Abstract

Abstract: The Office of Religious Affairs (KUA) is an institution under the auspices of the Ministry of Religious Affairs providing services to muslim communities in terms of marriage registration. As a service center, kua is expected to always provide optimal effort in order to create satisfaction in the community. In the midst of the Covid-19 Pandemic, KUA services must also be able to be done optimally by making new policies so as not to hamper the work program that has been established. This study analyzed the effectiveness of KUA services of Sumenep City Subdistrict. This type of research is normative legal research. The approach used is socio-legal. The solution of legal issues is analyzed qualitatively. The data collection techniques used are observations, interviews and documentation. The results of this study show that the effectiveness of Kua services of Sumenep City Subdistrict is classified as effective. That can be seen in the absence of denial of service during the Covid-19 Pandemic. That is because there is a system of employee work that is done alternately. Several supporting factors and inhibitory factors influence the effectiveness of KUA services in the Sumenep City District. Its supporting factors are the work environment, discipline and work ethic, community environment, and facilities and infrastructure. These supportive factors can accelerate and make a service run effectively. At the same time, the inhibiting factors are the limitations of Human Resources (HR) and distant locations. Keywords: Effectiveness, Service, Office of Religion Affairs (KUA), District of Sumenep City Abstrak: Kantor Urusan Agama (KUA) merupakan lembaga yang berada di bawah naungan Kementerian agama memberikan pelayanan kepada masyarakat yang beragama Islam dalam hal pencatatan nikah. Sebagai sebuah pusat pelayanan, diharapkan KUA selalu memberikan usaha yang optimal agar terciptanya kepuasan di dalam masyarakat. Di tengah Pandemi Covid-19 ini, pelayanan KUA juga harus dapat dilakukan secara optimal dengan cara membuat kebijakan-kebijakan baru agar tidak menghambat program kerja yang telah ditetapkan. Penelitian ini menganalisis efektivitas pelayanan KUA Kecamatan Kota Sumenep. Jenis Penelitian ini adalah penelitian hukum normatif. Pendekatan yang digunakan adalah socio-legal. Adapun pemecahan isu hukum dianalisis secara kualitatif. Teknik pengumpulan data yang digunakan adalah observasi (pengamatan), wawancara dan dokumentasi. Hasil penelitian ini menunjukkan bahwa efektivitas pelayanan KUA Kecamatan Kota Sumenep tergolong efektif. Hal ini dapat dilihat dengan tidak adanya penolakan pelayanan masa Pandemi Covid-19. Hal tersebut karena terdapatnya sistem kerja pegawai yang dilakukan secara bergantian. Efektivitas pelayanan KUA Kecamatan Kota Sumenep dipengaruhi beberapa faktor pendukung dan faktor penghambat. Di antara faktor pendukungnya adalah Lingkungan kerja, disiplin dan etos kerja, lingkungan masyarakat, dan sarana dan prasarana. Faktor pendukung tersebut dapat mempercepat dan membuat suatu pelayananan berjalan efektif. Sedangkan faktor penghambat yaitu keterbatasan Sumber Daya Manusia (SDM) dan lokasi yang jauh. Kata Kunci: Efektivitas, Pelayanan, Kantor Urusan Agama (KUA), Kecamatan Kota Sumenep.

Abstract

Human interaction with information and communication technologies has created a new culture in the digital age. It impacts new legal issues that demand solutions based on Islamic law. A theory incorporating culture in law construction is termed ‘urf’ in uṣūl al-fiqh. The purpose of this article is to investigate the role of ‘urf in the establishment of law for cyberspace problems. As a data source, this article employs a virtual ethnographic method with cyberculture products. The application of ‘urf in adapting culture in cyberspace is studied using Jasser Auda’s maqāṣid al-sharī'ah theory. This study discovered that culture in cyberspace is generated by netizens’ externalization, objectivation, and internalization processes. The ‘urf that applies in cyberspace is included in the ‘urf khaṣṣ. Meanwhile, the stated legislation must allude to the realization of human advantage, which means that the six aspects of Jasser Auda’s system must be considered when negotiating between revelation, fiqh, and ‘urf in cyberspace. Thus, the ‘urf of cyberspace can be employed as a legal element in digital-era situations.

