Abstract

The issue of whaling has been extensively debated in various international occasions since it causes a declines in many of the world’s whale population. Presently, Faroe Islands is one of the few regions in Denmark that still adamantly practiced whaling for traditional purposes, even though Denmark itself has prohibit it. This writing aims to analyze the whaling tradition in Faroe Islands from the International Law perspective. Further, to examine whether Denmark has an international obligation to end whaling activities in Faroe Islands. The method that is used in this writing is the normative legal research. The result of this analysis shows that the tradition in Faroe Islands is consistent with International Law, thus Denmark has no international obligation to end the tradition.

Abstract

The purpose of this service is to share experiences regarding online learning strategies to increase motivation and activeness of elementary school students, and to share experiences about online learning media and how to use them in supporting teaching and learning activities for elementary school students. The online learning system tend to reduce the motivation and activity of elementary school students, and make students become lazy to study. To overcome this situation, it is necessary to modify the learning strategies by teachers. Online learning carried out by several elementary schools in Singapadu Kaler village encountered several technical and non-technical obstacles, namely facility resources which is learning media that were too complicated, making it difficult for teachers and parents of students, as well as human resources obstacle, namely teachers who were less proficient in the use of online learning media and busy parents which resulting in limited devices that can be used by their children. This service uses the methods such as delivering online teaching experiences by members of the International Law Department, Faculty of Law, Udayana University, as well as questions and answers to obtain results and solutions as a form of solving problems and obstacles faced by teachers in conducting online learning during the Covid-19 pandemic.

Abstract

ABSTRAK Penulis melakukan studi ini bertujuan untuk membahas serta mengetahui secara mendalam mengenai perlindungan hukum terhadap kekerasan kekerasan seksual dalam rangka menegakkan hak asasi perempuan di masa globalisasi ini. Kemudian, penulisan hukum tersebut memakai metode penelitian normatif beserta prosedur pendekatan Undang-Undang (Regulation Approach) serta Pendekatan Analitis (Systematic Approach). Temuan studi menunjukkan bahwa peran CEDAW dan Optional Protocol CEDAW serta seluruh instrumen perlindungan perempuan sejatinya dapat menegakkan hak asasi perempuan dalam memperoleh rasa nyaman dan aman setiap harinya. Namun oleh karena kurangnya implementasi dalam lini kehidupan nyata membuat kekerasan seksual meningkat kian harinya secara universal terlebih di Indonesia. Bagaimana pun harus terdapat kesadaran nurani dalam batiniah diri seseorang terlebih pelaku terhadap korban. Kata Kunci: CEDAW, PBB, Kekerasan seksual. ABSTRACT The author conducted this study aimed at discussing and knowing in depth about legal protection against sexual violence to uphold women’s human rights in this era of globalization. Then, the writing of the law uses a normative research method along with the procedures for the Legal Approach (Regulation Approach) and the Analytical Approach (Systematic Approach). The study findings show that the role of CEDAW and Optional Protocol CEDAW belong with all instruments of women’s protection can uphold women's human rights in obtaining a sense of comfort and security every day. However, due to the lack of implementation in real life, sexual violence is increasing day by day universally, especially in Indonesia. However, a person’s inner self must be aware of conscience, especially the perpetrator against the victim. Key Words: CEDAW, United Nations, Sexual prosecution.

