Abstract

With regard to Decision Number: 1632 / Pid.Sus.2018 / PN.PLG Regarding Providing Illegal Data to Obtain Travel Documents According to Undang-Undang Nomor 6 Tahun 2011 Tentang Keimigrasian, it is necessary to study the basis for judges' considerations in deciding the case. In addition, the author also intends to analyze it from the point of view of Islamic criminal law. The method used in this research is a library research approach. The data source used is secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials. The results of the research show that the criminal sanctions in the Criminal Act deliberately provide invalid data to obtain the Travel Documents of the Republic of Indonesia in Decision Number: 1632 / Pid.Sus / 2018 / PN.PLG is 8 (eight) months imprisonment and a fine of Rp. .5,000,000, - (five million rupiah) provided that if the fine is not paid, it is replaced by imprisonment for 3 (three) months. Meanwhile, according to Islamic Criminal Law, Ta'zir punishments are imposed in the form of volume punishment and exile punishment. Abstract

Joint property is one of the important aspects of the marriage relationship regulated in Islamic law and positive law in Indonesia. In practice, the division of joint property often becomes a problem that triggers conflict during divorce. One of the legal instruments available to protect joint property is the application for marital confiscation, which is a legal action to secure property so that it is not misused by one of the parties during the divorce process. This study aims to analyze the provisions of marital confiscation against joint property claims and analyze the Maqashid Sharia perspective on the provisions of marital confiscation of joint property claims. The research method used is library research with a normative juridical research approach. The data analysis technique used is descriptive analysis which uses deductive thinking flow. The results of this study indicate that marital confiscation has an important role in maintaining justice and protecting the rights of joint assets in the division of joint property, and has provisions regulated in various laws and regulations. Marital confiscation arrangements can be found in several laws and regulations, including Article 190 of the Civil Code, Article 24 paragraph (2) letter c of Government Regulation No. 9 of 1975, Article 78 letter c of Law No. 7 of 1989 jo. Law No. 3 of 2006, and Article 823 Rv. According to the Maqashid Sharia perspective, the provision of marital confiscation against joint property claims can be interpreted as an effort to preserve joint property, offspring, soul, religion, and reason. This is in accordance with the principles of Maqashid Sharia which prioritizes the benefit of mankind in various aspects of life, including in the context of divorce.

Abstract

The early marriage controversy is a significant issue that affects people's views regarding marriage within the framework of Islamic religious doctrine and customs in Indonesia. This article examines how Islamic law adapts in response to socio-cultural changes, especially in regions with Muslim minority populations, which have mixed interpretations of the age of marriage. This study uses a qualitative descriptive approach with data collection through news and literature relevant to the keyword "Early marriage controversy in Indonesia." The analysis was carried out inductively to identify the forms, factors, and impacts of early marriage controversies on the lives of young couples, both from the perspective of health, quality of life, and religious and cultural norms. The results of the study show that this controversy reflects the challenges of integrating Islamic religious doctrine with local customary values, creating both positive and negative consequences for couples who marry young. In the context of Muslim minorities, this article recommends a flexible and responsive approach to Islamic law to socio-cultural dynamics, in order to achieve a balance between religious norms and the social needs of diverse communities.

Abstract

The phenomenon of child marriage frequently disregards children's reproductive rights. This study aims to explain the negligence of reproductive rights in child marriages by examining practices, factors, and the impacts of such neglect on girls' human rights. This paper employs a qualitative descriptive approach, and the data was gathered through the use of keywords to search the term "neglect of women's reproductive rights in child marriage”. The data was analyzed by reducing, describing, and interpreting the data in depth in order to reach a conclusion. This paper demonstrates that the practice of child marriage not only places females in a disadvantageous position, but also has an impact on reproductive rights, which has negative repercussions for survival, such as miscarriage, baby blues syndrome, and death. It is also anticipated that this paper can serve as a resource for conducting research on child marriage and the neglect of girls' reproductive rights from a broader and more multidisciplinary perspective, so that it can be used as a basis for formulating firm policies on reproductive rights

Abstract

This article discusses the implemention of the forced money (dwangsom institution) in the hadhânah case in the Religious Courts from the perspective of maqâshid al-shariah. This study found that the application of dwangsom sentences for hadhânah cases is very important to be applied, especially to the defendant who objects to carrying out court decisions; or default to the agreement; or there will be difficulties at the time of execution; or the plaintiff suffers a loss. In addition, implementing dwangsom in the hadhânah case will pave the way for the benefit of children who are still in the process of growth even though their parents divorce. Therefore, even if not asked by the plaintiff, the judge himself can decide the dwangsom sentence to the defendant to ensure the fulfillment of the needs of the children.

