Abstract

This article discusses the phenomenon of the gredoan tradition that occurs in the Osing Banyuwangi community. This tradition, which is usually carried out on the eve of the Prophet Muhammad's birthday, is used as an opportunity for young people or widowers and widows to find a soul mate or life partner. The aim of this research is to find out and describe the phenomenon of the gredoan tradition in the Osing Banyuwangi community and the sociological perspective of Islamic law in looking at the tradition phenomenon that occurs. The research method is qualitative, using a sociological approach and Islamic law. The results of the research show that the Gredoan tradition can be said to be a local ta'aruf which uses the basis of customs and culture in the Osing Banyuwangi community. This gredoan tradition is carried out on the eve of the birthday of the Prophet Muhammad SAW. The process is first, young men or widowers carry out gridu on women using sodho or sticks which are then inserted into the hole in the wall of the gedheg. Then the woman who was grieved will respond by breaking the sodho or returning the sodho. The gesture of breaking the sodho means acceptance and returning the sodho contains a gesture of rejection. Second, is ngeleboni, as an attempt by the male perpetrator to stay in touch with the woman's parents. Third, munggah kawen is the stage that is the peak goal of gredoan. The Gredoan tradition is classified as urf sahih. This is because in this tradition there are no deviations from the Quran and Hadith, in fact this tradition can bring benefits to society in the context of finding a soul mate.

Abstract

This article discusses the tradition of the Maron sub-district community's belief in marital taboos. The majority of people living in Maron Sub-district are Muslims, but they also believe in mystical things such as the myth of the dragon of the year which is believed to bring mudharat (death) to the bride and groom who violate it. The purpose of this study is to reinterpret the customs that developed in Maron Probolinggo sub-district. The method used is qualitative by using the sociology approach of Islamic law. The results of the author's research using Talcott Parsons' four AGIL imperatives approach, show that the Maron sub-district community still preserves the tradition of abstinence from the myth of the dragon of the year that has existed from ancestral times and from generation to generation. Various social structures or systems maintain equilibrium so that the tradition can still take place and survive until now. Furthermore, the values contained in the tradition are to seek benefits by avoiding taboos that are believed to cause harm. Therefore, I can conclude that the tradition is a valid 'urf whose existence can still be tolerated and practiced by the people of Maron Sub-district.

Abstract

This traditional marriage is a reflection of local wisdom that continues to survive in the current of modernization and globalization. One of the important elements in this traditional marriage is the nyabung tradition, a procession that has symbolic and social meaning in it. This tradition not only strengthens the bond between the bride and groom, but also strengthens extended family and community relationships. This research is a qualitative research that uses library study and field study methods, with a case study approach using observational data collection techniques, direct observation in the Maron area and interviews with elders in the Maron village. Research shows that the tradition of merging according to Islam does not contain any prohibitions included in its implementation. Because this nyabung tradition can be classified as "urf' fi'li", which means that it is a tradition related to actions carried out. By considering the benefits and negative effects, this tradition is also considered urf shahih, because the nyabung tradition is something that is known or familiar to humans and does not conflict with sharia'. Therefore, the tradition of merging in happiness is still valued as part of cultural heritage in customary law. On the other h and, the acceptance of this tradition in Islamic law depends on whether or not there are elements that conflict with sharia. Thus, there has been harmony between customary law and Islamic law in the nyabung tradition, because in its implementation there are no conflicting elements.

Abstract

Education not only aims to educate, but also to form moral and spiritual character. In the modern era, the challenge of maintaining Islamic values is increasingly greater due to the influence of materialistic and individualistic culture. The implementation of Sufism values in the madrasah environment can be carried out in various ways, such as thematic learning based on spiritual values, habituation of noble morals in daily activities, and examples provided by educators. This study examines the application of Sufism values in building the character of students at MI Khalafiyah Syafi'iyah Zainul Hasan Genggong. With qualitative methods and field research, data was collected through observation, interviews, and literature studies. The results of the study show that the integration of Sufism is carried out through the habituation of noble morals, the example of teachers, and spiritual activities such as dhikr and moral studies. By internalizing the values of Sufism, students are taught to respect morality and ethics, as well as developing a closer relationship with God, so that they grow into responsible and virtuous individuals. This approach has proven to be effective in forming students who are not only academically superior, but also have Islamic morals.