Abstract

Sirri marriage is valid regarding religion but is not registered at the KUA; consequently, its legal force is still problematic. This article answers two problems: first, the phenomenon of sirri marriage in Surabaya; second, maqasid al-syariah analysis of the phenomenon of sirri marriage in Surabaya. This research used descriptive qualitative methodology. The data collection technique used documentation and interview techniques. The results showed that many sirri marriage practices were carried out by the Surabaya community. Many factors cause the choice of sirri marriage, namely the lack of understanding of legal awareness of the mandatory registration of marriage in Indonesia, the factor of pregnancy outside of marriage, and the polygamy factor. Responding to the phenomenon of sirri marriage in Surabaya, the KUA also made various prevention and handling efforts, such as socialization about the importance of marriage registration, the impact of sirri marriage, coaching for perpetrators of sirri marriage, and others. Based on the maqasid al-syariah study, the phenomenon of sirri marriage is not an ideal marriage for Indonesian society because it cannot realize the objectives of sharia.

Abstract

The universal and integral understanding of the Islamic law need an integrative effort between jurisprudence (fiqh) and legal maxim (usul fiqh) in an applicable form. Both have a close relationship in building the foundation and overall material of jurisprudence. Theoretically, legal maxim is an Islamic legal reasoning method that would later raise the jurisprudential material. Therefore, to understand and respond the social problem of Islamic law, the integration between jurisprudence and legal maxim is absolutely needed. The only partial understanding of Islamic law by simply studying its product as written in some classical books of fiqh will certainly make it uprooted from its own historical aspect. While implementing Islamic law merely rooted from its methodology cannot comprehensively catch the chain of Islamic legal thought. It is, therefore, a necessary to integrate between fiqh and usul fiqh to have an integral understanding of Islamic law. This study focuses to realize such effort with a specific discussion on the case of marriage age limit under the maslahah mursalah perspective. The result of the integration of fiqh and usul fiqh is that the minimum age of conducting marital contract based on Islamic law in Indonesia is sixteen years old for woman and nineteen years old for man. [Memahami hukum Islam secara universal integral memerlukan upaya integrasi antara fiqh dan ushul fiqh dalam bentuk aplikatif. Keduanya memiliki korelasi erat dalam membangun aturan formil dan materil hukum Islam. Secara teoritis, ushul fiqh merupakan metode penalaran hukum Islam yang kemudian akan melahirkan fiqh. Oleh karena itu, untuk memahami dan menanggapi masalah sosial hukum Islam, integrasi antara ushul fiqh dan fiqh mutlak diperlukan. Mempelajari hukum Islam dengan hanya bermodal pemahaman fiqh seperti yang ditulis dalam beberapa buku klasik fiqh tentu akan membuatnya tercerabut dari aspek historis sendiri. Sementara menerapkan hukum Islam hanya berakar dari metodologinya tidak dapat secara komprehensif menangkap rantai pemikiran hukum Islam. Oleh karena itu, diperlukan upaya mengintegrasikan antara fiqh dan ushul fiqh agar memiliki pemahaman integral dari hukum Islam. Penelitian ini berfokus untuk mewujudkan upaya tersebut dengan pembahasan khusus pada kasus batas usia perkawinan di bawah perspektif maslahah mursalah. Hasil integrasi fiqh dan ushul fiqh yang dilakukan menghasilakan kesimpulan bahwa usia minimal melakukan perkawinan berdasarkan hukum Islam di Indonesia adalah enam belas tahun untuk perempuan dan Sembilan belas tahun laki-laki.]

