Abstract

Penelitian ini fokus pada kajian pada pasangan yang menikah dibawah umur memilih melangsungkan pernikahannya secara siri atau tidak dengan mengajukan dispensasi nikah. Kesimpulan penelitian adalah: Pertama, isbat nikah dilakukan oleh pasangan yang menikah dibawah umur dianggap penting dan sangat berguna, sebab dengan jalan tersebut mereka bisa mendapatkan akta nikah bagi perkawinan mereka, bisa memproses akta kelahiran anaknya, penentu status kewarisan mereka, pembuatan paspor dan lain-lain. Kedua, adapun pendapat Hakim Pengadilan Agama Pamekasan tentang permohonan pengajuan isbat nikah yang dilakukan oleh pasangan yang menikah dibawah umur menyatakan bahwa terdapat dua pelanggaran atas permohonan tersebut dan dinyatakan menyatakan bahwa seharusnya mereka (pasangan yang menikah di bawah umur) dulu sewaktu menikah mengajukan dispensasi nikah ke Pengadilan Agama. Sehingga pernikahannya tercatat sejak awal mereka menikah.

Abstract

The disputes resolution in the sharia financial institution gives opportunity and challenge for the Religious Court. Society tends to use ash-shulh by conducting deliberation in solving every dispute. This dispute resolution is taken because of the given legal freedom for society. Its purpose is to analyze the information on opportunities and challenges of the Religious Court as the judicial institution that has absolute authority in solving sharia economic disputes. This is qualitative research by studying secondary data and doing online and offline interviews with the informant. The Religious Court also plays a role in solving the disputes in the sharia microfinance institutions which generally choose the alternative way in disputes resolution by doing the negotiation. The study reveals that the sharia microfinance institutions depend on alternative ways in their dispute resolution such as negotiation and mediation by involving religious figures like Kyai. Madura society puts their trust in the religious figures more than the official institutions appointed in the Supreme Court Regulation No. 1 of 2016 concerning the Mediation in Court. However, the disputes resolution taken by society with the involvement of Kyai, is still based on the decree of the Religious Court in solving sharia disputes as a legal reference and a procedure taken by the judges.Penyelesaian sengketa di lembaga keuangan syariah memberikan peluang dan tantangan tersendiri bagi Pengadilan Agama. Masyarakat memiliki kecenderungan menggunakan ash-shulh dengan cara musyawarah mufakat dalam menyelesaikan setiap sengketa. Upaya penyelesaian sengketa ini dipilih karena kebebasan hukum bagi masyarakat untuk memilih jalan penyelesaian sengketa. Penelitian ini dilakukan dengan menggunakan metode kualitatif melalui data sekunder serta wawancara kepada informan, baik secara online maupun offline. Hasil dan pembahasan menunjukkan bahwa lembaga keuangan mikro syariah memilih jalur alternatif penyelesaian sengketa seperti perundingan dan mediasi dengan melibatkan melibatkan seorang tokoh agama seperti Kyai. Masyarakat Madura lebih percaya terhadap tokoh agama dibandingkan lembaga resmi yang telah ditetapkan oleh Peraturan Mahkamah Agung Nomor 1 tahun 2016 tentang Mediasi di Peradilan. Namun, penyelesaian sengketa yang diambil masyarakat dengan melibatkan Kyai, tetap mengacu pada keputusan pengadilan agama dalam menyelesaikan sengketa syariah sebagai acuan hukum dan cara yang diambil oleh para hakim.

Abstract

Corporate Social Responsibility and corporate zakat programs are two instruments for distributing with social responsibility funds that both have a legal basis, namely Law No.40 of 2007 concerning with Limited Liability Companies and company zakat, Law No.23 of 2011 concerning Zakat Management. In general, zakat and CSR contain the same vision and mission, namely concern for the overall social condition. Particularly, the life of the community is related to the welfare, security and peace of the people. The present study uses qualitative methods. The results of the research are Firstly, Bank BPRS Bhakti Sumekar Sumenep has form of Sharia Business Financing program activities (PUSYAR iB), Commercial Banks of BRI Syariah Bank fulfill CSR and corporate zakat through the National Zakat Agency (Baznas). Secondly, The social responsibility activities of Islamic Financial Institutions (LKS) which base their business activities on Islamic sharia principles are to set aside a portion (2.5%) of the company's profits in the form of zakat payments. In general, the expenditure of zakat funds here is not merely to fulfill the administrative requirements of the country but also to obtain the blessing value as a company based on sharia principles.

Abstract

The Ontalan tradition is a Maduranese tradition of throwing money to the bride and groom at the bridal events, which its people still preserve. The Ontalan practice is unique in its implementation because it only involves the groom’s family, relatives, and bhle. In contrast, the bride is not obligated to carry it out. Research was included in empirical legal research, namely studying and analyzing legal behavior, both individuals and society. The research method used by the researcher was qualitative. This research intended to understand the phenomena experienced by describing them in words and language in a particular natural context using various scientific methods. As empirical legal research, the approach used by researchers is a socio-legal approach. This research showed that Ontalan was first carried out at the groom’s house at the time of the bridal events, one day after its events. The groom’s family and relatives carried out the parties. The money given is not thrown away but is delivered using an envelope. Second, they carry out Ontalan to continue their ancestral heritage, help the bride and groom, reject lousy luck, and strengthen friendship because it does not conflict with religion. The benefits of implementing Ontalan were to create a spirit of social care through giving alms, bringing family relationships closer, strengthening ties, and making an equal household; those who do not implement Ontalan will receive social sanctions. Third, religion and culture are interrelated from the sociological perspective of Islamic law. The term Ontalan is a social definition because the actual social fact of Ontalan is a gift that, in its implementation, aims to create social change through efforts to help the bride and groom build harmonious and equal family relationships. Using the ‘Urf theory, the Ontalan tradition is included in ‘urf shahih because it does not conflict with sharia, benefits the practitioners, and contains religious values.