Abstract

The intention of this article is to provide comprehension regarding the modus operandi in the practice of illegal transhipment as the arrangement of the illegal transhipping act carried out by foreign vessels in the territory of Indonesia in an attempt to catch fish in the Indonesian Exclusive Economic Zone under UNCLOS 1982. This research is conducted based on normative juridicial legal research method. The result of this research explains that the modus operandi carried out in the practice of illegal transhipment is: 1) The first modus is to borrow permission from another vessel to carry out fishing. This method is an act of demolition of supervisors and law enforcement so that vessels that do not have a licence or ex-foreign vessel that is not allowed to operate can continue fishing; 2) The second modus is the change of suit by changing the ex-foreign vessel (a vessel created outside Indonesia but having legal status with the Indonesian flag) into the same vessel made in the country; and 3) The last modus is returning without deregistration. Ex-foreign shipowners use this modus by leaving the territory of Indonesia without going through the deregistration process. Furthermore, as a coastline state, Indonesia is able to enforce adherence to directives and regulations issued by other coastal states in line with UNCLOS Article 73 by using actions including boarding, inspection, arrest, and prosecution. Thus, the coastal state has the authority to enact its laws and regulations against vessels originating from other States in an attempt to carry out illegal fishing in its ZEE. ABSTRAK Tujuan pengkajian dari artikel ini adalah agar dapat memberikan pemahaman terkait modus operandi dalam praktik illegal transhipment serta pengaturan dari tindakan illegal transhipment yang dilakukan oleh kapal asing di teritori Indonesia dalam upaya menangkap ikan di Zona Ekonomi Ekslusif Indonesia berdasarkan UNCLOS 1982. Penelitian ini diteliti berdasarkan metode penelitian hukum yuridis normatif. Perolehan dari riset ini menjelaskan bahwa modus operandi yang dilakukan dalam praktik illegal transhipment yaitu: 1) Modus pertama adalah meminjam izin dari kapal lain untuk melakukan penangkapan ikan. Cara ini merupakan tindakan memongahi pengawas dan aparat penegak hukum sehingga kapal yang tidak mempunyai izin atau kapal eks-asing yang tidak diperbolehkan beroperasi dapat terus melakukan penangkapan ikan; 2) Modus kedua adalah mengganti baju dengan mengubah kapal eks-asing (kapal yang diciptakan di luar Indonesia tetapi berstatus hukum dengan berbendera Indonesia) menjadi seperti kapal yang dibuat di dalam negeri; dan 3) Modus terakhir adalah kembali tanpa deregistrasi (tanpa melapor ulang). Pemilik kapal eks-asing menggunakan modus ini dengan meninggalkan wilayah Indonesia tanpa melalui proses deregistrasi. Selain itu, dalam menjalankan kekuasaan kedaulatannya di ZEE, Indonesia sebagai negara pantai dapat mengambil langkah-langkah seperti naik ke atas kapal, inspeksi, penangkapan, dan penuntutan hukum untuk menegakkan kepatuhan terhadap peraturan dan ordonansi yang diterbitkan dari negara pantai sesuai dengan Pasal 73 UNCLOS. Dengan demikian, negara pantai memiliki kewenangan untuk menegakkan hukum dan peraturannya terhadap kapal yang berasal dari negara lain dalam upaya melaksanakan penangkapan ikan dengan ilegal di ZEE-nya. Kata Kunci: illegal transhipment, kejahatan perikanan, Zona Ekonomi Eksklusif.

Abstract

ABSTRAK Perang telah menjadi bagian dari sejarah kehidupan dan peradaban manusia di bumi. Guna menghindari korban dari konflik bersenjata, penggunaan senjata untuk berperang diatur dalam hukum humaniter. Seperti di Statuta Roma Pasal 8²(2)(b)(xx) melarang penggunaan senjata yang berkarakter menimbulkan kerusakan berlebihan alias kesakitan yang tak berkesudahan dan tidak pandang bulu. Adapun beberapa penggunanan senjata yang dilarang, salah satunya adalah ranjau anti-personil. Penggunaan ranjau anti-personil dilarang atas alasan kemanusiaan tersebut. Dari permasalahan ini penulis bertujuan untuk membahas serta mengetahui lebih dalam mengenai penggunaan ranjau anti-personil yang dilarang dalam konflik bersenjata. Dalam penulisan hukum, penulis menggunakan tata cara penulisan normative beserta prosedur pendekatan Undang-Undang (Regulation Approach) untuk menjawab permasalahan hukum yakni penggunaan ranjau anti-personil dalam konflik bersenjata. Selain itu penulis menggunakan Pendekatan Analitis (Analytical Approach) guna meninjau unsur-unsur pertanggungjawaban negara dari hukum humaniter internasional yang menggunakan ranjau anti-personil dalam konflik bersenjata. Melihat banyak situasi yang mengakibatkan korban perang hukum humaniter hadir untuk memanusiakan konflik bersenjata dengan cara membatasi penggunaan persenjataan perang, dimana salah satunya adalah ranjau anti-personil. Setiap negara yang terlibat konflik bersenjata harus memiliki kesadaran untuk membatasi militernya dalam penggunaan senjata tertentu. Kata Kunci: Konflik Bersenjata, Hukum Humaniter Internasional, Ranjau ABSTRACT War has turn into a part of human life’s history and civilization on earth. With regards to avoid victims of armed conflict, utilization of weapons is regulated in humanitarian law. As the Rome Statute Article 8²(2)(b)(xx) prohibits the use of weapons with character causes disproportionate catastrophe or endless and extensive misery. As for some of the prohibited uses of weapons, one of which is anti-personnel mines. Utilization of anti-personnel mines is constrained for humanitarian reasons. From this issue the author aims to discuss and find out further concerning the utilization of anti-personnel mines which are prohibited in armed conflict. In this writing, the author uses normative writing procedures along with the Regulatory Approach to answer the legal problem, namely the utilization of anti-personnel mines in armed conflict. Additionally, the author uses an Analytical Approach to review the elements of state responsibility from international humanitarian law that uses anti-personnel mines in armed conflict. Seeing many situations that have resulted in victims of war, humanitarian law exists to humanize armed conflict by limiting the use of weapons of war, the anti-personnel mines. Every country who is party to the armed conflict shall possess awareness through limit its military in the appliance of particular weapons. Abstract

