Abstract

Mashlahat theory has historically been widely used in developing Islamic law. The public interest is a fundamental issue that must be considered when exploring Islamic law. The main objective of the development of Islamic law is to realize the mashlahat. This study examines the relevance of the mashlahat theory in the development of Islamic law. This research is a type of library research and uses a philosophical approach. Data were analyzed through content analysis. The results of this study indicate that the purpose of Islamic law is to realize and maintain the mashlahat. A mulism will get mashlahat if he can keep the five main aspects in the dharury group: religion, soul, intellect, lineage and honor, and property. On the other hand, we will get mafsadat if we cannot maintain it. The theory of mashlahat is very much needed to form Islamic law and respond to the times. Consideration of mashlahat is limited to issues other than ritual worship. Mashlahat theory has been applied since the beginning of the growth and development of Islam during the Khulafa al-Rasyidun period. Until now, many products of Islamic law have been produced by adhering to the principle of mashlahat. With the theory of mashlahat, Islamic law will not stagnate. All new problems can be solved from the perspective of Islamic law. With the consideration that mashlahat, too, can be realized, including in the context of the MUI fatwa in preventing the spread of Covid-19.

Abstract

Halal product assurance is part of consumer rights that ensures consumers receive a legal guarantee for a product that has been certified halal. In Indonesia, there are efforts to internationalize halal product assurance standards through cooperation with other countries. This research aims to analyze the legal implications and orientation related to the internationalization of halal product assurance standards in Indonesia with other countries. This research is a normative legal study that emphasizes conceptual, legislative, and historical approaches. The research results indicate that the internationalization of halal product assurance standards in Indonesia can have positive implications, such as the adoption of Indonesian halal regulations and standards by other countries, increased cooperation with both Muslim-majority and non-Muslim countries, and enhanced competitiveness of Indonesian products in the global halal industry market, particularly from the small, micro, and medium enterprise sector. Future orientation in the internationalization of halal product assurance standards in Indonesia can be achieved through strengthening cooperation with non-Muslim countries in terms of technology transfer, and with Muslim countries to improve the quality of halal certification and strengthen their position in the global halal market. This research offers novelty in the form of international collaboration and legal implications that can have a wide-ranging impact, especially on the competitiveness of Indonesian products in the global halal market. Abstract

Islamic inheritance law highlights diverse approaches to its interpretation and implementation in Muslim-majority countries such as Indonesia and Oman. These differences arise from a legal gap between the universal principles outlined in the Qur'an and their application within national legal frameworks. In Indonesia, Islamic inheritance law functions within a pluralistic legal system, whereas in Oman, Sharia principles serve as the primary and integral foundation of the judiciary. This article examines how the foundational philosophy of Islamic inheritance law is understood and applied in Indonesia and Oman, two countries with contrasting legal systems, to identify both normative and practical challenges, as well as the implications of these differences for future legal development. Employing a normative and comparative legal approach, the study reviews relevant legislation, fatwas, and court decisions in both countries, alongside an analysis of classical and contemporary Islamic jurisprudence. The findings indicate that Indonesia adopts a conciliatory approach, balancing religious norms with modern social needs, while Oman tends to adhere to a more literal and textual interpretation of inheritance law. These differences reflect the dynamic nature of Islamic inheritance law philosophy in responding to each country's unique social, cultural, and political contexts. This contributes to the ongoing discourse on developing an adaptive and context-sensitive understanding of Islamic inheritance law within various national legal systems.

Abstract

The relationship between law and morals has become an academic and philosophical debate throughout the ages, especially in the schools of natural law and legal positivism. The school of natural law always relates law and morals in a close, inseparable relationship, like a coin. The law must contain moral values. Meanwhile, legal positivism clearly separates the relationship between law and morals. Thus the law is not at all related to morality, the problem of law contains moral values or not, not the substance and legal issues, the most important thing is that the law is made by a sovereign ruler. Law is separated from non-juridical elements, such as ethics, morals, politics, economics, sociology, and so on. In other words, the law is purified from something that is not law. With the very sharp differences between the two schools of law, the schools of natural law and legal positivism for hundreds of years have never agreed on the relationship between law and morals. Each has a paradigm, method, theory, and a strong philosophical basis in seeing the relationship between law and morals. Keywords: Natural Law, Legal Positivism, Law and Morals

Abstract

The Mandatory green building certification has emerged as a central policy tool to advance sustainable development and reduce the environmental impacts of the construction sector, yet in Indonesia, it operates within a hybrid regulatory framework that combines statutory rules with non-state technical standards. This study examines whether such mandatory certification is legally sound, economically rational, and proportionate in relation to the burdens it imposes on regulated actors. Using a juridical–economic approach, the research integrates doctrinal legal analysis with public policy economics by examining national statutes, ministerial and regional regulations, and private certification standards, alongside academic literature and international policy reports. The analysis is conducted qualitatively through legal interpretation, cost–benefit reasoning, and a proportionality test based on the criteria of legitimate aim, suitability, necessity, and proportionality stricto sensu. The findings show that mandatory green building certification clearly pursues a legitimate public objective, environmental protection and sustainable development, but its implementation raises concerns about legal certainty and distributive justice. Reliance on non-state standards without explicit statutory delegation creates normative ambiguity, while significant upfront compliance costs for design, technology, and certification disproportionately affect small and medium-sized enterprises. As a result, the policy satisfies the requirement of a legitimate aim but does not fully meet the elements of necessity and proportionality in the strict sense, since it is not always the least restrictive or most balanced means of achieving environmental goals. The study’s novelty lies in its integrated legal–economic assessment of green building certification through the principle of proportionality, offering a holistic framework that evaluates environmental regulation not only as a matter of legal validity but also as an instrument of economic rationality and fair burden-sharing in public policy.