Abstract

Discuss the issue of women is no end. Every angle of women invites a discussion that must be done in depth, including the issue of hadith which describes the necessity of a mahrom for women when they want to travel. On the one side the necessity of mahram has a positive impact for the security and protection of women, but on the other side invites problems because the dynamics of women's lives today that require doing activities outside the home without having to be accompanied by mahrom. Really a dilemma for women. On the one side want to live his life according to the command of religion by following the hadith of the Prophet, but on the other side, when following hadith textualy will make her busy in activity outside the home. Therefore, this paper will discuss more deeply the problem of women's journey by reinterpretation mahram concept of Fazlurrahman hermeneutic perspective, in order to find the best solution for Muslim women in particular, for Muslims in general. [Membahas persoalan perempuan seakan tidak ada habisnya. Setiap sudut perempuan mengundang diskusi yang harus dilakukan secara mendalam, termasuk persoalan hadis-hadis Nabi yang menjelaskan tentang keharusan adanya mahrom bagi perempuan ketika mau mengadakan perjalanan. Di satu sisi keharusan tersebut berdampak positif demi keamanan dan perlindungan perempuan, tapi di sisi lain mengundang problem karena dinamika kehidupan perempuan zaman sekarang yang mengharuskan melakukan aktifitas di luar rumah tanpa harus didampingi mahrom. Sungguh dilematis bagi perempuan. Di satu sisi ingin menjalani hidupnya sesuai perintah agama dengan cara mengikuti hadis Nabi, tapi di sisi lain, ketika mengikuti bunyi tekstual hadis akan menjadikannya semakit repot dalam beraktiftas di luar rumah. Oleh karena itu, tulisan ini akan membahas lebih mendalam persoalan perjalanan perempuan dengan cara reinterpretasi dan reaktualisasi konsep mahram perspektif hermeneutika Fazlurrahman, agar ditemukan solusi terbaik bagi perempuan muslimah pada khususnya, bagi umat Islam pada umumnya.]

Abstract

This study discusses the actualization of the concept of mahram in the hadith about the maqasid al shari’ah. The focus of this study are: How is the editorial of the prophetic hadith about the prohibition of women’s travel without mahram? What do the scholars say about addressing women’s travel? How is the actualization of the concept of mahram in the course of women on maqasid al shari’ah? This research is a library research with a qualitative descriptive-analytical type and with a philosophical approach. The conclusion of this study, that the reason behind the prohibition of women not allowed to travel alone without mahram is a concern for women’s safety when they are alone. The statement like this, the law of the obligation of mahram for women traveling is contextual, because maqasid al shari’ah, within the context of this obligation, is to provide protection and security to women. Whereas the command to include mahram in the journey of women is basically one of the observations to protect women from unwanted possibilities. Whereas the trustee can be replaced with another guardian in the form of a protection mechanism for the community, both individually and collectively, among others through legal rules, legislation, and public policies that can lead to safer and protected trip. [Penelitian ini membahas tentang reaktualisasi konsep mahram dalam hadis tentang perjalanan wanita perspektif maqasid al-shariah. Fokus penelitian ini adalah: Bagaimana redaksi hadis nabi tentang pelarangan perjalanan perempuan tanpa mahram? Bagaimana pendapat para ulama’ menyikapi perjalanan perempuan? Bagaimana reaktualisasi konsep mahram dalam perjalanan perempuan perspektif maqasid al-shari’ah? Penelitian ini adalah penelitian pustaka. Penelitian ini juga berjenis kualitatif yang bersifat deskriptif-analitis. Pendekatan penelitian ini menggunakan pendekatan filsafat. Kesimpulan penelitian ini, bahwa alasan di balik larangan perempuan tidak boleh bepergian seorang diri tanpa mahram adalah kekhawatiran terhadap keamanan perempuan saat bepergiaan seorang diri. Dalam pernyataan ini seperti ini, hukum kewajiban mahram bagi perempuan bepergian bersifat kontekstual, karena maqasid al-syari’ah dari kewajiban ini adalah untuk memberikan perlindungan dan keamanan kepada perempuan. Sedangkan perintah penyertaan mahram dalam perjalanan perempuan pada dasarnya adalah salah satu wasilah untuk melindungi perempuan dari kemungkinankemungkinan yang tidak dikehendaki. Sedangkan wasilah tersebut bisa diaganti dengan wasilah lain berupa mekanisme perlindungan bagi masyarakat, baik secara individu maupun kolektif antara lain melalui aturan-aturan hukum, perundang-undangan, dan kebijakan-kebijakan publik yang bisa membujat perjalanan lebih aman dan terlindungi.]

