Abstract

Hukum acara perdata merupakan hukum perdata formil, yang pada dasarnya berfungsi mempertahankan atau menegakkan hukum perdata materiil melalui pengadilan apabila terjadi pelanggaran terhadap hukum perdata materiil atau terjadi sengketa. Bahkan hukum acara perdata juga mengatur bagaimana tata cara memperoleh hak dan kepastian hukum manakala tidak terjadi sengketa melalui pengajuan “permohonan” ke pengadilan. Artikel ini ingin menjelaskan bagaimana mekanisme beracara di pengadilan perdata terhadap hukum acara perdata, dengan menggunakan metode penulisan secara normatif. Sebagai kesimpulan, artikel ini menjelaskan bahwa didalam beracara hukum acara perdata dapat ditinjau dalam dua aspek yakni dalam arti luas dan dalam arti sempit, dalam arti luas beracara meliputi segala tindakan hukum yang dilakukan, baik di luar maupun di dalam persidangan di pengadilan guna menyelesaikan suatu perkara menurut ketentuan hukum acara perdata. Sedangkan dalam arti sempit, beracara meliputi tindakan beracara di dalam persidang di pengadilan dari sidang pertama sampai dengan hakim menjatuhkan putusannya. Sedangkan untuk prosedur dalam pengajuan Gugatan di Pengadilan merujuk pada Pasal 118 ayat (1) Herizen Indlandsch Reglement (“HIR”)/Pasal 142 RBg. Abstract. Civil procedural law is formal civil law which basically is to defend or enforce material civil law through the court if there is a violation of the law toward material civil law or a dispute. Even the civil procedural law also regulates how to obtain legal rights and certainty, if there is no dispute through filing an "application" to the court. This article aims to explain how the procedure of mechanisms in civil courts toward civil procedural law by using the normative writing method. In conclusion, this article explains that civil procedural law proceedings can be viewed in two aspects, which are broad sense and narrow sense. In the broad sense, it includes all legal actions that are taken both outside and inside the court to resolve the case according to the provisions of civil procedural law. Whereas in a narrow sense, it includes proceeding at trial in court from the first trial until the judge makes his decision. whereas, the procedure for filing a lawsuit in court is referring to Article 118 paragraph (1) Herizen Indlandsch Reglement (“HIR”) / Article 142 RBg.

Abstract

Berlakunya Undang-Undang Nomor 30 Tahun 2014 tentang Adminstrasi Pemerintahan memberikan angin segar bagi para pencari keadilan dalam ruang lingkup Tata Usaha Negara. Dengan adanya Undang-Undang ini pula telah memperluas access to justice bagi pencari keadilan di Peradilan Tata Usaha Negara dengan cara membuka ruang-ruang tertutup yang sebelumnya tidak dapat dimasuki oleh para pencari keadilan. Sehingganya bagi warga masyarakat/Badan Hukum yang merasa dirugikan terhadap Keputusan Tata Usaha Negara dapat mengambil upaya Hukum administrasi. Dengan begitupula kita dapat mengetahui proses penyelesaian sengketa administrasi dengan  memperoleh sumbangsih berupa pengetahuan sekaligus menjelaskan secara definitif suatu sengketa Tata Usaha Negara dapat diselesaikan melalui mekanisme Pengadilan, atau  melalui upaya administratif terlebih dahulu. Adapun Tujuan dilakukanya penelitian ini untuk mengetahui dan menganalisis Upaya Administrasi dan Peradilan dalam sengketa Keputusan Tata Usaha Negara.

Abstract

The research aims at investigating the prevention efforts of corruption crime of management village fund reviewed from Indonesian law and to investigate the village fund management model reviewed from the perspective of corruption prevention aspect. This research used normativeempirical, the data used primary and secondary data from questionnaires and interview. This research is analyzed in qualitative with inductive method, and descriptive which is explaining, and describe appropriate with problems related with this research. In prevent corruption happens in management village fund, the effort which is offered by the researcher is: identified corruption modus, the increase ofintegrity capacityvillage officials, increase the capacity of village facilitators, refused intervention from local government in order to prevent the fraud in managing village funds and model village funds management of all village refers to Minister of Home Affairs regulation number 20 year of 2018 changes to the Minister of Home Affairs regulation number 113 year of 2014 which clearly there are all governance of village fund management models that are right on target, but in managing the village fund is still has officials not maximum or patient in manage village fund.Suggestion which is offered from the researcher in prevent corruption are identifycorruption modus, the increase ofintegrity capacity village officials, increase the capacity of village facilitators, refused intervention from local government, and T test result showed that the efforts of corruption prevention is effective and influence in management of village fund.