Abstract

This article discusses about the tradition of war in traditional marriages of the Banyuwangi Osing community. The majority of the people of Osing Banyuwangi are Muslims. However, they also very closely adhere to the cultural traditions inherited from their ancestors, including customs in marriage, one of which is the tradition of war of death. The purpose of this study is to analyze in depth about the customs that develop in the Banyuwangi Osng community. The method used is qualitative, using a sociological approach to Islamic law. The results of the research show that the war-war tradition in the traditional marriage of the Osing Banyuwangi community with a sociological theory approach with Talcott Parsons' AGIL paradigm, the authors can conclude that the existence or continuity of this tradition can still continue until now, due to the balance (balancing) formed in it. Various structures or components found in the Osing Banyuwangi community maintain mutual equilibrium (there is continuous interaction between components that reinforce each other), so that a balance occurs (balancing). Therefore, the author can conclude that the tradition of war of departure is a valid urf whose existence can still be maintained and practiced by the people of Osing Banyuwangi. Artikel ini membahas tentang tradisi perang bangkat dalam perkawinan adat masyarakat osing Banyuwangi. Masyarakat osing Banyuwangi mayoritas beragama Islam. Namun, mereka juga sangat erat memegang adat kebudayaan warisan para leluhurnya, termasuk adat dalam perkawinan, salah satunya tradisi perang bangkat. Tujuan penelitian ini adalah untuk menganalisa secara mendalam tentang adat yang berkembang di masyarakat osng Banyuwangi. Metode yang digunakan adalah kualitatiif, dengan menggunakan pendekatan sosiologi hukum Islam. hasil penelian menunjukkan bahwa radisi perang bangkat dalam perkawinan adat masyarakat osing Banyuwangi dengan pendekatan teori sosiologi dengan paradigma AGILnya talcott parsons, dapat penulis simpulkan bahwa eksistensi atau keberlangsungan tradisi tersebut masih bisa berlangsung sampai sekarang, dikarenakanadanya keseimbangan (balancing) yang terbentuk didalamnya. Berbagai struktur atau komponen yang terdapat di masyarakat osing Banyuwangi saling menjaga equilibrium (terjadi interaksi terus menerus antar komponen yang saling menguatkan), sehingga terjadi suatu keseimbangan (balancing). Oleh karena itu, dapat penulis simpulkan bahwa tradisi perang bangkat merupakan urf sahih yang keberadaannya msaih dapat dipertahankan dan dipraktikkan oleh masyarakat osing Banyuwangi.

usia merupakan aspek urgen dalam perkawinan. pengaruh usia perkawinan sangat besar pengaruhnya bagi lini kehidupan seseorang. Indonesia telah mengatur usia perkwinan 16 tahun bagi perempuan dan 19 tahun bagi laki-laki. Aturan tersebut dinilai telah melanggar hak-hak anak, khususnya bagi anak perempuan, seperti hak untuk mendapatkan pendidikan yang berkualitas, hak untuk mendapat keadilan, dan hak untuk mendapatkan kesehatan reproduksi. Sehingga perlu dilakukan reformasi terhadap aturan yang telah ada. Reformasi usia perkawinan ini mengambil titik relevansi dengan maqasid asy-syari’ah: hifz al-‘aql, hifz al-‘ird, dan hifz al-nasl.Age is an urgent aspect in marriage the influence of marriage age is very big influence for one's life line. Indonesia has set the age of 16 years for women and 19 for men. Such rules have violated the rights of children, especially for girls, such as the right to a quality education, the right to justice, and the right to health. Abstract

Marriage is a sunnatullah which its conditions is determined by religion. However, the existence of marriage becomes disturbed when faced with the matter of tradition, such as the tradition of colong marriage in the Osing Banyuwangi community. This matter is because this tradition has no comprehensive formulation within nas, including alquran, sunnah, as well as ijima’. The colong marriage is a form of making a marriage proposal with traditional Osing wasilah. However, this marriage tradition creates social tension in the community such that there are some who feel aggrieved. There are several factors causing this situation, including: disagreement by parents, nyepetaken lakon, fear of a proposal being rejected, and different social statuses and economic levels. In Islamic law sociology with the theory of al-‘urf approach,  consider that the colong marriage still considered of legitimate urf.[Perkawinan merupakan sunnatulllah yang ketentuannya telah ditetapkan dalam agama. Akan tetapi, eksistensi perkawinan menjadi terusik ketika dihadapkan dengan persoalan tradisi, seperti tradisi kawin colong pada masyarakat osing Banyuwangi. Hal tersebut dikarenakan tradisi ini tidak ada rumusan yang komprehensif di dalam nas baik Alquran, Sunnah maupun ijma’. Kawin colong merupakan bentuk peminangan dalam perkawinan dengan wasilah adat osing. Namun, tradisi kawin ini menyebabkan ketegangan sosial di masyarakat, sehingga ada pihak yang merasa dirugikan. Ada beberapa faktor penyebabnya, diantaranya adalah tidak disetujui oleh orang tua, nyepetaken lakon, takut lamaran ditolak dan perbedaan status sosial dan tingkat perekonomian. Abstract

