Abstract

The increasing number of pesantren and students reflects the rapid growth of these institutions over recent decades. The high number of students in religious-based educational institutions, such as pesantren, with their complex interactions involving children and the need for controlled environments, has been shown to increase vulnerability to sexual violence. This is evidenced by the occurrence of 12 cases of child sexual abuse between January and July 2022, with pesantren being the most frequent location, accounting for 5 cases (41.67%). Using an institutional approach, this paper aims to provide an alternative perspective on improving policies and procedures to enhance the effectiveness of preventing and addressing sexual violence in pesantren. Previous research by Pebriaisyah et al. focused on the power dynamics between kyai and female students in pesantren, highlighting patterns of abuse and proposing sexual education as a preventive measure. In contrast, this study emphasizes policy reform through institutional guidelines to prevent sexual violence. The key difference is that this study addresses broader policy aspects, while Pebriaisyah’s work is more specific to individual dynamics. The research employs a mixed-methods approach, combining quantitative and qualitative data, with primary data collected through online questionnaires from adolescents aged 14-17 during March 2023, and a normative juridical analysis using primary and secondary legal materials to analyze the prevention and handling of sexual violence in pesantren according to relevant laws and regulations. The findings conclude that, first, the authoritative nature of educational institutions in preventing and addressing sexual violence increases the likelihood of institutional leaders acting arbitrarily, often protecting perpetrators and neglecting victims. Second, the institutional approach can be implemented gradually, from preventive to responsive measures, through the development of multidisciplinary protocols and strategies specific to preventing and addressing sexual violence. Ultimately, a comprehensive legal framework will provide a foundation for task forces to act as the primary implementers of policies in preventing and handling sexual violence in pesantren.

Abstract

Pesatnya perkembangan internet yang sejalan dengan pertumbuhan penggunannya, hingga mengakibatkan meningkatnya kerentanan terhadap anak. Para pelaku kekerasan seskual kian beradaptasi dengan kemudahan yang diberikan internet guna mengeksploitasi kerentanan anak, sehingga menghasilkan modus operandi baru yang dapat disebut sebagai sexual grooming. Maka, penelitian ini berupaya melihat seberapa besar dampak yang sedemikian rupa diakibatkan oleh sexual grooming dari ketiadaan peraturan yang memadai, serta menemukan alternatif kebijakan yang dapat mencegah kekerasan seksual dengan mengkriminalisasi sexual grooming. Penelitian ini merupakan penelitian hukum normatif yang juga bersifat preskriptif. Pendekatan yang digunakan adalah pendekatan perbandingan dan pendekatan konseptual. Hasil penelitian ini menyimpulkan bahwa: pertama, kerentanan anak terhadap kekerasan seksual yang dilakukan secara daring meningkat seiring dengan masifnya penggunaan internet, yang mengakibatkan para pelaku beradaptasi dengan internet untuk melakukan kekerasan seksual guna menghindari penolakan dan pengungkapan. Kedua, sampai saat ini, hukum positif Indonesia masih belum mampu mendefiniskan serta melarang sexual grooming untuk mencegah kekerasan seksual, Indonesia hanya memiliki aturan yang melarang dan meminta pertanggugjawaban pelaku atas akibat dari sexual grooming.

Abstract

Kejahatan seksual kepada anak sudah sangat menghawatirkan, karena terjadi peningkatan jumlah korban dalam beberapa tahun ini. Kebijakan tindakan kebiri kimia yang diharapkan mampu menekan angka kejahatan seksual kepada anak nyatanya tidak dapat meredam dan menghantikan kejahatan seksual terhadap anak. Kebijakan kebiri kimia yang diatur dalam UU Perlindungan Anak dan Peraturan Pelaksananya menemui banyak permasalahan baik dalam konsep maupun dalam implementasinya. Metode yang digunakan adalah yuridis normatif, yang dianalisis secara kualitatif. Hasil penelitiannya adalah terjadi salah konsepsi terhadap sanksi tindakan kebiri kimia di Indonesia, sanksi tindakan harus berupaya mengobati dan memulihkan sedangkan sanksi tindakan kebiri di Indonesia akan mengakibatkan rasa sakit dan merupakan upaya pembalasan. Selain itu terdapat problematika dalam pelaksanaannya antara lain mengenai efektifitas kebijakan tindakan kebiri kimia melalui UU Perlindungan anak, biaya kebiri kimia mahal, penolakan dokter menjadi pelaksana, ketidak jelasan dosis, belum ada aturan teknis mengenai pelaku berjenis perempuan serta belum masuknya tindakan kebiri kimia dalam RUU KUHP.

