings show Indonesia has strong legal frameworks for sports and human rights, yet protection of Pencak Silat athletes remains weak. Issues include poor supervision, limited facilities, and low legal literacy. This study’s novelty is linking sports law and human rights, recommending stronger regulations, better institutional capacity, and synchronized policies to safeguard athletes’ rights, safety, and welfare.

Abstract

Indonesia's rapid digital transformation has heightened its exposure to cybersecurity threats, prompting the introduction of several national policies aimed at enhancing cyber resilience. This study evaluates the effectiveness of three key regulations—Peraturan BSSN No.8/2020, Perpres 82/2022, and Perpres 47/2023—through a qualitative policy analysis framework. Data were drawn from national cyber incident statistics, regulatory documents, and secondary literature. Methodologically, the study applies qualitative frameworks and correlates policy timelines with cyber incident volumes between 2020 and 2023. Statistical tools, including time-series and regression analyses, are used to determine regulatory impacts on threat reduction. Findings reveal that while the regulations establish a strong structural foundation, implementation remains weak. Cyber incidents continued to rise post-regulation, and key challenges such as agency fragmentation, underinvestment (0.02% of GDP), and limited stakeholder collaboration persist. Case studies, including breaches at Dukcapil and Imigrasi, underscore the urgent need for better enforcement and inter-agency coordination. Comparative analysis with regional peers like Singapore highlights further room for improvement in governance and public-private synergy. The study concludes that Indonesia’s cybersecurity policies are directionally sound but require systemic reforms, centralized coordination, and investment scaling to achieve tangible outcomes. These insights contribute to the literature on regulatory effectiveness and cyber governance in emerging economies

Abstract

Penelitian  ini  bertujuan  untuk  mengevaluasi  sistem pengelolaan keuangan dan pelaporan pajak di kantor notaris sesuai regulasi terkini, mengidentifikasi kendala yang dihadapi, serta merumuskan solusi strategis untuk meningkatkan kepatuhan. Pendekatan penelitian  menggunakan  metode  kualitatif  deskriptif  dengan  studi  literatur  dan  tinjauan yuridis normatif terhadap peraturan perundang-undangan, jurnal ilmiah, dan dokumen resmi. Hasil kajian menunjukkan bahwa keberhasilan pengelolaan keuangan dan pelaporan pajak sangat dipengaruhi oleh kualitas sistem informasi keuangan internal, literasi perpajakan, dan pemanfaatan  teknologi  digital  seperti  e-Filing, e-Billing, e-Bupot dan e-Faktur. Penelitian terdahulu  (Saptono  et  al.,  2023;  Setiawan et al., 2025; Febrina et al., 2024) menegaskan bahwa kualitas sistem digital dan kemudahan penggunaannya meningkatkan kepuasan dan niat  kepatuhan  Wajib  Pajak  profesi,  termasuk  notaris.  Namun,  tingkat  kepatuhan  notaris masih bervariasi, dipengaruhi oleh keterbatasan sumber daya manusia, minimnya pemahaman regulasi,    serta    adaptasi    terhadap    perubahan    kebijakan.    Regulasi    terbaru    seperti PER-08/PJ/2022, PER-6/PJ/2024, PER-7/PJ/2025, dan PMK No. 47/2024 menekankan kewajiban registrasi elektronik, integrasi NIK sebagai NPWP, serta penguatan pengawasan anti-penghindaran  pajak.  Rekomendasi  penelitian  mencakup  penguatan  kapasitas  SDM melalui pelatihan rutin, implementasi SIK terintegrasi, pendampingan oleh konsultan pajak, serta penyesuaian prosedur internal dengan regulasi terkini, guna meningkatkan akuntabilitas dan memastikan kepatuhan pajak yang berkelanjutan di lingkungan kantor notaris.

Abstract

Pasal 25A Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 pada penambahan afiks “yang berciri nusantara” memberikan derivasi terhadap konsep negara kepulauan sebagaimana diatur dalam United Nations Conventions on The Law of The Sea Tahun 1982, bahwa ada ciri khusus bagi Indonesia dalam memaknai konsep negara kepulauan. Untuk membahas hal tersebut, penelitian ini menggunakan metode penelitian hukum dengan pendekatan perundang-undangan, pendekatan konsep, dan pendekatan sejarah. Hasil penelitian ini menunjukkan bahwa ratio legis derivasi konsep negara kepulauan dalam konstitusi Indonesia pada amandemen kedua sebagai penguatan kedaulatan negara dalam pembangunan wilayahnya harus berciri nusantara. Founding constitution sejak awal perumusan, menyatakan bahwa wilayah Indonesia memiliki ciri khusus, hal tersebut juga menjadi dasar logis deklarasi Juanda bahwa Indonesia adalah negara kepulauan. Maka, akibat hukum pembangunan wilayah yang tidak didasarkan atas ketentuan konstitusi, khususnya politik hukum negara kepulauan yang berciri nusantara, memiliki potensi inkonstitusional. Kerangka hukum Negara Kesatuan Republik Indonesia adalah negara kepulauan yang berciri nusantara.

Abstract

Pemilihan kepala daerah merupakan salah satu pesta demokrasi dan menjadi elemen penting dalam sistem demokrasi di Indonesia. Pasal 18 ayat (4) UUD NRI 1945 mengamanatkan bahwa “Gubernur, Bupati, dan Walikota masing-masing sebagai kepala pemerintah daerah provinsi, kabupaten, dan kota dipilih secara demokratis.” Penentuan ambang batas pencalonan kepala daerah merupakan komponen krusial dalam sistem pemilu yang dirancang untuk mendukung stabilitas politik dan meningkatkan efektivitas pemerintahan. Namun, penerapan ambang batas ini sering memicu hal terkait dengan kepastian hukum serta konsistensinya terhadap prinsip-prinsip demokrasi. Penelitian ini membahas terkait dengan bentuk kepastian hukum dalam ambang batas pencalonan kepala daerah yang demokratis. Penelitian ini bertujuan untuk menganalisis dan mengetahui bentuk kepastian hukum ambang batas pencalonan kepala daerah yang demokratis yang sesuai dengan Pasal 18 ayat (4) UUD NRI 1945. Metode penelitian ini menggunakan hukum normatif dengan Pendekatan Perundang-Undangan (Statute Approach) dan Pendekatan Konseptual (Conseptual Approach). Hasil dari penelitian ini adalah bahwa makna dalam Pasal 18 Ayat 4 UUD NRI 1945 bersifat open legal policy dan bentuk kepastian hukum ambang batas pencalonan kepala daerah yaitu dengan ditiadakannya ambang batas (threshold).
