Abstract

This article explores how the Religious Offices in Surabaya and Sidoarjo implement preventive measures against child marriage, sirri marriage, and domestic violence—issues that have the highest incidence rates in East Java. Notably, only a limited number of Religious Offices have actively engaged in such preventive efforts. This study examines the implementation, challenges, and evaluation of these preventive measures through interviews with relevant stakeholders. The findings indicate that the preventive initiatives undertaken by the Religious Offices in Surabaya and Sidoarjo are to promote family well-being by fostering healthy family relationships in both thought and action, ensuring financial stability, upholding the principles of Islamic marriage, and protecting families from violence. These efforts seek to establish a stable family structure capable of raising future generations. [Artikel ini mengeksplorasi bagaimana Kantor Urusan Agama Surabaya dan Sidoarjo dalam melakukan pencegahan terkait perkawinan anak, nikah siri, dan KDRT. Pasalnya, tidak semua Kantor Urusan Agama mengimplementasikan pencegahan terkait isu-isu di atas. Kantor Urusan Agama di Surabaya dan Sidoarjo menjadi acuan utama penelitian ini. Penelitian ini sendiri mengkaji bagaimana pelaksanaan, tantangan, dan evaluasi pencegahan dari ketiga problematika tersebut dengan wawancara mendalam kepada para aparat Kantor Urusan Agama Surabaya dan Sidoarjo. Di simpulkan bahwa implementasi pencegahan yang dilaksanakan oleh Kantor Urusan Agama Surabaya dan Sidoarjo tidak lain adalah dengan mewujudkan keluarga sejahtera dengan mengatur pola hubungan keluarga yang baik dalam pemikiran dan tindakan. Fokus mereka adalah meningkatkan kemampuan dalam mengelola kebutuhan finansial, pemahaman terkait prinsip-prinsip perkawinan menurut Islam, serta menguatkan pemahaman para pasangan terkait tindakan anti kekerasan.]

Abstract

Puasa merupakan salah satu kewajiban yang wajib dijalankan bagi setiap orang  Puasa dimulai saat terbitnya fajar sampai terbenanmnya Matahari. Selaras dengan itu, secara umum perhitungan mulai dan berakhirnya puasa, mengikuti jadwal imsakiyah waktu setempat. Namun, hal yang berbeda di Sembung, Margopatut, Sawahan, Nganjuk yang dalam melaksanakan puasa mengikuti wilayah Bojonegoro.  Berangkat dari kasus tersebut di atas, maka penelitian ini dirancang dengan tujuan untuk mengetahui tinjaun fiqih waktu salat terhadap kasus tersebut Guna mencapai tujuan tersebut, maka penelitian ini dirnacang dalam penelitian kualititatif dengan metode pengumpulan data dengan penelaahan dokumen–dokumen yang terkait dengan obyek penelitian, serta analisis data dengan menggunakan analisis deskriptif induktif. Berdasarkan penelitin yang telah dilakukan diperoleh kesimpulan bahwa Pelaksanaan Puasa Warga Dusun Sembung Desa Margopatut Kabupaten Nganjuk Yang Mengikuti Waktu Imsakiyah Bojonegoro diperoleh bahwa waktu buka puasa selama satu tahun kalender masehi yang terdiri dari 365 hari terdapat 53% waktu maghrib lebih dahulu Bojonegoro 1 menit dibandingkan dengan wilayah Nganjuk, sedangkan 47% memperoleh hasil yang sama.

Abstract

Divorce in unregistered polygamous marriages constitutes one of the most pressing socio-legal challenges in contemporary Indonesia, particularly after the enactment of Supreme Court Circular (SEMA) No. 3 of 2018, which prohibits religious courts from granting isbat nikah for such unions. This article examines two interrelated questions: first, the practical problems of divorce faced by women in unregistered polygamous marriages within the SaMaRa Centre community; and second, the perspectives of religious court judges regarding these issues, assessed through the normative lenses of the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) and Maqāṣid al-Sharīʿah. Methodologically, this study adopts qualitative fieldwork, combining semi-structured interviews with women affected by such marriages and judges from religious courts in Surabaya and Probolinggo. The findings reveal divergent judicial approaches: some judges uphold strict procedural consistency in line with SEMA No. 3/2018, while others emphasise fairness and maṣlaḥah (public welfare) to justify more flexible rulings. This divergence underscores a judicial dilemma between procedural uniformity and the imperative of justice for vulnerable women. By situating these debates within international human rights norms and Islamic legal theory, the study emphasises the need to develop a more inclusive legal framework that balances state regulations with gender justice. Ultimately, it argues for stronger judicial pathways to protect women’s rights in informal unions, offering insights into the intersection of law, religion, and social realities in Muslim-majority contexts.

Abstract

This paper explores the aspect of maqasid al-shari’ah in the Shafi’i madhab (school of Islamic jurisprudence) and the urgency of the maqasid al-shari’ah (Islamic law objectives) of the Shafi’i madhab in the ijtihad (independent reasoning) of contemporary Islamic law. A qualitative descriptive approach was designed in this literature study. The present study promotes that the aspect of maqasid al-shari’ah in the Shafi’i madhab can be noticed in qiyas (analogical reasoning). The Shafi’i madhab concerns al-Juwaini’s (a prominent Sunni figure) ideas and thoughts to classify al-maslahah al-daruriyyah (primary interests), al- hajiyyah (secondary interests), and al-tahsiniyyah (complimentary interests). Likewise, al- Ghazali’s (another influential Mulism jurist) views on about al-daruriyyah al-khams (five categories of primary interests) in al-Mustasfa, his greatest work of the law, becomes the basic guideline on the Islamic law issuance in this school of thoughts. Maqasid al-shari’ah, the foundation for ijtihad, in the Shafi’i madhab is employed when a new issue has no legal considerations at all in the past and needs to possess a legal certainty, or there has been a decision, but it requires re-ijtihad since the legal decision does not confirm the current conditions. Additionally, the re-ijtihad is also attempted due to different aspects of public interests/benefits. It, therefore, needs a new consideration that differs from the previous law.

Abstract

The issue of dawn is a classic discussion that is interesting to study. Rumors about the differences in interpretation of the Sharia evidence from the perspective of the imam of the school of thought and astronomy have become an actual discussion that is never-ending to be reviewed. It seems that dawn is one of the determinants of the entry of the five obligatory prayer times, so it is an urgent problem among Muslims to know the form of visualization and when dawn occurs. Therefore, it is necessary to have a match between the naqli evidence and the opinions of the imam of the school of thought and astronomy to interpret dawn as a sign of the entry of the morning prayer time. However, if there is a discrepancy between the three, it does not necessarily mean that the sharia evidence needs to be corrected. But rather an oversight in interpreting and studying nature regarding its relationship to the sharia evidence.
