Abstract

This journal discusses the phenomenon of Online Gender-Based Violence (OGBV) which is increasingly worrying in the digital era, especially related to the spread of non-consensual intimate content (NCII) or what is often referred to as "revenge porn." This study explores the factors that cause NCII, including abuse of trust, unsafe use of technology, and weak legal regulations. OGBV, as a form of gender-based violence, has profound psychological, social, and economic impacts on victims, including trauma, stigma, and career losses. In addition, this journal also discusses the prevention and protection efforts needed, such as increasing digital literacy, strengthening regulations, and collaboration between various stakeholders. It is hoped that with stronger measures, the threat of the spread of non-consensual intimate content can be minimized and protection for victims can be increased.

Abstract

Economic globalization has increasingly shaped the field of intellectual property rights (IPR), transforming copyright protection from a domestic matter into a strategic tool of global trade. Through international instruments such as the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs) and the Berne Convention of 1886, universal copyright standards are enforced across jurisdictions. Yet this harmonization generates tension between international obligations and national legal sovereignty. This article employs a juridical-normative method with doctrinal, case study, and comparative approaches to examine these dynamics. The case of Auld Lang Syne illustrates how public domain works evolve into shared cultural heritage, while the dispute of Ahmad Dhani v. Once Mekel reveals persistent enforcement challenges in Indonesia. Comparative analysis of the United States, United Kingdom, Japan, and Indonesia demonstrates divergences in copyright duration, derivative work protection, and exceptions such as parody. The article argues that Indonesia must ground its response to globalization of IPR in Pancasila and the 1945 Constitution, thereby ensuring that national copyright law is not merely a passive rule taker within the global system but an active framework that safeguards cultural identity and national interests.

Abstract

Globalization has significantly transformed economic, political, legal, social, and cultural dimensions worldwide, including Indonesia as a developing country. The rapid development of information and communication technology has accelerated integration into global markets and posed both opportunities and challenges for national legal systems. This article analyzes the impact of economic globalization on corporate law reform in Indonesia using a normative legal research method with a literature review approach. The discussion highlights that globalization compels legal reform through institutional, instrumental, and cultural changes, particularly in corporate governance, investment, and intellectual property protection. Findings indicate that Indonesian corporate law must adapt to global standards while maintaining national identity and constitutional values based on Pancasila and the 1945 Constitution. Strengthening legal harmonization, ensuring legal certainty, and fostering responsive law are essential to optimize the benefits of globalization while safeguarding national economic interests.

Abstract

This research aims to address economic globalization based on Pancasila. This type of research is juridical research, drawn from a literature review. The results of this study conclude that Indonesia's most appropriate stance in facing economic globalization is to adhere firmly to the Pancasila ideology and the 1945 Constitution (especially the original text and the spirit of the economic articles therein) as the main guideline in all fields. Economic globalization is like a strong current that brings both opportunities and threats; to filter this current, Pancasila must be used as a filter and foundation in the formulation of every policy. Actively fighting for a just global economic order. A national stance does not mean isolation; Indonesia must instead participate in international forums to encourage reform of more balanced global rules. Thus, the ideals of Indonesian independence to contribute to creating world peace and social justice (the Preamble to the 1945 Constitution) can be realized. This stance is evident, for example, in Indonesia's support for WTO reform to take into account the interests of developing countries, and the G20 initiative for a fair global digital tax. Indonesia can be the moral voice of Pancasila in the midst of the global economic arena.