Abstract

This research aims at investigating the the effectiveness of the role of the Inspectorate Role of the in the Supervision and Control Systems of Village Funds Management on Inspectorate of Gorontalo Utara Regency, factors which hampers the role of the Inspectorate Role of the in the Supervision and Control Systems of Village Funds Management, and what efforts which can be done to strengthen the role of the inspectorate in the supervision and control systems of village fund management. This research was conduct in the regional organization of North Gorontalo regency, where this research is an empirical juridical research, using interview methods and data analysis using descriptive techniques. The findings reveal thatthat the implementation of the effectiveness of the role of the Inspectorate Role of the in the Supervision and Control Systems of Village Funds Management on Inspectorate of Gorontalo Utara regency is already done based on SOPs and statutory provisions, but stil not effective. The factors which the effectiveness of the role of the Inspectorate Role of the in the Supervision and Control Systems of Village Funds Management On Inspectorate of Gorontalo Utara Regency was less of human resources, inadequate infrastructure, and efforts to strengthening the APIP and SPIP, in making good governance. The recommendation in this research are, the key to realizing good governance is by creating quality human resources, fulfilling adequate facilities and infrastructure, strong legislation and sense of self-awareness for the executors of government administration activities in Gorontalo Utara regency.Bahasa Indonesia Abstrak: Penelitian ini bertujuan untuk mengetahui efektivitas Peran Inspektorat dalam Sistem Pengawasan dan Sistem Pengendalian terhadap Pengelolaan Dana Desa (Studi Inspektorat Kabupaten Gorontalo Utara), dan mengetahui faktor-faktor apa yang menghambat peran inspektorat dalam sistem pengawasan dan sistem pengendalian terhadap pengelolaan dana desa, serta upaya-upaya apa yang dapat dilakukan dalam memperkuat peran inspektorat dalam sistem pengawasan dan sistem pengendalian terhadap pengelolaan dana desa. Penelitian ini dilaksanakan di organisasi perangkat daerah Kabupaten Gorontalo Utara, di mana penelitian ini merupakan penelitian yuridis empiris, dengan menggunakan metode wawancara dan analisis data menggunakan teknik deskriptif. Hasil penelitian ini menunjukan bahwa pelaksanaan efektivitas peran inspektorat dalam sistem pengawasan dan sistem pengendalian terhadap pengelolaan dana desa Kabupaten Gorontalo Utara sudah dilaksanakan berdasarkan SOP dan ketentuan perundang-undangan, tetapi belum efektif. Faktor yang menghambat efektivitas peran inspektorat dalam sistem pengawasan dan sistem pengendalian terhadap pengelolaan dana desa Kabupaten Gorontalo Utara, yaitu kurangnya sumber daya manusia dan sarana prasarana yang kurang memadai, upaya yang dilakukan melalui penguatan APIP dan SPIP, dalam mewujudkan pemerintahan yang baik (good governance). Kontribusi yang dapat dipetik dalam penelitian ini adalah, kunci mewujudkan pemerintahan yang baik (good governance) dengan cara menciptakan sumber daya manusia yang bermutu, memenuhi sarana dan prasarana yang memadai, penguatan peraturan perundang-undangan, serta menumbuhkan rasa kesadaran diri bagi para pelaksana kegiatan penyelenggaraan pemerintah daerah di Kabupaten Gorontalo Utara.

Abstract

Penelitian ini bertujuan untuk mengetahui potensi korupsi dalam pengelolaan dana desa dan untuk mengetahui upaya pencegahan korupsi dalam pengelolaan dana desa. Penelitian ini merupakan penelitian yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Pengelolaan dana desa setelah diterbitkannya Undang Undang nomor 6 tahun 2014 tentang desa mengalamai berbagai macam permasalahan diantara munculnya tindak pidana korupsi yang diatur dalam undang undang nomor 20 tahun 2001 tentang pencegahan tindak pidana korupsi, sehingganya pemerintah desa diharapkan sebisa mungkin melakukan berbagai macam pencegahan terhadap tindak pidana korupsi baik itu dalam hal pengambilan kebijakan, pengalokasian anggaran maupun dalam mekanisme pengambilan kebijakan. Pencegahan tindak pidana korupsi ini harus terus dilakukan mulai dari level yang paling bawah yaitu pemerintahan desa sehingga kedepannya akan terwujud masyarakat desa yang sadar hukum yang akan meningkatkan tatanan pemerintahan yang baik. Hasil penelitian yang didapatkan dalam hal pencegahan korupsi dalam pengelolaan dana desa adalah berusaha untuk mengenali berbagai macam modus tindak pidana korupsi yang ada didesa, meningkatkan capasity building para perangkat desa serta penguatan kapasitas pendamping desa.

