Abstract

Indonesia has enormous natural wealth that must be managed properly and based on the Constitution of the Republic of Indonesia Year 1945 controlled by the state and used to the greatest extent for the prosperity of the people. The management of natural wealth in the oil and gas sector is carried out by business entities, both state-owned enterprises, regional-owned enterprises, private businesses, both foreign private and national self-reliance. To produce oil and gas requires a very large investment both for research, exploration, and exploitation as well as equipment. The equipment used by the Cooperation Contract Contractor (KKKS) for upstream oil and gas activities in accordance with Government Regulation no. 35 of 2004 is State Wealth/State Property (BMN). The determination of BMN is stated in the cooperation contract signed between the government and KKKS. Thus, the equipment is a BMN based on a contractual agreement in accordance with Government Regulation number 27 of 2014 as updated by Government Regulation no 28 of 2020, and reported in the Central Government Financial Statements (LKPP).

Abstract

The right to obtain access to education is clearly stated in the 1945 Constitution of the Republic of Indonesia (UUDNRI). However, it turns out that there are still Indonesian indigenous people who do not feel the right to education at all, they are the Baduy tribe. This research aims to explain and provide solutions so that the fulfillment of the right to education in Indonesia is equitable, especially for the Baduy community. This research compares the perspectives of positive law, customary law and Islamic law in understanding the right to education, and reveals the urgency of all three in determining priority actions for the Baduy tribe. Researchers used the Systematic Literature Review (SLR) method to collect data to find out and answer the problems in this research. The research results reveal that the right to education is part of Human Rights (HAM) which is very fundamental in nature. and Positive law is the highest rule in Indonesia which also guarantees the implementation of the right to education for all Indonesian people. The government must be firm and active in providing guarantees for the right to education in accordance with the mandate of the Constitution and several other state regulations, and play an important role in establishing positive law as the main guideline that must be obeyed and followed by all Indonesian citizens..

Abstract

Citations in Google Scholar serve as a crucial indicator for assessing the impact and relevance of a scientific publication. However, many academics and researchers face challenges in increasing the citation count of their work. This article discusses strategies for enhancing citation numbers through effective dissemination. The methods employed include outreach and training programs, publication in reputable journals, optimization of Google Scholar profiles, and the utilization of academic social media platforms such as ResearchGate and Academia.edu. The findings indicate that a better understanding of publication techniques and scholarly promotion contributes to increased citations. Furthermore, research collaboration and active engagement in academic communities have been shown to expand the reach of scientific work. This article asserts that with the right strategies, academics can enhance the visibility of their research and strengthen their scholarly impact.

Abstract

This paper analyzes the protection of privacy rights in Indonesia in the context of digital slander dissemination, framed within the post-truth era. Using a normative juridical analysis, this study evaluates the adequacy and limitations of Indonesia's legal framework, particularly focusing on the Law on Electronic Information and Transactions (ITE Law), in addressing digital defamation. The rise of the post-truth era, characterized by the spread of misinformation and subjective narratives, has exacerbated the challenges in safeguarding privacy rights online. The paper examines legal provisions, case law, and practical enforcement mechanisms to assess how well privacy rights are protected in digital slander cases. Findings highlight the gaps in the current legal framework, including unclear definitions and enforcement challenges. The study also explores the role of social media platforms and suggests potential legal reforms to strengthen privacy protections and hold digital platforms accountable for harmful content. Ultimately, this paper calls for more robust legal definitions, improved law enforcement, and stronger platform accountability to better protect privacy in the digital age.

Abstract

This study describes the protection of constitutional rights of Indonesian migrant workers after being placed in destination countries. Migrant workers often face various challenges, including exploitation, discrimination, and violence. This research highlights the protection efforts undertaken by the Indonesian government and international organizations to ensure the fulfilment of migrant workers' rights in accordance with the constitution. The main focus is on policy implementation, bilateral agreements, and multilateral cooperation aimed at improving the conditions and protection of migrant workers. Research methods include policy analysis, case studies, and interviews with migrant workers and relevant stakeholders. Key findings include challenges in policy implementation, the need for improvements in the protection system, and the importance of advocacy and awareness of rights as part of long-term solutions. This study makes a significant contribution to understanding the protection of constitutional rights of Indonesian migrant workers abroad and offers policy recommendations to enhance their protection in the future.

Abstract

Adanya kewenangan Judicial review Mahkamah Konstitusi telah memberikan ruang untuk menafsirkan. Penelitian ini bertujuan untuk menganalisis implikasi hermeneutika filosofis terhadap kewenangan Judicial review Mahkamah Konstitusi. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan deskriptif analisis. Hasil pembahasan, dalam pembacaan teks undang-undang selalu dibuat bersifat positivistik dan objektivisme oleh penafsir yang otoritatif, tanpa adanya prasangka hakim atau penafsir saat membaca teks undang-undang. Pandangan Hans-Georg Gadamer bahwa setiap pembacaan teks manapun, penafsir atau hakim selalu tidak pernah bersih dari tradisi dan sejarah kekiniannya (Wirkungesgeschilches) maka tidak ada pembacaan teks yang bersifat objektif dan bersih dari prasangka. Hermeneutik filosofis-nya Gadamer menunjukkan bahwa makna suatu teks tidak pernah selesai atau tertutup, selalu ada makna baru dalam interpretasi yang dilakukan oleh hakim atau penafsir, karena teks undang-undang sudah dalam horizonnya sendiri dan hakim juga sudah dalam horizonnya sendiri yang menurut Gadamer akan terjadi peleburan horizon teks undang-undang dengan horizon hakim atau penafsir, yang membuat interpretasi makna teks akan semakin meluas dalam melihat suatu makna di dalam teks inilah disebut Gadamer peleburan horizon-horizon Horizon Verschmelzung. Kata Kunci: Hermeneutika Filosofis, Judicial Review, Mahkamah Konstitusi
