Abstract

This article analyzes the rejection of an application for child marriage dispensation at the Sukadana Religious Court, Indonesia. Normatively, building a family and preserving the lineage are human rights, but the judges reject the application for the marriage dispensation. This normative research used observation, interviews, and documentation to collect data. In rejecting the marriage dispensation, the Religious Court judges used two arguments: normative (fiqh rules) and juridical (regulations related to human rights). The legal arguments integrate Islamic values (benefits and avoiding disgrace) with human rights principles. They seek to protect the petitioners' human rights, especially children's rights. From the finding above, the researchers suggest that there is no conflict between Islam and human rights. Both harmonize in their value of protecting the citizens. This study has implications for the increased unregistered marriages that do not have legality.

Abstract

Moral values ​​and tolerance for families of different religions are the foundation in the most important efforts to maintain harmony in the family. Working together in doing good without differentiating the type of religion is a way to increase and strengthen harmony. The purpose of this study was to determine the factors that trigger religious differences in the family, to determine the inculcation of moral values ​​in children in different religious families and to determine the tolerance attitude of society in families in which have different religions. This research uses field research, using a qualitative descriptive approach, which is to clearly describe events in the form of moral inculcation and tolerance for families of different religions through the interview process. Factors that trigger religious differences in families due to interfaith marriages and interfaith families due to changing religions. The inculcation of children's moral values ​​in families of different religions includes: religiosity, discipline and morals. The attitude of tolerance in the community applies an attitude of tolerance to families of different religions including: freedom of religion, respect for different religions, and agreeing with religious differences. All types of applications carried out by the community have an attitude of tolerance.

Abstract

Penelitian ini bertujuan untuk mengungkap SEMA Nomor 2 Tahun 2023 dalam pencegahan perkawinan beda agama. Persoalan ini menarik untuk diteliti karena perkawinan beda agama sering meninggalkan polemik di masyarakat, termasuk di kalangan praktisi hukum. Penelitian menggunakan metode pustaka, sifatnya deskriptif analitis menggunakan sumber data hukum primer dan sekunder. Riset ini menyimpulkan bahwa SEMA menjadi petunjuk bagi hakim sekaligus untuk memutus polemik di kalangan hakim dan masyarakat. SEMA Nomor 2 Tahun 2023 ini juga berperan dalam pencegahan pernikahan beda agama dan sejalan dengan ajaran agama yang sesungguhnya memerintahkan setiap pemeluknya menikah dengan pria maupun wanita yang seagama. Oleh sebab itu ketika marak terjadinya penetapan pencatatan perkawinan pasangan beda agama dari peradilan sesungguhnya hal itu bisa diakhiri dengan SEMA tersebut. Sudah selayaknya hakim dalam memeriksa perkara perkawinan terlebih dahulu menggunakan asas formal yakni hukum perkawinan, bukan menggunakan hukum lain yakni hukum administrasi kependudukan.

Abstract

Dalam praktek transaksi digital metode pembayaran dengan menggunakan QR kode perlu adanya kehati-hatian terhadap tindakan pemalsuan QR kode oleh pihak yang melanggar hukum atau tidak bertanggung jawab. Penelitian ini bertujuan untuk menjelaskan dan menganalisis perlindungan hukum bagi konsumen pada transaksi pembayaran nontunai berbasis QRIS (Quick Response Code Indonesian Standard) Perspektif Hukum Positif dan Perspektif Hukum Ekonomi Syariah dengan pendekatan yuridis normatif. Hasil penelitian Analisis Perlindungan Hukum Bagi Konsumen Pada Transaksi Pembayaran Nontunai Berbasis QRIS (Quick Response Code Indonesian Standard) Perspektif Hukum Positif berkaitan dengan perlindungan hukum preventif, selain dari pengaturan umum mengenai perlindungan konsumen yang terdapat dalam Undang-Undang Perlindungan Konsumen No. 8 Tahun 1999, bagi Konsumen QRIS terdapat regulasi signifikan yang mengatur. Bank Indonesia telah menerbitkan Pengaturan Anggota Dewan Gubernur Nomor 21/18/PADG/2019 tentang Implementasi Standar Nasional Quick Response Code, Peraturan Bank Indonesia Nomor 22/20/PBI/2020 tentang Perlindungan Konsumen Bank Indonesia, Peraturan Bank Indonesia Nomor 18/40/PBI/2016 tentang Penyelenggaraan Pemrosesan Transaksi Pembayaran, Peraturan Bank Indonesia Nomor 20/6/PBI/2018 tentang Uang Elektronik. Kemudian berdasarkan Perspektif Hukum Ekonomi Syariah di tinjau dari teori sadd dzari’ah terkait pengumpulan data pribadi yang semula diperbolehkan karena mengandung kemanfaatan, tetapi dalam tujuan yang akan dicapainya berpotensi dapat berakhir dengan kerugian dan kemafsadatan bila tanpa adanya perlindungan dari Pemerintah. Abstract