This paper examines the harmonization between customary law and religious law in traditional marriages of the Banyuwangi osing community. The contribution of religious law to the existence of customary law is inseparable. With the theory of reception a contrario, a harmonization between the two will be known. The method used in this research is qualitative-descriptive. The approach used is fiqhiyyah rules. The harmonization of customary law and religious law in traditional Bangkat marriages in the Osing Banyuwangi community can be seen from the absence of conflict and intersection between of them so that this Bangkat marriage custom is classified into a urf khas and urf sahih. It’s called Urf khas, because this custom applies to the people of Osing and urf sahih because this custom is not contrary to the Shari'a. Bangkat customary marriages basically show advice and hopes in order to create a happy home life. The form of advice and hope can be seen from the symbols of the tools used at customary times, namely sewur which means someone when choosing a mate, which in Islam is stated to be seen from the side of kafa'ah (wealth, lineage, beauty, and religion). Then the obligation to provide a place to live and provide a living by the husband to his wife as mentioned in Islam, in the Bangkat custom is reflected in the cingkek, bokor, bantal and kloso. Islam also teaches to give some of their sustenance to charity, in the Bangkat custom it is reflected in the coins from the kosekan that are given to people who are present at the Bangkat wedding ceremony.

Abstract

Pembagian harta bersama setelah perceraian merupakan bentuk ideal pengelolaan sistem keluarga egaliter, akibat adanya aturan harta bersama dalam perkawinan. UU Perkawinan, PP No. 09 Tahun 1975 dan KHI No. 01 Tahun 1991 telah mengatur secara tegas tentang harta bersama dan pembagian harta bersama. Penelitian ini akan mengkaji konsep pembagian harta bersama yang telah diatur dalam UU Perkawinan, dan secara khusus diatur dalam Kompilasi Hukum Islam pasal 97 dengan menjadikan maqasidh syariah Jasser Auda sebagai teori analisis. Sebagai metode penelitian untuk mendapatkan hasil yang optimal, peneliti menggunakan dua pendekatan. Yang pertama adalah pendekatan konseptual dan yang kedua adalah pendekatan negara. Hasil penelitian menunjukkan bahwa secara filosofis aturan pembagian harta bersama memiliki semangat filosofis Islam. Dalam tinjauan maqashid syariah, Jasser Auda, pembagian harta setelah perceraian memiliki semangat menjaga aspek kekeluargaan dan martabat manusia, bukan maqoshid syariah yang bersifat individualistis.

Abstract

Madin merupakan salah satu lembaga pendidikan yang mempelajari tentang ilmu keagamaan. Diantara ilmu keagamaan yang dipelajari adalah ilmu Al-Qur’an, fiqih, hadist dan tajwid. Dalam mempelajari Al-Qur’an, ilmu tajwid sangat berperan penting dalam mempelajari dan membaca Al-Qur’an. Oleh karena itu, dalam pengajaran ilmu tajwid diperlukan metode yang membuat pembelajaran menjadi efektif dan membuat peserta didik merasa nyaman dalam mempelajarinya. Pembelajaran efektif belum bisa diterapkan di Madin Nurul Islam Desa Krucil Kecamatan Krucil. Hal tersebut dikarenakan beberapa faktor, yaitu dari pengajar dan lingkungan. Berdasarkan permasalahan tersebut, mahasiswa KKN berinisiatif untuk menerapkan metode Mehisa (Menyanyi Hidayatus Shibyan) dalam mempelajari ilmu tajwid supaya mempermudah santri dalam membaca dan mempelajari Al-Qur’an. Pendekatan yang digunakan dalam kegiatan ini adalah ABCD (Asset Bassed Community Development). Subjek dalam kegiatan ini adalah santri Madin Nurul Islam di Desa Krucil. Berdasarkan penerapan metode Mahisa dapat dikatakan pembelajaran tajwid di Madin menjadi meningkat, hal tersebut diketahui ketika santri mulai aktif dan lancar dalam menghafal hukum-hukum bacaan tajwid.