Abstract

The identification of the Madurese local concept, Bhuppa’-Bhâbhu’-Ghuru-Rato, is a part of the conflict resolution instrument based on social construction theory. This concept serves as a strong foundation underlying the social relationships and moral structure of the Madurese community, which remains deeply rooted in various aspects of daily life. This research aims to analyze the significant role of the socio-cultural value system of the Madurese community in shaping the behavioral compliance of Madurese families. The research is qualitative in nature, relying on both primary and secondary data. Primary data is obtained from field studies, including direct observations and mapping of research aspects. The research findings indicate that there has been controversy in the interpretation of threats related to social inequality, economic family issues, and the pandemic already experienced. This interpretational controversy has been caused by differences in understanding, conflicting interests, and varying traditions or practices. Differences in understanding are evident from the varying levels of comprehension between groups in the community, which also highlights differences in literacy levels when interpreting these issues. The four important elements of Bhuppa’-Bhâbhu’-Ghuru-Rato play a vital role in controlling and providing guidance through families to enhance compliance. These elements are actualized in daily praxis as binding normative rules.

Abstract

This study examines a sakinah family empowerment by optimizing the role of Badan Penasihat Pembinaan dan Pelestarian Perkawinan (Body for Marital Advisory Guidance and Maintenance (BMAGM)) and parents from a mental revolution perspective. There are three research questions: What is the so-called BMAGM? What and how is the correlation between the national revolution movement and sakinah family empowerment in Indonesia? What strategies are carried out in doing mental revolution in a family in order to have a sakinah family? This qualitative research collected both primary and secondary data. Three essential findings in this study are as follows. First, BMAGM is a legal social-religious organization whose particular duty is to cope with problems in a family. Second, there are three programs in the National Mental Revolution Movement (NMRM) as stated in the Presidential Instruction No. 12 of 2016 i.e. Indonesia in Order Movement (IOM) in point H/8; United Indonesia Movement (UIM) point J/10; Clean Indonesia Movement (CIM) point A/1. Third, in the perspective of the National Mental Revolution Movement (NMRM), parents’ role is essential. Therefore, parents are a strategic issue and should be prioritized in building sakinah family in Indonesia.

Abstract

This research aims to understand the phenomenon of increasing childfree marriage as a contemporary social construction and analyze it from the perspective of maqashid al-sharia, especially related to the principle of progeny preservation in Islam. This study uses a descriptive qualitative approach with a field research method. Primary data was obtained through in-depth interviews with two married couples (four informants), each of whom committed to a child-free marriage. The data were analyzed thematically with an eminic and ethical approach, as well as interpretive-descriptive. Research has found that couples' decisions to marry without having children are based on a desire to achieve happiness and well-being throughout their life with their partner, as well as avoiding the creation of a toxic family. These internal factors are reinforced by external factors such as education, economy, and career. Research has also found that wives play a key role in these decisions regarding reproductive rights. From the perspective of Islamic law, although there is no explicit text prohibiting childfree marriage, maqashid al-sharia still emphasizes the importance of the sustainability of offspring. The childfree decision is a conscious choice of a married couple to pursue happiness and well-being without the presence of children, on the grounds of avoiding the potential for toxic families. In the Islamic view, childfree marriage falls within the territory of ijtihadiyyah which requires a legal approach based on maqashid al-sharia and 'illat analysis. Although this phenomenon is socially acceptable, normatively Islam still prioritizes the importance of offspring as part of the purpose of sharia.

Abstract

Madurese’s resistance to the development of tourism facilities is based on the socio-cultural conditions of the community, which is less open to modernization. This research describes the form of resistance and reflects on its relation to Madurese society’s social and historical conditions. This research uses qualitative data with interview methods, collecting news on the internet, and literature studies. Data collection in this research begins with reading news on the internet on Madurese's resistance related to modern facilities and modern tourism, then conducting interviews with informants to confirm data from the news. Data analysis was carried out through three stages, namely describing data, classifying, and interpreting data thematically to reveal the meaning of the resistance by the Madurese community against the development of tourism facilities. The findings of this study highlight at least three main things, namely the forced closure of non-Muslim entertainment venues due to dissatisfaction with the resulting value shifts. Second, the presence of powerful actors triggers resistance from the community. Third, Madurese people tend to make tourism based on Islamic Sharia as they believe in their daily lives.

Abstract

Abstract: Muslim jurists agree that selling waqf property is forbidden A case happened when concrete pillars of a waqf mosque was sold in a mosque called Istiqlal in Daja village. The pillars were initially planned to be installed during rebuilding of the mosque. The research discovered that this pillar originated from charity. These pillars were re-sold to collect more fund from community to continue the rebuilding. Majority of sunni schools of law (Shafii, Maliki and Hanbali) view that such transaction is forbidden because there is no valid reason for selling the pillar. In addition, the seller is not the rightful person to do so. Meanwhile, Hanafi jurists allow such practice as long as all requirements are met, especially the availability of replacement property as well as fulfilment of all terms and conditions of selling.