Abstract

This study analyzes the authority of the local government in harmonizing, unifying, and strengthening the concept of the Provincial Regional Regulation Draft. 15 of 2019 concerning Amendments to Law no. 12 of 2011 and their application in South Sumatra Province. The results of the analysis and discussion show that the regional government is not authorized to harmonize, unify, and consolidate the draft Provincial Regulation Draft after the issuance of Law No. 15 of 2019. After the issuance of this Law, harmonization, unification, and strengthening of the draft Provincial Regulation Draft are carried out by ministries or institutions that run a government in the field of law previously coordinated by the legal bureau (regional government apparatus). This activity is a form of deliberation in establishing law and one of the principles in Islamic nomocracy and democracy in Islam. The implementation of harmonization, unification, and consolidation of the draft Provincial Regulations in South Sumatra has not been under the provisions in Law No. 15 of 2019. The process of harmonizing, unifying, and strengthening the concept of the Draft Provincial Regulation in South Sumatra is still being implemented by the regional government (legal bureau as regional apparatus). Suggestions from researchers, namely that the provisions in Law no. 15 of 2019 and it is necessary to guide to human resources in the South Sumatra Province. This process needs to be linked to the concept of Maqhasid Syariah so that the substance of the Provincial Regulation does not conflict with the public interest (benefit).

Abstract

At this time, in the contemporary and modernization era, it is easier for couples who want to get married, especially with economic conditions that have begun to recover from the influence of the pandemic, so this is very supportive of quickly achieving their desire to marry. For couples who have previously been married and want to remarry, of course there are other requirements that must be met. Thus, sometimes some couples take shortcuts in falsifying their identity, such as being a widow or a virgin, in order to achieve their desire to get married officially. This is not impossible, in fact, it often happens that prospective female partners deliberately fake their identities to be accepted by male partners who are still virgins. The main problem in this research is how to implement the husband's right to annul the marriage due to falsifying the identity of the prospective wife, as well as how the judge's legal considerations are in resolving this problem. This study uses qualitative research methods with a normative descriptive approach. Data sources are based on literature studies and court decisions which are then analyzed using the content analysis method. The research results prove that the husband's rights in cases of identity fraud by his future wife are protected by the state based on statutory regulations so that the husband can take legal action to defend his rights. The judge in this case has given appropriate legal considerations so that no party is harmed as a consequence of their respective actions.

Abstract

The mechanism for the Ijab Qobul in marriage by the groom is carried out verbally, however there are differences for grooms who have disabilities or for people with disabilities, where people with disabilities use several methods in carrying out the Ijab Qobul. The aim of this research is to find out what the efforts of the Religious Affairs Office (KUA) are in providing services for people with disabilities and what the guidance mechanism for preparing Ijab Qobul is for people with disabilities at KUA Ilir Timur 2, KUA Sukarami, KUA Ilir Barat 1, KUA Bukit Kecil. The research method used in this thesis is field research with qualitative research data. The data collection techniques are carried out using interviews and documentation. By using data analysis techniques, namely descriptive which describes and explains the main topics discussed in this research. Then use conclusion drawing in a deductive manner. The results of this research are that the Religious Affairs Office's efforts in providing services for people with disabilities, namely marriage guidance for people with disabilities, are carried out independently (individually). Because for people with disabilities who are deaf, they need a facilitator in sign language, while for people with disabilities they need a way for wheelchairs and also a special room for people with disabilities and there are also different solutions from each KUA of Palembang City in providing a mechanism for preparing Ijab Qobul for people with disabilities at KUA Palembang City.

Abstract

Penelitian ini berjudul Kewenangan Jaksa Dalam Pencegahan Dan Pemberantasan Perusakan Hutan Di Wilayah Hukum Kejaksaan Tinggi Sumatera Selatan. Dengan metode penelitian yuridis empiris yang dengan kata lain adalah jenis penelitian hukum sosiologis. Penelitian ini menyimpulkan bahwa pengambilalihan berkas perkara oleh kejaksaan tinggi sumatera selatan selaku penuntut umum karena hasil penelitian berkas perkara tersebut masih terdapat minimnya alat bukti dan belum tergambar niat jahat pelaku/tersangka dalam melakukan tindak pidana perusakan hutan. Pengambilalihan perkara ini menggunakan terminologi “melengkapi berkas perkara. Kemudian kendala yang dihadapi dalam proses penyidikan tindak pidana perusakan hutan oleh Kejaksaan antara lain adalah : a). minimnya batas waktu yang dimiliki oleh penuntut umum untuk menyelesaikan penyidikan yakni 50 (lima puluh) hari; b) belum terdapatnya peraturan yang lebih teknis mengenai prosedur pengambil alihan proses penyidikan perkara; c) Belum adanya pengaturan maupun bentuk kesepahaman antara Kejaksaan selaku penuntut umum maupun Kementerian Kehutanan selaku PPNS maupun Kepolisian RI selaku penyidik mengenai teknis pengambil alihan perkara dimaksud, termasuk tanggungjawab terhadap tersangka maupun barang bukti yang disita.

Abstract

This study examines the normative construction of the Indonesian Corruption Eradication Commission's (KPK) wiretapping authority, specifically concerning "wiretapping beyond the main case" or incidental findings. The analysis focuses on the tension between KPK's extraordinary powers in combating corruption and the constitutionally guaranteed right to privacy. Using a normative legal research approach, this study evaluates the conformity of extended wiretapping practices with human rights limitation principles, including legality, necessity, proportionality, and due process of law. Findings reveal normative ambiguity in existing regulations, which could lead to broad discretion and potential violations of constitutional rights. The research proposes an ideal formulation for wiretapping authority limits, emphasizing strict subject and object restrictions, judicial authorization, time limitations, and independent oversight. This framework aims to achieve a balance between effective corruption eradication and the protection of human rights within a democratic rule of law.
