Abstract

Layanan informasi desa merupakan salah satu aspek penting dalam mendukung penyelenggaraan pemerintahan desa yang efektif, transparan, dan responsif terhadap kebutuhan masyarakat. Namun, penyampaian informasi mengenai fasilitas umum dan situs cagar budaya di Desa Dermayu masih belum optimal karena masih dilakukan secara konvensional dan belum didukung oleh media visual yang komunikatif. Kegiatan pengabdian ini bertujuan untuk mengoptimalkan layanan informasi desa melalui pembuatan dan visualisasi peta administrasi, fasilitas umum, serta situs cagar budaya di Kantor Desa Dermayu. Metode yang digunakan adalah pendekatan kualitatif deskriptif-eksplanatif melalui tahapan observasi lapangan, pengambilan titik koordinat menggunakan GPS, pengumpulan data sekunder, pengolahan data spasial dengan QGIS, validasi bersama perangkat desa, hingga pencetakan dan pemasangan peta di kantor desa. Hasil kegiatan menunjukkan bahwa program ini berhasil menghasilkan peta yang memuat informasi spasial secara lebih lengkap, akurat, sistematis, dan mudah dipahami. Peta yang dihasilkan tidak hanya berfungsi sebagai dokumen spasial desa, tetapi juga menjadi media informasi visual yang mendukung peningkatan kualitas layanan informasi, membantu administrasi desa, perencanaan pembangunan, publikasi potensi lokal, serta pengenalan situs cagar budaya seperti Makam Selawe, Masjid Pusaka Baiturrahmah, dan Sumur Penganten. Selain itu, keberadaan peta juga mendorong kesadaran masyarakat terhadap pentingnya pelestarian warisan budaya lokal. Dengan demikian, program kerja ini tidak hanya menghasilkan luaran berupa peta desa, tetapi juga menjadi bentuk pemberdayaan berkelanjutan yang memperkuat tata kelola informasi desa dan pelestarian budaya berbasis potensi lokal.

Abstract

This study aims to analyze legal protection for victims of domestic violence committed by perpetrators who use drugs and the obstacles in its implementation. The study uses an empirical juridical method with a statutory regulatory approach and field research through interviews and literature studies. The results of the study indicate that legal protection has been regulated in Law Number 23 of 2004 concerning the Elimination of Domestic Violence and Law Number 3 of 2026 concerning the Protection of Witnesses and Victims and is supported by assistance services by the DP3APPKB of Cirebon City. However, its implementation is not optimal because victims tend not to report due to fear, lack of understanding of legal procedures, economic dependence on the perpetrator and the perpetrator's characteristics as a drug user. Therefore, it is necessary to strengthen legal education, coordination between agencies and protection services that are more easily accessible to victims.

Abstract

Penelitian ini bertujuan untuk menganlisis pengaturan serta penerapan mengenai asas rechterlijk pardon dalam hukum pidana Indonesia sebagai instrumen untuk mewujudkan keadilan substantif. Penelitian ini menggunakan metode hukum normatif dengan pendekaan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa asas rechterlijk pardon memiliki landasan normatif yang kuat melalui Pasal 54 ayat (2) Undang-undang Nomor 1 Tahun 2023 tentang KUHP dan Pasal 256 ayat (1) Undang-undang Nomor 20 Tahun 2025 tentang KUHAP. Analisis terhadap empat putusan pengadilan menunjukkan adanya pola pertimbangan hakim yang relatif konsisten, meliputi ringannya perbuatan, kondisi pelaku yang rentan, bukan seorang residivis, serta adanya pemulihan hubungan dengan korban. Penerapan terhadap asas ini mencerminkan pergeseran paradigma pemidanaan dari pendekatan retributif menuju pendekatan yang lebih restoratif dan humanis

Abstract

Sexual violence against children is a crucial issue that has shown a steady increase over time and has significant impacts on the physical, psychological, and social well-being of victims. This study aims to examine the legal protection provided to child victims of sexual violence by the Women and Children's Service Unit (UPPA) of the Cirebon City Police, identify the obstacles that arise, and assess the effectiveness of its implementation. This study used an empirical juridical method with a sociological juridical approach, namely examining legal provisions and their application in practice through the collection of primary and secondary data. The results of the study indicate that legal protection for child victims of sexual violence is implemented through two main approaches: preventive and repressive. In the repressive approach, UPPA provides protection through an investigative process oriented towards the interests of the child, psychological assistance, protection of the victim's identity, and collaboration with various related parties to support the recovery process. The preventive approach is carried out through educational activities, outreach, and supervision involving families, communities, and the government to prevent acts of sexual violence. However, the implementation of this protection still faces various obstacles, including limited resources, low public awareness, and victims' psychological conditions, which can hinder the legal process. Therefore, more synergistic collaboration between law enforcement officials, the government, and the community is needed to ensure more effective and optimal legal protection for child victims of sexual violence, ensuring that children's rights are fully met.

