Abstract

Batasan usia perkawinan di Indonesia diatur oleh Undang-Undang dengan menyebut batas usia yang pasti, tetapi dalam Islam tidak ada menyebutkan terkait yang pasti mengenai batas usia perkawinan. Perbedaan pandangan antara hukum Islam dan positif menimbulkan keraguan terkait perkawinan anak khususnya pada kasus pasangan muda yang hamil diluar kawin. Dispensasi kawin menjadi alternatif bagi mereka yang tidak sesuai usia minimal untuk kawin. Penelitian ini bertujuan untuk menganalisis prosedur dispensasi kawin untuk yang kawin di bawah usia yang diperbolehkan dan akibat hukum akibat penetapan hakim menurut hukum perdata dan hukum Islam. Penelitian ini merupakan penelitian jenis yuridis normative, bersifat analitis deskriptif dengan pendekatan kasus (case approach) dan pendekatan konseptual (conseptual approach). Data sekunder, yang terdiri dari bahan hukum primer, sekunder, dan tersier yang relevan dengan masalah ini kemudian analisis data kualitatif. Hasil penelitian ini menjelaskan bahwa prosedur pengajuan dispensasi kawin melibatkan persyaratan administrasi dan tahapan pengajuan yang harus dilaksanakan. Kemudian, akibat hukum dari Hakim mengabulkan dan menolak dispensasi kawin meliputi akibat secara perdata dan hukum Islam. Dimana secara perdata adanya penetapan dari Hakim berupa ditolak dan diterima yang berguna untuk syarat melangsungkan perkawinan di KUA. Kemudian akibat secara Hukum islam berkaitan dengan status perkawinan, harta perkawinan, status anak, hak waris, nasab serta wali anak. The age limit for marriage in Indonesia is regulated by law by mentioning a definite age limit, but in Islam there is no mention regarding the exact age limit for marriage. The difference in views between Islamic and positive law raises doubts regarding child marriage, especially in the case of young couples who are pregnant outside of marriage. Dispensation of marriage is an alternative for those who do not meet the minimum age for marriage. This study aims to analyse the procedure for dispensation of marriage for those who marry under the permitted age and the legal consequences of the judge's decision according to civil law and Islamic law. This research is normative juridical research, descriptive analytical in nature with a case approach and conceptual approach. Secondary data, consisting of primary, secondary, and tertiary legal materials relevant to this issue then qualitative data analysis. The results of this study explain that the procedure for applying for marriage dispensation involves administrative requirements and the stages of submission that must be carried out. Then, the legal consequences of the Judge granting and refusing marriage dispensation include civil consequences and Islamic law. Where in civil law there is a determination from the Judge in the form of being rejected and accepted which is useful for the conditions for marrying at the KUA. Then the consequences in Islamic law are related to marital status, marital property, child status, inheritance rights, nasab and child guardians.

Abstract

Local radio stations play a vital role in the broadcasting industry, serving as a key platform for sharing information and entertainment with the community. However, as the digital music industry continues to evolve, local radio stations in Medan face increasingly complex challenges in complying with copyright laws for songs and music. This study explores the struggles of local radio stations in meeting royalty payment obligations while also examining the regulatory and economic barriers that impact the enforcement of copyright laws in the broadcasting sector. Using a juridical-normative approach with qualitative methods, this research conducts a case study of several local radio stations in Medan. The findings reveal that although awareness of royalty obligations is growing, significant challenges remain. These include unclear regulations, financial burdens, and a lack of understanding of how royalties are distributed. This study highlights the need for greater collaboration between the government, collective copyright management organizations, and radio industry players to establish a fairer and more sustainable system for ensuring compliance with music copyright laws in local broadcasting.

Abstract

This journal discusses the phenomenon of Online Gender-Based Violence (OGBV) which is increasingly worrying in the digital era, especially related to the spread of non-consensual intimate content (NCII) or what is often referred to as "revenge porn." This study explores the factors that cause NCII, including abuse of trust, unsafe use of technology, and weak legal regulations. OGBV, as a form of gender-based violence, has profound psychological, social, and economic impacts on victims, including trauma, stigma, and career losses. In addition, this journal also discusses the prevention and protection efforts needed, such as increasing digital literacy, strengthening regulations, and collaboration between various stakeholders. It is hoped that with stronger measures, the threat of the spread of non-consensual intimate content can be minimized and protection for victims can be increased.

Abstract

Economic globalization has increasingly shaped the field of intellectual property rights (IPR), transforming copyright protection from a domestic matter into a strategic tool of global trade. Through international instruments such as the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs) and the Berne Convention of 1886, universal copyright standards are enforced across jurisdictions. Yet this harmonization generates tension between international obligations and national legal sovereignty. This article employs a juridical-normative method with doctrinal, case study, and comparative approaches to examine these dynamics. The case of Auld Lang Syne illustrates how public domain works evolve into shared cultural heritage, while the dispute of Ahmad Dhani v. Once Mekel reveals persistent enforcement challenges in Indonesia. Comparative analysis of the United States, United Kingdom, Japan, and Indonesia demonstrates divergences in copyright duration, derivative work protection, and exceptions such as parody. The article argues that Indonesia must ground its response to globalization of IPR in Pancasila and the 1945 Constitution, thereby ensuring that national copyright law is not merely a passive rule taker within the global system but an active framework that safeguards cultural identity and national interests.

Abstract

Globalization has significantly transformed economic, political, legal, social, and cultural dimensions worldwide, including Indonesia as a developing country. The rapid development of information and communication technology has accelerated integration into global markets and posed both opportunities and challenges for national legal systems. This article analyzes the impact of economic globalization on corporate law reform in Indonesia using a normative legal research method with a literature review approach. The discussion highlights that globalization compels legal reform through institutional, instrumental, and cultural changes, particularly in corporate governance, investment, and intellectual property protection. Findings indicate that Indonesian corporate law must adapt to global standards while maintaining national identity and constitutional values based on Pancasila and the 1945 Constitution. Strengthening legal harmonization, ensuring legal certainty, and fostering responsive law are essential to optimize the benefits of globalization while safeguarding national economic interests.

Abstract

This research aims to address economic globalization based on Pancasila. This type of research is juridical research, drawn from a literature review. The results of this study conclude that Indonesia's most appropriate stance in facing economic globalization is to adhere firmly to the Pancasila ideology and the 1945 Constitution (especially the original text and the spirit of the economic articles therein) as the main guideline in all fields. Economic globalization is like a strong current that brings both opportunities and threats; to filter this current, Pancasila must be used as a filter and foundation in the formulation of every policy. Actively fighting for a just global economic order. A national stance does not mean isolation; Indonesia must instead participate in international forums to encourage reform of more balanced global rules. Thus, the ideals of Indonesian independence to contribute to creating world peace and social justice (the Preamble to the 1945 Constitution) can be realized. This stance is evident, for example, in Indonesia's support for WTO reform to take into account the interests of developing countries, and the G20 initiative for a fair global digital tax. Indonesia can be the moral voice of Pancasila in the midst of the global economic arena.
