Abstract

The purpose of this research is to find out and analyze poverty in terms of the Covid-19 Pandemic and in general before the Pandemic hit Rungkang Village, and how to overcome poverty occurs through the role of government and the Islamic economy so that it can eliminate poverty. This type of research is descriptive qualitative research, and the approach used in this research is ethnographic research. The research location taken was in Rungkang Village, Losari District, Brebes Regency. The implementation time is from November 2021 to May 2022. The data taken is real data obtained from the field. Sources of data in this study were obtained from communities affected by the Covid-19 pandemic in Rungkang Village, Losari District, Brebes Regency. Data collection techniques were carried out using observation, interviews, and documentation. The data analysis technique uses interactive Milles and Huberman analysis. The results of the study show that the Covid-19 Pandemic has had an impact on changing the behavior of the people of Rungkang Village where economic activity has driven an increasing poverty rates where unemployment has reduced the economy.

Abstract

The advancement of digital technology has significantly transformed buying and selling systems, particularly through online marketplace platforms. One notable innovation is the paylater payment scheme, which allows consumers to defer payments after completing transactions. While this method offers practical convenience, it raises critical concerns from the perspective of Sharia economic law, especially regarding the elements of riba (interest), gharar (uncertainty), and transactional justice. This study aims to analyze the implementation of paylater features in the Hijabequlla marketplace by examining their compliance with Sharia economic principles. Using a qualitative descriptive method, data were collected through observation, interviews, and literature review. The findings reveal that although the paylater scheme facilitates online purchases, its current implementation shows potential violations of Sharia provisions—particularly those outlined in the DSN-MUI Fatwa No. 1 of 2004 concerning interest-based transactions. The novelty of this research lies in its contextual analysis of a contemporary marketplace platform using the framework of Islamic economic law, offering insights into the alignment—or misalignment—between digital consumer financing and Sharia norms. The study concludes that a reconstruction of the paylater system is needed to ensure compliance with Islamic legal standards, thereby promoting fair and ethical digital transactions.Keywords: Marketplace; Paylater; DSN-MUI Fatwa; Digital Transactions; Sharia Economic Law.

Abstract

AbstrakArtikel ilmiah ini membuktikan bahwa hukum wanita karir dalam Islam dengan merujuk kepada pendapat para ulama dan fuqaha sangat beragam. Pandangan bahwa wanita tidak boleh berkarir di luar rumah secara totalitas dibantah dalam artikel ini. Wanita lebih utama di rumah memang benar, namun bukan berarti berkarir bagi wanita di luar rumah itu tidak boleh. Islam mengatur secara gamblang dan jelas bagaimana seharusnya wanita yang ingin berkarir. Berkarir di luar rumah juga pernah dilakukan oleh para wanita di zaman Nabi Muhammad Saw, termasuk istri-istri beliau dan para shahabiyyah (sahabat dari kalangan perempuan). Kajian ini mengajak para pembaca terutama para laki-laki untuk lebih arif dalam memandang wanita karir. Selain itu,  agar para wanita karir paham akan hukum Islam dalam berkarir sehingga tidak melewati batas-batas yang telah ditetapkan dalam Islam.AbtractThis scientific article proving that legal career women in Islam by referring to the opinion of the scholars and jurists are very diverse.The view that women should not be a career outside the home in totality is contradicted with the conclusion this article.Women better at home it is true, but it does not mean a career for women outside the home it should not be. Islam set in stark and clear how should women who want a career. A career outside the home has also been done by women at the time of the Prophet Muhammad's wives, including she and his shahabiyyah.This study invites readers especially the males to be more discerning in looking at career women. Abstract

Syari’ah economic practice actually has been widely recognized by Indonesian Moslem. However, a new positive   form of   this   practice   only   begins   after   reformation   period   by the establishment of Undang-undang Nomor 10 Tahun 1998 tentang Perubahan Undang-undang Nomor 7 Tahun 1992, and Undang-undang Nomor 21 Tahun 2008 tentang Perbankan Syari’ah. Act on Syari’ah Banking has been delivered as the governmental appreciation and accommodation to public norms (living law). Moreover, economic practice   access   with syari’ah principle becomes so facilitated, and thus, any   banking   conventional   activities appear   being   easily   conducted   in   benefiting   banks   in   general   while   preserving   the costing pattern and other issues based on syari’ah principle.This type of research is library research (library research), in the sense that all data sources come from written materials in the form of books, documents, magazines and texts that are related to the topic of discussion through a review of various literature related to research which includes primary, secondary data. , dantertier. The data collected, read.The political dynamics of sharia economic law in legislation as a form of juridical implementation of sharia economics can be seen from Law of the Republic of Indonesia Number 7 of 1992 concerning Banking, where sharia banks are understood as profit-sharing banks. Abstract

The issue with this controversy is the use of dinar and dirham as the standard currency in the past, which is considered by some Muslim groups as a superior exchange tool for buying and selling compared to modern currency. However, on the other hand, the use of dinar and dirham is deemed impractical in its application. The purpose of this research is to explore the views of contemporary fiqh scholars on the use of dinar and dirham as a means of exchange in buying and selling, and to examine to what extent the use of dinar and dirham can be applied in the context of modern economics. The research method employed is literature study by collecting and analyzing various opinions of scholars and relevant literature. The results of the study show that contemporary fiqh scholars have diverse views on the use of dinar and dirham as a means of exchange in buying and selling. Some scholars argue that the use of dinar and dirham is still relevant in the context of modern economics because they have stable intrinsic value and can avoid inflation problems. However, there are also those who believe that the use of dinar and dirham is limited to the past and is not practical in its use in the modern era. The conclusion of this research is that the use of dinar and dirham as a means of exchange in buying and selling remains a topic of debate in the perspective of contemporary fiqh. The decision to use dinar and dirham or other currencies should be based on the convenience and needs of society, as well as adequate infrastructure support for their use. This research can provide a more comprehensive understanding of the controversy surrounding the use of dinar and dirham in the context of contemporary fiqh and can serve as a reference for academics and society to make wise decisions in the use of exchange tools for buying and selling.