The resultsofthe study onDecisionNumber. 859/Pid.Sus/2023/Pn.Bjm. The judgestatedthatthedefendantwasproventohavecommittedsexualviolenceagainst a 13-year-old childvictim, thedefendant as aneducator. However, theadditionalpunishmentimposedonthedefendant in theformofchemicalcastrationisconsideredcontroversial, whichincreasesthepunishmentfortheperpetrator. The ambiguity in thetechnicalimplementation, thepotentialforchanges in theperpetrator'sconditionduringdetention, theunpreparednessoftheimplementinginstitution, andethicalconflictswithmedicalpersonnel. Tentu saja tidak seimbang jika sudut pandang terhadap anak sebagai korban diabaikan. Pemerintah Indonesia memberlakukan hukuman kebiri kimia sebagai trobosan dalam meminimalisir tingkat kejahatan kekerasan seksual terhadap anak yang semakin meningkat. Berdasarkan pengaturan Undang-Undang Nomor.17 Tahun 2016 tentang perlindungan anak dalam pelaksanaan hukuman kebiri kimia memberikan amanat dokter untuk melaksanakan hukuman kebiri kimia kepada pelaku. Menimbulkan problematika terkait aspek hak asasi manusia dan etika kedokteran. Dapat dilihat dari Putusan Nomor. 859/Pid.Sus/2023/Pn.Bjm yang menjatuhkan terdakwa hukuman tambahan kebiri kimia. Hasil penelitian terhadap Putusan Nomor. 859/Pid.Sus/2023/Pn.Bjm. Hakim menyatakan bahwa terdakwa terbukti melakukan kekerasan seksual terhadap anak korban 13 tahun, terdakwa sebagai tenaga pendidik. Namun hukuman tambahan yang dijatuhi kepada terdakwa berupa kebiri kimia dianggap kontroversi yang memperberat hukuman bagi pelaku.Ketidakjelasan dalam teknis pelaksanaan, potensi perubahan kondisi pelaku selama masa tahanan, ketidaksiapan institusi pelaksana, serta konflik etika dengan tenaga medis. Hal ini menyebabkan risiko ketidakpastian hukum dan potensi pelanggaran hak asasi manusia bagi pelaku, yang tetap harus dilindungi hak-haknya selama proses hukum dalam pelaksanaa sanksi. Abstract

Ideally, the validity of Testimonium de Auditu evidence in cases of sexual violence should provide stronger legal protection for victims, given that sexual violence often occurs in closed situations without direct witnesses. However, in reality, Testimonium de Auditu has long been considered to have insufficient evidentiary strength in Indonesian criminal law, leading to its frequent disregard in law enforcement processes. This research focuses on how regulatory changes in Indonesia have accommodated and strengthened the validity of Testimonium de Auditu in the context of sexual violence crimes. This study aims to analyze the renewal of the validity of Testimonium de Auditu evidence in sexual violence crimes based on the perspective of Indonesian legislation. The research is classified as a qualitative literature study, utilizing a normative legal approach. The findings indicate that the reforms outlined in the Indonesian Criminal Code (KUHP), Constitutional Court Decision Number 65/PUU-VIII/2010, and Law Number 12 of 2022 on Sexual Violence Crimes (UU TPKS) have strengthened the position of Testimonium de Auditu as valid evidence in cases of sexual violence. These reforms allow Testimonium de Auditu to be recognized and more adaptive within the criminal justice system, particularly in addressing the challenges of proving sexual violence, which often lacks direct witnesses.

Abstract

Democracy in the government system places emphasis on power in the hands of the people; however, with the approval of election law number 7 of 2017 regarding the regulation of threshold requirements for presidential and vice presidential candidates, it is considered detrimental to the people because the additional conditions related to the administrative requirements for presidential and vice presidential candidates are deemed to be contradictory. With the 1945 Constitution Article 6A paragraph (2) and Article 28 D paragraph (3) on human rights, especially the right to participate in politics, the space for democracy is limited because, basically, Indonesian people have the right to vote and choose. In fact, it has been proven that there are only two candidates for president and vice president in the 2014–2019 and 2019–2024 election periods, forcing the public to choose the candidates that have been provided, even though these candidates are not necessarily the candidates that the public expects, thus giving the impression of forcing personal human rights to participate. in the presidential election. In this research, the author uses a normative legal research method in the form of a library search. The results of the research show that the nomination requirements regulated in the 1945 Constitution, Article 6A paragraph (2), do not regulate thresholds, but there are additional requirements in Article 222 that have become controversial, so that the threshold causes the loss of political rights to be able to suggest presidential and vice presidential candidates. Conflicts can destroy democracy. . Indonesia. People and political parties who want to run for the presidential election cross the threshold so that entering a presidential system gives rise to limited democracy. This is because national hopes still require a judicial review to guarantee the upholding of human rights, which hampers the process of emerging more alternative leadership candidates to realize people's welfare. From a benefit perspective, whatever government policy, must take into account the aspirations of its people, so that government policy must be in line with the public interest.

