Abstract

Akad ba’i murabahah merupakan salah satu akad transaksi dalam jual beli yang dilakukan dalam bentuk hutang piutang seperti contoh pada pembiayaan. PT FIF Syariah cabang Banda Aceh ialah salah satu lembaga keuangan non bank yang memberi pelayanan pembiayaan kepada masyarakat khusus pada produk AHM. Qanun No. 11 Tahun 2018 tentang Lembaga Keuangan Syariah menjadi salah satu peraturan yang menetapkan bagaimana praktik dalam transaksi muamalah yang sesuai dengan prinsip Islam. Penelitian ini bertujuan untuk meneliti bagaimana Penerapan Diktum-diktum perjanjian pembiyaan pembelian motor secara non tunai pada PT FIF Syariah cabang Banda Aceh pasca pemberlakuan Qanun LKS No. 11 Tahun 2018? Dan Bagaimana tinjauan akad ba’i murabahah terhadap klausula dan diktum perjanjian pembiayaan pembelian motor pada PT FIF Syariah cabang Banda Aceh pasca pemberlakuan Qanun LKS No. 11 Tahun 2018?. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan yuridis normatif, teknik pengumpulan data berupa dokumentasi kontrak. Hasil penelitian dari analisa kontrak perjanjian pembiayaan pada PT FIF Syariah cabang Banda Aceh yang telah dilakukan menunjukkan bahwa penerapan diktum perjanjian yang telah diterapkan sesuai dengan ketentuan yang dimuat dalam Qanun LKS, pada penerapannya pihak manajemen PT FIF Syariah mengutamakan kesepakatan dari pada pihak konsumen sebelum melanjutkan kontrak. Klausula dan diktum perjanjian yang telah dimuat dalam kontrak perjanjian pada PT FIF Syariah cabang Banda Aceh ini juga telah memenuhi syarat sah jual beli dalam bentuk akad ba’i murabahah, didalamnya meliputi subyek hukum, keterangan objek yang jelas, transparansi harga dan perolehan margin keuntungan, biaya-biaya, penetapan denda dan pemberi kuasa atas jaminan fidusia.

Abstract

Trust is crucial in a business like Seven Barbershop; the two sides work together as funders and managers. As a result, the Seven Barbershop business gained proportionally, 50:50. The purpose of this research is to identify the system for the outcomes in the Seven Barbershop business, which operates under the accreditation. The researchers used observation and interview methods to gather data; inductive data analysis techniques were used, and the researchers viewed the system for the outcome at Seven Barbersho as part of the overall scheme, so that researchers could draw conclusions as a whole. The results of the research show that the practice of bsgi results is already in line with the theory, as demonstrated by the fact that Taufik Agustia owns the business of Seven Barbershop, which is a shohibul mall. Where the owner of the capital gave the space and equipment to the researchers, Taufik Agustia. In a partnership at Seven Barbershop, capital owners and managers share profits proportionately. This means that the profits from monthly turnover are deducted from operating costs, such as the purchase of silets, strawberries, hair oil, electricity, and charges, then the net profit is divided between the capital owner and the managers.

Abstract

One of the financial institutions that contribute effectively to channeling business capital financing is the Sharia Consumer Cooperative Mitra Niaga Sejahtera located in Lambaro Aceh Besar. This institution is supervised by the Sharia Supervisory Board which is tasked with overseeing the operations and practices of LKS in order to adhere to sharia principles. This research examines murabahah financing and looks at the extent of the supervision of the Sharia Supervisory Board at the Mitra Niaga Sejahtera Sharia Consumer Cooperative. So that it raises questions about the murabahah financing mechanism based on the DSN MUI Fatwa Review. In this study the authors used a type of qualitative research and produced data in the form of descriptive analysis. Data collection techniques using interview techniques in the field and documentation. The results of the research obtained that the initial mechanism to become a member / prospective member of murabahah financing is by submitting application for murabahah business capital financing with predetermined conditions, ensuring that murabahah financing is on target, checking the pillars such as contracts, parties to the transaction, objects, objectives and benefits of the financing.