This research aims to research, analyze and examine Immigration Regulations from the perspective of Indonesian Citizen Travel Documents. Based on Law no. 6 of 2011 concerning Immigration, foreigners when traveling in Indonesia are required to have travel documents, travel documents are official letters issued by authorized officials from a country. The research method used in this research is the normative legal research method. The results of the discussion show that regulations regarding travel documents for Indonesian citizens are regulated in Law Number 6 of 2011 concerning Immigration as an umbrella rule for immigration legislation. In Article 1 number 13, number 15 and number 16 of the Immigration Law, the meaning of travel documents, the meaning of travel documents of the Republic of Indonesia and Passports of the Republic of Indonesia are given. In full it states: Article 1 number 13, namely: Travel Documents are official documents issued by authorized officials from a country, the United Nations, or other international organizations for travel between countries which contain the identity of the holder. Article 1 number 15: Travel Documents of the Republic of Indonesia are Passports of the Republic of Indonesia and Travel Documents are Like Passports of the Republic of Indonesia. Article 1 number 16: Passport of the Republic of Indonesia, hereinafter referred to as Passport, is a document issued by the Government of the Republic of Indonesia to Indonesian citizens to travel between countries which is valid for a certain period of time. The same regulation is also contained in Government Regulation Number 40 of 2023 concerning the Fourth Amendment to Government Regulation Number 31 of 2023 concerning Implementing Regulations of Law Number 6 of 2011 concerning Immigration.

Abstract

Penelitian ini bertujuan guna menganalisis perlindungan hukum terhadap relawan kemanusiaan dalam konflik bersenjata berdasarkan hukum humaniter internasional, dengan studi kasus pembunuhan Razan Al Najjar oleh tentara Israel. Razan Al Najjar adalah seorang perawat sukarela yang ditembak mati saat bertugas di Jalur Gaza pada tahun 2018. Peristiwa ini memicu pertanyaan sampai mana hukum humaniter internasional, khususnya Konvensi Jenewa 1949 dan Protokol Tambahan, melandasi perlindungan terhadap pekerja kemanusiaan yang terlibat dalam konflik bersenjata. Melalui pendekatan yuridis normatif, penelitian ini mengeksplorasi asas-asas hukum humaniter internasional, termasuk prinsip pembedaan, proporsionalitas, dan perlindungan terhadap personel medis. Hasil penelitian menunjukkan bahwa tindakan pembunuhan terhadap Razan Al Najjar mengindikasikan pelanggaran serius pada hukum humaniter internasional, pada hakikatnya memberikan perlindungan khusus kepada personel medis dan relawan kemanusiaan. Penelitian ini juga menyoroti pentingnya penegakan hukum internasional dalam konflik bersenjata, serta perlunya mekanisme yang lebih efektif untuk menjamin perlindungan bagi relawan kemanusiaan di lapangan.

Abstract

Penelitian ini bertujuan untuk menganalisis kekosongan pengaturan mengenai validitas traditional fishing grounds dalam hukum laut internasional serta menilai status keberlakuannya dalam perkembangan hukum saat ini. Pada penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan konseptual dan pendekatan kasus melalui analisis terhadap ketentuan UNCLOS 1982, praktik negara, dan preseden tribunal internasional dengan pengumpulan data menggunakan studi kepustakaan yang menghasilkan data sekunder berupa bahan hukum yang meliputi bahan hukum primer seperti undang-undang dan putusan internasional yang relevan, bahan hukum sekunder berupa buku serta jurnal, dan bahan hukum tersier yang kemudian dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa tidak adanya pengaturan eksplisit mengenai traditional fishing grounds dalam UNCLOS 1982 menimbulkan ketidakpastian hukum, karena konvensi tersebut hanya mengakui traditional fishing rights dalam konteks terbatas Pasal 51 ayat (1) dan tidak menyediakan definisi maupun mekanisme pengakuan terhadap wilayah tangkap historis. Kekosongan ini menyebabkan penilaian validitas traditional fishing grounds bergantung pada interpretasi tribunal internasional, bukti historis, serta kesepakatan bilateral antarnegara