Abstract

The role of government in budget management is something that must be done adequately based on the principles such as transparency, accountability, participation, and aspiration; because it is closely related to services in the village. The budget management should be conducted based on the applicable regulations. However, there are often found many village apparatus who has a potency to abuse their power in its authorities. This phenomenon, furthermore, causing some polemics among peoples and tends to abandon some regulations which should become a basis of the apparatus policies. The research aims at investigating the mechanism of village development budget management and the control of village development budget management. The mechanism, however, should be started with proper planning, budgeting, implementation, business manager, report, and accountability. Also, management control is must be done through several stages, such as pre supervision, channelization, use, and post channelization.

Abstract

Nowadays, Indonesia as a developing country has been developed in various sectors. Globalization is a process of organizational change from the function of capitalism which is marked by the emergence of the integration of markets and transnational companies and the lagging of supranational institutions. With this, it is possible for it to affect the work patterns of Indonesian society. For this reason, a further legal remedy will be needed if the party that feels disadvantage is not satisfied with the outcome of the dispute resolution that arises due to the development of globalization. The intended legal remedies are administrative efforts as referred to in Article 48 of Law Number 51 of 2009 concerning Amendments to Law Number 9 of 2004 concerning Amendments to Law Number 5 of 1986 concerning State Administrative Court (PTUN). The aim of this article is to find out the authority for dispute resolution of State Administrative Court (PTUN) toward dismissal with no reverence verdict and dispute resolution efforts for State Administrative Court (PTUN) toward dismissal with no reverence verdict. Juridical normative is applied as research method. This research concludes that dispute resolution on personnel is done through the State Administrative Court except it is caused by violations of the disciplinary rules of the State Civil Apparatus which will be resolved through administrative appeals to the Court of Civil Service.

Abstract

There are legal issues in the society which resolved through a non-litigation mediation process, especially in civil disputes, where there are several factors that influence people prefer to settle legal issues through non-litigation aspects rather than resolving cases by litigation or through the court. This article aims at explaining how the principles and stages of civil dispute resolution through non-litigation mediation and the essence or value that can be used for the society in dispute. So it can be concluded that this article wants to explain that non-litigation mediation in principle has a consensual as well as collaborative nature, so the result will have win-win solution for each sides, so that the problematic side is cannot be harmed. Then there is a very large value which can be taken, if several problems that arise in society, especially in civil cases which resolved through non-litigation mediation aspects.

Abstract

Penelitian ini bertujuan untuk mengetahui Penerapan Keadilan Restoratif (Restorative Justice) Dalam Kasus Persetubuhan Terhadap Anak (Putusan Nomor : 31/Pid.Sus/2018/PN.Lbto dan Hambatan-Hambatan Penerapan Retorative Justice Dalam Perkara Nomor 31/Pid.Sus/2018/PN Lbto. Jenis penelitian yang digunakan dalam kajian ini adalah metode penelitian normatif empiris merupakan penggabungan antara pendekatan hukum normatif dengan adanya penambahan berbagai unsur empiris. Hasil penelitian menunjukan bahwa konsep keadilan restorative justice sudah seharusnya dapat diterapkan dalam putusan hakim Nomor : 31/Pid.Sus/2018/PN.Lbto karena terdakwa dalam hal ini mau untuk bertanggung jawab untuk menikahi korban dan korbanpun dalam hal ini tidak dirugikan. Kemudian dari sisi hambatan yang dialami yaitu hambatan dari segi social dan hambatan dari segi politik hokum pidana di Indonesia.

Abstract

This paper aims to know how the flow of authority of the village head in appointing Village Administrator in the perspective of Law No. 6/2014 on the Village. This research uses descriptive normative research type. This research was conducted to obtain information, explanation and data on the authority of the Village Head in appointment of Village Administrator in accordance with Law No. 6/2014. The result of the research shows that the procedure of appointment of Village Device In Haya Haya Village, Limboto Sub-district, Gorontalo Regency before the enactment of Law No. 6/2014 was to be decided by the Village Head, but after the enactment of Law No. 6/2014 appointment of village apparatus should be consulted with the Regional Administrator  given on behalf of the Bupati/Mayor and the constraining factors both experienced by the Village Government and the Village Applicant candidate is the lack of public awareness that the community has not served as Village Government itself, the level of education of Human Resources (HR), age, fees for file management, and the socialization that was done only in certain areas.