Abstract

The long-running conflict between Israel and Palestine has yet to find a bright light. The international community became aware of this situation and denounced Israel's actions in Palestine. Various parties believe that Israel has committed grave human rights breaches, while many Israeli supporters argue that the attack is a form of vengeance and protection for Israel against attacks by Palestinian supporters. The purpose of this study is to examine the Israeli-Palestinian conflict from the standpoint of international humanitarian law and human rights. Primary, secondary, and tertiary legal resources are the sources of legal materials employed in the normative juridical research process. This study employs a conceptual and case-based approach, methodologies for collecting legal materials through library studies, and analysis of legal materials through the use of legal materials obtained to address problems. The research findings revealed that Israel has violated humanitarian norms (humanity). There were multiple cases in which the Israeli military breached humanitarian precepts. The use of heavy weaponry with uncertain consequences caused significant damage, and several Palestinians died. The Palestinian people's situation is deteriorating due to a food supply problem. Until recently, the International Court of Justice (ICC) has taken no action to prosecute war crimes committed by Zionist Israel.

Abstract

Narcotics crimes in Indonesia have caused many victims, especially among the young generation of the nation, which is very dangerous for the lives of society, the nation, and the state. In enforcing criminal law against narcotics crimes, it is a concern in connection with the rampant disparity in sentencing. The court decisions in Case Number 47/Pid.Sus/2024/PN.Tbt and Case Number 48/Pid.Sus/2024/PN. Tbt imposed sentences with very different differences, so that the considerations and implications need to be studied in depth. The results of this study indicate that there is no legal regulation that prohibits disparity in sentencing. The occurrence of disparity in sentencing for narcotics crimes in the verdict of narcotics crimes Case Number 47/Pid.Sus/2024/PN.Tbt and Case Number 48/Pid.Sus/2024/PN. Tbt refers to the principle of judges' freedom in carrying out their judicial functions. The judge's considerations in the verdict of narcotics crimes Case Number 47/Pid.Sus/2024/PN.Tbt with defendant Jefri and Case Number 48/Pid.Sus/2024/PN. Tbt with defendant Supriadi are an integral and inseparable unit, but there was an error in the judge's considerations so that the sentences were imposed with very different differences. The implications of the disparity in sentencing in the two decisions are that there is injustice, uncertainty and uselessness in law enforcement against narcotics crimes.

Abstract

The crime of human trafficking has been regulated by Law Number 21 of 2007 concerning the eradication of the crime of trafficking. When the victims have experienced material and immaterial losses, restitution is one of the forms of assistance to victims of the crime of human trafficking. The research method used in this study is descriptive-analytical with a normative legal research type. Furthermore, the research data consists of primary and secondary data. Law Number 21 of 2007 regulates restitution for victims of human trafficking. Decision 322/Pid. Sus/2023/PN Jkt. Sel does not provide restitution, while Decision 667/Pid. Sus/2023/PN Kis does. Judges need to be consistent and objective in handling human trafficking cases so that justice is achieved. Decision 322/Pid. Sus/2023/PN Jkt. Sel is considered to have paid less attention to the facts of the trial, while Decision 667/Pid. Sus/2023/PN Kis is appropriate because the judge creates legal certainty. Legal certainty in a judge's decision must be based on relevant facts.