Abstract

This study discusses the application of maqasid al-shar'ah principles in the gender-responsive marriage Jurisprudence. The focus of this research is: how the principles of maqasid al-shar'ah could be used as a foundation and approach of Ijtihad? How is the application of maqasid al-shar'ah principles in the issue of gender-responsive marriage Jurisprudence? This research is a qualitative research, which is in the form of descriptive-analytical library research. The approach used is the philosophical approach. In this study it was found that there are four rules of maqasid al-shar'ah which are used as the basis for jihad. These norms was then applied in a gender-responsive divorce Jurisprudence. This research concludes, that the holder of divorce rights is male, but the divorce can be pronounced based on the court's decision so that the results are more objective. In addition, divorce must be done for certain reasons, such as the cause of a constant dispute that cannot be resolved. Therefore, divorce without cause and without dialogue with his wife, is prohibited because it gives the effect of harm especially to his wife and children. [Penelitian ini membahas tentang penerapan kaidah maqāṣid al-sharīah dalam fikih pernikahan responsif gender. Fokus penelitian ini adalah: bagaimana kaidah-kaidah maqāṣid al-sharīah yang bisa dijadikan landasan dan pendekatan Ijtihad? Bagaimana penerapan kaidah-kaidah maqāṣid al-sharīah dalam persoalan fikih pernikahan responsive gender? Penelitian ini adalah penelitian kualitatif, berupa penelitian pustaka yang bersifat deskriptifanalitis. Pendekatan yang digunakan adalah pendekatan filsafat. Dalam penelitian ini ditemukan, bahwa ada empat kaidah maqāṣid alsharīah yang dijadikan landasan untuk berijtihad. Kaidah-kaidah inilah yang selanjutnya diterapkan dalam fikih perceraian responsive gender. Penelitian ini menyimpulkan, bahwa pemilik hak talak adalah laki-laki, akan tetapi talak tersebut bisa diucapkan berdasar putusan pengadil agar hasilnya lebih objektif. Selain itu, talak haruslah dilakukan karena sebab-sebab tertentu, seperti sebab perselisihan terus menerus yang tidak bisa diselesaikan. Oleh karena itu, perceraian tanpa sebab dan tanpa ada dialog dengan istri, hukumnya haram karena memberi dampak kemudaratan khususnya kepada istri dan anak. ]

Abstract

Pembahasan mengenai kepastian hukum benda jaminan gadai yang berasal dari hasil kejahatan dan akibat hukumnya bagi perusahaan gadai. Penelitian yang dilakukan dengan menggunakan metode yuridis normatif. Permasalahan yang berkaitan dengan bagaimana kepastian hukum bagi perusahaan gadai atas benda jaminan gadai yang berasal dari hasil kejahatan. Analisis kepastian hukum terhadap benda jaminan hasil kejahatan bagi kreditur sama sekali tidak didapatkan dikarenakan benda jaminan sebagai obyek gadai di kembalikan kepada pelapor/korban, sehingga kreditur tidak dapat menjual obyek gadai sebagai pengganti kerugian atas pinjaman dana yang sudah di keluarkan kepada nasabah.

Abstract

Pembahasan mengenai perlindungan hukum perdata pemilik tanah atas dasar adanya unsur penipuan dalam akta jual beli tanah yang dibuat oleh PPAT. Penelitian yang dilakukan dengan menggunakan metode yuridis normatif. Permasalahan yang berkaitan dengan perlindungan  hukum perdata pemilik tanah atas  akta perjanjian jual beli tanah yang dibuat oleh PPAT atas dasar adanya unsur penipuan. Analisis Perlindungan  hukum perdata pemilik tanah atas  dasar adanya unsur penipuan bahwa bagi pemilik hak atas tanah yang dirugikan maka pemilik mengajukan gugatan  untuk pembatalan AJB yang telah dibuat oleh PPAT, bentuk perlindungan bagi pemilik hak atas tanah, berkaitan dengan ganti rugi materiil sesuai apa yang telah diputuskan oleh majelis hakim.