Abstract

AbstractFreedom of the Press is a necessity in a democratic country. The Press Institute as one of the pillars of democracy has a big role in translating the values of freedom of opinion, obtaining valid information and providing access to reliable information as well as efforts to unite the nation. The era of Indonesian democracy opened the faucet for press freedom which had a positive impact, but also had a negative impact. The amount of information in the digital era that is conveyed to the public is not all information whose truth is beyond doubt, but there is also information that contains fake news, what is more worrying is that the press agencies are spreading the fake news. In the process of handling press cases, there are special regulations stipulated in the Press Law, where the handling is very different from the handling of other crimes, including the criminal accountability process which is also different from other crimes. Therefore, it is necessary for law enforcers to understand in handling press cases in Indonesia and for an understanding of who can be held responsible for criminal acts in the press which spreads fake news.AbstrakKebebasan Pers menjadi sebuah keniscayaan dalam negara demokrasi. Lembaga Pers sebagai salahsatu pilar demokrasi mempunya peranan besar dalam menterjemahkan nilai kebebasan berpendapat, mendapatkan informasi yang valid dan memberikan akses informasi yang terpercaya serta upaya untuk mempersatukan bangsa. Era demokrasi Indonesia membuka keran kebebasan pers yang punya dampak positif, namun juga punya dampak negatif. Banyaknya informasi di era digital yang disampaikan kepada masayarakat tidak semua informasi yang kebenarannya tidak diragukan lagi, namun ada juga informasi yang mengandung berita bohong, yang lebih menghawatirkan adalah yang menyebarkan berita bohong tersebut adalah Lembaga pers. Dalam proses penanganan perkara pers, terdapat regulasi yang khusus yang diatur dalam UU Pers, dimana penangananya sangat berbeda dengan penanganan kejahatan lain termasuk proses pertanggung jawaban pidaananya juga berbeda dengan tindak pidana lain. Olehkarenanya perlunya pemahaman para penegak hukum dalam menangani kasus pers di Indonesia serta perlunya pemahaman mengenai siapa yang dapat mempertanggungjawabkan perbuatan pidana pada Pers yang menyebarkan berita bohong.

Abstract

Bringing judicial proceedings against the body or memory of a deceased defendant was once possible, but this is no longer possible in today’s world, as criminal actions must be stopped even before a deceased complainant is named as a suspect. This research aims to examine the criminal justice system in Indonesia regulating the status of cases against the determination of a suspect in a person as a witness/reported person who has first died. The research method used in this study is normative juridical. According to the findings of the study, the current Criminal Procedure Code cannot provide an adequate answer regarding the validity of the determination of a suspect against a deceased person, because it only states that the investigation must be stopped if the suspect dies, which implies that the suspect should have been determined during the investigation process. Therefore, lawmakers should make rules regarding the mechanism for investigations when the reported or suspected guilty person dies. Because in fact, the death of a person as a reported person suspected of committing a criminal offense requires the termination of the criminal case because the legal subject who should be held accountable for the criminal offense has died.

Abstract

Child sexual exploitation through AI-based cyberpornography is a serious and growing threat in the digital era. Advanced AI technologies, such as deepfake and AI bots, provide new opportunities for perpetrators to easily create and disseminate exploitative content, significantly impacting the physical, psychological, and social well-being of child victims. Although Indonesia has established legal frameworks such as the Child Protection Act and the Electronic Information and Transactions (ITE) Act, adaptive regulatory revisions and stronger implementation are needed to address AI-based crimes and provide maximum protection for children. This study aims to analyze the legal protection for children as victims of AI-based cyberpornography in Indonesia. It employs a normative juridical method focusing on the study of legal norms, both written and customary, to explore legal solutions to this issue. Using primary and secondary legal materials, the analysis is conducted descriptively and prescriptively to evaluate the application of existing laws and propose relevant enhancements or updates. The findings reveal that child sexual exploitation in AI-based cyberpornography represents a crime leveraging advanced technologies such as deepfake and AI chatbots, with serious psychological, social, and physical consequences for victims. Despite existing regulations such as the ITE Act and Child Protection Act, legal gaps related to AI use in these crimes demand regulatory reforms to address modern legal challenges and reinforce cross-sectoral collaboration

Abstract

Social engineering-based phishing is increasingly rampant in Indonesia, exploiting victims' psychological weaknesses to access illegal and spread false information. The main legal problem is the imperfection of regulations, such as the ITE Law and the Criminal Code, which do not accommodate the psychological manipulation aspect of this crime. This study aims to identify regulatory gaps related to the legal responsibility of phishing perpetrators and the effectiveness of regulations in dealing with this crime. The method used is normative juridical, with analysis of laws and regulations, literature studies, and reviews of court decisions. The findings show that the ITE Law focuses more on technical-based crimes, while the psychological aspect of phishing has not been explicitly regulated. failed to prove the perpetrator's intent (dolus) is an obstacle to law enforcement. The implication of this study is the need to revise the ITE Law to expand the scope of "illegal access" and integration with the Personal Data Protection Law (PDP Law). This reform is expected to improve legal protection for victims and strengthen the effectiveness of law enforcement against cybercriminals.

