Abstract

This article examines the legal certainty implications of Constitutional Court Decision No. 128/PUU-XXIII/2025, which extends the office incompatibility rule in Article 23 of Law No. 39 of 2008 on State Ministries to vice ministers. Using doctrinal legal research with statutory, case, conceptual, and comparative approaches, this article reconstructs the Court’s ratio decidendi and evaluates the ruling through four indicators of legal certainty: normative clarity, institutional coherence, predictability, and administrability. The analysis shows that the decision strengthens normative clarity by closing a statutory gap that previously allowed vice ministers to hold concurrent positions in state owned enterprises, private companies, or publicly funded organizations. Yet the ruling also creates implementation risks because the transitional period may invite fragmented compliance, administrative delay, or selective enforcement. This article argues that legal certainty after the decision depends not only on the Court’s interpretation, but also on concrete executive follow up. Its novelty lies in developing a compliance framework consisting of normative clarification, institutional mapping, transitional safeguards, and verifiable replacement mechanisms to align constitutional supremacy, executive accountability, and state owned enterprise governance.

Abstract

This study aims to analyze the adaptive management strategies of administrators in responding to the dynamics of higher education institutions, using a case study of Gorontalo Polytechnic. Higher education institutions are required to adapt to policy changes, quality demands, and internal foundation dynamics to maintain academic stability. This research uses a qualitative case study approach. Data collection was conducted through in-depth interviews, observations, and documentation with university leaders, educational staff, and students. Data analysis was conducted through data reduction, data presentation, and conclusion drawing, and its validity was tested through triangulation. The results indicate that Gorontalo Polytechnic administrators implement adaptive management strategies through adjustments to academic and administrative policies that refer to standard operating procedures, strengthening internal coordination, and utilizing digital-based administrative systems. Furthermore, the academic community plays an active role in maintaining academic stability by adapting to policy changes and institutional dynamics. This adaptive management strategy contributes to management stability, improved performance, and the sustainability of the university.

Abstract

This study examines the ineffectiveness of the Witness and Victim Protection Agency (LPSK) in providing legal protection for child victims of sexual violence in Gorontalo Province. Based on victimology theory, ideal protection should be proactive, comprehensive, and focused on victim recovery. However, findings in the field indicate a significant gap between theory and practice. The LPSK’s implementation of protection is reactive, partial, and delayed, driven by informal coordination with the Women’s Empowerment and Child Protection Agency (DP3A). The LPSK, headquartered in Jakarta, only gets involved after a case escalates, creating dangerous bureaucratic delays and leaving victims vulnerable. The root of the problem is the lack of LPSK representative offices in the regions, which is exacerbated by internal factors such as limited budgets, as well as external factors such as low socialization, weak inter-agency coordination, and social stigma. This study concludes that this ineffectiveness is a complex, systemic problem, necessitating strategic measures such as establishing a LPSK representative office in Gorontalo, strengthening the budget, intensive outreach, and formalizing inter-agency synergy through joint Standard Operating Procedures (SOPs) to achieve optimal protection in accordance with the principles of victimology.

Abstract

Fenomena perundungan (bullying) di sekolah telah banyak diteliti dari perspektif psikologi dan pendidikan, kajian hukum empiris yang secara spesifik mengukur efektivitas penegakan hukum di sekolah vokasi dengan mengintegrasikan dua kerangka teori besar teori Soerjono Soekanto dan sistem hukum Lawrence M. Friedman masih sangat terbatas, khususnya di konteks Indonesia Timur. Penelitian ini mengisi celah tersebut dengan menganalisis kesenjangan antara law in books dan law in action dalam penanganan perundungan di SMK Negeri 1 Provinsi Gorontalo, serta memetakan hambatan penegakan hukum secara berlapis per aktor. Penelitian menggunakan pendekatan yuridis empiris (socio-legal research) dengan wawancara mendalam terhadap enam informan kunci penyidik Unit PPA Polda Gorontalo, guru BK, dan tenaga pendidik serta studi dokumentasi regulasi dan data kasus. Hasil menunjukkan bahwa meskipun regulasi nasional (UU No. 35 Tahun 2014, UU No. 11 Tahun 2012/SPPA, KUHP, dan Permendikbud No. 82 Tahun 2015) telah menyediakan kerangka hukum komprehensif, penegakan di lapangan terhambat oleh silent culture, penyelesaian internal tanpa dokumentasi, serta lemahnya koordinasi lintas sektor. Kontribusi penelitian ini terletak pada pengembangan model koordinasi hukum-sekolah berbasis pendekatan restoratif yang dapat diadaptasi untuk konteks sekolah vokasi di kawasan Indonesia Timur.

Abstract

This article examines the problems of village head elections from the perspective of constitutional democracy. Village head elections constitute an important instrument of local democracy because they enable village communities to directly determine their leaders. However, their implementation still faces problems, including money politics, neutrality of village officials, weak supervision, social conflict, and uncertainty in dispute resolution. This research uses normative legal research with statutory and conceptual approaches. The study concludes that village head elections must be strengthened through clearer regulation, impartial election committees, effective supervision, and a more certain dispute resolution mechanism.

Abstract

Structure that assigns the General Election Supervisory Agency, or Bawaslu, extensive authority over prevention, supervision, examination, sanctioning, and adjudication. The diversity of administrative misconduct, however, is not consistently matched by differentiated enforcement procedures, creating risks of excessive proceduralization for correctable violations and inadequate protection when governmental action directly affects electoral rights. This study examines the institutional configuration of administrative electoral enforcement and formulates an alternative governance model through qualitative legal and institutional analysis. The research examines electoral legislation, Bawaslu regulations, documented administrative violation practices, and peer reviewed literature concerning electoral management, administrative enforcement, institutional capacity, and election governance. The findings identify three structural problems: functional concentration within Bawaslu, insufficient differentiation between compliance restoration and rights adjudication, and the absence of systematic criteria for determining enforcement intensity. This study proposes a Differentiated Administrative Enforcement Model comprising the Corrective Compliance Track, Proportional Administrative Sanction Track, and Rights Protection Adjudication Track. Case allocation is determined through six variables consisting of legal actor, direct legal harm, seriousness, reversibility, recurrence, and electoral urgency. Functional separation between examination and adjudication complements this structure without requiring a new electoral institution. The model demonstrates that effective election governance requires administrative responses that are proportionate, timely, accountable, and capable of protecting electoral rights