Abstract

Media sosial telah menjadi alat yang semakin krusial bagi warganet dalam berpartisipasi aktif dalam mewujudkan keadilan dan meningkatkan akuntabilitas penegakan hukum di Indonesia. Penelitian ini bertujuan untuk merinci dan menganalisis peran media sosial dalam memfasilitasi partisipasi warganet serta dampaknya terhadap keadilan dan akuntabilitas, khususnya dalam konteks penegakan hukum di Indonesia. Dalam metodologi penelitian ini, dilakukan studi literatur menyeluruh dan analisis mendalam terhadap kasus-kasus kontroversial yang melibatkan media sosial. Temuan utama penelitian ini menunjukkan bahwa partisipasi aktif warganet melalui media sosial dapat berkontribusi signifikan dalam mewujudkan keadilan dan meningkatkan tingkat akuntabilitas penegakan hukum di negara ini. Dengan berbagai platform media sosial, warganet dapat dengan cepat menyebarkan informasi, memobilisasi dukungan publik, dan mengawasi tindakan penegak hukum. Meskipun demikian, penelitian ini juga mengidentifikasi beberapa tantangan dan kendala yang perlu diatasi agar potensi media sosial dapat dimaksimalkan dalam mencapai tujuan tersebut. Dukungan yang lebih kuat, pengelolaan konten yang bijaksana, dan regulasi yang tepat diperlukan untuk memastikan bahwa media sosial dapat berfungsi sebagai alat yang efektif dalam mencapai keadilan dan akuntabilitas dalam penegakan hukum di Indonesia.

Abstract

This study aims to analyze the management of tabarru funds in sharia health insurance and the sharia health insurance claims process at Bank Muamalat Syariah. The method used in this study is a literature study method, and through a qualitative descriptive approach. Sharia Health Insurance has a solid legal basis, firmly rooted in the principles of Islamic sharia (ta'awun, avoiding gharar and usury) and supported by positive Indonesian law (Law No. 40 of 2014) and DSN-MUI Fatwas (No. 21, 52, 53) which regulate general guidelines, Wakalah bil Ujrah contracts, and Tabarru' contracts. All operations are based on the main principles of Takaful (mutual responsibility), Wakalah (representation), and Tabarru' (voluntary contribution) for the benefit of the community broadly and sustainably. In practice, Bank Muamalat's Sumber Branch, in collaboration with trusted insurance partners, strictly manages the Tabarru' Fund, which is separated from the company's funds and invested in halal instruments such as Sukuk and Sharia Deposits. To ensure fairness, the Claims Process is designed to be efficient through a Cashless or Rembes mechanism, while still implementing strict health history verification (anti-fraud) to exclude pre-existing conditions, ensure transparency, and ensure compliance with the agreed-upon agreements to maintain participant trust.

Abstract

The rapid growth of electronic transactions in the digital era has driven the transformation of conventional contract models into e-contracts based on digital and automated systems. However, this transformation poses serious challenges in terms of legal protection for consumers, particularly regarding refund and warranty clauses, which are often unilaterally drafted by businesses. The main issue addressed in this research is the lack of clarity in the substance of refund and product warranty clauses in electronic contracts, which contradicts the principles of contractual fairness and consumer protection. This study used a normative juridical method with statutory and comparative legal approaches, focusing on international practices, particularly in the European Union. The findings reveal a regulatory gap in Indonesia's positive law, including Law No. 8 of 1999 on Consumer Protection, Law No. 11 of 2008 on Electronic Information and Transactions, and the Indonesian Civil Code. The absence of minimum standards for refund and warranty clauses results in an imbalance of power between businesses and consumers and undermines legal certainty in digital transactions. Therefore, there is a need to harmonize the principle of freedom of contract with consumer protection through the establishment of regulations that govern standard clauses in a transparent, proportional, and fair manner. Such regulation is expected to resolve the dilemma between business efficiency and the fairness of legal protection, and to foster the development of a sustainable digital trade ecosystem.

Abstract

This study examines the influence of convenience and security on brand loyalty, mediated by brand trust, among Muslim college students using the DANA digital wallet. In the Islamic fintech context, where ethical values intersect with technological adoption, trust and loyalty are key to user retention. Although DANA offers strong usability and security, it trails competitors in loyalty, raising the question: how do convenience and security affect brand loyalty through brand trust among users familiar with Islamic economic principles? This research is significant as it connects conventional consumer behavior with Islamic economic perspectives, focusing on a demographic familiar with sharia-based financial principles. Using a quantitative approach, the study analyzed survey data from 100 purposively sampled students at the Faculty of Sharia and Islamic Economics, IAIN Syekh Nurjati Cirebon. All of them are DANA users for over three months. Findings revealed that convenience and security significantly influence brand trust. Brand trust fully mediates the impact of convenience and partially mediates the impact of security on brand loyalty. These results highlight that while functionality is important, trust, especially when aligned with Islamic ethical values, is crucial in fostering loyalty. To improve user retention, digital wallet providers should enhance not only technical performance, but also ethical guarantees rooted in transparency and fairness, as emphasized in Islamic economics.
