Trust is an essential element in the realm of investment. This study examines two legal issues in Bancassurance's PAYDI marketing. This study employs normative legal research, a systematic scientific approach used to address legal concerns that result from regulation. The utilized data consists of secondary sources, including statutes, judicial rulings, legal doctrines, and scholarly viewpoints. This study suggests that it is important to examine the teleological contractual relationship between the parties involved, particularly those that place importance on the social and moral components of the contract's goal. The collaboration between PAYDI and life insurance firms in implementing bancassurance marketing strategies with distribution business models is essential.

Global climate change due to environmental damage departed from an understanding on the anthropocentrism perspective onenvironment making human beings the center of everything on earth and thereby exploiting the natural resource as much as possible. The unwise exploitation of land in Indonesia results in forest or land fire exerting the effect of globalwarming leading to global climate change and endangering the life, particularly the fulfillment of human rights to good andhealthy living environment. Corporate liability and state responsibility are two important points in addressing the climate change in Indonesia. Indonesia has been committed to contributing to addressing climate change by ratifying an international agreement, Paris Agreement, to reduce greenhouse gas emission and to actively prevent climate change. The enforcement of environmental law through litigation is carried out using various mechanisms for filing environmental lawsuit to demand compensation for economic and ecological losses and restoration of environmental damage against corporation

The industrial revolution in the era of globalization greatly influenced the authority and practice of notary in the future and became an interesting issue. Developments in technology (information) are the result of human intellectual works that have brought extraordinary change in human lifestyle. The purpose of this research to determine the impact of globalization regarding the authority of a notary and the responsibilities of a notary and the ideal authority in developing and completing the authority and services of a notary in the era of the industrial revolution 4.0. Notaries play a role in carrying out some of the public functions of the state in the field of civil law which carry out legal services to people/public who have responsibilities regarding authentic evidence in the form of letters, deeds or documents made in writing for various legal actions, agreements and stipulations law or other authorities based on the will and requests of the parties. The research method used is normative juridical by reviewing and analyzing legal materials in the form of notary regulations using library research. The results of this study are that currently notaries in Indonesia are still bound by Indonesian Notary Act namely Undang Undang Jabatan Notaris(shorten UUJN) which is no longer fulfill with the needs of the development of globalization. The authority of notary services and practices as a result of the impact of globalization is a challenge and opportunity for the development and improvement of the future of the profession and position of a notary with the support of information technology which must be regulated by the state through amendments to UUJN.

Introduction to the Problem: The development of information technology has given rise to various types of electronic contracts in the form of adhesion contracts. Unfair legal issues surround the contract formation process and the content of new electronic contract models, such as browser wrap agreements and sign-in wrap agreements. In several cases that have been decided by the Court, the panel of judges has its own standards for deciding disputes based on a fair electronic contract. Purpose/Study Objectives: This paper aims to elaborate on the nature of contractual fairness from an electronic contract perspective. Design/Methodology/Approach: This study employed the statute approach and the case approach. This research examines various regulations relating to agreements, electronic contracts, the doctrine of unconscionability and examizing a number of decisions pertaining to electronic contracts from courts in Indonesia as well as various other nations. Findings: The research results can be concluded that nature of fairness in electronic contracts can be tested through two indicators, the process of forming the contract and clauses in the agreement. Electronic contracts are considered procedurally unfair if the weak party does not know and realizes that they are bound by a contract. An electronic contract is considered substantively unfair if a clause in the contract places an unreasonable burden on the weaker party. In addition to the doctrine of unconscionability, the principles of transparency, duty to read, and reasonable expectation must also be used to ensure fairness in electronic contracts. These principles need to be formulated into the norms of the Indonesian Information Transaction Act to protect consumers from unfair contracts. Paper Type: Research Article

This paper critically examines the Constitutional Court Decision Number 83/PUU-XXII/2024, which reviews the constitutionality of Article 251 of the Indonesian Commercial Code (KUHD) concerning the principle of utmost good faith in insurance contracts. The article stipulates that coverage becomes void if the insured conceals any facts, even if done in good faith. The urgency of this writing lies in the necessity to interpret Article 251 of the KUHD systematically and teleologically, particularly within the context of legal protection for both insurers and insured parties. This research employs a normative juridical approach with a prescriptive analysis of legal norms and the implications of the Court’s decision. The findings indicate that the phrase “renders the insurance void” in Article 251 of the KUHD should not be construed as void by law (nietig van rechtswege) but rather voidable (vernietigbaar), as it concerns the subjective element of mutual consent. The Court's decision has significant implications for restructuring insurance contract norms to ensure fair and proportional protection for all parties involved.