Mastering vocabulary is essential for language acquisition, particularly in Arabic. This study aims to develop and evaluate the feasibility and effectiveness of AVLI (Arabic Vocabulary on Lectora Inspire) for grade X students at Baitul Jannah Integrated Islamic High School. Employing a research and development approach, this study utilized the ADDIE development model, which includes analysis, design, development, implementation, and evaluation phases. Data were collected through documentation, observation, interviews, questionnaires, and tests. The findings revealed that the Lectora Inspire-based mufradat learning media is deemed feasible, achieving a feasibility test score of 75% from material expert validators and 90% from media validators. User feedback was positive, with 86% of 106 respondents finding the learning media engaging. Moreover, AVLI proved effective in enhancing mufradat learning, evidenced by an increase in average student scores from 65.5 on the pretest to 85.5 on the posttest, a rise of 30 points. Consequently, this study concludes that Lectora Inspire-based learning media is both feasible and effective for teaching mufradat to grade X students, highlighting its potential implications for Arabic language education.

Abstract

The objective of this research is to explore the relationship between the cultural environment, social media, and religious moderation among Generation Z in Lampung Province. This study utilizes a quantitative research methodology supported by SmartPLS 3.0 software. Primary data was collected using a purposive sampling method, focusing on Generation Z in Lampung Province, with a total of 500 respondents. Data collection was conducted via Google Forms, and responses were evaluated using a Likert scale. The findings reveal a path coefficient of 0.409, coupled with a notably high t-statistic value of 6.345 and a p-value of 0.000. These results provide empirical evidence that the cultural environment exerts a positive influence on religious moderation within Generation Z in Lampung Province. Likewise, a path coefficient of 0.350 and a t-statistic value of 5.354, which surpasses the critical threshold of 1.96, along with a p-value of 0.000, indicate that social media positively impacts religious moderation in this cohort as well. In summary, the research underscores the significant roles that both the cultural environment and social media play in shaping religious moderation among Generation Z in Lampung Province. This study adds to the existing literature by examining the interplay between cultural and technological influences on the religious behaviors of young people. By understanding how local and global cultural values disseminate through social media and shape attitudes towards religious moderation, the findings offer valuable insights into the sociology of religion. Practically, these insights are essential for policymakers, educators, and religious institutions in crafting programs that promote diverse religious moderation. Such initiatives are crucial for preventing polarization, fostering tolerance, and enhancing social cohesion in an ever-changing landscape.

Abstract

The purpose of this research is to analyze fiqh siyasah on the decision of the Constitutional Court Number 116/PUU-XXI/2023 on Parliamentary Threshold. Through a normative juridical approach and fiqh siyasah analysis, this research examines the principles of justice, deliberation and maslahat in accordance with sharia values in decision-making by the panel of judges. This research is normative juridical research, namely research by collecting primary and secondary legal materials that are relevant to research using a conceptual approach, to the decision of the Constitutional Court Number 116/PUU-XXI/2023 both in the study of constitutional law and fiqh siyasah. The results of this study found that the constitutional court emphasized a formal legal approach in decision making so that substantive justice was not achieved. This can be seen that the Constitutional Court continues to impose a parliamentary limit of 4% because it is considered not contrary to the principles of the 1945 Constitution. In the study of fiqh siyasah on the decision of the Constitutional Court Number 116 / PUU-XXI / 2023 concerning Parliamentary Threshold, it shows the lack of substantial judicial ijtihad value. The Court is more inclined to legal formalities than fighting for representative justice which should be the main focus. One of the ijtihad that can be used by the Constitutional Court is ijtihad ta'lili, which is ijtihad based on an analysis of 'illat al-ḥukm (the reason or cause of a legal provision). In this context, the Court should analyze whether the 4% threshold still meets the rationality of justice and democratic effectiveness, or has actually exceeded its original purpose and caused constitutional harm.

Abstract

Abstract: Halal food decisions by Muslim consumers illustrate complex interactions. In urban and suburban areas, generation Z faces a multicultural and pluralistic environment which influences their perspective, including regarding food consumption. Halal food purchasing decisions by Muslim consumers around the world reflect a complex mix of Halal Food Awareness and Halal Certification. The aim of this research is to look at aspects of halal food awareness and halal certificates in making decisions to purchase halal food for Generation Z Muslim consumers in urban and sub-urban areas. The research methodology used in this research is quantitative using SmartPLS 3.0 software. Primary data collection was carried out by taking a sample of respondents, namely generation Z Muslim consumers in Urban and Sub-Urban areas in Lampung Province using a purposive sampling method. A total of 300 samples were used for this research. Data was obtained through the use of Google Form, with indicator assessment carried out using a Likert Scale. The research results show that awareness of halal food and halal certificates influence the decision to purchase halal food among Generation Z Muslim consumers in urban areas in Lampung Province. Awareness of halal food influences the decision to purchase halal food among Generation Z Muslim consumers in Sub-Urban Areas in Lampung Province. Halal certificates do not influence the decision to purchase halal food among Generation Z Muslim consumers in Sub-Urban Areas in Lampung Province.Keywords: Halal Food Awareness; Halal Certificate; Purchasing Decisions; Muslim Consumers;  and Generation Z