Abstract

Background. Aggravated theft is a form of theft involving certain circumstances that result in a more severe criminal sanction. Aims. This study aims to analyze whether the elements of aggravated theft were fulfilled in Decision Number 135/Pid.B/2026/PN Sbr based on Law Number 1 of 2023 concerning the Criminal Code. Methods. This research employs a normative juridical method using a statutory approach and a case approach. The legal materials used consist of laws and regulations, court decisions, scientific journals, and legal literature, which are analyzed using a qualitative-descriptive method. Result. The results of the study indicate that the defendant's actions fulfilled the elements of aggravated theft as stipulated in Article 477 paragraph (1) letter e of Law Number 1 of 2023. These elements are met because the defendant took property belonging to another person without permission, with the intention of unlawfully possessing it, and committed the act at night inside a house. Conclusion. Therefore, the Panel of Judges' decision to find the defendant guilty of aggravated theft has a legal basis in the facts established during the trial.

Abstract

Sexual violence against children remains a serious concern in Indonesia, with the number of cases continuing to increase each year. The enactment of Law Number 12 of 2022 concerning Sexual Violence Crimes (Tindak Pidana Kekerasan Seksual, TPKS Law) marks a significant milestone in providing a more comprehensive legal framework for protecting victims and prosecuting perpetrators. This research aims to assess the implementation of legal protection for child victims of sexual violence at the Cirebon City Police Department and to identify the challenges faced in its application. Using a normative juridical research method with a legislative approach and a case approach, this study analyses primary legal materials — including the TPKS Law, the Child Protection Law, and the Kitab Undang-Undang Hukum Pidana (KUHP) — as well as secondary materials such as legal literature and field data obtained from the Cirebon City Police. The findings indicate that the TPKS Law provides a comprehensive legal basis for victim protection, rehabilitation, and the prosecution of perpetrators. However, its implementation faces a number of obstacles, including the psychological condition of victims, fear and shame within families, a tendency toward amicable settlement, the withdrawal of reports, and limited law enforcement authority. The study concludes that the effectiveness of legal protection is not solely determined by the regulatory framework, but is also shaped by social, cultural, and psychological factors. Accordingly, a collaborative approach among law enforcement, the government, and the community is essential to ensure optimal protection and justice for child victims. Strengthening public awareness, improving victim support services, and enhancing law enforcement capacity are crucial steps toward realising a child-friendly justice system.

Abstract

This study investigates the role of the public prosecutor in ensuring the right to restitution for children who are victims of sexual violence within Indonesia’s criminal justice system. Although the right to restitution for child victims is normatively guaranteed under the Child Protection Law, the Law on Sexual Violence Crimes, and related Government Regulations, the active participation of the prosecutor as dominus litis is essential for its implementation. The findings show that prosecutors are responsible for including restitution claims in the indictment or sentencing demand, ensuring that restitution is granted in court decisions, and coordinating the tracing and sale of the defendant’s assets to guarantee the execution of restitution. However, prosecutors continue to face several challenges in carrying out this responsibility. These include offenders who are unable or unwilling to pay, unclear technical regulations, and limited understanding of restitution procedures. As a result, restitution orders are often not fully enforced, thereby preventing victims’ rights to recovery from being effectively fulfilled. Therefore, there is a need to strengthen prosecutorial capacity, promote more active enforcement from the prosecution stage through execution, and establish clear guidelines for handling restitution claims in cases involving child victims of sexual violence as part of broader child protection efforts.

Abstract

This research is motivated by the importance of analyzing the grounds for a judge's sentencing decision regarding perpetrators of joint theft specifically in Judgment Number 128/Pid.B/2026/PN Sbr, which reveals a disparity in sentences between Defendant I and Defendant II. The study aims to analyze the fulfillment of the elements of Article 477 paragraph (1) letter g of Law Number 1 of 2023 concerning the Criminal Code and to examine the judge's reasoning for imposing different sentences on the two defendants. A qualitative method with a normative-juridical approach was employed, utilizing literature reviews and legal document analysis specifically Judgment Number 128/Pid.B/2026/PN Sbr, relevant legislation, books, and journals. The results indicate that the elements of joint theft were deemed satisfied based on trial facts: the presence of legal subjects, the act of taking a motorcycle belonging to another, the intent of unlawful possession, and the involvement of both Defendant I and Defendant II in removing the vehicle from the scene. The findings reveal that the sentencing disparity 1 year and 5 months for Defendant I versus 1 year for Defendant II was based on the principle of sentencing individualization. This took into account each defendant's role, degree of culpability, aggravating and mitigating circumstances, and criminal history; Defendant I had a prior conviction, whereas Defendant II had no criminal record. The study implies that imposing different sentences on perpetrators of the same offense can reflect proportional justice, provided it is grounded in trial facts and objective legal reasoning; thus, sentencing serves not merely as punishment but also aims to create a deterrent effect, facilitate rehabilitation, prevent recidivism, and ensure public protection.