Perjanjian kredit dengan dalam pengikatan obyek jaminan berupa surat kuasa jual dapat menimbulkan masalah hukum di kemudian hari bagi kreditor. Namun di sisi lain hal tersebut masih terjadi di masyarakat dengan anggapan sebagai wujud salah satu bentuk kebebasan berkontrak. Penulis dalam penelitian ini ingin menelaah dan menganalisa lebih lanjut tentang kedudukan hukum kuasa jual yang ditanda tangani oleh debitor kepada kreditor bersamaan dengan perjanjian kredit dan bentuk perlindungan hukum bagi kreditor dalam pengikatan obyek jaminan berupa surat kuasa jual saat debitor Wanprestasi Metode penelitian yang digunakan adalah penelitian hukum normatif, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau bahan hukum sekunder sedangkan pendekatan masalah dilaku kan dengan menggunakan pendekatan undang-undang dan pendekatan konseptual. Hasil penelitian menunjukkan kuasa jual yang ditandatangani oleh debitor kepada kreditor bersamaan dengan perjanjian kredit berakibat batal demi hukum. Perlindungan hukum kepada kreditor tetap ada meskipun surat kuasa menjual menjadi tidak sah atau batal demi hukum karena pada prinsipnya segala harta kekayaan debitor akan menjadi jaminan umum bagi perutangannya dengan semua kreditor.

In commercial contracts, the debates about 'fairness and balance' that led to the 'injustice and imbalance' position of the parties basically irrelevant to be disclosed. It is based on the consideration that the positions of the parties in commercial contracts is similar on the stage of the negotiation process (pre-contractual phase), the formation of the contract (contractual phase) and the execution of the contract (post-contractual phase). Meanwhile, the results of the exchange of the interests of the parties considered fair if it lasts proportionally. The proportionality of exchange of rights and obligations under commercial contracts do not demand results that are always balanced and same (equilibrium-mathematically), therefore the differences in the results are considered fair and reasonably acceptable if the exchange process of the rights and obligations stay proportional. Application of the principle of proportionality in the whole chain of contractual process is basically a manifestation of the doctrine of "fairness of contract" adopted and developed today.Keywords : the exchange of rights and obligations, the principle of proportionality,fairness doctrine in a contract

Personal data protection is fundamental because every individual's privacy is important. This article analyses related principles of human security in the context of processing personal data to ensure the safety of every personal data subject. The result of the paper shows that every effort in processing personal data must based on principles to ensure the fulfillment of human security principles. This article argues that crowdsourcing personal data often carried out in the digital era violates human security principles when impact losses are incurred to man.

Seluruh Satuan Kerja di bidang kesehatan baik pusat maupun daerah dan FKTP atau FKRTL dalam pengadaan obat baik untuk program JKN maupun program kesehatan lainnya tidak perlu melakukan proses pelelangan, namun dapat langsung memanfaatkan Katalog Elektronik (e-Catalogue) obat dengan prosedur Pengadaan Secara Elektronik (e-Purchasing). Pengadaan Obat BPJS Secara Elektronik (e-Purchasing) merupakan merupakan tata cara pembelian obat BPJS sesudah sistem Katalog Elektronik (e-Catalogue) Obat tersedia. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan (statue approach) dan pendekatan komparatif (comparative approach). Puskesmas sebagai UPT-SKPD termasuk pengguna barang/jasa yang menggunakan APBD dan/atau APBN sebagai bagian dari unsur penyelenggara Pemerintah Daerah (D), sehingga keberadaan Puskesmas tidak berbeda dengan Rumah Sakit Pemerintah Daerah maka model Pengadaan Obat BPJS secara Elektronik (e-Purchasing) di Rumah Sakit dapat diaplikasikan juga di Puskesmas dengan membentuk perangkat organisasi Pengadaan Barang/Jasa untuk menyederhanakan alur sistem Pengadaan Obat BPJS secara Elektronik (e-Purchasing) di Puskesmas.