Abstract

The protection of patient health data confidentiality is a fundamental aspect of the healthcare system, aimed at maintaining individual privacy rights. However, many medical data breaches still occur, posing risks to patients socially, psychologically, and legally. Therefore, regulations regarding healthcare professionals' obligations to maintain patient medical information have been clarified in Law No. 17 of 2023 on Health and the Code of Ethics for Health Professionals. This study examines the legal responsibility of healthcare professionals in maintaining patient health confidentiality and evaluates the obstacles and legal efforts made to enforce these regulations. The study uses a normative legal method by studying laws, legal concepts, and cases. Data were collected through a literature search that examined laws, legal books, and court decisions related to medical confidentiality breaches. This study found that regulations have clearly defined the obligations of healthcare professionals in maintaining patient medical data confidentiality. However, the implementation in the field still faces various obstacles, such as a lack of understanding among healthcare professionals regarding regulations, weak supervision systems, and challenges in enforcing the law for violators. Existing regulations have established severe sanctions for medical confidentiality breaches, but their effectiveness still needs to be strengthened through increased education for healthcare professionals, enhanced data security infrastructure, and more consistent monitoring and law enforcement.

Abstract

Perlindungan anak merupakan upaya komprehensif yang bertujuan menjamin kesejahteraan dan hak-hak anak. Dalam kondisi krisis, tingkat kerentanan anak-anak sangat tinggi terhadap kekerasan seksual akibat beberapa faktor yang melekat pada diri mereka. Penelitian ini bertujuan dalam menelaah perlindungan hukum anak sebagai korban kekerasan seksual di kab Bandung serta kendala dan upaya perlindungan hukum anak sebagai korban kekerasan seksual di kab Bandung. Pendekatan yuridis normatif diterapkan pada penelitian ini, berfokus pada analisis normatif terhadap berbagai kajian pustakan dan regulasi hukum yang berlaku, yang berfokus pada perlindungan korban kejahatan seksual. Penelitian ini menggunakan analisis kualitatif dengan mengombinasikan kajian pustaka serta data dari wawancara yang didapatkan secara langsung. Penelitian ini dilakukan di Polresta Kab Bandung dan UPTD PPA Kab Bandung. Berdasarkan hasil penelitian diperoleh simpulan bahwa, Polresta Kab Bandung dan UPTD PPA Kab Bandung memberikan pendampingan komprehensif mulai dari assessment hingga pemulihan psikis dengan bantuan psikolog dan psikiater maupun bantuan hukum. Implementasi perlindungan hukum telah menunjukkan hasil yang cukup baik, meskipun dalam implementasinya masih ditemukan tantangan dari segi sosial dan kebudayaan, dimana masih ada anggapan bahwa kekerasan seksual adalah aib keluarga. Berdasarkan hasil penelitian, saran yang diberikan yaitu diperlukan penguatan sinergitas antara pihak pemerintah, penegak hukum, serta elemen masyarakat di Kab Bandung untuk memaksimalkan upaya perlindungan serta penyembuhan kepada anak sebagai korban kekerasan seksual dengan menciptakan ekosistem secara kondusif dan aman.

Abstract

Developing Indonesia’s new capital city, Nusantara (IKN) in East Kalimantan, has the potential to significantly impact indigenous communities, particularly in agrarian conflicts arising from expanding development land that intersects with indigenous territories. This study aims to analyze the potential agrarian conflicts and adequate legal protections for indigenous peoples in addressing these impacts. The method is normative juridical, with data collected through library research on relevant regulations, literature, and studies. The findings show that agrarian conflicts resulting from the IKN development may arise due to the mismatch between the legal recognition of Indigenous land rights and the allocation of development land that does not actively involve Indigenous communities. Legal protection for indigenous peoples can be achieved by recognizing land rights, strengthening agrarian regulations that are more responsive to indigenous rights, and implementing the Free, Prior, and Informed Consent (FPIC) principle in the planning and management of IKN development. The conclusion of this study emphasizes the importance of recognizing indigenous land rights and involving them in every stage of development to prevent agrarian conflicts and create more equitable development policies.
